SUMMARY

02 cases that an update account of the national database on animal husbandry shall be locked

On November 22, 2019, the Minister of Agriculture and Rural Development promulgates the Circular No. 20/2019/TT-BNNPTNT prescribing the update, exploitation and management of the national database on animal husbandry.

The national database on animal husbandry includes: Databases on domestic animal breeds, domestic animal genetic sources, animal feed and products from the treatment of animal husbandry wastes; Databases on animal husbandry establishments, animal husbandry product processing establishments and animal husbandry product markets; Database on epidemic-free animal husbandry zones; Other databases on animal husbandry.

In which, Databases on domestic animal breeds comprise of: Organizations and individuals producing domestic animal sperms, embryos and larva and incubation facilities: name, telephone number, email (if any); addresses of domestic animal sperm, embryo, larva and egg production establishments; name of domestic animal breeds producing sperms, embryos, larva and breeding eggs; sperm, embryo, larva and egg production scale and quantity…

Update accounts of the national database on animal husbandry shall be delegated from central to local levels. The Department of Livestock Production shall grant and lock update accounts of individuals and organization. An update account shall be locked when:

- An institution granted with the account is divided, merged, or dissolved, has its operation terminated or is transferred; or,

- An individual granted with the account changes his/her working unit, takes leave or retires.

This Circular takes effect on January 7, 2020.

Circular

Prescribing the update, exploitation and management of the national database on animal husbandry[1]

 

Pursuant to the Government’s Decree No. 15/2017/ND-CP of February 17, 2017, defining the functions, tasks, powers and organizational structure of the Ministry of Agriculture and Rural Development;

Pursuant to the November 19, 2018 Law on Animal Husbandry;

At the proposal of the Director of the Department of Livestock Production;

The Minister of Agriculture and Rural Development promulgates the Circular prescribing the update, exploitation and management of the national database on animal husbandry.

 

Chapter I

GENERAL PROVISIONS

Article 1.Scope of regulation

This Circular details the update, exploitation and management of the national database on animal husbandry prescribed in Clause 4, Article 11 of the Law on Animal Husbandry.

Article 2.Subjects of application

This Circular applies to organizations and individuals involved in the update, exploitation and management of the national database on animal husbandry.

 

Chapter II

NATIONAL DATABASE ON ANIMAL HUSBANDRY

Article 3.Database on legal documents on animal husbandry

The database on legal documents on animal husbandry includes the animal husbandry-related legal documents prescribed in Article 4 of the Law on Promulgation of Legal Documents.

Article 4.Databases on domestic animal breeds, domestic animal genetic sources, animal feed and products from the treatment of animal husbandry wastes

1. Data on domestic animal breeds include:

a/ Organizations and individuals producing breeding domestic animals: name,telephone number, email (if any); addresses of breed production establishments;production scale; origin, name, level, quantity and techno-economic norms of, and declared standards applicable to, breeding domestic animals;

b/ Organizations and individuals producing domestic animal sperms, embryos and larva and incubation facilities: name, telephone number, email (if any); addresses of domestic animal sperm, embryo, larva and egg production establishments; name of domestic animal breeds producing sperms, embryos, larva and breeding eggs; sperm, embryo, larva and egg production scale and quantity;

c/ Individuals providing artificial insemination or breeding domestic animal embryo transplantation services: name, telephone number, email (if any) and address; number of crossbred semen doses or transplanted embryos per year;

d/ Organizations and individuals owning breeding boars, male buffalos and bulls for direct mating for commercial purposes: name, telephone number, email (if any) and address; mating scale, strains and quantity of breeding males for mating and annual mating results (if any);

dd/ Organizations and individuals trading in breeding domestic animals, sperms, embryos, eggs and larva: name, telephone number, email (if any) and address; strains and quantity of breeding domestic animals traded annually; domestic animal breeds, sperms, embryos, eggs and larva having gone through quarantine, checking and quality assessment;

e/ Domestic animal strain and breed testing establishments: name, telephone numbers, email (if any), address; animal husbandry scale and testing capacity (tested domestic animal strains and breeds and the maximum number of tested domestic animals); those assigned to inspect domestic animal strains and breeds;

g/ List of domestic animal breeds that need to be conserved;

h/ List of domestic animal breeds banned from export.

