SUMMARY

The minimum usable area of an apartment is not less than 25 m²

On December 31, 2019, the Ministry of Construction issues the Circular No. 21/2019/TT-BXD on promulgating the National technical regulation on apartment building.

Accordingly, apartment in the building must has at least one living room and one sanitation area with the minimum usable area of an apartment is not less than 25 m². Besides, apartments must have natural light, for apartment has more than two living rooms, it shall be allowed that one room do not have natural lighting. Similarly, bedrooms must be well ventilated and have natural light with minimum usable area must not less than 9 m².

In addition to the above requirements, apartment building must also meet a number of other design requirements such as: Ensure the design life of at least 50 years; the structure of the building must ensure long-term durability corresponding to the design life; the design life of a construction must be clearly stated in the design dossier and other documents; the investor must  conduct the inspection and assessment of the quality of the construction to carry out interventions that extend the use duration of the construction in accordance with law provisions.

This Circular takes effect on July 01, 2020.

On promulgating the National technical regulation on apartment buildings

Pursuant to the Decree No. 81/2017/ND-CP of the Government on defining function, task, power and organizational structure of the Ministry of Construction;

Pursuant to the Decree No. 127/2007/ND-CP dated August 01, 2007 of the Government on detailing the Law on standards and technical regulations;

Pursuant to the Decree No. 78/2018/ND-CP dated May 16, 2018 of the Government on amending and supplementing a number of Article of the Decree No. 127/2007/ND-CP dated August 01, 2007 of the Government on detailing the Law on standards and technical regulations;

At the proposal of the Science - Technology and Environment Department,

The Minister of Construction hereby issues the Circular on promulgating the national technical regulation on apartment buildings, No. QCVN 04:2019/BXD.

Article 1.To issues together with this Circular the National technical regulation on apartment buildings, No. QCVN 04:2019/BXD.

Article 2.This Circular takes effect on July 01, 2020.

Article 3.Ministers, heads of ministerial-level agencies, heads of government-attached agencies, presidents of provincial/municipal Peoples Committees, and relevant organizations and individuals shall implement this Circular./.

Introduction

The QCVN 04:2019/BXD was compiled by the Construction Science and Technology Institute, submitted by the Science - Technology and Environment Department, appraised by the Ministry of Science and Technology and issued together with the Circular No. 21/2019/TT-BXD dated December 31, 2019 of the Minister of Construction.

THE NATIONAL TECHNICAL REGULATION ON APARTMENT BUILDINGS

National technical regulation on apartment buildings

1. GENERAL PROVISIONS

1.1. Scope of regulation

1.1.1.This technical regulation prescribed technical requirements applied in construction of new apartment building, re-construction of apartment building of up to 150-meter height or down to 03 basements, including apartment building constructed for residence purpose and building constructed for multiple purposes.

1.1.2.For apartment building higher than 150 meter or have 04 basements or more, in addition of compliance with this technical regulations, it must be supplemented technical requirements and solutions for organization and constructional techniques in compliance with its specific features on fire protection of such apartment building, on the basis of standard document allowed to use in accordance with law provisions.   Those requirements and solutions must be appraised and approved by the specialized competent authority.

1.2. Subjects of application

This regulation applies to organizations and individuals that involve in constructional investment, management and use of apartment building.

1.3. Reference documents

The following reference documents is necessary for application of this regulation. In case the reference documents are amended and/or supplemented, the new documents shall prevail.

1.4. Interpretation of terms

In this Regulation, the terms below are construed as follows:

1.4.1

Apartment building

A building contains two or more stories, having multiple apartments, shared passageways and stairs, contains private ownership, common ownership and systems of common infrastructural constructions for households, individuals and organizations, including apartment building constructed for residence purpose and apartment building constructed for mixed purposes.

NOTE: Apartment building constructed for mixed purposes hereinafter referred to as mixed apartment building.

1.4.2.

Group of apartment building

The collection of two or more apartment buildings which constructed according to the approved planning, project dossiers approved by competent authority.

1.4.3.

Mixed apartment building

Apartment building serves mixed purposes is designed and constructed for residence purpose and other purposes such as office place, service location, economic place....

1.4.4.

Apartment part in mixed apartment building

The construction of apartments is in mixed apartment buildings, constructed according to the planning and project documents approved by competent authority.

1.4.5.

Apartment

The self-contained living space, meeting the needs of living for a family, individual or group. An apartment may have one or more different functional spaces such as: The living room - common space; Work and study space; Ancestor worship place; Bedrooms; Dining room; Kitchen; Toilet; Washing, drying clothes space; Balcony or loggia; Storage room.

1.4.6.

Apartment in the building

Apartment contained in an apartment building or mixed apartment building, serves the purpose of residence for a family, individual or a group.

1.4.7.

Other functions

Parts of construction in the mixed apartment building serve other purposes, including: office, restaurant, supermarket, hotel, accommodation apartments (condotel...), office combine with accommodation apartments (officetel) and other services.

1.4.8.

Accommodation apartments

An apartment contained in the mixed apartment building (condotel...), serves the purpose of leasing for accommodation, has necessary furniture, equipment and services so that the lessee can self-serve during the course of accommodation.

1.4.9.

Combination of office and accommodation apartment (Officetel)

A combination of office and accommodation apartment contained in the mixed apartment building and has necessary furniture, equipment and services for a single or multiple individual to work and inhabit.

1.4.10.

Height of the building

The height is from the ground placed under the approved planning to the highest point of the building (including attic or slope roof). For a construction has different ground levels, the height of the building shall be calculated at the lowest ground level of the approved planning.

