CIRCULAR
Amending and supplementing a number of articles of the Minister of Transport’s Circular No. 12/2022/TT-BGTVT dated June 30, 2022, on the List of potentially unsafe commodities under the management of the Ministry of Transport

Pursuant to the Law on Product and Goods Quality No. 05/2007/QH12 dated November 21, 2007;
Pursuant to the Law on Road Traffic Order and Safety No. 36/2024/QH15 dated June 27, 2024;
Pursuant to the Government’s Decree No. 132/2008/ND-CP dated December 31, 2008, detailing the implementation of a number of articles of the Law on Product and Goods Quality; the Government's Decree No. 74/2018/ND-CP dated May 15, 2018, amending and supplementing a number of articles of the Government’s Decree No. 132/2008/ND-CP of December 31, 2008; the Government's Decree No. 154/2018/ND-CP dated November 09, 2018, on amending, supplementing and repealing certain regulations on investment and business conditions in sectors under management of the Ministry of Science and Technology and certain regulations on specialized inspections;
Pursuant to the Government's Decree No. 13/2022/ND-CP dated January 21, 2022, amending and supplementing a number of articles of the Government’s Decree No. 132/2008/ND-CP of December 31, 2008, and Decree No. 74/2018/ND-CP of May 15, 2018, detailing a number of articles of the Law on Product and Goods Quality, and Decree No. 86/2012/ND-CP of October 19, 2012, detailing and guiding the implementation of a number of articles of the Law on Measurement;
Pursuant to the Government’s Decree No. 56/2022/ND-CP dated August 24, 2022, defining the functions, tasks, powers and organizational structure of the Ministry of Transport;
At the proposal of the Director of the Science -Technology and Environment Department and the General Director of the Vietnam Register;
The Minister of Transport hereby promulgates the Circular amending and supplementing a number of articles of the Minister of Transport’s Circular No. 12/2022/TT-BGTVT dated June 30, 2022, on the List of potentially unsafe commodities under the management of the Ministry of Transport.
Article 1. Amending and supplementing a number of articles of the Minister of Transport’s Circular No. 12/2022/TT-BGTVT dated June 30, 2022, on the List of potentially unsafe commodities under the management of the Ministry of Transport (hereinafter referred to as Circular No. 12/2022/TT-BGTVT)
1. To amend and supplement Clause 2 Article 3 of Circular No. 12/2022/TT-BGTVT as follows:
“2. Regarding the List of products and goods prescribed in the Appendix II to this Circular, the following rules shall be applied:
a) Imported products and goods must be granted technical quality and safety and environmental protection certificates according to regulations after customs clearance and before marketing;
b) Products and goods that are domestically manufactured and assembled must be granted technical quality and safety and environmental protection certificates before marketing.”.
2. To repeal Clause 3 Article 3 of Circular No. 12/2022/TT-BGTVT.
3. To remove the phrase “Directorate” in Clause 1 Article 6 of Circular No. 12/2022/TT-BGTVT.
4. To replace the phrase “Director General of the Directorate for Roads of Vietnam” in Article 7 of Circular No. 12/2022/TT-BGTVT with the phrase “Director of the Department for Roads of Vietnam”.
5. To replace Appendices I, and II to Circular No. 12/2022/TT-BGTVT with Appendices I and II to this Circular.
Article 2. Effect
1. This Circular takes effect from February 15, 2025.
2. For imported goods not included in the List of goods and products specified in Appendices I and II to this Circular, but included in the List of goods and products specified in Appendices I and II to Circular No. 12/2022/TT-BGTVT, which have been granted a registration for technical quality and safety and environmental protection inspection of imported vehicles, or a registration for technical quality and safety and environmental protection inspection of spare parts of motor vehicles imported before the effective date of this Circular, the procedures for certification of technical quality and safety and environmental protection shall continue to follow regulations applicable at the time of grant of the aforesaid registration.
3. For imported goods included in the List of goods and products specified in Appendices I and II to this Circular, but not included in the List of goods and products specified in Appendices I and II to Circular No. 12/2022/TT-BGTVT, of which customs declaration forms have been registered before the effective date of this Circular, the procedures for import shall follow regulations applicable at the time of registering such customs declaration forms./.