2. Data on domestic animal genetic sources include:

a/ Organizations and individuals collecting domestic animal genetic sources: name, telephone number, email (if any), address; name, quantity, locations for collection of, bio-criteria and use value of domestic animal genetic sources;

b/ Organizations and individuals conserving domestic animal genetic sources: name, telephone number, email (if any), address; name, quantity, locations and methods of conservation of domestic animal genetic sources;

c/ Organizations and individuals exploiting and developing domestic animal genetic sources: name, telephone number, email (if any), address; name, quantity, location of exploitation and development of domestic animal genetic sources.

3. Data on animal feed include:

a/ Establishments producing commercial animal feed having certificates of eligibility for animal feed production granted by provincial-level Departments of Agriculture and Rural Development: name, telephone number, email (if any); address and designed capacity; numbers and dates of grant of certificates, and certificate-granting agency;

b/ Establishments producing commercial animal feed having certificates of eligibility for animal feed production granted by the Department of Livestock Production: name, telephone number, email (if any), address, designed capacity; numbers and dates of grant of certificates;

c/ Animal feed importers: name, telephone number, email (if any), address;

d/ Animal feed trading establishments: name, telephone number, email (if any), address;

dd/ Animal feed testing establishments: name, telephone number, email (if any), address; testing scale;

e/ Output of commercial animal feed: name, quantity, domestic animals fed with commercial animal feed;

g/ Imported animal feed: name, quantity, value, and origin;

h/ List of chemicals, bio-products and microorganisms banned from use in animal feed;

i/ List of materials permitted for use as animal feed;

k/ Laboratories designated in the field of animal feed: name, telephone number, email (if any), address; designated testing methods; date of designation, expiry date, designating agency;

l/ Regulation conformity certification organizations designated in the field of animal feed: name, telephone number, email (if any) and address; designated scope; date of designation, expiry date, designating agency.

4. Data on products from the treatment of animal husbandry wastes include:

a/ Establishments producing products from the treatment of animal husbandry wastes: name, telephone number, email (if any), address and designed capacity;

b/ Establishments testing products from the treatment of animal husbandry wastes: name, telephone number, email (if any), address;

c/ Name and quantity of products from the treatment of animal husbandry wastes and declared applicable standards.

Article 5.Databases on animal husbandry establishments, animal husbandry product processing establishments and animal husbandry product markets

1. Data on animal husbandry establishments include:

a/ Data on organizations and individuals engaged in animal husbandry: name and code of animal husbandry establishment, telephone number, email (if any) and address; types and quantities of domestic animals, names of domestic animal breeds, animal husbandry methods and productivity;

b/ Data on animal husbandry conditions: animal husbandry scale and density; declaration of animal husbandry activities; safe distances in animal husbandry farms; diseases (epidemics) under supervision, measures to ensure biosafety;

c/ Certificates of animal husbandry establishments: numbers and date of grant of certificate of eligibility for animal husbandry and certificate-granting agency; number and date of grant of certificate of good animal husbandry practices and certificate-granting agency; number and date of grant of certificate of biosafety animal farm and certificate-granting agency;

d/ Designated conformity certification organizations: name, telephone number, email (if any) and address; date of designation, expiry date, designating agency.

2. Data on animal husbandry product processing establishments include: name, code, telephone number, email (if any) and address; food safety certificate, date of grant of certificate and certificate-granting agency; designed capacity, animal husbandry products, categories of processed products, origin of materials for processing of animal husbandry products; quantity of local and imported materials and processed output, export value, domestic and export markets of animal husbandry products.

