Decree 309/2025/ND-CP amending Decree 26/2019/ND-CP detailing Law on Fisheries, amended and supplemented under Decree 37/2024/ND-CP

DECREE

Amending and supplementing a number of articles of the Government’s Decree No. 26/2019/ND-CP of March 08, 2019, detailing a number of articles of, and measures to implement, the Law on Fisheries, amended and supplemented under the Government’s Decree No. 37/2024/ND-CP of April 04, 2024

Pursuant to the Law on Organization of the Government No. 63/2025/QH15;

Pursuant to the Law on Fisheries No. 18/2017/QH14;

At the request of the Minister of Agriculture and Environment;

The Government hereby promulgates this Decree amending and supplementing a number of articles of the Government’s Decree No. 26/2019/ND-CP of March 08, 2019, detailing a number of articles of, and measures to implement, the Law on Fisheries, amended and supplemented under the Government’s Decree No. 37/2024/ND-CP of April 04, 2024.

Article 1. To annul the phrase “and other related regulations” at Point b Clause 5 Article 36 of Decree No. 26/2019/ND-CP, as amended and supplemented under Clause 14 Article 1 of Decree No. 37/2024/ND-CP.

Article 2. To annul Point c Clause 6 Article 70b of Decree No. 26/2019/ND-CP, as added under Clause 36 Article 1 of Decree No. 37/2024/ND-CP.

Article 3. To suspend the effect of regulations on minimum permissible exploitation sizes of certain aquatic species living in natural water areas under Appendix V promulgated together with Decree No. 37/2024/ND-CP until amendments are made to ensure conformity with legal regulations, the Party’s policies, and directives of the Government and the Prime Minister, specifically:

1. Frigate tuna (Auxis thazard) at ordinal number 11, Section 1.

2. Eastern little tuna (Euthynnus affinis) at ordinal number 12, Section 1.

3. Largehead hairtail (Trichiurus lepturus) at ordinal number 15, Section 1.

4. Spotted sardinella (Sardinella gibbosa) at ordinal number 36, Section 1.

5. Bullet tuna (Auxis rochei) at ordinal number 63, Section 1.

6. Yellowfin tuna (Thunnus albacares) at ordinal number 64, Section 1.

7. Bigeye tuna (Thunnus obesus) at ordinal number 65, Section 1.

8. Skipjack tuna (Katsuwonus pelamis) at ordinal number 66, Section 1.

9. Hardback prawn (Parapenaeopsis hardwickii) at ordinal number 15, Section 2.

10. Squid (Loligo chinensis and Loligo edulis) at ordinal number 1, Section 4.

Article 4. Effect

This Decree takes effect from the date of its signing for promulgation.

Article 5. Implementation responsibilities

Ministers, Heads of ministerial-level agencies, Heads of Government-attached agencies, Chairpersons of People’s Committees at all levels, and other related organizations and individuals shall be responsible for implementing this Decree.