NOTE: Rooftop technical equipment: antenna, lightning rod, solar powered equipment, metal water tanks, chimneys, ventilation pipes, decorative architectural details are not included in the building height.

1.4.11

Clearance height

Height from the finished story surface to the underside of the beam structure, completed story or ceiling or technical system of the story.

1.4.12

Height of building in service of fire prevention and fighting

The height of the building shall be determined by the distance from the street that the fire truck can access the lower edge of the door hole (window) opens on the outer wall of the highest story.

NOTE No.1: When there is no door opening, the height of the highest story is determined by half the total height of the story and ceiling of that story.

NOTE No.2: In case the technical story is the top story, the highest story of the building shall be the lower story adjacent to the technical story.

1.4.13

Usable area of an apartment

story space shall be determined according to the clearance space of the apartment: Including story area including walls/partitions of rooms in the apartment, area of balcony, loggia; not including the story area has pillar/load-bearing walls, technical box inside the apartment and the area of surrounding wall/partition of the building/apartment, wall/ partition between the apartments.

NOTE: Clearance space are measured to the inner edge of the wall /partition/glass/story railings (excluding interior decoration items such as wall

tiles/edges/molds ...). For balcony, loggia, the whole area of the story shall be calculated, in case of having shared wall edge, the inner edge of the wall shall be included.

1.4.14

Number of story

Number of story on a building includes all the stories above the ground (including technical story, tum story) and semi-basement, excluding attic story.

NOTE No.1: The attic story shall be excluded from total number of story only if it to cover the cage of stairs or elevator wells, covering the technical equipment of the construction (if any), and the area of the attic roof not exceeding 30% of the roof area.

NOTE No.2: the number of story shall not include the mezzanine with construction acreage not exceed 10% construction acreage of the underneath story and its whole acreage not exceed 300m2 and if it used as technical area only (for example: technical bottom of the pool, generator placed floor or other construction technical equipment).

NOTE No. 3: For a construction has different ground levels, the number of story shall be calculated at the lowest ground level of the approved planning.

1.4.15

Attic story

An inner story of a sloping roof where all or part of its vertical surface is made up of an inclined roof surface or folding roof, in which the surround wall (if any) is not higher than the floor surface of 1.5 m.

1.4.16

Ground story

The story that its floor elevation is higher than or equal to the ground elevation where the construction is located according to approved plan.

1.4.17

Basement

Basement refers to the story with more than a half of its height is lower than ground elevation where the construction is located according to approved plan.

1.4.18

Semi-basement

Semi-basement refers to the story that a half of its height is higher than or equal to ground elevation where the construction is located according to approved

plan.

1.4.19

Technical story

A story or a part of story arranged with technical room or technical equipment of the building. Technical story can be the basement, semi-basement, attic story or other story in the middle part of the building.

1.4.20

Technical room

The room arranged with technical equipment of the building or the story. Technical rooms can be arranged on the whole floor or part of the technical story.

1.4.21

Accommodation room

Rooms in an apartment can be used for single or multiple function. Accommodation room is bed room and other living rooms.

1.4.22

Balcony

The space with protective guardrails, protruding from the surrounding walls of the apartment building.

1.4.23

Loggia

The space with protective guardrails, recede from the surrounding walls of the apartment building.

1.4.24

Community living activities space

The space arranged to organize common activities of the residents live in the apartment building, group of apartment building, such as: resident s conferences, cultural activities, recreation, entertainment and other community activities.

1.4.25

Elevator lobby

The vacant space front of the elevator doors.

1.4.26

Transitional compartment

Transitional space between two doors, used to protect from the entry of

smoke and other gases when entering the building, into the staircase or other rooms of the building.

1.4.27

Fire protection compartment

Part of the building which separated from other parts of the building by walls and fire protection floors type 1.

1.4.28

Shelter room

The area arranged in the shelter story is used for temporary evacuation in case of fire.

1.4.29

Shelter story

Story used for temporary evacuation a ranged in the building with height of over 100 meter. Shelter story may contain one or multiple shelter room.

1.4.30

Fire protection system

The system including: Smoke protection system, internal fire hydrant system, external fire hydrant system, automatic fire extinguishing systems, public fire alarm and sound systems, fire alarm and public sound system, emergency lighting and escape lightning system, firefighting elevator, rescue vehicles and equipment, structural solution, rescue solution, smoke prevention system, fire spreading prevention system.

1.4.31

Designed life

Expected use duration according to the design of the work to calculate the construction structure (including the foundation) to ensure safety of force-bearing and ensure normal conditions of use during the period of construction exploitation and use without carry out any major repairs or reinforce force-bearing structure.

1.4.32

Selected regulation for application

National or international technical standards, regional standards or foreign standards shall be selected for application of the project in accordance with law provisions in force.

1.4.33

Standard documents

Documents of rules, instructions or features with activities or result of them, including: Technical standards, regulations, technical rules and code of practice.

2. TECHNICAL RULES

2.1. General requirements

2.1.1.Apartment buildings and mixed apartment buildings must meet requirements for safety force-bearing, stability and design life. Not to construct building in areas with dangerous geological risks (landslide, earth flow...) flooded areas, often flooded when no technical measures to ensure safety of construction works.

2.1.2.Apartment buildings and mixed apartment buildings must meet requirements for fire safety as prescribed in the QCVN 06:2019/BXD and related provisions. The equipment, arrangement, inspection and maintenance of fire prevention and fighting and rescue means must comply with the requirements of current regulations.

NOTE: In a number of special cases, it is allowed to reduce some requirements related to fire prevention and fighting of this Regulation for specific constructions, only if there is substantiation sent to the Ministry of Construction clarify supplement and replacement solutions and such substantiation must be appraised and approved by the Police Department of Fire Prevention and Rescue.

