CIRCULAR
Amending and supplementing a number of Articles of the Minister of Transport’s Circular No. 12/2011/TT-BGTVT of March 30, 2011, on grant and revocation of certificates of insurance or financial security under the 1992 International Convention on Civil Liability for Oil Pollution Damage[1]
Pursuant to the November 25, 2015 Maritime Code of Vietnam;
Pursuant to the Government’s Decree No. 12/2017/ND-CP of February 10, 2017, defining the functions, tasks, powers and organizational structure of the Ministry of Transport;
Pursuant to the 1992 International Convention on Civil Liability for Oil Pollution Damage to which Vietnam is a contracting party;
At the proposal of the Director of Legal Department and the Director of the Vietnam Maritime Administration;
The Minister of Transport promulgates the Circular amending and supplementing a number of articles of the Minister of Transport’s Circular No. 12/2011/TT-BGTVT of March 30, 2011, on grant and revocation of certificates of insurance or financial security under the 1992 International Convention on Civil Liability for Oil Pollution Damage.
Article 1.To amend and supplement a number of articles of the Minister of Transport’s Circular No. 12/2011/TT-BGTVT of March 30, 2011, on grant and revocation of certificates of insurance or financial security under the 1992 International Convention on Civil Liability for Oil Pollution Damage (the 1992 CLC)
To amend and supplement Clause 1, Article 3 as follows:
“1. A certificate of insurance or financial security of civil liability for oil pollution damage (below referred to as certificate) shall be granted by the Vietnam Maritime Administration or provincial-level Maritime Administrations or Port Authorities authorized by the Vietnam Maritime Administration to carry out the ship registration (below referred to as seagoing ship registry offices) to attest that insurance or another financial security for a seagoing ship is in force and complies with the requirements prescribed in Article VII of the 1992 CLC”.
Article 2.To annul Article 10.
Article 3.Effect
This Circular takes effect on October 1, 2019.
Article 4.Organization of implementation
The Chief of the Office, the Chief Inspector, directors of departments, the Director of the Vietnam Maritime Administration, heads of related agencies and related organizations and individuals shall implement this Circular.-
