CIRCULAR
Guiding a number of articles of the Law on Animal Husbandry regarding animal feed[1]
Pursuant to the Government’s Decree No. 15/2017/ND-CP of February 17, 2017, defining functions, tasks, powers and organizational structure of the Ministry of Agriculture and Rural Development;
Pursuant to the November 19, 2018 Law on Animal Husbandry;
At the proposal of the Director of the Department of Livestock Production;
The Minister of Agriculture and Rural Development promulgates the Circular guiding a number of articles of the Law on Animal Husbandry regarding animal feed.
Chapter I
GENERAL PROVISIONS
Article 1.Scope of regulation
This Circular guides a number of provisions of Clause 4, Article 37; Clause 2, Article 46; Point dd, Clause 2, Article 48; and Point c, Clause 2, Article 79, of the Law on Animal Husbandry regarding animal feed, including:
1. Quality standards of animal feed subject to compulsory declaration in standards declared for application;
2. Labeling of animal feed;
3. Reporting on animal feed production;
4. List of chemicals, bio-products and microorganisms banned from use in animal feed and list of materials permitted for use as animal feed.
Article 2.Subjects of application
This Circular applies to domestic and foreign organizations and individuals engaged in animal feed-related activities in Vietnam’s territory.
Chapter II
SPECIFIC PROVISIONS
Article 3.Quality standards of animal feed subject to compulsory declaration in standards declared for application
Quality standards of animal feed subject to compulsory declaration in standards declared for application are provided in Appendix I to this Circular.
Article 4.Labeling of animal feed
1. Contents shown on animal feed labels are specified in Appendix II to this Circular.
2. Animal feed being bulk goods must be accompanied by documents specified in Appendix III to this Circular upon circulation, except traditional animal feed that has not yet been processed and sold directly to farmers.
3. Animal feed supplied under orders and animal feed for internal consumption with packages are not required to be labeled under Clause 1 of this Article upon circulation but must show signs on their packages for identification and mistake avoidance and be accompanied by documents specified in Appendix III to this Circular.
4. Animal feed containing veterinary drugs with antibiotic ingredients for prevention and treatment of animal diseases must fully have on their labels or in accompanied documents upon circulation information on antibiotic names and contents, use instructions and expiry dates.
Article 5.Reporting on animal feed production
Commercial animal feed produces shall monthly report on animal feed production according to the form provided in Appendix IV to this Circular to the Department of Livestock Production and provincial-level Departments of Agriculture and Rural Development of their localities via the Internet or by post in the first week of the subsequent month; and make unscheduled reports at request of competent agencies.
Article 6.List of chemicals, bio-products and microorganisms banned from use in animal feed and list of materials permitted for use as animal feed
1. The list of chemicals, bio-products and microorganisms banned from use in animal feed is provided in Appendix V to this Circular.
2. The list of materials permitted for use as animal feed is provided in Appendix VI to this Circular.
3. The Department of Livestock Production shall:
a/ Summarize and submit to the Minister of Agriculture and Rural Development for annual review and update the lists mentioned in Clauses 1 and 2 of this Article;
b/ Update and announce traditional feed products and commercial single ingredients on the portal of the Ministry of Agriculture and Rural Development.
Traditional feed products that have not yet been declared under this Point may be produced for purposes of trading and exchange within household-based animal farms, households and business households.
Chapter III
ORGANIZATION OF IMPLEMENTATION
Article 7.Effect
1. This Circular takes effect on January 14, 2020.
2. This Circular replaces:
a/ The Minister of Agriculture and Rural Development’s Circular No. 28/2014/TT-BNNPTNT of September 4, 2014, promulgating the list of chemicals and antibiotics banned from import, production, trading and use in cattle and poultry feed in Vietnam;
b/ The Minister of Agriculture and Rural Development’s Circular No. 42/2015/TT-BNNPTNT of November 16, 2015, promulgating the additional list of chemicals and antibiotics banned from import, production, trading and use in cattle and poultry feed in Vietnam;
c/ The Minister of Agriculture and Rural Development’s Circular No. 01/2017/TT-BNNPTNT of January 16, 2017, supplementing the list of chemicals and antibiotics banned from import, production, trading and use in cattle and poultry feed in Vietnam;
d/ The Minister of Agriculture and Rural Development’s Circular No. 02/2019/TT-BNNPTNT of February 11, 2019, promulgating the list of traditional and single-ingredient feed products permitted for circulation in Vietnam.
Article 8.Transitional provisions
1. Labels of animal feed products under the Minister of Agriculture and Rural Development’s Circular No. 20/2017/TT-BNNPTNT of November 10, 2017, guiding the implementation of the Government’s Decree No. 39/2017/ND-CP of April 4, 2017, on management of animal and aquatic feed, which are printed before the effective date of this Circular, remain valid through December 31, 2021.
2. Animal feed permitted for circulation in Vietnam before the effective date of this Circular under the Government’s Decree No. 39/2017/ND-CP of April 4, 2017, on management of animal and aquatic feed, of which ingredients contain raw materials not yet declared under Point b, Clause 3, Article 6 of this Circular, may continue to be circulated through December 31, 2021.
Article 9.Implementation responsibility
Any problems arising in the course of implementation of this Circular should be promptly reported to the Ministry of Agriculture and Rural Development for solution or amendment and supplementation.-