2.1.3.Apartment buildings and mixed apartment buildings must ensure access to the elderly and people with disabilities in accordance with the QCVN 10:2014/BXD.

2.1.4.Apartment buildings and mixed apartment buildings must be designed and built to meet the requirements of energy efficiency in accordance with the QCVN 09:2017/BXD.

2.1.5.Apartment buildings and mixed apartment buildings must comply with regulations on life and health safety in accordance with the QCXDVN 05:2008/BXD. Termite prevention requirements for apartment buildings must comply with the selected technical standards.

2.1.6.Apartment buildings and mixed apartment buildings must be maintained in accordance with the procedures.

2.1.7.Apartment in a mixed-use apartment building must have independent entrance (excluding emergency staircase compartment).

2.1.8.Other functional part such as office, restaurant, supermarket, hotel,

accommodation apartments (condotel...), office combine with accommodation apartments (officetel) and other services in the mixed apartment building be arranged in separate areas, according to the approved project and operation management as prescribed.

2.2. Requirement on planning and architecture

2.2.1.The use of land of apartment building and mixed apartment buildings must ensure proper land use purposes and meet the requirement of economical use of land.

2.2.2.Apartment buildings and mixed apartment buildings must be designed and constructed in accordance with construction plans and planning approved by competent authorities.

2.2.3.Population for apartment building and mixed apartment building must be uniformly calculated in all design dossiers progress according to regulations, and must be determined in accordance with the population norms approved by competent agencies for construction investment projects.

2.2.4.Apartment in the building

2.2.4.1.There must be at least one living room and one sanitation area. The minimum usable area of an apartment is not less than 25 m2.

2.2.4.2.For commercial housing projects, the percentage of apartments with an area of less than 45 m2must not exceed 25% of the total number of apartments of the project.

2.2.4.3.Apartments must have natural light. The apartment has 02 or more rooms; it shall be allowed that one room do not have natural lighting.

2.2.4.4.Bedrooms must be well ventilated and have natural light. The minimum usable area of a bedroom in an apartment must not less than 9 m2.

2.2.5.Accommodation apartments

2.2.5.1. The minimum usable area of an accommodation apartment must not less than 25 m2.

2.2.5.2.Other requirements shall be set according to the selected standard for the accommodation apartment.

2.2.6.Combination of office and accommodation apartment (Officetel)

2.2.6.1.The using area of an office combined with accommodation apartment must not be less than 25 m2, in which the working area must be at least 9 m2. The kitchen shall not be included in the office combined with accommodation apartment.

2.2.6.2.Other requirements shall be set according to the selected standard for design of office combined with accommodation apartment.

2.2.7.Community living activities space

Apartment buildings and apartments in mixed apartment buildings must have community living space to ensure the minimum average living area of 0.8 m2per apartment, in which there must be suitable space for holding resident conferences.

b) For apartment complexes in a construction project where community living space cannot be arranged in each building, it is allowed to combine in a separate location or area with a total area for community activities. discount up to 30%, radius from the lobby of buildings to community activities place must not exceed 300 m and need calculations and explanations to ensure convenient living needs for residents.

2.2.8.Other functional parts such as office, restaurant, supermarket, hotel, accommodation apartments (condotel...), office combine with accommodation apartments (officetel) and other services in the mixed apartment building must be designed in accordance with current regulation and selected regulation for application.

2.2.9.Apartment building, apartment in the building of the mixed apartment building must have section for hanging clothes that guarantee the building and urban aesthetic.

2.2.10.In apartment building and mixed apartment building

- For living room, the clearance height must not less than 2.6 meter;

- For kitchen and bathroom, the clearance height must not less than 2.3 meter.

- For basement, semi-basement, technical story, the clearance height must not less than 2.0 meter;

- For shelter room, the clearance height must not less than 2.6 meter;

- For inner space of the sloped roof used as bed room or living room, the clearance height of a half of the room area must not less than 2.1 meter;

- For other rooms and area of different functions of the apartment (other than living purpose), the minimum clearance height must not less than 2.6 meter.

2.2.11.Window of the apartment building and mixed apartment building:

- Windows must only be made of flip or sliding doors with a safety stop on opening. The position of the door opening and closing control units must comply with the regulations of the QCXDVN 05:2008/BXD.

- For apartments without balconies or loggia, at least one window must be arranged on the outside wall of the house with the size of the air opening is not small than (600x600) mm for rescue purpose.

2.2.12.Fences, balustrade balconies and loggia, including the height from floor to the bottom of the door or window sill in an apartment building or mixed apartment building must not be less than 1.4 meter. Other position shall comply with the QCXDVN 05:2008/BXD.

2.2.13.Staircases in apartment buildings and mixed apartment buildings must be designed and arranged to meet usage requirements and safety for human escape in accordance with regulations of QCXDVN 05:2008/BXD, QCVN 10:2014/BXD and QCVN 06:2019/BXD.

2.2.14.Sloped way in apartment building and mixed apartment building:

- Sloped way in automobile garages must meet the requirements of the QCVN 13:2018/BXD;

- Sloped way for pedestrians must ensure access for the elderly and people with disabilities as prescribed in the QCVN 10:2014/BXD.

2.2.15.Exit routes, emergency way and emergency exits in apartment building and mixed apartment buildings must comply with regulations of QCVN 06:2019/BXD and QCVN 10:2014/BXD.

2.2.16.Roads for fire engines and ground spaces of apartment buildings and mixed apartment buildings must comply with regulation of the QCVN 06:2019/BXD and Article 2.9 this Regulation.

