SUMMARY

Time for approving the receipt of international emergency aid for relief is 03 days

On April 20, 2020, the Government promulgates the Decree No. 50/2020/ND-CP on providing provisions on receipt, management and use of international emergency aid for relief and remediation of natural disaster consequences.

Accordingly, the time for consideration and approval of decision on receiving the international emergency aid for relief is not exceeding 03 days, from the date on which the sufficient and valid dossier is received by the managing agency. A dossier submitted to the authority competent to approve the receipt of international emergency aid for relief comprises: A written proposal; The donor's written notice or agreement and the list of aid amounts (enclosed with the Vietnamese translation); Other documents related to the aid amount.

The aid recipient may open an account at the State Treasury where conducting transactions for receipt and use of aid amounts in cash (according to the aid agreement or the management requirements). For aid amounts that do not belong to the State budget revenues, the aid recipient may open an account at the Vietnamese commercial bank.

This Decree takes effect on June 15, 2020.

DECREE

On receipt, management and use of international emergency aid for relief and remediation of natural disaster consequences[1]

 

Pursuant to the June 19, 2015 Law on Organization of the Government;

Pursuant to the June 19, 2013 Law on Natural Disaster Prevention and Control;

At the proposal of the Minister of Agriculture and Rural Development;

The Government promulgates the Decree on receipt, management and use of international emergency aid for relief and remediation of natural disaster consequences

Chapter I

GENERAL PROVISIONS

Article 1.Scope of regulation

This Decree provides for receipt, management and use of international emergency aid amounts for relief and remediation of natural disaster consequences in Vietnam.

Article 2.Subjects of application

1. Aid donors include foreign governments, international organizations, organizations authorized by foreign governments, non-governmental organizations, and other foreign organizations and individuals that directly provide non-refundable emergency aid for relief and remediation of natural disaster consequences.

2. Aid recipients include institutions established in accordance with Vietnam’s law and having functions and tasks and operating in line with objectives and contents of aid amounts, including:

a/ Ministries, ministerial-level agencies, government-attached agencies, provincial-level People’s Committees;

b/ Central bodies of socio-political organizations;

c/ The Vietnam Red Cross Society.

3. Aid beneficiaries include agencies, organizations, households, individuals and enterprises hit by natural disasters.

4. Other agencies, organizations and individuals involved in receipt, management and use of international emergency aid for relief and remediation of natural disaster consequences in Vietnam.

Article 3.Interpretation of terms

In this Decree, the terms below are construed as follows:

1. “International emergency aid for relief” means non-refundable and not-for-profit aid amounts of aid donors that are approved to be provided within 3 months after a natural disaster occurs for relief activities under Clause 1, Article 32 of the Law on Natural Disaster Prevention and Control.

2. “International emergency aid for remediation of natural disaster consequences” means non-refundable and not-for-profit aid amounts of aid donors that are approved to be provided within 9 months after a natural disaster occurs for remedying natural disaster consequences under Clause 1, Article 30 of the Law on Natural Disaster Prevention and Control.

3. “Managing agencies” means the agencies specified in Clause 2, Article 2 of this Decree.

4. “Aid owners” means organizations assigned by managing agencies to receive and manage aid amounts.

5. “Aid users” means agencies and organizations assigned by competent authorities to use aid amounts.

6. “Decision on receipt of emergency aid for relief” means a decision on receipt of international emergency aid amounts for relief issued by a competent agency which must have the following principal contents: name of the aid amount; aid donor; managing agency; aid owner; objectives of the aid amount; total aid value; aid distribution plan; and implementation responsibility.

7. “Decision on policy of receiving international emergency aid for remediation of natural disaster consequences” means the Prime Minister’s decision on policy of receiving international aid amounts to remedy natural disaster consequences, which must have the following principal contents: name of the aid amount; aid donor; aid recipient; objectives of the aid amount; total aid value; and aid distribution plan.

