DECREE
Annulling a number of legal documents of the Government[1]
Pursuant to the June 19, 2015 Law on Organization of the Government; and the November 22, 2019 Law Amending and Supplementing a Number of Articles of the Law on Organization of the Government and the Law on Organization of Local Administration;
Pursuant to the June 22, 2015 Law on Promulgation of Legal Documents; and the June 18, 2020 Law Amending and Supplementing a Number of Articles of the Law on Promulgation of Legal Documents;
At the proposal of the Minister of Justice;
The Government promulgates the Decree annulling a number of legal documents of the Government.
Article 1. To annul the following legal documents in whole
1. The Council of Ministers’ Decree No. 189-HDBT of June 4, 1992, detailing the implementation of the Ordinance on Consular Affairs.
2. The Government’s Decree No. 161/1999/ND-CP of October 18, 1999, detailing the implementation of a number of articles of the Ordinance on Conclusion and Implementation of Treaties.
3. The Government’s Decree No. 159/2003/ND-CP of December 10, 2003, on the supply and use of checks.
4. The Government’s Decree No. 42/2007/ND-CP of March 26, 2007, on ranks of officers and non-commissioned officers in the People’s Public Security Forces.
5. The Government’s Decree No. 53/2010/ND-CP of May 19, 2010, on geographical areas eligible for investment incentives and enterprise income tax incentives, for administrative units established as a result of the Government’s adjustment of administrative boundaries.
6. The Government’s Decree No. 101/2011/ND-CP of November 4, 2011, detailing the implementation of the National Assembly’s Resolution No. 08/2011/QH13, additionally providing a number of tax-related solutions for removing difficulties for enterprises and individuals.
7. The Government’s Decree No. 60/2012/ND-CP of July 30, 2012, detailing the implementation of Resolution No. 29/2012/QH13, issuing a number of tax policies to remove difficulties for organizations and individuals.
8. The Government’s Decree No. 183/2013/ND-CP of November 15, 2013, on the Charter on organization and operation of the Vietnam Airlines.
9. The Government’s Decree No. 184/2013/ND-CP of November 15, 2013, on the Charter of organization and operation of the Vietnam Maritime Corporation.
10. The Government’s Decree No. 10/2014/ND-CP of February 13, 2014, on the Charter of organization and operation of the Vietnam Southern Food Corporation.
11. The Government’s Decree No. 41/2020/ND-CP of April 8, 2020, on extension of time limits for tax and land rental payment.
12. The Government’s Decree No. 109/2020/ND-CP of September 15, 2020, on extension of time limits for excise tax payment for domestically manufactured or assembled cars.
13. The Government’s Decree No. 114/2020/ND-CP of September 25, 2020, detailing the implementation of the National Assembly’s Resolution No. 116/2020/QH14 on reduction of payable enterprise income tax amounts in 2020 for enterprises, cooperatives, non-business units and other organizations.
14. The Government’s Decree No. 44/2021/ND-CP of March 31, 2021, providing guidance on deductible expenses upon determination of income liable to enterprise income tax for amounts paid as supports and donations by enterprises and organizations for Covid-19 prevention and control activities.
15. The Government’s Decree No. 52/2021/ND-CP of April 19, 2021, on extension of time limits for payment of value-added tax, enterprise income tax, personal income tax and land rental in 2021.
16. The Government’s Decree No. 92/2021/ND-CP of October 27, 2021, detailing the implementation of the National Assembly Standing Committee’s Resolution No. 406/NQ-UBTVQH15, issuing a number of solutions to support enterprises and people affected by the Covid-19 epidemic.
17. The Government’s Decree No. 104/2021/ND-CP of December 4, 2021, on extension of time limits for payment of excise tax for domestically manufactured or assembled cars.
18. The Government’s Resolution No. 30/2008/NQ-CP of December 11, 2008, on urgent measures to curb economic recession, maintain economic growth and ensure social security.
Article 2. To annul the following legal documents in part
1. To annul Articles 23, 24 and 25 of the Government’s Decree No. 19/2011/ND-CP of March 21, 2011, detailing the implementation of a number of articles of the Law on Adoption.
2. To annul Article 10 of the Government’s Decree No. 34/2014/ND-CP of April 29, 2014, promulgating the Regulation on land border areas of the Socialist Republic of Vietnam.
3. To annul Clause 2, Article 22 of the Government’s Decree No. 52/2015/ND-CP of May 28, 2015, on the National Legal Database.
4. To annul Clause 2, Article 3 of the Government’s Decree No. 75/2020/ND-CP of July 1, 2020, detailing a number of articles of the Law Amending and Supplementing a Number of Articles of the Law on Foreigners’ Entry into, Exit from, Transit through, and Residence in Vietnam.
5. To annul Article 12 of the Government’s Decree No. 104/2022/ND-CP of December 21, 2022, amending and supplementing a number of articles of the decrees concerning the submission and presentation of household registration books and temporary residence books in paper form upon performance of administrative procedures and provision of public services.
Article 3. Implementation provisions
1. This Decree takes effect on December 19, 2023.
2. Ministers, heads of ministerial-level agencies, heads of government-attached agencies, chairpersons of provincial-level People’s Committees, and related agencies and units shall implement this Decree.-