2.2.17.Parking spaces (including cars, motorbikes (including electric motorbikes) and bicycles).

2.2.17.1.Parking lots of apartment buildings and apartments in mixed apartment buildings must ensure the following requirements:

a) Must be part of the approved project area; the parking space of cars must be separated to the parking space of motorbikes and bicycles.

b) The minimum parking space (including internal roads in garages or parking lots) is at least 25 m2for 04 apartments, but not smaller than 20 m2for 100 m2of apartment use area, in which ensures a minimum of 6 m2of parking space for motorbikes and bicycles for each apartment.

c) Apartment of Social housing, resettlement and low-income housing: the permitted parking area is allowed to be equal to 60% of the norm prescribed in Clause b) of this Article and at least 6 m2of motorbike and bicycle parking places for each apartment.

d) For parking space using mechanical or automatic garage (herein after referred to as mechanical garage), for every 100 m2of used area of an apartment, there must be at least 12 m2of parking space in the garage (for multi-stories mechanical garages, the parking area is multiplied by the number of floors for the mechanical garage). The way leading to the garage must be in accordance with

the technology of the garage and must comply with the current regulations.

2.2.17.2.Area of the parking space (including internal way in garage or parking lot) of accommodation apartment and office combined with accommodation apartment in the mixed apartment building must be calculated so that guarantee minimum of 20 m2for 160  m2of apartment usable area; and it must be in the area of approved project.

2.2.17.3.Apartment building and mixed apartment building must have parking space for people with disabilities. The location and number of parking spaces for people with disabilities must be calculated in accordance with the QCVN 10:2014/BXD.

2.2.18.Apartment building and apartment in the mixed apartment building must have arranged area of 5 m2to 6 m2per person for building management staffs, parking security staff, security guards, technical service staff.

2.3. Requirement on structure

2.3.1.Structure of an apartment building or mixed apartment building during construction and operation must meet the following requirements:

a) Load bearing safety: Be designed and constructed to ensure durability, ensure stability, withstand the loads and load combinations most unfavorable affecting them, including loads over time, which include loads related to Vietnam s natural conditions (storms, earthquakes, lightning, floods) prescribed in the QCVN 02:2009/BXD.

b) Usability to use normally: To maintain normal conditions of use, not be deformed and deteriorate other properties beyond the permitted limits of the selected standards applicable to the works.

c) Ensure fire resistance: Structures and structural materials of a building must ensure fire resistance and fire hazard requirements as prescribed in the QCVN 06:2019/BXD and regulation in Article 2.9 of this Regulation.

d) Designed life:

+ Apartment buildings, mixed apartment buildings must be calculated to ensure the design life of at least 50 years (except for other cases decided by the person determining investment or the investor in accordance with the time of exploitation and use of works.)

+ The structure of the building must ensure long-term durability corresponding to the design life.

+ The design life of a construction must be clearly stated in the design dossier and other documents of the construction according to the provisions of law. By the expiration of using the construction s design (design life), the person determining investment or the investor shall have notice and conduct the

inspection and assessment of the quality of the construction to carry out interventions that extend the use duration or take other handling measures according to the provisions of law.

2.3.2.Apartment buildings and mixed apartment buildings must meet the following requirements:

a) Sideway at the top of the building and relative sideway between stories must not be larger than the prescribed values according to the selected standards.

b) The maximum acceleration of movement at the peak of the building caused by the load of wind shall not excess prescribed value in selected design standards.

2.3.3.The foundation and foundation structure, basement structure and underground technical system of the building must be calculated and design base on specific features of the base ground, hydro geology conditions of the construction location, erosion extent of the base ground and underground water and must meet the following requirements:

- Ensuring safety of load bearing and stability;

- Ensuring that the settlement of structure and shrinkage is within the permitted limits according to the design tasks and the selected standards;

- Ensuring safety for the construction and nearby constructions during the execution of foundation and basement.

2.3.4.The construction and use of apartment building and mixed apartment building must not cause damage to the technical infrastructure system and surrounding constructions.

2.3.5.When renovating the apartment building and mixed apartment building, the structure diagram and the actual status of the building must be take into account.

2.4. Requirement on elevator

2.4.1.Apartment building and mixed apartment building with 05 stories or more must have at least 01 elevators, which have 10 stories or more must have at least 02 elevators and ensure the flow of users according to the selected standards.

NOTE: In an apartment building, mixed apartment building with elevators, there must be at least one specialized elevator with a clear passage size of the cabin for transport of the emergency stretcher.

2.4.2.At least 01 elevators must be arranged for each 200 people live in the building, excluding people in the first story (the ground story). In case of calculating by number of apartments, at least 01 elevators shall be arranged for 70 apartments. The lifting capacity of an elevator must not be less than 400 kg. In the case the building has one elevator, the minimum lifting capacity of the

elevator shall not less than 600 kg.

2.4.3.For apartment building, mixed apartment building have fire prevention height of over 50 meter, each fire protection compartment of the building must have an elevator satisfies the requirement of carrying fire fighting forces and equipment as well as rescue purpose as prescribed in the TCVN 6396-72:2010 and TCVN 6396-73:2010.

2.4.4.The width of the passenger elevator lobby must be arranged in accordance with the selected standards.

2.4.5.The elevator must have anti-jamming protection device, automatic rescue kit and internal phone system from the cabin to the outside. The elevator must only operate when all the doors are closed.

2.4.6.Lifting capacity and speed of the elevator must meet requirements according to the selected standards.