8. “Document on international emergency aid for remediation of natural disaster consequences” means a document stating the emergency situation, necessity, objectives, and principal contents of aid amounts; socio-economic and environmental outcomes and efficiency; total value and structure of the aid; aid provision method; conditions of the aid donor (if any); and method of managing the implementation of aid amounts.

9. Aid regarded as state budget revenue means aid amounts provided in cash or in kind to be managed and spent by the Vietnamese side in accordance with the law on the state budget and relevant legal documents.

Article 4.Principles of aid receipt, management and use

1. Aid shall be received, managed and used in an open, transparent, timely and effective manner and for proper purposes and eligible subjects, with harmonious and close coordination among related ministries, sectors, localities, organizations and individuals.

2. It is not permitted to receive goods banned from import by law and aid amounts adversely affecting the environment, community health, political security and social order and safety and infringing upon interests of the State and the people.

3. Aid receipt, management and use must comply with Vietnam’s law and commitments made with aid donors.

Article 5.Funds for performance of the aid receipt task

1. The state budget must allocate funds for renting warehouses and storing yards and cover other related expenses in accordance with the law on the state budget and in conformity with the delegation of powers for state budget management. Funding sources and responsibility to allocate funds must be stated in aid receipt decisions approved by competent authorities.

2. Expenses for receipt of aid amounts not regarded as state budget revenues shall be paid by aid recipients.

 

Chapter II

PROCESS OF RECEIVING INTERNATIONAL EMERGENCY AID FOR RELIEF

Article 6.Process of receiving international emergency aid for relief

The process of receiving international emergency aid for relief is as follows:

1. Preparation for aid receipt.

2. Approval of aid receipt.

3. Aid receipt.

Article 7.Preparation for aid receipt

1. Within 1 working day after receiving information from the aid donor, the managing agency shall assign an attached unit to act as the aid owner.

2. The aid owner shall reach agreement with the aid donor on principal contents of international emergency aid amounts for relief, including aid form and value, quantity and value of aid amounts to be distributed, methods and places of aid receipt, and other related contents.

Article 8.Approval of receipt of international emergency aid for relief

1. Competence to approve receipt of international emergency aid for relief:

a/ The Prime Minister may approve the receipt of aid amounts related to security, national defense or religion, those with unidentified managing agencies and those involving import of goods falling within his/her deciding competence as provided by law;

b/ Heads of the agencies and organizations specified in Clause 2, Article 2 of this Decree may approve the receipt of aid amounts other than those specified at Point a of this Clause.

2. Procedures for approving the receipt of international emergency aid for relief falling under the Prime Minister’s competence:

a/ A managing agency shall send aid documents together with a dossier for receipt of international emergency aid for relief to the Ministry of Agriculture and Rural Development for approval;

b/ The Ministry of Agriculture and Rural Development shall collect opinions of related agencies at a meeting or collect opinions in writing or in other forms, then summarize and submit them to the Prime Minister within 3 days after receiving a valid dossier.

c/ The Prime Minister shall consider and approve the receipt of international emergency aid for relief.

3. Procedures for approving the receipt of international emergency aid for relief falling under competence of heads of the agencies and organizations specified in Clause 2, Article 2 of this Decree:

a/ An aid owner shall compile a dossier for receipt of international emergency aid for relief for submission to a managing agency;

b/ The managing agency shall collect opinions of related agencies at consultation meetings or in other forms;

c/ The managing agency shall consider and approve the receipt of international emergency aid for relief;

d/ The time limit for consideration and approval of a decision on receipt of international emergency aid for relief is 3 days after the managing agency receives a complete and valid dossier.

4. A dossier for receipt of international emergency aid for relief to be submitted to a competent authority for approval must comprise:

a/ A request for approval of the receipt of international emergency aid for relief (its contents are specified in Appendix I to this Decree);

b/ A notice of aid of the aid donor or an aid agreement and a list of aid amounts (accompanied by their Vietnamese translations);

c/ Other documents relevant to aid amounts as specified by law.