3. Data on animal husbandry product markets include:

a/ Data on information about prices of breeding animals, breeding animal products; complete compound animal feed products used in the stage of fattening pigs and chicken; a number of main animal feed materials; main animal husbandry products;

b/ Data on animal husbandry product import and export markets include animal husbandry product importing and exporting countries; quantities and categories of animal husbandry products; specifications, import value and export value;

c/ Data on treaties include the Agreement on Sanitary and Phytosanitary Measures (SPS) and trade commitments (tariff and non-tariff commitments), Technical Barriers to Trade (TBT) Agreement, documents on SPS and TBT of importing member states.

Article 6.Database on epidemic-free animal husbandry zones

Data on epidemic-free animal husbandry zones include name and address of animal husbandry zone, domestic animals, animal husbandry scale; certified diseases (epidemics), bio-safety control measures, number and date of grant of certificate of epidemic-free animal husbandry zones.

Article 7.Other databases on animal husbandry

1. Data on science and technology in animal husbandry include:

a/ Results of scientific research in animal husbandry;

b/ Technologies applied in animal husbandry;

c/ List of national standards and technical regulations on animal husbandry; technical processes; techno-economic norms; technical advances.

2. Data on animal epidemic prevention and control in accordance with the law on animal health: type of epidemic, type of affected domestic animals, epidemic-hit locations, number of domestic animals affected by an epidemic.

3. Data on establishments that have certificate of eligibility for animal husbandry, certificate of epidemic-free animal husbandry zone, certificate of good animal husbandry practices, certificate of biosafety animal farm, and/or certificate of eligibility for animal feed production revoked.

4. Data on establishments that have decision on designation of conformity certification organization or decision on designation of animal feed laboratory revoked or invalidated.

 

Chapter III

UPDATE AND EXPLOITATION OF THE NATIONAL DATABASE ON ANIMAL HUSBANDRY

Article 8.Frequency of update of the national database on animal husbandry

1. Monthly update (before the 30thof every month) of the contents specified in Article 3 and at Point a, Clause 3, Article 5 of this Circular.

2. Quarterly update (before the 30thof the last month of every quarter) of the contents specified at Points a and b, Clause 1; Point a, Clause 2; Points a, b, c and d, Clause 3; and Points a and c, Clause 4, Article 4; Clause 1, Article 5, and Article 6, of this Circular.

3. Annual update (before December 30 every year) of the contents specified at Points c, d, dd, e, g and h, Clause 1; Points b and c, Clause 2; Points dd, e, g, h, i, k and l, Clause 3; and Point b, Clause 4, Article 4; Clause 2, and Points b and c, Clause 3, Article 5, and Article 7, of this Circular.

Article 9.Exploitation of the national database on animal husbandry

1. Institutions that act as focal points in building and updating national data on animal husbandry for the central and provincial levels may exploit national data on animal husbandry according to their power delegation.

2. Organizations and individuals may exploit and use the national database on animal husbandry under Articles 3, 4, 5, 6 and 7 of this Circular.

 

Chapter IV

MANAGEMENT OF THE NATIONAL DATABASE ON
ANIMAL HUSBANDRY

Article 10.Management of update accounts of the national database on animal husbandry

1. Update accounts of the national database on animal husbandry shall be delegated from central to local levels.

2. Grant and locking of update accounts: The Department of Livestock Production shall grant and lock update accounts of individuals (cadres, civil servants and public employees) and organizations (state administrative agencies).

3. Management of update accounts:

a/ Institutions granted with update accounts shall assign their individual members to administer, update, exploit and manage the national database on animal husbandry in accordance with law;

b/ Individuals granted with update accounts shall ensure confidentiality, administration, update, exploitation and management of the database and use granted accounts in accordance with law.

4. An update account shall be locked when:

a/ An institution granted with the account is divided, merged, or dissolved, has its operation terminated or is transferred; or,

b/ An individual granted with the account changes his/her working unit, takes leave or retires.

Article 11.Contents of management of the national database on  animal husbandry

1. Building and operating technical infrastructure and software of the national database on  animal husbandry, ensuring connection and synchronous sharing of data in the entire system. Resources for building and operating technical infrastructure and software of the national database on  animal husbandry come from the state budget and mobilized social resources.