2.4.7.The elevator must ensure safety in accordance with the QCVN 02:2011/BLĐTBXH and be tested for safety before being put into use in the following cases:

- After installation;

- After major repair;

- After occurrence of severe accident, incident and such incidents were solved;

- At expiration of inspection or at the request of state management agencies in charge of occupational safety.

2.4.8.The machine placed room and elevator equipment must be accessible and safe to access, and must not be located directly on the apartment. The elevator well must ensure soundproofing requirements as prescribed in the QCXDVN 05:2008/BXD and noise prevention as prescribed in the QCVN 26:2010/BTNMT.

2.4.9.Water tank shall not be allowed to directly placed above the elevator wells and water, heat and gas supply pipelines shall not be allowed to pass through the elevator wells.

2.4.10.The elevator must ensure access to the elderly and people with disabilities in accordance with the QCVN 10:2014/BXD.

2.5. Requirement on water supply system and drainage

2.5.1.Water supply and drainage systems must meet the requirements for water supply and drainage requirements prescribed in the QCVN 01:2019/BXD, the technical requirements as specified in the "Water and Sewerage System Code of Regulations" and the selected standard applies.

2.5.2.Water supply system must ensure hygienic quality as specified in the QCVN 1-1:2018/BYT and meet user needs prescribed in the selected standard applies.

2.5.3.Indoor firefighting water supply system and outdoor firefighting water supply system must meet the following requirements:

- When there is no outdoor fire-fighting water supply system or the water flow or pressure of fire-fighting water (pressure head) is not available, there must be reserved water sources that ensure the firefighting water flow of the indoor fire hydrant system for at least 3 hours;

- The building with a height of fire prevention and fighting higher than 50 meter must have fire hydrant for firefighters arranged on each floor, the farthest door of the floor must be within 45 meter from the fire hydrant (the moving way must be take into account). The waiting hydrant must be placed in the fire-proof transitional compartment (the transitional compartment of the smoke-free stair compartment or transitional compartment of the firefighter elevator). The waiting hydrant system for firefighter force must has waiting hydrant installed outside the building to supply water from a vehicle or fire pump and be connected to an indoor firefighting water supply pipeline. The waiting hydrant must satisfy the current regulations;

- Indoor fire hydrants must be located in places where they are easy to access and use. The necessary flow of the indoor fire hydrant system shall be taken according to the selected technical standard, particularly for building with a fire prevention height of over 50 meter and a floor area of each floor larger than 1500 m2, the residential floors must ensure firefighting water flow for not less than 4 fire fighting sprays, each of which has a flow of 2,5 liters per second during the calculated firefighting period but not less than 1 hour. Each position of the floor must ensure that there are two fire hydrants can simultaneously approach.

- Suppliant of water to fire-fighting systems must comply with current regulations and standards on fire prevention and fighting.

2.5.4.The water drainage system must comply with regulations in selected standard applies.

2.5.5.Rainwater drainage system on the roof must ensure rainwater drainage with all weather in the year. Rain-water standing pipes are not allowed to leak and need to be connected to the building s drainage system and then to the common drainage system of the area.

2.5.6.The entire drainage system of the building must be connected to the drainage system of the whole area for centralized treatment or be treated as required at the QCVN 14:2008/BTNMT before pouring into the regional drainage system.

2.5.7.The wastewater treatment tank of the building must be located in a

convenient position, having enough conditions for waste suction and treatment, ensuring safety for load bearing, not cracking, leaking and not affecting the environment when operating.

2.6. Requirement on air ventilation system and air conditional system

2.6.1.Apartments and spaces outside apartments in apartment building or mixed apartment building must have natural or compulsory ventilation systems. Local ventilation must be arranged for kitchen bath room, sanitary room area.

2.6.2.Fresh air flow for each apartment must not be less than 30 m3per hour per person or not less than the total amount of exhaust gas from the kitchen, bathroom and toilet of the apartment.

2.6.3.The kitchen must have the air ventilation system exhaust air outside the house and circulate air.

2.6.4.Exit way, lobby in the middle of the apartment must ensure the air exchange coefficient not less than 4 times per hour according to the volume of the lobby.

NOTE: Exit way, lobby in the middle of the apartment must not be naturally ventilated (sealed, no windows) must ensure the air exchange coefficient is not less than 4 times per hour according to the volume of the lobby without air conditioner or not less than 1 m3per hour per m2with air conditioning arrangement.

2.6.5.Parking garages must ensure air exchange coefficient not less than 6 times per hour for normal ventilation mode and 9 times per hour for exhaust ventilation mode.

2.6.7.When using forced ventilation and air conditioning systems, the following requirements must be met:

The outside climate parameters for the design of ventilation and air conditioning systems comply with QCVN 02:2009/BXD and selected standard applies.

- Only use refrigerants that ensure environmental safety according to current regulations;

- Emitted gas must not cause discomfort or harm to people and surrounding properties;

- Not to cause noise beyond the permissible limits on operation;

- Rooms with toxic substances must have independent suction, treatment and air supply systems; Fresh air must be supplied directly into the room with a flow rate not less than 90% of the exhaust volume.

2.6.7.The drainage system in the toilets of apartment building and mixed apartment buildings must ensure no leakage of gases and odors affecting the

health of people living and staying in apartment building and mixed apartment buildings.

2.6.8.The exhaust ventilation systems, smoke extraction and smoke protection systems for emergency exits, fire resistance levels of wind pipes and canals must be in compliance with the requirements of QCVN 06:2019/BXD.

2.7. Requirement on waste collecting system

2.7.1.Apartment buildings and mixed apartment buildings must have a waste collecting system that meets regulations on fire safety and environmental sanitation.

