DECREE

Defining the functions, tasks, powers and organizational structure of the Government Inspectorate of Vietnam

 

Pursuant to the February 18, 2025 Law on Organization of the Government;

At the proposal of the Government Inspector General;

The Government promulgates the Decree defining the functions, tasks, powers and organizational structure of the Government Inspectorate of Vietnam.

 

Article 1. Position and functions

The Government Inspectorate of Vietnam  is a ministerial-level agency of the Government, performs the state management of inspection, citizen reception, settlement of complaints and denunciations, and prevention and combat of corruption and negative acts nationwide; and carries out inspection, citizen reception, settlement of complaints and denunciations, and prevention and combat of corruption, wastefulness, and negative acts in accordance with law.

Article 2. Tasks and powers

The Government Inspectorate of Vietnam shall perform the tasks and exercise the powers specified in the Law on Organization of the Government, Law on Inspection, Law on Citizen Reception, Law on Complaints, Law on Denunciations, Anti-Corruption Law and the Government's regulations on the functions, tasks, powers and organizational structure of ministries and ministerial-level agencies as well as the following specific tasks and powers:

1. To submit to the Government draft laws and resolutions of the National Assembly, draft ordinances and resolutions of the National Assembly Standing Committee, draft resolutions and decrees of the Government, and draft decisions of the Prime Minister on inspection, citizen reception, settlement of complaints and denunciations, and prevention and combat of corruption and negative acts according to its approved annual lawmaking programs and plans, and other draft legal documents as assigned by the Government and Prime Minister.

2. To submit to the Government and Prime Minister for approval strategies, master plans, and annual, medium- and long-term development plans on the fields under its state management; and draft decisions and directives and other documents on inspection, citizen reception, settlement of complaints and denunciations, and prevention and combat of corruption and negative acts and organize implementation thereof.

3. To promulgate circulars, decisions, directives and other documents on inspection, citizen reception, settlement of complaints and denunciations, and prevention and combat of corruption and negative acts within its competence.

4. To direct, guide, examine, and organize the implementation of legal documents and approved strategies, programs and plans on inspection, citizen reception, settlement of complaints and denunciations, and prevention and combat of corruption and negative acts; to carry out public information and law dissemination and education regarding inspection, citizen reception, settlement of complaints and denunciations, and prevention and combat of corruption and negative acts.

5. Regarding inspection:

a/ To formulate tentative inspection programs and submit them to the Prime Minister for approval; to formulate, and organize the implementation of, its inspection plans; to guide the inspectorates of the Ministry of National Defense, Ministry of Public Security, State Bank of Vietnam and Government Cipher Committee, inspection agencies established under treaties, and inspectorates of provinces and centrally run cities (below referred to as provincial-level inspectorates) to formulate their inspection plans and urge and inspect the implementation thereof;

b/ To inspect the implementation of policies and laws, the performance of tasks and exercise of powers by ministries, ministerial-level agencies, Government-attached agencies, and People’s Committees of provinces and centrally run cities (below referred to as provincial-level People’s Committees); to inspect the implementation of policies and laws, the performance of tasks and exercise of powers by agencies, organizations, units and individuals subject to the management of ministries without a ministerial inspectorate;

c/ To inspect the compliance with laws in the fields subject to the state management of ministries without a ministerial inspectorate;

d/ To inspect complicated cases involving the state management responsibilities of more than one ministry, ministerial-level agency or provincial-level People's Committee;

dd/ To inspect the management and use of state capital and assets at enterprises;

e/ To conduct inspections when detecting signs of violations;

g/ To inspect cases requested by ministers, heads of ministerial-level agencies, or heads of Government-attached agencies;

h/ To inspect other cases as assigned by the Prime Minister and competent authorities;

i/ To examine the accuracy and legality of inspection conclusions of inspectorates of the Ministry of National Defense, Ministry of Public Security, State Bank of Vietnam and Government Cipher Committee, inspection agencies set up under treaties, and provincial-level inspectorates, and post-inspection handling decisions of heads of the same-level state management agencies when necessary;

k/ To re-inspect cases for which the inspectorates of the Ministry of National Defense, Ministry of Public Security, State Bank of Vietnam and Government Cipher Committee, inspection agencies set up under treaties, or provincial-level inspectorates have issued inspection conclusions if detecting signs of violations;

l/ To monitor, urge and inspect the implementation of its inspection conclusions and inspection handling decisions of the Prime Minister;

m/ To request ministries, ministerial-level agencies, Government-attached agencies and provincial-level People's Committees to assign professionals to participate in its inspection teams when necessary;

n/ To coordinate with the State Audit Office of Vietnam in handling overlaps between inspection and state audit activities; to guide inspection agencies to handle overlaps between inspection and state audit activities; to assume the prime responsibility for, and guide, the handling of overlaps in inspection activities among inspection agencies in accordance with law;

o/ To propose competent state agencies to amend and supplement existing regulations or promulgate new ones to meet management requirements; to recommend termination or annulment of unlawful regulations detected through inspection;

p/ To propose the Prime Minister and competent agencies or organizations, and request heads of other agencies or organizations to examine the responsibility of, and handle, organizations and individuals under their management that are detected through inspection as having committed violations of law or fail to implement inspection conclusions, requests and handling decisions.