2. Collecting, processing and updating information into the national database on animal husbandry, which shall be automated through the digitalization of declaration, input, storage, processing, analysis of data and making reports.

3. Managing rights to access and update information in the national database on  animal husbandry.

4. Monitoring and supervising the use of the national database on  animal husbandry.

5. Training human resources and assisting the operation and exploitation of the national database on animal husbandry.

Article 12.Assurance of security for the national database on animal husbandry

1. Using copyrighted security software and applying technologies to detect and prevent illegal access.

2. Using encrypted channels and authenticating user information in logging in the system administrator; logging in applications; automatically sending and receiving data among servers; inputting and editing data.

3. Encrypting transmission lines of the national database on animal husbandry.

4. Taking measures to ensure authenticity and integrity of data in the national database on animal husbandry.

5. Professional activities to ensure the management of confidentiality of the system, which include tracing login, creation, change or deletion of data in order to serve the system management and supervision.

6. Setting up and maintaining a backup system to ensure uninterrupted operation of the system.

7. Applying measures for periodical backup of data and protection of such data by data hiding and encryption.

8. Taking other necessary measures to protect database security.

 

Chapter V

RESPONSIBILITIES OF RELATED ORGANIZATIONS AND INDIVIDUALS

Article 13.Responsibilities of the Department of Livestock Production

1. To assume the prime responsibility for building the national database on animal husbandry.

2. To assume the prime responsibility for, and guide related organizations and individuals in, reporting on data to serve the update, exploitation and management of the national database on animal husbandry and summarization of information nationwide.

3. To assume the prime responsibility for operating, maintaining, supervising and upgrading technical infrastructure and software and measures to ensure safety for the national database on animal husbandry.

4. To manage administrator accounts, grant the right to update and exploit the national database on animal husbandry.

5. To instruct, guide and periodically or extraordinarity inspect the update, exploitation and management of local databases on animal husbandry. To organize training in the update, exploitation and management of the national database on animal husbandry.

6. To evaluate and rate institutions’ capacity for updating, exploiting and managing animal husbandry databases and publicize results every year.

7. To coordinate with related organizations and individuals in addressing problems arising in the course of update, exploitation and management of the national database on animal husbandry.

8. To build infrastructure facilities for the update, exploitation and management of the national database on animal husbandry.

9. To organize the update of data under Article 3; Points e, g and h, Clause 1; Points b and c, Clause 2; Points b, c, dd, e, g, h, i, k and l of Clause 3; and Points b and c, Clause 4, Article 4; Point d, Clause 1, Article 5; Point c, Clause 1, and Clause 4, Article 7 of this Circular; to take responsibility for timeliness, adequacy and accuracy of information updated into the national database on animal husbandry.

Article 14.Responsibilities of related units of the Ministry of Agriculture and Rural Development

1. The Science, Technology and Environment Department

a/ To instruct and guide related organizations and individuals in reporting on data to serve the update, exploitation and management of the national database on science and technology in animal husbandry;

b/ To coordinate the Department of Livestock Production in updating, exploiting and managing the national database on animal husbandry within the ambit of its assigned functions and tasks;

c/ To inspect the implementation of this Circular’s provisions on update, exploitation and management of the national database on science and technology in animal husbandry;

d/ To organize update of data under Points a and b, Clause 1, Article 7 of this Circular; to take responsibility for timeliness, adequacy and accuracy of data updated into the national database on animal husbandry.

2. The Department of Animal Health

a/ To instruct and guide related organizations and individuals in reporting on data on epidemic prevention and control to serve the update, exploitation and management of the national database on epidemic prevention and control in animal husbandry; epidemic-free animal husbandry zones, and imported animal feed products of animal origin;

b/ To coordinate with the Department of Livestock Production in updating, exploiting and managing the national database on animal husbandry within the ambit of its assigned functions and tasks;

c/ To inspect the implementation of this Circular’s provisions on update, exploitation and management of the national database on epidemic prevention and control in animal husbandry; epidemic-free animal husbandry zones, and imported animal feed products of animal origin;

d/ To organize update of data under Points c and g, Clause 3, Article 4 (for imported animal feed of animal origin); Article 6 and Clause 2, Article 7 of this Circular; to take responsibility for timeliness, adequacy and accuracy of information updated into the national database on animal husbandry.