2.7.2.waste collecting system inside apartment building and mixed apartment buildings is allowed to be arranged according to garbage collection pipelines or garbage collection rooms located on each story. This system must ensure the collection of all waste generated indoors with a retention period of no longer than 01 days.

2.7.3.The indoor waste collection pipeline system must meet the following requirements:

- Garbage collection door must be arranged at collection room located on each story. The garbage collection room must be a closed space, naturally or forcedly ventilated, not spreading odors to surrounding areas;

- The entrance to the garbage collection room on each story must go through the fire-fighting transitional compartment. Garbage collection rooms and fire-proof transitional compartment must be arranged with automatic fire alarm system or automatic fire fighting system;

- Combination of pipes, doors of garbage collection pipes, shields, valves and collection room’s door must be made of anti-corrosive and non-flammable materials (as prescribed in the QCVN 06:2019/BXD). This combination must be soundproofed when arranged close to the bedroom;

- The door of a garbage collection pipeline must be a type 1 fire-proof door, tightly closed, able to prevent odors and have automatic smoke blocking devices;

The top part of the garbage collecting pipe must have a vent pipe protruding from the roof of not lower than 0.7 meter, the cross-sectional area must not be less than 0.05 m2and must have rain roofs and screens to prevent insects and rodents from entering;

- The garbage storage room must be arranged directly under the garbage collection pipeline at the first floor above ground or semi-basement or first basement (if there is no semi-basement); The garbage compartment must have a clearance height of not less than 2.5 m and a door open inside out; The garbage storage room must have doors separated from the entrances to the apartment by solid walls and separated from other parts of the apartment with fire-blocking

walls (with fire resistance levels not lower than REI 60); Must have ventilation system; Having automatic fire alarm system, automatic fire fighting system;

The garbage storage room must have a collecting pit and a dirty water pipeline leading to the common wastewater drainage system of the building, as well as a separate entrance for garbage transportation.

2.7.4.The indoor waste collection system on each story must meet the following requirements:

- Garbage collection bins must be placed at each story in a separate room, without obstructing the escape and rescue;

- In each garbage collection room, it is required to concurrently arrange biodegradable organic waste bin and persistent garbage collection bin;

- Garbage collection room must be separated from other areas by fire-blocking parts and must has ventilation systems, automatic fire alarm systems and automatic fire fighting systems;

- Garbage collection bins must be tight, not scattering, not leaking, not causing spillage during transportation. The removal of waste collection bins from each story must be carried out within a day;

- Types of garbage which pose a risk of fire and/or disease spread must not be put into garbage collection bins.

2.8. Requirement on systems of electricity, lightning protection, noise protection and communication

2.8.1.Apartment buildings and mixed apartment buildings must meet requirements on design, installation and operation of electrical equipment, lightning protection systems and communication and information systems as prescribed in the QCVN 12:2014/BXD, QCVN QTĐ 08:2010/BCT, QCVN 09:2017/BXD, the Code of electrical equipment and current regulations.

2.8.2.An indoor transformer must meet the following requirements:

a) Comply with the provisions of Part III - Code of electrical equipment.

b) Not to install the transformer room directly below, directly above or adjacent to the gathering rooms of over 50 people. The transformer room must be separated from other parts of the house by fire-blocking walls with fire resistance levels not lower than REI 120 and with fire-blocking floor having fire resistance levels not lower than REI 90.

c) The transformer chamber must have automatic fire alarm and firefighting system.

2.8.3.The electrical engineering room must be located in a dry, locked, open outward door, ensuring easy inspection and switching of electricity. Gas pipes; flammable ducts; water technical pipes; lids, valves, flanges, gates, hoses,

pipelines and technical boxes are not allowed to be arranged through electric engineering rooms.

2.8.4.Houses with a fire prevention and fighting height of 28 m or higher must be equipped with backup generators with minimum capacity to ensure operation of priority electricity networks, including: electricity for domestic water pump, fire water pump, automatic fire alarm system, smoke protection system, firefighter elevator, public lighting, fire alarm, CCTV, fire alarm and regulator escape control and other loads according to current design standards.

NOTE: For buildings with a fire prevention and fighting height lower than 28 m, when it is required to equip automatic fire fighting systems, the smoke protection system must have backup power sources to ensure the operation of these systems according to the QCVN 06:2019/BXD.

2.8.5.The diesel generator room and fuel storage space shall be allowed to be arranged on the first floor, semi-basement or first basement when ensuring the following regulations:

a) Diesel generator room and fuel storage space must not be located directly below or next to the living rooms and must be separated from other parts of the house by fire-blocking walls with fire resistance level not lower than REI 120 and fireproof floor have fire resistance level no lower than REI 90.

b) The fuel storage space for 3 working hours is allowed to be located next to the generator room and must be separated from the generator room by fire-blocking walls type 1 and self-closing fire prevention door according to QCVN 06:2019/BXD. Fuel storage tanks for generators operating longer than 3 hours must be located outside the building.

c) Diesel generator room and fuel storage room must have equipment to collect and store oil spills in case of incident; it must have automatic fire alarm system; must have separate smoke exhaust system and place where smoke exhaust vent must not pose danger to people on the upper stories.

2.8.6.The apartment building, apartment part in mixed apartment building be designed with noise prevention in accordance with the provisions of the QCVN 26:2010/BTNMT and selected standard applies.

2.9. Requirement on fire safety

2.9.1.Apartment building and mixed apartment building must comply with fire safety regulations in accordance with QCVN 06:2019/BXD and also meeting the following additional requirements:

2.9.1.1.Walls and partitions between the units; walls and partitions between common corridors (outside of apartments) and other rooms, must have fire resistance level not less than EI 60.