Article 9.Receipt of international emergency aid for relief

1. After the aid receipt is approved by a competent authority, an aid owner shall:

a/ Notify the aid donor of the competent authority-approved decision on receipt of international emergency aid for relief;

b/ Submit to the managing agency for issuance a notice to related agencies for coordination in receiving aid;

c/ Notify related agencies and localities of plans for emergency aid in the form of providing experts and accompanying animals for relief;

d/ For international emergency aid for relief provided in kind, carry out specialized inspection procedures and customs clearance procedures in accordance with law;

dd/ For international emergency aid for relief provided in cash, open an account for aid receipt (in case such account is not yet available) or notify the aid donor of account number for cash receipt (in case such account is available). International emergency aid for relief in a foreign currency shall be transferred into a foreign-currency account opened at a licensed credit institution or sold to a licensed credit institution in accordance with law.

2. Based on decisions on receipt of international emergency aid for relief, aid owners shall assume the prime responsibility for, and coordinate with related agencies in, receiving and implementing emergency aid for relief.

 

Chapter III

PROCESS OF RECEIVING INTERNATIONAL EMERGENCY AID FOR REMEDIATION OF NATURAL DISASTER CONSEQUENCES

Article 10.Process of receiving international emergency aid for remediation of natural disaster consequences

The process of receiving international emergency aid for remediation of natural disaster consequences is as follows:

1. Preparation for aid receipt.

2. Decision on policy of receiving international emergency aid for remediation of natural disaster consequences falling under the approving competence of the Prime Minister.

3. Approval of documents on international emergency aid for remediation of natural disaster consequences.

4. Receipt, management and implementation of aid amounts.

Article 11.Preparation for aid receipt

1. A managing agency shall assign an attached unit to act as the aid owner to reach agreement with the aid donor on principal contents of international emergency aid for remediation of natural disaster consequences.

2. The aid owner shall coordinate with the aid donor in making a document on international emergency aid for remediation of natural disaster consequences, made according to the form provided in Appendix II to this Decree.

Article 12.Decision on policy of receiving international emergency aid for remediation of natural disaster consequences falling under the approving competence of the Prime Minister

1. The Prime Minister shall approve the policy of receiving the following  international emergency aid amounts for remediation of natural disaster consequences :

a/ Aid amounts related to security, national defense or religion;

b/ Aid in form of procurement or provision of various types of goods for which the Prime Minister’s permission is required;

c/ Aid amounts with unidentified managing agencies.

2. Order and procedures for deciding on policy of receiving international emergency aid for remediation of natural disaster consequences falling under the competence of the Prime Minister

a/ A managing agency shall send a written request for approval of aid receipt policy together with a document on international emergency aid for remediation of natural disaster consequences to the Ministry of Agriculture and Rural Development for appraisal;

b/ Within 3 working days after receiving the managing agency’s request, the Ministry of Agriculture and Rural Development shall collect written opinions of related agencies on aid necessity, objectives and sources, conditions of the aid donor (if any) and the Vietnamese side’s ability to satisfy the donor’s conditions. The time limit for related agencies to give their written opinions is 5 working days after receiving the request;

c/ The Ministry of Agriculture and Rural Development shall appraise and submit to the Prime Minister for consideration and decision the policy of receiving international emergency aid for remediation of natural disaster consequences or issue a reply to the managing agency within 5 working days after the expiration of the time limit for collecting opinions of related agencies, in case the draft aid document needs explanation or modification;

d/ Within 5 working days after receiving appraisal opinions of the Ministry of Agriculture and Rural Development, the managing agency shall explain and assimilate them and complete the dossier, then send it to the Ministry of Agriculture and Rural Development. Within 5 working days after receiving a complete dossier, the Ministry of Agriculture and Rural Development shall consider and submit it to the Prime Minister;

dd/ The Prime Minister shall consider and decide on the policy of receiving international emergency aid for remediation of natural disaster consequences.