3. The Agro Processing and Market Development Department

a/ To instruct and guide related organizations and individuals in reporting on data to serve update, exploitation and management of the national database on animal husbandry product processing;

b/ To coordinate with the Department of Livestock Production in updating, exploiting and managing the national database on animal husbandry within the ambit of its assigned functions and tasks;

c/ To inspect the implementation of this Circular’s provisions on update, exploitation and management of the national database on animal husbandry product processing; domestic and foreign markets;

d/ To organize update of data under Clause 2, Article 5 of this Circular; to take responsibility for timeliness, adequacy and accuracy of information updated into the national database on animal husbandry.

4. The Department of Plant Protection

a/ To instruct and guide related organizations and individuals in reporting on data to serve update, exploitation and management of the national database on imported animal feed of plant origin;

b/ To coordinate with the Department of Livestock Production in updating, exploiting and managing the national database on animal husbandry within the ambit of its assigned tasks and functions;

c/ To inspect the implementation of this Circular’s provisions on update, exploitation and management of the national database on imported animal feed of plant origin;

d/ To organize update of data under Points c and g, Clause 3, Article 4 of this Circular (for imported animal feed of plant origin); to take responsibility for timeliness, adequacy and accuracy of information updated into the national database on animal husbandry.

5. The Center for Informatics and Statistics

a/ To assume the prime responsibility for, and guide related organizations and individuals in, reporting on data to serve the update, exploitation and management of the national database on domestic and foreign markets;

b/ To coordinate with the Department of Livestock Production in updating, exploiting and managing the national database on animal husbandry within the ambit of its assigned functions and tasks;

c/ To organize update of data under Clause 3, Article 5 of this Circular; to take responsibility for timeliness, adequacy and accuracy of information updated into the national database on animal husbandry.

Article 15.Responsibilities of provincial-level Departments of Agriculture and Rural Development

1. To instruct and guide training in building databases, and update, exploitation and management of the national database on animal husbandry in their localities for related organizations and individuals.

2. To coordinate with the Department of Livestock Production in updating, exploiting and managing the national database on animal husbandry according to their delegated powers and assigned functions and tasks.

3. To inspect related organizations and individuals in implementing this Circular’s provisions on information provision and update, exploitation and management of the national database on animal husbandry in their localities.

4. To build infrastructure facilities for building databases, and updating, exploiting and managing the national database on animal husbandry in their localities.

5. To organize update of data underPoints a, b, c, d and dd, Clause 1; Point a, Clause 2; Points a, d and e, Clause 3; and Point a, Clause 4, Article 4; Points a, b and c, Clause 1, Article 5; and Clause 3, Article 7, this Circular; to take responsibility for the timeliness, adequacy and accuracy of information updated into the national database on animal husbandry.

Article 16.Responsibilities of related organizations and individuals

1. To strictly comply with the Circular and regulations on update, exploitation and use of information on the national database on animal husbandry.

2. Designated conformity certification organizations shall update data on certificates of good animal husbandry practices and certificates of biosafety animal farms specified at Point c, Clause 1, Article 5 of this Circular.

3. Organizations and individuals collecting domestic animal genetic sources shall update data specified at Point a, Clause 2, Article 4 of this Circular.

4. To take responsibility for timeliness, adequacy and accuracy of information updated into the national database on animal husbandry.

 

Chapter VI

ORGANIZATION OF IMPLEMENTATION

Article 17.Effect

This Circular takes effect on January 7, 2020.

Article 18.Implementation responsibility

Any problems arising in the course of implementation of this Circular should be reported to the Ministry of Agriculture and Rural Development for consideration, amendment and supplementation.-