2.9.1.2.Walls and partitions which is not bearing load between apartments,

must have fire resistance level not less than EI 40 and fire hazard level K0.

2.9.1.3.Balustrade of balconies and loggias of the third story or higher must be made of incombustible substances.

2.9.1.4.Rooms with public function must be separated from living rooms by fire-blocking partitions of type 1, fire-blocking floor of type 3, and in buildings of fire-resisting types I, they must be separated by fire-blocking floor of type 2.

2.9.1.5.Buildings with 02 to 03 basements, it must have type I fire-resisting level.

2.9.2.For buildings with height of 75 meter to 100 meter, in addition to complying with the provisions of Article 2.9.1, the following additional requirements must be ensured:

2.9.2.1.The building must has type I fire-resisting level, requirement for fire resistance of building construction and parts shall be in comply with the QCVN 06:2019/BXD.

2.9.2.2.The building must be divided into fire prevention compartment according to the height, with the height of each compartment not exceeding 50 m. Fire prevention compartments must be separated to each other by a fire prevention floor with the minimum fire resistance of 150 REI or by a technical story with the horizontal load bearing structure (floor and ceiling) of the minimum fire prevention limitation not less than REI 90.

2.9.2.3.The maximum allowable area of a floor within a fire protection compartment must be complied with the QCVN 06:2019/BXD.

2.9.2.4.At the intersection of fire prevention floor and fire prevention parts and the building s covering structure must be solutions to ensure that fire does not spread through fire prevention parts.

2.9.2.5.Each fire protection compartment according to its height must have an independent fire protection system (fire fighting water supply, smoke exit, exit lighting, fire alarm, automatic fire fighting) that operate independently. Fire protection compartment are allowed to share water supply stations, fire pump stations, smoke exhaust fans, and fire alarm control cabinets.

2.9.2.6.Above the exit from garages on the first floor, it is required to arrange -cantilever roof of incombustible substances with a width not less than 1.0 meter and ensure the distance from this roof to the lower edge of the upper window not less than 4.0 meter.

2.9.2.7.The allowable distance from the entrance of the apartment to the nearest emergency exit (staircase or external exit) must be complied with the QCVN 06:2019/BXD.

2.9.2.8.Clearance widths for staircase and staircase landing of N1-type

staircases in the residential part of a building must not be less than 1.20 meter; N2 type staircase chamber is not less than 1.05 meter with the clearance hole between stairs is not less than 100 mm.

2.9.2.9.From all smoke-free staircases, there must be staircases leading to the roof through type 2 fire doors. The door of an apartment leading to the corridor must be a type 1 fire prevention door.

2.9.2.10.Other functional parts of the building (including technical rooms, auxiliary rooms for the apartment) must be separated from the building’s part by solid fire prevention walls with fire resistance level of  REI 150 and type 1 fire prevention floors and separate exits.

2.9.2.11.The elevator wells of the apartment part shall not have connected to the rest of the building. The wells of the technical system (including garbage pipes) of the apartment and the rest of the building must be separate.

2.9.2.12.The insulation (if any) of external wall must be made of incombustible substance. It is allowed to use insulation layer of combustible materials Ch1 and Ch2 (QCVN 06:2019/BXD) if it is protected from all sides by concrete or plaster with a thickness of not less than 50 mm. At the places of installation of window frames and doors on the outside wall, the thickness of layer of concrete (plaster) must not be less than 30 mm.

2.9.2.13.Window assemblies and glazing panels of balconies and loggias must be made of incombustible or low-burning materials (Ch1).

2.9.2.14.Fire prevention doors must be arranged appropriately for each case as follows:

a) Fire prevention door on wall and floors separating fire protection compartment must have fire resistance level not lower than E1 90.

b) Fire prevention door must be type 1 in the following cases: door in the interior wall of smoke-free staircases chamber and elevator lobby, door of apartment to common corridor, door on structure covering technical room, equipment or material room with high fire risk, technical well and room.

b) Fire prevention door must be type 2 in the following cases: door from the transitional compartment into the smoke-free staircase, into the elevator lobby and into the room with the waste pipe.

d) Door of elevator well (door of elevator story) leading into elevator lobby must be smoke-free door.

NOTE: Door of elevator story is the access door designed to be installed in elevator well at parking lot to allow entry into and exit from the cabin.

2.9.2.15.Materials for finishing ceiling, wall and floor on emergency exits, in elevators lobbies, common halls and technical stories must be incombustible

substances.

2.9.2.16.The acoustic tile of rooms and the heat insulation of equipment and technical pipelines must be made of incombustible substances.

2.9.2.17.The pipelines of the technical system (drainage, rainwater, hot and cold water supply, garbage collection pipes) are made of incombustible substances. Water supply pipes within the area of an apartment (except for vertical shaft) shall be allowed to be made of inflammable materials of type Ch1 and Ch2.

NOTE: In case of using UPVC pipes or inflammable materials of type Ch1 and Ch2 for water supply and drainage pipelines, these pipes, apart from meeting technical requirements according to the selected standard applies, must be placed in technical boxes and ensure the prevention fire spread requirements according to the QCVN 06:2019/BXD.