6. Regarding citizen reception and settlement of complaints and denunciations:

a/ To receive citizens; to receive and process complaints, denunciations, petitions and reports; to settle complaints and denunciations according to its competence;

b/ To assume the prime responsibility for, and coordinate with related agencies in, receiving citizens at the Central Citizen Reception Offices;

c/ To monitor, examine and urge ministries, ministerial-level agencies, Government-attached agencies and provincial-level People’s Committees in the citizen reception, settlement of complaints, and implementation of decisions on settlement of complaints;

d/ To propose the Prime Minister or competent persons to apply necessary measures to terminate violations and examine the responsibility of, and handle, violators when detecting violations in the settlement of complaints, causing damage to the State’s interests or lawful rights and interests of citizens, agencies and organizations;

dd/ To receive, classify and propose the settlement of denunciations falling under the competence of the Prime Minister when assigned;

e/ To verify contents of denunciations, report verification results and recommend measures to settle denunciations falling under the competence of the Prime Minister when assigned;

g/ To consider the settlement of denunciations by ministers, heads of ministerial-level agencies, heads of Government-attached agencies or chairpersons of provincial-level People’s Committees which shows signs of violation; when having a ground to believe that the settlement of a denunciation involves violation of law, to propose the the Prime Minister to consider and re-settle the denunciation;

h/ To build, manage and use the national database on citizen reception and processing and settlement of complaints, denunciations and recommendations.

7. Regarding prevention and combat of corruption, wastefulness and negative acts:

a/ To organize, direct and guide the implementation of regulations on prevention and combat of corruption and negative acts according to its competence or as directed by the Government, Prime Minister, and competent authorities;

b/ To inspect cases showing signs of corruption, wastefulness and negative acts according to its competence; to inspect the implementation of the law on prevention and combat of corruption, wastefulness and negative acts by ministries, ministerial-level agencies, Government-attached agencies, provincial-level People’s Committees, and enterprises and organizations of the non-state sector according to its competence or as directed by the Prime Minister, competent authorities or as requested by ministers, heads of ministerial-level agencies, heads of Government-attached agencies, and chairpersons of provincial-level People’s Committees;

c/ To coordinate with agencies and organizations in detecting corruption, wastefulness and negative acts; to urge the handling of persons who commit corruption, wastefulness and negative acts in accordance with law;

d/ To control assets and income of persons who hold positions and powers in agencies, organizations and units according to its competence; to build, manage, use and protect the national database on control of assets and income;

dd/ To monitor and assess the situation of corruption and negative acts and the prevention and combat of corruption and negative acts at ministries, sectors, localities and the non-state sector;

e/ To coordinate with the State Audit Office of Vietnam, Ministry of National Defense, Ministry of Public Security, Supreme People’s Procuracy, Supreme People’s Court, Party Central Committee’s Commission for Internal Affairs, and agencies in the internal affairs sector in providing and exchanging information, documents and experience related to the prevention and combat of corruption, wastefulness and negative acts; to summarize, assess and forecast the situation of corruption and negative acts, and propose policies and solutions against corruption and negative acts.

8. To guide, and implement regulations on power control and prevention and combat of corruption and negative acts in inspection, citizen reception and settlement of complaints and denunciations, prevention and combat of corruption and negative acts under the Party’s regulations and the State’s laws.

9. To request ministries, ministerial-level agencies, Government-attached agencies and provincial-level People’s Committees to report on the situation and results of inspection, citizen reception, settlement of complaints and denunciations and prevention and combat of corruption and negative acts, to request the Ministry of National Defense, Ministry of Public Security, State Bank of Vietnam and provincial-level People’s Committees to review experience from inspection, citizen reception, settlement of complaints and denunciations and prevention and combat of corruption and negative acts, and to summarize and report them to the Government.

10. To perform the function of the national permanent body for implementation of the United Nations Convention against Corruption, and act as a national focal point in exchange of information with international partners in prevention and combat of corruption; to enter into international cooperation on inspection, citizen reception, settlement of complaints and denunciations and prevention and combat of corruption and negative acts.