Article 13.Approval of documents on international emergency aid for remediation of natural disaster consequences

1. For international emergency aid amounts for remediation of natural disaster consequences for which the Prime Minister is competent to decide on receipt policy, managing agencies shall, based on receipt policy decisions, approve documents on international emergency aid for remediation of natural disaster consequences.

2. For international emergency aid amounts for remediation of natural disaster consequences not mentioned in Clause 1, Article 12 of this Decree:

a/ A managing agency shall collect opinions of the Ministry of Agriculture and Rural Development, Ministry of Planning and Investment and Ministry of Finance and related agencies and localities;

b/ To-be-collected opinions must focus on suitability of international emergency aid amounts for remediation of natural disaster consequences with specific contexts of ministries, sectors and localities; appropriateness of the method of implementation of international emergency aid amounts for remediation of natural disaster consequences; capital source; commitments, conditions for provision of aid amounts of the aid donor and participants (if any); ability to satisfy the aid donor’s conditions and requirements; effectiveness and sustainability of the remediation of natural disaster consequences after aid amounts are distributed;

c/ A dossier to be sent for opinion collection must comprise a written request of the aid owner  for approval of the document on international emergency aid for remediation of natural disaster consequences; a document of the aid donor on agreed contents of international emergency aid amounts for remediation of natural disaster consequences (aid notice or agreement); and a draft document on international emergency aid for remediation of natural disaster consequences;

d/ The time limit for related agencies to give their written opinions is 5 working days after receiving the managing agency’s request;

dd/ Based on opinions of related ministries, agencies and localities, the managing agency shall assign the aid owner to complete the document on international emergency aid for remediation of natural consequences for submission to the managing agency for consideration and approval;

e/ After approving the document, the managing agency shall notify such to the Ministry of Agriculture and Rural Development, Ministry of Planning and Investment, Ministry of Finance, and related agencies and localities.

Article 14. Modification of decisions on aid receipt policy and decisions on approval of documents on international emergency aid for remediation of natural disaster consequences

1. Modification of a decision on aid receipt policy

a/ The managing agency shall send a written request for modification of the decision on policy of receiving international emergency aid for remediation of natural disaster consequences to the Ministry of Agriculture and Rural Development;

b/ The Ministry of Agriculture and Rural Development shall collect opinions of the Ministry of Finance and related agencies on modified contents. The time limit for related agencies to give their written opinions is 5 working days after receiving the request for opinion;

c/ The Ministry of Agriculture and Rural Development shall sum up opinions and submit the modified policy of receiving international emergency aid amounts for remediation of natural disaster consequences to the Prime Minister for consideration and decision.

2. Modification of a document on international emergency aid for remediation of natural disaster consequences

a/ For international emergency aid amounts for remediation of natural disaster consequences specified in Clause 1, Article 12: The managing agency shall, based on the Prime Minister’s decision on modification of the policy of receiving international emergency aid for remediation of natural disaster consequences, modify the document on international emergency aid for remediation of natural disaster consequences;

b/ For international emergency aid amounts for remediation of natural disaster consequences not specified in Clause 1, Article 12:

If there is a change in aid objectives or scale or aid users, the managing agency shall collect opinions of the Ministry of Agriculture and Rural Development and related agencies on the change within 5 working days. The managing agency shall, based on such opinions, decide on approval of the modified document on international emergency aid for remediation of natural disaster consequences.

If there are changes in other contents, the managing agency shall consider and decide on approval of the modified document on international emergency aid for remediation of natural disaster consequences.

Article 15.Receipt, management and use of aid

Based on documents on international emergency aid for remediation of natural disaster consequences approved by managing agencies, aid owners shall receive, manage and use aid amounts under regulations.

 

Chapter IV

MANAGEMENT OF INTERNATIONAL EMERGENCY AID AMOUNTS FOR RELIEF AND REMEDIATION OF NATURAL DISASTER CONSEQUENCES

Article 16.Principles of financial management of international emergency aid amounts for relief and remediation of natural disaster consequences

1. International emergency aid amounts for relief and remediation of natural disaster consequences that are regarded as state budget revenues and spending tasks must comply with the law on the state budget.