2.9.2.18.The protection of smoke prevention, fire alarm and automatic fire fighting systems complies with the QCVN 06:2019/BXD and the following provisions:

a) All rooms other than apartment (garage, auxiliary room, technical room, public space, garbage store room...) and garbage-collecting pipes must have sprinkler head (except for technical rooms of electricity or electron on demand of arrangement of gas fire extinguishing equipment or system).

b) Above the entrances to the apartments, sprinklers must be blocked up from the fire-fighting water supply pipeline through a current relay.

c) Fire alarm system must clearly indicate the address of each apartment. In the rooms of apartments and story’s corridors, including elevator lobby must have smoke detectors installed. Each apartment must be equipped with a loudspeaker system to guide the in case of escape, ensuring everyone in the apartment can hear announcements and instructions when an incident occurs.

d) The fire alarm system, equipment, automatic fire extinguishing equipment in the channels, electrical engineering wells, communication and other technical wells at risk of fire must be installed.

e) Power source supply for the fire protection system includes: elevators in service of transporting forces and fire-fighting means; smoke prevention system; automatic fire alarm system, fire fighting; must be taken from separate electrical cabinets or separate panels with different paint colors, which follow two separate routes to the distribution equipment of each fire protection compartment.

2.9.2.19.The electric wires and cables of the priority power supply for a fire-fighting system within a fire protection compartment must be placed in metal pipes and/or boxes or pipes, boxes, wells and channels made of incombustible substances and have fire resistance limitation not less than REI 90 or not less than

REI 150 when located outside of fire protection compartment.

2.9.3.All basements in a building with from 02 or 03 basements, must be equipped with two-way emergency communication system between the fire control room to the following areas:

- Equipment room related to fire-fighting system, especially pump room of sprinkler system, pump room supplying water to vertical piping system, circuit commutation room, generator and elevator room.

- All rooms that install control equipment for smoke control systems;

- Firefighter elevators.

- Every shelter room;

- Control rooms of air ventilation system.

2.9.4.For buildings with a height from 100 meter to 150 meter, in addition to complying with the provisions of Articles 2.9.1 and 2.9.2, it is necessary to arrange the shelter story and shelter room to meet the following requirements:

a) The shelter stories shall not more than 20 floors apart. Apartments or part of apartments and offices shall not be allowed to be arranged on the shelter story. Commercial activities shall not be allowed to be arranged on the shelter story.

NOTE No. 1: The technical story or part of the technical story may be used as a shelter room when the provisions of b), c), d), e) f), g) and h) of Article 2.9.4 are met.

b) Shelters room on the shelter story must be protected by fire-blocking parts with fire resistance levels not less than REI 150.

c) The shelter room must have an area of 0.3 m2per person, which is sufficient to accommodate the total number of people as listed below:

- Number of people on the story contains shelter room;

- Half of the total number of people of all upper stories from the shelter story to the next shelter story; half of all people of all upper stories for the top story with shelter room;

- Half of the total number of people of all beneath stories from the shelter story to the next shelter story; half of all people of all beneath stories for the bottom story with shelter room;

d) The shelter room must be naturally ventilated through fixed wall openings arranged on two outer walls (ventilation window) meeting the following requirements:

- The total area of ventilation window must be at least equal to 25% of the shelter room;

- Minimum height of ventilation windows (from bottom to top) must not be less than 1.2 m;

- Ventilation windows for shelter room must be located at least 1.5 m horizontally and 3.0 m vertically from other unprotected wall vents lies equal to or below it. If the ventilation window of the shelter room has a total area not less than 50% of the shelter room, the vertical distance can be reduced to 1.5 m.

e) All equipment and tools placed in the shelter room must be made of incombustible substances.

f) The shelter room must have a door with smoke-free elevator room and an exit to the firefighter elevator.

g) Shelter room must have its own fire protection equipment, including: indoor fire hydrant, sprinkler automatic fire fighting system, incident lighting, telephone to contact to the outside, emergency radio transmission system ...

h) Inside the emergency staircase and on the outside of the emergency staircase wall at the shelter story must have a notice board with the content "GIAN LÁNH NẠN/FIRE EMERGENCY HOLDING AREA” placed at a height of 1,500 mm from the finished ground surface of the staircase landing or the floor of the shelter story. The height of letters on notice boards must not be less than 50 mm.

NOTE: In addition to the presentation in Vietnamese and English, the content of the notice board may be displayed in other languages depending on the features of common residents in the building.

3. REQUIREMENT ON MANAGEMENT

3.1.New constructions under scope of regulation of Section 1.1 must comply with the technical regulations in this Regulation.

3.2.Encourage application of this Regulation when renovating old apartment building.

3.3.Transitional provisions

- Dossiers of design and construction of apartment building and mixed apartment building which appraised before this Regulation takes effect shall be allowed to continue comply with appraised design dossiers.

- Dossiers of design and construction of apartment building and mixed apartment building which appraised after this Regulation takes effect have to comply with provisions of this Regulation.

4. RESPONSIBILITY OF ORGANIZATION AND INDIVIDUAL

4.1.All organizations and individuals participating in activities related to the construction of new apartment building and mixed apartment building which include formulation, evaluation, approval, organization of implementation, management and the elaboration of national standards, local standards and local technical regulations related to apartment building must comply with the provisions of this regulation.

4.2.The People s Committees of provinces and cities, prescribing the method of determining the population in apartment buildings and mixed apartment buildings, ensure that they are suitable to the practical conditions of population size and technical infrastructure, social infrastructure to apply and manage within the province and city area.

4.3.In the course of implementing this Regulation, if any problems arise, all comments should be sent to the Department of Science, Technology and Environment (the Ministry of Construction) for guidance and handling.

5. ORGANIZATION OF IMPLEMENTATION

5.1.The Ministry of Construction shall responsible for disseminating and guiding the application of this Regulation to relevant subjects.

5.2.State management agencies in charge of construction in localities shall organize the inspection of compliance to this Regulation in the elaboration, appraisal, approval and management of construction of apartment building and mixed apartment building on the locality.