11. To organize and direct the implementation of programs and plans on scientific research and application of scientific and technological advances to inspection, citizen reception, settlement of complaints and denunciations and prevention and combat of corruption and negative acts.

12. To carry out administrative reform in line with the Government’s state administrative reform programs and plans and the Prime Minister’s direction.

13. To apply information technology, carry out digital transformation and management of specialized data serving its state management function.

14. To manage, appoint, relieve from duty, and grant cards to inspectors of different ranks in accordance with law.

15. To manage the organizational apparatus, payrolls, cadres, civil servants and public employees; and implement the salary regime and entitlements, commendation and disciplining regimes and policies toward cadres, civil servants and public employees under its management in accordance with law.

16. To give written opinions to ministers, heads of ministerial-level agencies, and chairpersons of provincial-level People’s Committees regarding the appointment, re-appointment, or relief from duty of the Chief Inspector of the Ministry of National Defense, Chief Inspector of the Ministry of Public Security, Chief Inspector of the State Bank of Vietnam, Chief Inspector of the Government Cipher Committee, and Chiefs of provincial-level Inspectorates.

17. To provide its cadres, civil servants and public employees with further training in professional skills; to provide further training of and guidance on professional inspection activities, examination, citizen reception settlement of complaints and denunciations and prevention and combat of corruption and negative acts to cadres, civil servants and public employees of ministries, sectors and localities.

18. To manage finances and assets assigned to it and use budget allocations in accordance with law.

19. To manage and direct the operation of its attached non-business units in accordance with law.

20. To perform other tasks as assigned by the Government or Prime Minister in accordance with law.

Article 3. Organizational structure

1. The Legal Department.

2. The Department for Personnel and Organization.

3. The Department of Planning and Finance.

4. The Office of Government Inspectorate of Vietnam.

5. The Department for International Cooperation.

6. The Bureau for Settlement of Complaints-Denunciations and Inspection for the North Region (Bureau I).

7. The Bureau for Settlement of Complaints-Denunciations and Inspection for the Central Region (Bureau II).

8. The Bureau for Settlement of Complaints-Denunciations and Inspection for the Southern Region (Bureau III).

9. The Anti-Corruption Bureau (Bureau IV).

10. The Department for Inspection and Settlement of Complaints-Denunciations in the Fields of Internal Affairs, Home Affairs, Ethnic Affairs and Religious Affairs (Bureau V).

11. The Bureau for Inspection and Settlement of Complaints-Denunciations in the Fields of Finance and Banking (Bureau VI).

12. The Bureau for Inspection and Settlement of Complaints-Denunciations in the Field of Construction (Bureau VII).

13. The Bureau for Inspection and Settlement of Complaints-Denunciations in the Fields of Agriculture and Environment (Bureau VIII).

14. The Bureau for Inspection and Settlement of Complaints-Denunciations in the Field of Industry and Trade (Bureau IX).

15. The Bureau for Inspection and Settlement of Complaints-Denunciations in the Fields of Health and Education (Bureau X).

16. The Bureau for Inspection and Settlement of Complaints-Denunciations in the Fields of Culture, Sports, Tourism, and Foreign Affairs (Bureau XI).

17. The Bureau for Inspection and Settlement of Complaints-Denunciations in the Field of Science and Technology (Bureau XII).

18. The Bureau for Supervision and Appraisal (Bureau XIII).

19. The Bureau for Post-Inspection Supervision, Verification and Settlement (Bureau XIV).

20. The Central Citizen Reception Committee.

21. The Inspection Newspaper.

22. The Inspector Training College.

The units specified in Clauses 1 thru 20 of this Article are administrative organizations that assist the Government Inspector General in performing the state management function; the units specified in Clauses 21 and 22 of this Article are non-business units that serve the state management function of the Government Inspectorate of Vietnam.

The Central Citizen Reception Committee shall directly manage the Central Citizen Reception Offices in Hanoi and Ho Chi Minh City.

The Government Inspector General shall decide on the functions, tasks, powers and organizational structures of units attached to the Government Inspectorate of Vietnam.

Article 4. To annul and amend the provisions on inspection in relevant Decrees

1. To remove the word “Inspection” and the comma after it in Clause 30, Article 2; and annul Clause 11, Article 3 of the Government’s Decree No. 25/2025/ND-CP of February 21, 2025, defining the functions, tasks, powers and organizational structure of the Ministry of Home Affairs.