2. For international emergency aid amounts for relief and remediation of natural disaster consequences that are not regarded as state budget revenues, aid recipients shall manage and use such amounts under aid agreements signed with aid donors in accordance with Vietnam’s law, organization and operation charters of aid recipients and the accounting law.

Article 17.Opening of aid receipt accounts

1. Under aid agreements or management requirements, aid recipients shall open accounts at the State Treasury offices where their transactions are conducted to receive and use aid amounts in cash under their management and use.

2. The order and procedures for opening accounts and management and use of accounts must comply with the State Treasury’s regulations.

3. For aid amounts not regarded as state budget revenues, aid recipients may open accounts at Vietnamese commercial banks.

Article 18.Formulation of financial plans for aid amounts regarded as state budget revenues

1. For aid belonging to the state budget, as per the law on the state budget, aid recipients shall formulate and report annual revenue and expenditure estimates of non-refundable aid to managing agencies for decision, and send to same-level finance agencies for inclusion in state budget estimates and submission to competent authorities for approval.

2. In case there are new non-refundable aid amounts not yet included in state budget estimates allocated and assigned by competent authorities, aid recipients shall formulate additional state budget estimates in accordance with the law on the state budget or include such amounts in the next year’s state budget estimates for accounting state budget revenues and expenditures.

3. For aid amounts not regarded as state budget revenues, aid recipients shall formulate and report estimates to competent authorities for decision.

Article 19.Management of aid amounts in cash and in kind regarded as state budget revenues

1. For non-refundable aid amounts in cash:

a/ Aid recipients shall spend aid amounts under aid agreements;

b/ The State Treasury shall control aid spending under regulations on state budget management;

c/ On a monthly basis or upon receipt of a new aid, aid recipients shall make a dossier and complete procedures for recording non-refundable aid as a state budget revenue and aid spending as a state budget expenditure according to the state budget index.

2. For aid amounts in kind:

a/ Based on related dossiers and documents, and actual goods delivery and receipt, aid recipients shall carry out procedures for the State Treasury to record state budget revenues and expenditures;

b/ Based on dossiers and documents, the State Treasury shall control aid spending and record state budget revenues and expenditures;

c/ Customs dossiers and procedures for imported non-refundable aid goods must comply with the customs law.

Article 20.Tax policies applicable to aid goods

1. Taxes, charges and fees applicable to non-refundable aid goods must comply with the law on taxes, charges and fees.

2. Procedures and dossiers of request for tax exemption/refund for non-refundable aid goods must comply with the tax administration and customs laws.

Article 21.Accounting and account finalization

1. Accounting and account finalization of aid amounts regarded as state budget revenues must comply with the law on the state budget.

2. Accounting and account finalization of aid amounts not regarded as state budget revenues must comply with the accounting law and organization and operation charters of aid recipients.

Article 22.Audit of aid reports

1. Non-refundable aid amounts regarded as state budget revenues shall be audited in accordance with the state audit law.

2. Non-refundable aid amounts not regarded as state budget revenues shall be audited by independent audit firms in accordance with the law on independent audit or upon request of aid donors and must comply with Vietnam’s audit law.

 

Chapter V

EXAMINATION AND EVALUATION OF AID RECEIPT, MANAGEMENT AND USE AND INFORMATION AND REPORTING REGIMES

Article 23.Principles of examination and evaluation of aid receipt, management and use

1. Examination and evaluation shall be carried out in a comprehensive, systematic and objective manner in order to promptly detect and handle  problems, difficulties or violations in the course of receiving, managing and using international emergency aid for relief and remediation of natural disaster consequences.

2. Aid shall be provided to serve proper objectives, to eligible subjects, within the scope, and with contents as approved by competent authorities.

3. Information serving the examination and evaluation of aid receipt, management and use must be sufficient, timely, accurate, truthful and transparent.

