SUMMARY

TO COMBINE NATIONAL DEFENSE AND SECURITY EDUCATION IN THE PRIMARY SCHOOL

On June 19, 2013, the National Assembly issues the Law No. 30/2013/QH13 on National Defense and Security Education.

In particular, beside that national defense and security education is a curricular subject in upper secondary schools, professional secondary schools and intermediate vocational schools, the National Assembly also emphasizes on that national defense and security education in primary and lower secondary schools is incorporated into other subjects in the curricula in combination with extra-curriculum activities suitable to the age of pupils.

Also in accordance with this Law,  managers of non-state enterprises which include enterprises of medium or larger size; enterprises serving national defense and security; enterprises operating in deep-lying, remote, border and island areas shall attend national defense and security knowledge training. Managers of non-public non-business units shall attend national defense and security knowledge training. And when attending national defense and security knowledge training, they are entitled to receive their full salaries and allowances, travel support or one-off payment of return tickets and meal support provided by non-state enterprises or non-public non-business units. The state budget will cover expenses for national defense and security knowledge training and accommodation for those living far from training establishments.

Pursuant to Articles 103 and 106 of the 1992 Constitution of the Socialist Republic of Vietnam, which was amended and supplemented under Resolution No. 51/2001/QH10 of December 25, 2001, of the Xth National Assembly, the 10th session;

Law on National Defense and Security Education

(No. 30/2013/QH13)

Pursuant to the 1992 Constitution of the Socialist Republic of Vietnam, which was amended and supplemented under Resolution No. 51/2001/QH10;

The National Assembly promulgates the Law on National Defense and Security Education.

Chapter I

GENERAL PROVISIONS

Article 1. Scope of regulation

This Law provides principles, policies, basic contents and forms of national defense and security education; tasks and powers of agencies and organizations and rights and responsibilities of citizens regarding national defense and security education.

Article 2. Subjects of application

1. Vietnamese agencies, organizations and citizens.

2. Foreign organizations operating and individuals residing in the Vietnamese territory shall comply with this Law and laws concerning national defense and security education.

Article 3. Interpretation of terms

In this Law, the terms below are construed as follows:

1. National defense and security knowledge includes a system of viewpoints of the Communist Party of Vietnam and policies and laws of the State on national defense and security; the tradition of founding and defending the country and military skills.

2. Military skills means the capability to practice necessary basic contents of military techniques and tactics.

Article 4. Goals of national defense and security education

To educate citizens about national defense and security knowledge to promote patriotism, the tradition of founding and defending the country, national pride and superiority, and to raise the sense of, responsibility for and self-awareness about the performance of national defense and security tasks to protect the socialist fatherland of Vietnam.

Article 5. Principles of national defense and security education

1. To comply with the Constitution and law of the Socialist Republic of Vietnam, to be placed under the leadership of the Communist Party of Vietnam and the uniform management of the State.

2. National defense and security education is the responsibility of the political system and all people, in which the State plays the key role.

3. To combine national defense and security education and political and ideological education and law dissemination and education in association with building up comprehensively strong grassroots bases.

4. To conduct comprehensive education with focal and key points in appropriate forms; to combine theory with reality and theory with practice.

5. Programs and contents on national defense and security education must suit each target group and promptly respond to practical situations.

6. To assure state secrets, planning, inheritance, development, scientificity, modernity, understandability, practicality and effectiveness.

Article 6. State policies on national defense and security education

1. The State assures resources for national defense and security education activities and adopts priority policies for border, island, mountainous, deep-lying and remote areas.

2. The State encourages and creates conditions for agencies, organizations and individuals to contribute their intellect, energy, money and property to national defense and security education.

3. Agencies, organizations and individuals with achievements in national defense and security education are commended and rewarded in accordance with law.

Article 7. Citizens’ right to and responsibility for national defense and security education

Citizens have the right and responsibility to learn and study to master national defense and security knowledge. Persons participating in national defense and security education are entitled to regimes and policies in accordance with law.

