Resolution No. 27/NQ-CP 2020 pilot specific mechanisms to shorten time for compensation to land recovery projects

RESOLUTION

Approving the pilot application of specific mechanisms and processes to shorten time for compensation, support, resettlement and handover of construction sites to land recovery projects in Ho Chi Minh City^[1]

THE GOVERNMENT

Pursuant to the June 19, 2015 Law on Organization of the Government;

Pursuant to the November 29, 2013 Land Law;

After considering proposals of the Ho Chi Minh City People’s Committee in Report No. 1345/UBND-DT of April 11, 2019; and of the Ministry of Natural Resources and Environment in Report  No. 68/TTr-BTNMT of October 23, 2019, approving the pilot application of specific mechanisms and processes to shorten time for compensation, support, resettlement and handover of construction sites to land recovery projects in Ho Chi Minh City,

RESOLVES:

Article 1.To approve the Ho Chi Minh City People’s Committee’s pilot application of specific mechanisms and processes to shorten time for compensation, support, resettlement and handover of construction sites to land recovery projects in Ho Chi Minh City as follows:

1. The Ho Chi Minh City People’s Committee shall issue a land price adjustment coefficient at the beginning of the year to formulate a compensation, support and resettlement plan and collect opinions of people whose land is recovered. The land price adjustment coefficient issued at the beginning of the year is only used for making the compensation, support and resettlement plan and collecting opinions of people whose land is recovered, not the specific land price of the type of recovered land at the time of a land recovery decision.

2. The Ho Chi Minh City People’s Committee shall decide on the specific land price of the type of recovered land at the time of the State’s land recovery decision as prescribed in Clause 2, Article 74 of the 2013 Land Law.

Article 2.Organization of implementation

1. This Resolution takes effect on the date of its signing.

2. The Ho Chi Minh City People’s Committee shall:

a/ Issue regulations on coordination in land recovery, compensation, support and resettlement for application in the City to ensure publicity and transparency in order to shorten time for implementation.

b/ Organize the implementation of the Government-approved contents mentioned in Article 1 of this Resolution and annually report implementation results to the Government.

3. Ministers, heads of ministerial-level agencies and government-attached agencies, the Chairperson of the Ho Chi Minh City People’s Committee, and related agencies, organization and individuals shall implement this Resolution.-
