Circular 08/2026/TT-BCT amending Circular 04/2020/TT-BCT on auction of import tariff quotas for used automobiles under CPTPP

CIRCULAR

Amending and supplementing a number of articles of the Minister of Industry and Trade’s Circular No. 04/2020/TT-BCT dated January 22, 2020, prescribing the auction of import tariff quotas for used automobiles under the Comprehensive and Progressive Agreement for Trans-Pacific Partnership

Pursuant to the Law on Promulgation of Legal Documents No. 64/2025/QH15, which was amended and supplemented under Law No. 87/2025/QH15;

Pursuant to the Law on Foreign Trade Management No. 5/2017/QH14;

Pursuant to the Government’s Decree No. 40/2025/ND-CP defining the functions, tasks, powers and organizational structure of the Ministry of Industry and Trade, amended and supplemented under Decree No. 109/2025/ND-CP and Decree No. 193/2025/ND-CP;

At the proposal of the Director General of the Agency of Foreign Trade;

The Minister of Industry and Trade hereby promulgates the Circular amending and supplementing a number of articles of the Minister of Industry and Trade’s Circular No. 04/2020/TT-BCT dated January 22, 2020, prescribing the auction of import tariff quotas for used automobiles under the Comprehensive and Progressive Agreement for Trans-Pacific Partnership.

Article 1. Amending and supplementing Clause 2, Article 5 of the Minister of Industry and Trade’s Circular No. 04/2020/TT-BCT dated January 22, 2020, as follows:

“2. Used automobiles to be imported under tariff quotas in accordance with Article 3 of this Circular must satisfy the rules of origin in the CPTPP Agreement and have supporting documentation certifying origin when import procedures are carried out.”

Article 2. Amending and supplementing Clause 1, Article 6 of the Minister of Industry and Trade’s Circular No. 04/2020/TT-BCT dated January 22, 2020, as follows:

“1. The principles, order and procedures for auction of tariff quotas must comply with the law on property auction.”

Article 3. Amending and supplementing Appendix I to the Minister of Industry and Trade’s Circular No. 04/2020/TT-BCT dated January 22, 2020, as follows:

1. To replace the phrase “Cylinder capacity ≤ 3,000 cm³ (pcs)” with “Engine displacement ≤ 3,000 cm³ (pcs)” in the third column of Appendix I.

2. To replace the phrase “Cylinder capacity ≥ 3,000 cm³ (pcs)” with “Engine displacement > 3,000 cm³ (pcs)” in the fourth column of Appendix I.

Article 4. Effect

1.  This Circular takes effect from February 25, 2026.

2. The Minister of Industry and Trade’s Decision No. 731/QD-BCT dated March 04, 2020, on correction of the Minister of Industry and Trade’s Circular No. 04/2020/TT-BCT dated January 22, 2020, prescribing the auction of import tariff quotas for used automobiles under the Comprehensive and Progressive Agreement for Trans-Pacific Partnership, is hereby annulled./.