Article 8. National defense and security education centers

1. A national defense and security education center is an establishment educating and training in national defense and security knowledge and military skills for target groups prescribed in this Law.

2. National defense and security education centers include:

a/ National defense and security education centers of army schools;

b/ National defense and security education centers of tertiary education institutions.

3. Planning of national defense and security education centers must conform with planning of army schools and planning of tertiary education institutions and meet requirements on national defense and security education for target groups.

4. The Prime Minister shall approve the planning of, and prescribe conditions for establishing, national defense and security education centers.

Article 9. Prohibited acts

1. Taking advantage of national defense and security education activities to distort line and viewpoints of the Party and policies and laws of the State; disclose state secrets; propagate hostile policies, sow division among the great national unity bloc; or infringe upon interests of the State or rights and legitimate interests of organizations or individuals.

2. Obstructing the implementation of national defense and security education.

3. Other acts as prescribed by law.

Chapter II

NATIONAL DEFENSE AND SECURITY EDUCATION IN SCHOOLS

Article 10. Primary and lower secondary schools

1. National defense and security education in primary and lower secondary schools is incorporated into other subjects in the curricula in combination with extra-curriculum activities suitable to the age of pupils.

2. To assure bases for pupils to preliminarily understand the tradition of founding and defending the country and people’s armed forces; and have a sense of discipline and unity and love for the fatherland and compatriots.

Article 11. Upper secondary schools, professional secondary schools and intermediate vocational schools

1. National defense and security education is a curricular subject in upper secondary schools, professional secondary schools and intermediate vocational schools.

2. To assure that pupils have preliminary understanding about all-people national defense and people’s security; the national tradition to fight foreign aggressors, people’s armed forces and military art of Vietnam; have basic and necessary knowledge about civil defense and military skills; and be ready to render military services to defend the fatherland.

3. To organize teaching and learning according to the program schedule. Based on specific conditions, to coordinate with related agencies, organizations and units in organizing in the school year extra-curricular activities with appropriate contents and forms for pupils.

Article 12. Vocational colleges and tertiary education institutions

1. National defense and security education is a curricular subject in vocational colleges and tertiary education institutions.

2. To assure that learners have basic knowledge about the Party’s viewpoints and the State’s policies and law on national defense and security; and building of the all-people national defense and people’s security, the posture of all-people national defense associated with the posture of people’s security and people’s armed forces; be supplemented with knowledge about civil defense and military skills; and be ready to render military services to defend the fatherland.

3. To organize teaching and learning in national defense and security education centers, vocational colleges or tertiary education institutions. Based on specific conditions, to coordinate with related agencies, organizations and units in organizing study and extra-curricular activities with appropriate contents and forms for learners during the training program.

Article 13. Schools of state agencies, political organizations and socio-political organizations

1. National defense and security education is a curricular subject for learners of schools of state agencies, political organizations and socio-political organizations.

2. To assure that learners master the Party’s viewpoints and the State’s policies and law on national defense and security; military art of Vietnam; national defense and security situation and tasks; defense zones; civil defense; combination of economy and national defense and security; and combination of national defense and security and external affairs.

3. Based on the Ministry of National Defense’s framework program and regulations of competent agencies, schools of political organizations shall elaborate and implement national defense and security education programs and contents within the system of schools of political organizations.

4. Based on the Ministry of National Defense’s framework program, schools of state agencies and socio-political organizations shall elaborate and implement national defense and security education programs and contents for their learners.

Chapter III

NATIONAL DEFENSE AND SECURITY KNOWLEDGE TRAINING

Article 14. For persons of state agencies and organizations, political organizations and socio-political organizations

1. National defense and security knowledge training for persons of state agencies and organizations, political organizations and socio-political organizations is conducted uniformly nationwide.

2. To receive national defense and security knowledge training are:

a/ Cadres and civil servants, managerial public employees;

b/ Elective deputies;

c/ Managerial staff of state enterprises;

d/ Part-time officers in communes, wards and townships (below referred to as commune level); heads of hamlets, villages and street quarters (below referred to as villages); heads of mass organizations in villages;

dd/ Members of the Communist Party of Vietnam.