4. Examination and evaluation results shall be transparently publicized and fully archived.

Article 24.Contents of examination and evaluation

1. Actual receipt, management and use of aid as approved by competent authorities.

2. Information and reporting regimes.

3. Difficulties and problems arising in the course of receiving, managing and using aid.

4. Plans to address shortcomings, difficulties and problems arising in the course of receiving, managing and using aid.

Article 25.Methods and order of examination and evaluation

1. Examination and evaluation of aid receipt, management and use shall be carried out by the following methods:

a/ Reporting;

b/ Formation of examination and evaluation teams.

2. Examination and evaluation shall be carried out periodically (before, during and after the receipt of aid) and extraordinarily (in case of necessity).

3. Procedures for examining and evaluating aid receipt, management and use:

a/ To prepare and submit an examination and evaluation plan for approval;

b/ To form an examination and evaluation team (if any);

c/ To notify the examination and evaluation plan and request preparation of documents for examination;

d/ To carry out examination and evaluation;

dd/ To summarize and report examination and evaluation results;

e/ To notify examination results and conclude examination and evaluation.

Article 26.Responsibility to examine and evaluate aid receipt, management and use

1. Managing agencies shall assume the prime responsibility for, and coordinate with related agencies in, examining and evaluating aid receipt and implementation.

2. Aid users shall provide relevant information and statistics to serve the examination and evaluation of aid receipt, management and use.

3. Managing agencies shall pay expenses for examination and evaluation, including: working trip expenses incurred for cadres and civil servants assigned to perform the task of examination and evaluation and other related expenses covered by managing agencies’ budgets.

Article 27.Information and reporting regimes

1. Information regime:

a/ Aid owners shall disclose information about aid amounts approved by competent authorities on their portals or websites;

b/ People’s Committees at all levels shall publicize beneficiaries and support policies and levels for beneficiaries in the mass media or post up information at their head offices.

2. Reporting regime:

a/ Aid users shall report to aid owners on actual receipt and use of aid within 5 working days from the date of completion of implementation of aid and make irregular reports at the request of aid owners;

b/ Aid owners shall report to managing agencies on actual receipt, management and use of aid within 5 working days after receiving aid users’ reports;

c/ Managing agencies shall report to the Ministry of Agriculture and Rural Development, Ministry of Planning and Investment and Ministry of Finance on contents of aid receipt within 3 working days after aid receipt and allocation decisions are approved;

d/ The Ministry of Agriculture and Rural Development shall summarize and report to the Prime Minister on actual receipt and implementation of emergency aid amounts for natural disaster victims upon request.

 

Chapter VI

RESPONSIBILITIES OF AGENCIES IN RECEIPT AND IMPLEMENTATION OF INTERNATIONAL EMERGENCY AID FOR RELIEF AND REMEDIATION OF NATURAL DISASTER CONSEQUENCES

Article 28.Responsibilities of managing agencies

In addition to the responsibilities specified in Chapters I, II, III, IV and V of this Decree, managing agencies shall:

1. Direct their attached units to coordinate with functional agencies in seeking and contacting aid donors  in order to call for and attract aid.

2. Direct, guide and examine aid owners in receiving and managing aid amounts, complying with current regulations, and fulfilling commitments with aid donors.

3. Monitor and evaluate the receipt and implementation of aid amounts; promptly detect and address according to their competence problems, difficulties and violations in the course of receiving and using aid or notify them to competent agencies for handling.

4. Fully and promptly arrange fundings to support aid receipt under approved decisions.

5. Take responsibility before the Government for quality, efficiency and progress of aid implementation in accordance with law.

6. Properly observe the reporting regime specified in Clause 2, Article 27 of this Decree.

Article 29.Responsibilities of aid owners

In addition to the tasks and powers specified in Chapters I, II, III, IV and V of this Decree, aid owners have the following tasks and powers:

1. To receive, manage and implement aid amounts in accordance with current regulations and commitments with aid donors. For aid amounts in kind, to complete customs clearance procedures within 48 hours after aid goods arrive in Vietnam in order to promptly distribute the goods to localities (except aid goods subject to specialized inspection).