2. To replace the word “Inspection” in Clause 26, Article 2 with the word “Examination”; and annul Clause 14, Article 3 of the Government’s Decree No. 28/2025/ND-CP of February 24, 2025, defining the functions, tasks, powers, and organizational structure of the Ministry of Foreign Affairs.

3. To remove the word “inspection” and the comma before it at Point g, Clause 7, and Points b, c and d, Clause 14, Article 2; replace the word “Inspection” at Point d, Clause 22, Article 2 with the word “Examination”; remove the word “Inspection” and the comma after it in Clause 28, Article 2; and annul Clause 11, Article 3 of the Government’s Decree No. 29/2025/ND-CP of February 24, 2025, defining the functions, tasks, powers, and organizational structure of the Ministry of Finance.

4. To remove the word “Inspection” and the comma after it in Clause 29, Article 2; and annul Clause 2, Article 3 of the Government’s Decree No. 33/2025/ND-CP of February 25, 2025, defining the functions, tasks, powers, and organizational structure of the Ministry of Construction.

5. To remove the word “inspection” and the comma before it in Clause 44, Article 2; and annul Clause 7, Article 3 of the Government’s Decree No. 35/2025/ND-CP of February 25, 2025, defining the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Environment.

6. To remove the word “inspection” and the comma before it in Clause 19, Article 2; and annul Clause 10, Article 3 of the Government’s Decree No. 37/2025/ND-CP of February 26, 2025, defining the functions, tasks, powers, and organizational structure of the Ministry of Education and Training.

7. To remove the word “inspection” and the comma after it in Clause 17, Article 2; and annul Clause 7, Article 3 of the Government’s Decree No. 39/2025/ND-CP of February 26, 2025, defining the functions, tasks, powers, and organizational structure of the Ministry of Justice.

8. To remove the word “Inspection” and the comma after it and replace the phrase “specialized inspection” in Clause 38, Article 2 with the phrase “specialized examination”; and annul Clause 7, Article 3 of the Government’s Decree No. 40/2025/ND-CP of February 26, 2025, defining the functions, tasks, powers, and organizational structure of the Ministry of Industry and Trade.

9. To remove the word “Inspection” and the comma after it in Clause 16, Article 2; annul Clause 5, and remove the phrase “the Ministry Inspectorate” and the comma before it in Article 3 of the Government’s Decree No. 41/2025/ND-CP of February 26, 2025, defining the functions, tasks, powers, and organizational structure of the Ministry of Ethnic and Religious Affairs.

10. To remove the word “Inspection” and the comma after it and the phrase “perform the administrative inspection tasks on agencies, organizations and individuals under the management of the Ministry of Health; perform specialized inspection tasks in fields under the state management of the Ministry of Health” and the semicolon before it in Clause 29, Article 2; and annul Clause 7, Article 3 of the Government’s Decree No. 42/2025/ND-CP of February 27, 2025, defining the functions, tasks, powers, and organizational structure of the Ministry of Health.

11. To remove the word “Inspection” and the semicolon after it, and replace the phrase “specialized inspection” with the phrase “specialized examination” in Clause 39, Article 2; and annul Clause 6, Article 3 of the Government’s Decree No. 43/2025/ND-CP of February 28, 2025, defining the functions, tasks, powers, and organizational structure of the Ministry of Culture, Sports and Tourism.

12. To remove the word “inspection” and the comma after it in Clause 27, Article 2; and annul Clause 11, Article 3 of the Government’s Decree No. 55/2025/ND-CP of March 2, 2025, defining the functions, tasks, powers, and organizational structure of the Ministry of Science and Technology.

13. To remove the word “inspection” and the comma before it in Clause 10 and the phrase “inspection (if any)” and the comma before it in Clause 11, Article 4; annul Point b, Clause 1, Article 5; Clause 3, Article 6; Clause 8, Article 15; and remove the phrase “, inspection” in Clause 4, Articles 18; Clause 4, Article 19; Clause 4, Article  21, and Clause 3, Article 23 of the Government’s Decree No. 45/2025/ND-CP of February 28, 2025, on the organization of specialized agencies under People's Committees of provinces and centrally run cities, and People’s Committees of rural districts, districts, townships, provincial cities and municipal cities.

Article 5. Effect

1. This Decree takes effect on June 1, 2025.

2. This Decree replaces the Government’s Decree No. 81/2023/ND-CP of November 27, 2023, defining the functions, tasks, powers and organizational structure of the Government Inspectorate of Vietnam.

Article 6. Implementation responsibility

Ministers, heads of ministerial-level agencies, heads of Government-attached agencies, and chairpersons of provincial-level People’s Committees shall implement this Decree