3. Programs, contents, forms and time for national defense and security knowledge training for the persons specified in Clause 2 of this Article conform with criteria for titles and leading and managerial positions and task requirements.

Article 15. For managers of non-state enterprises and non-public non-business units

1. Managers of non-state enterprises shall attend national defense and security knowledge training. These non-state enterprises include:

a/ Enterprises of medium or larger size;

b/ Enterprises serving national defense and security;

c/ Enterprises operating in deep-lying, remote, border and island areas.

2. Managers of non-public non-business units shall attend national defense and security knowledge training.

3. Contents of national defense and security knowledge training for the persons specified in Clauses 1 and 2 of this Article focus on the State’s policies and law on national defense and security.

4. This Article does not apply to foreigners.

Article 16. For typical persons and prestigious persons in communities

1. Typical persons and prestigious persons in communities to receive national defense and security knowledge training are religious dignitaries and assistants, patriarchs of villages and clans, and cultural, social, science and art workers.

2. Provincial-level People’s Committees shall coordinate with the Vietnam Fatherland Front of the same level and related agencies and organizations in organizing national defense and security knowledge training for typical persons and prestigious persons in communities.

3. Based on the Ministry of National Defense’s framework program, the guidance of competent agencies and organizations and local national defense and security tasks, provincial-level People’s Committees shall elaborate and implement programs and contents of national defense and security knowledge training for typical persons and prestigious persons in communities.

Article 17. Competence to call for attendance and prescribe national defense and security knowledge training establishments

The Government shall provide the competence to call for attendance and national defense and security knowledge training establishments for the persons specified in Articles 14, 15 and 16 of this Law.

Article 18. Regimes and benefits for persons attending national defense and security knowledge training

1. When attending national defense and security knowledge training, the persons specified in Clause 2, Article 14 of this Law are entitled to receive their full salaries and allowances. Those living far from training establishments are entitled to receive state budget support of accommodation and travel or one-off payment of return tickets and meal.

2. When attending national defense and security knowledge training, the persons specified in Clauses 1 and 2, Article 15 of this Law are entitled to receive their full salaries and allowances, travel support or one-off payment of return tickets and meal support provided by non-state enterprises or non-public non-business units. The state budget will cover expenses for national defense and security knowledge training and accommodation for those living far from training establishments.

3. When attending national defense and security knowledge training, the persons specified at Point c, Clause 1, Article 15 and Article 16 of this Law living far from training establishments are entitled to receive state budget support of accommodation, meal and travel or one-off payment of return tickets.

4. Persons completing national defense and security knowledge training programs are granted certificates.

Chapter IV

POPULARIZATION OF NATIONAL DEFENSE AND SECURITY KNOWLEDGE FOR ALL PEOPLE

Article 19. Contents of national defense and security knowledge to be popularized

Necessary knowledge about independence, sovereignty, unity and territorial integrity of the fatherland; sabotage plots and tricks of hostile forces; national defense and security tasks in each period; civil defense; citizens’ responsibilities for the cause of building and defending the socialist fatherland of Vietnam.

Article 20. Forms of popularization of national defense and security knowledge

1. Through speakers, communicators and the mass media.

2. Through community meetings, activities of the Vietnam Fatherland Front, mass organizations, cultural, art, physical training and sports activities, activities of grassroots cultural institutions and traditional cultural activities.

3. Incorporation into call-up, anniversary and traditional-day events.

4. Through activities of agencies and organizations managing tangible and intangible cultural heritages, natural reserves, memorial sites, monuments, war martyr cemeteries, tradition houses, museums, cultural and sports palaces for youths and adolescents, and national defense and security sports clubs.

