CIRCULAR

Annulment of a number of legal documents promulgated by the Minister of Health

Pursuant to the Law on Promulgation of Legal Documents No. 64/2025/QH15, which was amended and supplemented under Law No. 87/2025/QH15;

Pursuant to the Government's Decree No. 78/2025/ND-CP dated April 01, 2025, detailing a number of articles of, and providing measures for guiding the implementation of, the Law on Promulgation of Legal Documents, amended and supplemented under Decree No. 187/2025/ND-CP;

Pursuant to the Government's Decree No. 42/2025/ND-CP dated February 27, 2025, defining the functions, tasks, powers and organizational structure of the Ministry of Health;

At the request of the Director of the Department of Medical Services Administration; Director of the Agency of Traditional Medicine Administration; Director of the Vietnam Food Administration; Director of the Agency for Disease Control; Director of the Agency for Health Infrastructure and Medical Equipment; Director of the Drug Administration of Vietnam; and the Director of the Department of Legal Affairs.

The Minister of Health hereby promulgates the Circular on annulment of a number of legal documents promulgated by the Minister of Health.

Article 1. Wholly annulment of a legal document promulgated by the Minister of Health

The Minister of Health's Circular No. 20/2024/TT-BYT dated October 14, 2024, amending and supplementing a number of articles of the Minister of Health's Circular No. 09/2015/TT-BYT dated May 25, 2015, prescribing certification of advertising content for special products, goods, and services under the management of the Ministry of Health.

Article 2. Partial annulment of 2 legal documents promulgated by the Minister of Health

1. To annul Circular No. 09/2015/TT-BYT, except for the following provisions:

a) Point a Clause 3 and Clause 6 Article 1; Clause 1, Point a, Point b Clause 2 Article 3; the provisions on food at Point dd Clause 2 Article 3; Article 4; Clause 7 Article 20; the provisions on cases of expiration of validity of the certificates of advertising content for food, milk and nutritional products for children at Clause 3 Article 23;

b) Point b, Point c, Point d and Point dd Clause 3 Article 1; Article 7, Article 10, Article 16; Point b Clause 1 and Clause 3 Article 12 and the scope of regulation on certification of advertising content for drugs in Circular No. 09/2015/TT-BYT, which were annulled by the Minister of Health's Circular No. 25/2018/TT-BYT dated September 28, 2018, annulling a number of legal documents in the health sector promulgated or jointly promulgated by the Minister of Health.

2. To annul Clause 3 Article 4 of the Minister of Health's Circular No. 57/2024/TT-BYT dated December 31, 2024, prescribing decentralization in the settlement of administrative procedures in the field of medical examination and treatment under the management of the Ministry of Health.

Article 3. Effect

1. This Circular takes effect from February 15, 2026.

2. The Chief Office of the Ministry, the Director of the Department of Legal Affairs, Directors General and Directors of Departments and Administrations under the Ministry of Health, and relevant agencies, organizations and individuals shall implement this Circular.

Article 4. Transitional provisions

1. Certificates of advertising content granted in accordance with Circular No. 09/2015/TT-BYT, Circular No. 20/2024/TT-BYT and Circular No. 57/2024/TT-BYT before the effective date of this Circular shall continue to be applied until they are until superseded, revoked, or otherwise cease to be valid in accordance with law.  Dossiers currently under processing shall be handled in accordance with the law applicable at the time of receipt of such dossiers.

2. Cases of expiration of validity of certificates of advertising content granted in accordance with Circular No. 09/2015/TT-BYT, Circular No. 20/2024/TT-BYT and Circular No. 57/2024/TT-BYT before the effective date of this Circular shall continue to be determined in accordance with Article 23 of Circular No. 09/2015/TT-BYT./.
