CIRCULAR
Prescribing the collection, disposal and use of plant byproducts[1]
Pursuant to the Government’s Decree No. 15/2017/ND-CP of February 17, 2017, defining functions, tasks, powers and organizational structure of the Ministry of Agriculture and Rural Development;
Pursuant to the November 19, 2018 Law on Crop Production;
At the proposal of the Director of the Department of Crop Production;
The Minister of Agriculture and Rural Development promulgates the Circular prescribing the collection, disposal and use of plant byproducts.
Chapter I
GENERAL PROVISIONS
Article 1.Scope of regulation
This Circular prescribes the collection, disposal and use of plant byproducts in cultivation areas of agricultural crops, ornamental plants and edible mushrooms.
Article 2.Subjects of application
This Circular applies to organizations, households and individuals engaged in activities mentioned in Article 1 of this Circular.
Article 3.Interpretation of terms
In this Circular, the terms below are construed as follows:
1. Plant byproducts means auxiliary products arising in process of tending, harvesting and preliminarily processing crop products in cultivation areas of plants;
2. Disposal of byproducts means application of appropriate technological solutions or technical measures to increase use efficiency of plants and prevent environmental pollution and spread of harmful pests.
Chapter II
PROVISIONS ON COLLECTION, DISPOSAL AND USE OF PLANT BYPRODUCTS
Article 4.Disposal of plant byproducts
1. Plant byproducts shall be collected and classified according to use purposes; not be stored in the same place with chemicals, packages, empty pesticide bottles, fertilizers and other inorganic impurities in process of collection and transport.
2. The collection and transport of plant byproducts must not affect agricultural production in cultivation and transport areas and cause no environmental pollution and spread of harmful pests.
3. The application of advanced techniques in the cultivation and collection of plant byproducts, and of techniques and technologies for compression of byproducts before transport is encouraged.
4. Residues and plant byproducts in areas of harmful pests must comply with the law on plant protection and quarantine.
Article 5.Disposal of plant byproducts
1. Plant byproducts are disposed as follows:
a/ Burying-plowing or milling;
b/ Squeezing under grooves or beds;
c/ Burying in multi-purpose pits or covering tree stumps; covering soil;
d/ Composting for use as traditional organic fertilizers;
dd/ Drying;
e/ Other solutions and measures.
2. To encourage the use of bio-products and the application of new technological and technical advances in the disposal of plant byproducts.
3. The disposal of plant byproducts must cause no environmental pollution and spread of harmful pests.
Article 6.Use of plant byproducts
1. To encourage the use of plant byproducts as raw materials for production of mushrooms, animal feed, fertilizers or for other industries.
2. Plant byproducts to be used as raw materials for production of mushrooms, animal feed, fertilizers, products and goods must meet manufacturers’ requirements and comply with relevant regulations.
Chapter III
ORGANIZATION OF IMPLEMENTATION
Article 7.Responsibilities of the Department of Crop Production
1. To organize the dissemination of and provide guidance on collection, disposal and effective use of plant byproducts.
2. To draft documents guiding collection and disposal of plant byproducts.
3. To assume the prime responsibility for, and coordinate with provincial-level Departments of Agriculture and Rural Development in, updating information about the collection, disposal and use of plant byproducts nationwide.
Article 8.Responsibilities of provincial-level Departments of Agriculture and Rural Development
1. To organize the dissemination and implementation of regulations on collection, disposal and use of plant byproducts in their localities.
2. To coordinate with the Department of Crop Production in drafting documents guiding collection and disposal of plant byproducts; guiding organizations, households and individuals to collect, dispose of and use plant byproducts.
3. To assume the prime responsibility for, and coordinate with district- and commune-level People’s Committees and related units in, inspecting and examining the observance of regulations on collection, disposal and use of plant byproducts in their localities.
4. To provide information about collection, disposal and use of plant byproducts in their localities at the request of the Ministry of Agriculture and Rural Development (the Department of Crop Production).
Article 9.Responsibilities of organizations, households and individuals engaged in the collection, disposal and use of plant byproducts
1. To comply with regulations on collection, disposal and use of plant byproducts, ensuring these activities cause no environmental pollution and spread of harmful pests.
2. To take responsibility for quality of plant byproducts at request of manufacturers and as required by relevant regulations.
Article 10.Effect
1. This Circular takes effect on January 1, 2020.
2. Any problems arising in the course of implementation should be promptly reported to the Ministry of Agriculture and Rural Development for amendment and supplementation.-