5. Other forms suitable to the practical situation of each locality and community.

Article 21. Popularization of national defense and security knowledge for people in border, island, mountainous, deep-lying and remote areas

1. Popularization of national defense and security knowledge for people in border, island, mountainous, deep-lying and remote areas complies with Articles 19 and 20 of this Law and must meet the following requirements:

a/ Being associated with the tasks to protect sovereignty and territorial integrity, maintain security, order and social safety, build borders of peace and friendship, and fight and prevent crimes in border and island areas;

b/ Based on specific conditions, popularizing national defense and security knowledge to persons who have an active role and positive influence in ethnic minority communities, owners of ships and boats; household heads and laborers in border and island areas.

2. The State encourages organizations and individuals to voluntarily popularize national defense and security knowledge in accordance with law to people in border, island, mountainous, deep-lying and remote areas; and provides national defense and security education materials for ethnic minority people.

3. People’s Committees at all levels shall direct military agencies of the same level in assuming the prime responsibility for, and coordinating with the Border Guard, Navy, Marine Police and local police in, popularizing national defense and security knowledge to people in border, island, mountainous, deep-lying and remote areas.

Article 22. Popularization of national defense and security knowledge at enterprises and non-business units

1. National defense and security knowledge is popularized to managers of non-state enterprises who are not required to attend national defense and security knowledge training and employees of enterprises and non-business units under Articles 19 and 20 of this Law.

2. Managers of enterprises and non-business units shall coordinate with competent state agencies and trade unions in popularizing national defense and security knowledge to their employees.

3. Provincial-level People’s Committees shall direct military and police agencies and law dissemination and education councils of the same level in popularizing national defense and security knowledge to the persons specified in Clause 1 of this Article.

Chapter V

NATIONAL DEFENSE AND SECURITY TEACHERS, LECTURERS, SPEAKERS AND COMMUNICATORS

Article 23. Teachers and lecturers

1. National defense and security teachers and lecturers include full-time teachers and lecturers, guest lecturers and seconded army and police officers.

2. National defense and security teachers and lecturers must hold a bachelor or higher degree in national defense and security education. Those holding a bachelor or higher degree in another discipline must possess a teacher training certificate and a certificate of training of national defense and security teacher or lecturer.

3. The Government shall specify the standard qualifications for national defense and security teachers and lecturers suitable to each target group of learners; and the time and schedule for obtaining such qualifications.

Article 24. Training, refresher courses and recruitment of teachers and lecturers

1. Training of national defense and security teachers and lecturers is provided as follows:

a/ Four-year full-time training in national defense and security education. Eligible for enrollment are holders of higher secondary education diplomas;

b/ Two-year full-time training for second diploma. Eligible for enrollment are holders of bachelor degrees in other disciplines;

c/ Eighteen-month full-time training for second diploma. Eligible for enrollment are teachers and lecturers of upper secondary schools, vocational education institutions and tertiary education institutions who have obtained a certificate of national defense and security education training for at least 6 months.

2. National defense and security teachers and lecturers are provided with regular retraining and refresher courses at schools of people’s armed forces or national defense and security education centers.

3. The Government shall provide conditions on tertiary education institutions and schools of people’s armed forces for training of national defense and security teachers and lecturers. The Ministry of Education and Training shall decide on tertiary education institutions and schools of people’s armed forces eligible for training of national defense and security teachers and lecturers.

The Ministry of Education and Training, ministries, related ministerial-level agencies and provincial-level People’s Committees shall direct their attached educational institutions in planning the enrollment, training and recruitment of national defense and security teachers and lecturers at these educational institutions from upper secondary to tertiary level.

Article 25. Responsibilities and benefits of teachers and lecturers

1. To teach according to national defense and security education contents and programs prescribed for each target group, assuring quality and effectiveness.

2. National defense and security teachers and lecturers specified in Clause 1, Article 23 of this Law are entitled to the regime on uniforms, except seconded army and police officers; and other regimes as prescribed by law.