2. To promptly report to managing agencies on problems, difficulties and violations in the course of receiving and implementing aid or to notify them to competent agencies for handling.

3. To take responsibility before managing agencies for quality, effectiveness and progress of aid implementation in accordance with law.

4. To properly observe the reporting regime specified in Clause 2, Article 27 of this Decree.

Article 30.Tasks of related agencies in receiving and implementing aid

1. The Ministry of Agriculture and Rural Development:

a/ To act as the focal point for state management of international emergency aid for relief and remediation of natural disaster consequences;

b/ To submit to the Prime Minister for consideration and approval the receipt of international emergency aid amounts for relief falling under the deciding competence of the Prime Minister;

c/ To summarize and submit to the Prime Minister for consideration and decision the policy of receiving emergency international aid for remediation of natural disaster consequences with contents related to security, national defense, religion  or procurement and supply of goods subject to the Prime Minister’s permission;

d/ To assume the prime responsibility for, and coordinate with related agencies in, submitting to the Prime Minister for consideration and decision the policy of receiving emergency aid amounts for remediation of natural disaster consequences in case managing agencies remain unidentified;

dd/ To direct units to resolve as soon as possible cases related to aid goods subject to animal or plant quarantine, veterinary drugs, vaccines for prevention and control of epidemics, equipment and tools for animal health and other goods items under management by the Ministry of Agriculture and Rural Development in accordance with law.

2. The Ministry of Finance:

a/ To assign a focal point to provide guidance and assistance in completion of procedures for quick customs clearance of aid goods;

b/ To provide according to its competence guidance on financial management of international emergency aid capital for relief and remediation of natural disaster consequences regarded as state budget revenues and spending tasks in accordance with this Decree;

c/ To examine the implementation of financial management regimes applicable to aid owners and aid users;

d/ To give opinions on receipt of aid amounts under regulations;

dd/ To perform the state management of aid amounts regarded as state budget revenues.

3. The Ministry of National Defense:

a/ To coordinate with related agencies in appraising and receiving national defense-related aid amounts;

b/ To permit foreign military ships and military aircraft carriers to transport aid goods into Vietnam in accordance with law;

c/ To coordinate with functional agencies in managing and controlling foreign personnel involved in the transportation of aid goods on board foreign military ships and aircraft entering Vietnam.

4. The Ministry of Public Security:

a/ To coordinate in examining aid amounts involving security and state secret elements under the management by the Public Security Forces  upon request;

b/ To coordinate in examining and handling violations related to the management and use of international emergency aid for relief and remediation of natural disaster consequences.

5. The Ministry of Health:

a/ To direct its attached units in carrying out specialized inspection as soon as possible of aid goods items under its management in accordance with law;

b/ To give opinions on receipt of aid amounts in accordance with law.

6. The Ministry of Industry and Trade shall resolve cases related to the receipt of aid goods under its management in accordance with law.

7. Ministries, ministerial-level agencies, government-attached agencies, and provincial-level People’s Committees shall, within the ambit of their functions and tasks, raise donations and receive emergency aid amounts for relief and remediation of natural disaster consequences; and coordinate with one another in receiving aid goods under their management in accordance with law.

8. Provincial-level People’s Committees:

a/ To coordinate with managing agencies in identifying the need for assistance and plans on aid implementation;

b/ To direct functional agencies in receiving and distributing aid amounts to beneficiaries;

c/ To monitor and examine aid distribution to ensure prompt and proper distribution of aid to eligible subjects in accordance with law;

d/ To properly observe the information and reporting regimes as prescribed by law.

Chapter VII

IMPLEMENTATION PROVISIONS

Article 31.Effect

This Decree takes effect on June 15, 2020.

Article 32.Implementation responsibility

Ministers, heads of ministerial-level agencies and government-attached agencies, chairpersons of provincial-level People’s Committees and related agencies, organizations and individuals shall implement this Decree.-
