Circular 22/2019/TT-BNNPTNT guiding on management of domestic animal breeds

CIRCULAR

Guiding a number of articles of the Law on Animal Husbandry regarding management of domestic animal breeds and breed products^[1]

Pursuant to the Government’s Decree No. 15/2017/ND-CP of February 17, 2017, defining functions, tasks, powers and organizational structure of the Ministry of Agriculture and Rural Development;

Pursuant to the November 19, 2018 Law on Animal Husbandry;

At the proposal of the Director of the Department of Livestock Production;

The Minister of Agriculture and Rural Development promulgates the Circular guiding a number of articles of the Law on Animal Husbandry regarding management of domestic animal breeds and breed products.

Chapter I

GENERAL PROVISIONS

Article 1.Scope of regulation

This Circular guides Clause 1, Article 15; Clause 4, Article 16; Point a, Clause 4, Article 20; Point a, Clause 2, Article 21; and Clause 3, Article 24, of the Law on Animal Husbandry.

Article 2.Subjects of application

This Circular applies to domestic and foreign organizations and individuals engaged in activities related to domestic animal breeds and breed products in Vietnam.

Chapter II

SPECIFIC PROVISIONS

Article 3.Exchange of precious and rare domestic animal genetic sources for research, selection and creation of new domestic animal strains and breeds and for production and trading

1. Organizations and individuals may exchange precious and rare domestic animal genetic sources, including breeds, eggs, sperms and embryos.

2. Organizations and individuals engaged in exchange of precious and rare domestic animal genetic sources shall comply with purposes and contents that have been registered with the Minister of Agriculture and Rural Development.

3. In every December or upon request of competent agencies, organizations and individuals that exchange precious and rare domestic animal genetic sources shall report to the Minister of Agriculture and Rural Development in writing and electronic form on situation and results of use of exchanged precious and rare domestic animal genetic sources according to the form provided in Appendix I to this Circular.

Article 4.Forms of dossier documents for exchange of precious and rare domestic animal genetic sources

1. Application for registration of exchange of precious and rare domestic animal genetic sources, made according to the form provided in Appendix II to this Circular.

2. Family records of precious and rare domestic animal genetic sources to be exchanged, made according to the form provided in Appendix II to this Circular.

Article 5.Dossier documents for first-time import of breeding males, sperms and embryos of cattle breeds

1. An application for import of a breeding male or sperms and embryos of a cattle breed, made according to the form provided in Appendix III to this Circular.

2. Family records of a breeding male or sperms and embryos of a cattle breed to be imported, made according to the form provided in Appendix III to this Circular.

3. Documents of a competent agency or an organization authorized by the competent agency of the exporting country, certifying origin, quality and use purpose of breed (these documents may be the originals or certified copies enclosed with their Vietnamese translations certified by the importer).

Article 6.Dossier documents for export of domestic animal breeds or domestic animal breed products on the list of domestic animal breeds banned from export for scientific research, exhibition or advertising

1. An application for export of a domestic animal breed or domestic animal breed product on the list of domestic animal breeds banned from export for scientific research, exhibition or advertising, made according to the form provided in Appendix IV to this Circular.

2. Family records of the exported domestic animal breed or domestic animal breed product on the list of domestic animal breeds banned from export for scientific research, exhibition or advertising, made according to the form provided in Appendix IV to this Circular.

3. The original or a certified copy of the cooperation agreement on scientific research, exhibition or advertising of the domestic animal breed or domestic animal breed product on the list of domestic animal breeds banned from export for scientific research, exhibition or advertising.

4. Other documents (if any) related to export of domestic animal breed or domestic animal breed product.

Article 7.Quality standards subject to compulsory declaration and quality norms applicable to breeding males and females

Quality standards subject to compulsory declaration and quality norms applicable to breeding males and females are specified in Appendix V to this Circular.

Chapter III

ORGANIZATION OF IMPLEMENTATION

Article 8.Responsibilities of related parties

1. The Department of Livestock Production shall:

a/ Advise on and synthesize contents related to the management of domestic animal breeds and breed products nationwide;

b/ Inspect and examine quality of domestic animal breeds and breed products nationwide.

2.  The Department of Animal Health shall provide information on export and import of domestic animal breeds and breed products to the Department of Livestock Production on the 30^thday of the last month of every quarter or at the request of competent agencies.

3. Provincial-level Departments of Agriculture and Rural Development shall:

a/ Organize the implementation of this Circular in their localities;

b/ Carry out quality inspection and examination of domestic animal breeds and breed products in their localities.

4. Organizations and individuals engaged in the fied of domestic animal breeds and breed products shall comply with this Circular and relevant regulations.

Article 9.Transitional provision

Licenses related to production, trading, exchange, import and export of domestic animal breeds and breed products granted by competent agencies before the effective date of this Circular remain valid until their expiry dates.

Article 10.Effect

1. This Circular takes effect on January 15, 2020.

2. This Circular replaces:

a/ The Minister of Agriculture and Rural Development’s Decision No. 66/2005/QD-BNN of October 31, 2005, promulgating the regulations on management and use of breeding bulls;

b/ The Minister of Agriculture and Rural Development’s Decision No. 07/2005/QD-BNN of January 31, 2005, promulgating the regulations on management and use of breeding boars;

c/ The Minister of Agriculture and Rural Development’s Decision No. 13/2007/QD-BNN of February 9, 2007, promulgating the regulations on management and use of breeding male buffaloes;

d/ The Minister of Agriculture and Rural Development’s Decision No. 108/2007/QD-BNN of December 31, 2007, promulgating the regulations on management and use of breeding bucks.

3. This Circular annuls:

Article 7 of the Minister of Agriculture and Rural Development’s Circular No. 43/2018/TT-BNNPTNT of December 28, 2018, prescribing import and export of plant varieties, livestock breeds and plant genetic sources; import of pesticides and articles on the list of articles subject to plant quarantine and pest risk analysis before being imported into Vietnam.

Any problems arising in the course of implementation of this Circular should be promptly reported to the Ministry of Agriculture and Rural Development for appropriate amendment and supplementation.-