Article 26. Speakers

National defense and security speakers are persons invited by competent agencies or organizations to participate in national defense and security knowledge training, including:

1. Leaders of ministries and central departments and sectors;

2. Leaders of general departments, military zones, armed services, service branches and equivalent of the Ministry of National Defense; general departments, agencies, departments and equivalent of the Ministry of Public Security and related ministries, departments and sectors;

3. Provincial-level leaders; leaders of urban and rural districts, towns and provincial cities; commune-level leaders;

4. Leaders of provincial-level departments, sectors and branches; divisions of provincial-level departments, sectors and branches and sections and divisions of urban and rural districts, towns and provincial cities;

5. Specialists, scientists.

Article 27. Communicators

Based on criteria prescribed by the Minister of National Defense, chairpersons of commune-level People’s Committees shall consider and decide on recognition of national defense and security communicators.

Article 28. Responsibilities and benefits of speakers and communicators

1. To disseminate contents of national defense and security education prescribed for each target group.

2. To participate in all training activities organized by competent authorities to improve their knowledge and working skills.

3. To be provided with necessary information and materials related to their assigned tasks and powers.

4. To enjoy regimes and policies as prescribed by law.

Chapter VI

FUNDS FOR NATIONAL DEFENSE AND SECURITY EDUCATION

Article 29. Funding sources

1. The State shall assure funds for national defense and security education which will be allocated annually in accordance with the law on state budget.

2. Enterprises and non-business units shall assure funds for national defense and security education in accordance with this Law. These funds may be accounted into deductible expenses when determining taxable incomes as prescribed by law.

3. Other lawful revenues.

4. The Government shall detail this Article.

Article 30. Spending contents

1. Regular expenditures.

2. Development investment expenditures.

3. Other expenditures as prescribed by law.

4. The Government shall specify spending items for national defense and security education.

Article 31. Cost estimation, implementation and finalization

1. Ministerial-level agencies, government-attached agencies, other central agencies and People’s Committees at all levels shall annually estimate, implement and finalize budget funds for national defense and security education in accordance with law.

2. Enterprises and non-business units shall annually plan funds for national defense and security education.

Chapter VII

NATIONAL DEFENSE AND SECURITY EDUCATION-RELATED TASKS AND POWERS OF AGENCIES AND ORGANIZATIONS

Article 32. State management of national defense and security education

1. To promulgate and organize the implementation of legal documents on national defense and security education.

2. To disseminate and popularize legal documents on national defense and security education.

3. To provide programs and contents; to compile, publish, print and distribute manuals, textbooks and materials; to provide criteria for teachers, lecturers and communicators; and standards on physical foundations and teaching aids for national defense and security education; and to grant certificates of completion of national defense and security knowledge training.

4. To manage resources for development of national defense and security education.

5. To organize and direct the training and management of national defense and security teachers, lecturers and communicators.

6. To study and apply science and technology to national defense and security education.

7. To carry out international cooperation in national defense and security education.

8. To inspect, examine and settle complaints and denunciations; to conduct preliminary and final reviews and commendation and handle violations in the observance of the law on national defense and security education.

Article 33. State management agencies of national defense and security education

1. The Government shall perform the uniform state management of national defense and security education nationwide.

2. The Ministry of National Defense shall assume the prime responsibility for, and coordinate with the Ministry of Public Security and the Ministry of Education and Training in, assisting the Government in performing the state management of national defense and security education.

3. Ministries and ministerial-level agencies shall coordinate with the Ministry of National Defense in performing the state management of national defense and security education according to their competence.

4. People’s Committees at all levels shall perform the state management of national defense and security education in their localities within the scope of their tasks and powers.

Article 34. Tasks and powers of the Ministry of National Defense

1. To promulgate according to its competence or propose competent authorities to promulgate legal documents on national defense and security education.

2. To assume the prime responsibility for, and coordinate with the Ministry of Education and Training, ministries and ministerial-level agencies in, planning a system of national defense and security education centers nationwide and propose it to the Prime Minister for consideration and decision; to decide on the establishment of national defense and security education centers of army schools.

3. To assume the prime responsibility for, and coordinate with the Ministry of Public Security, the Ministry of Education and Training, ministries, ministerial-level agencies and related central agencies and organizations in:

a/ Providing the framework program on national defense and security education for learners at schools of state agencies, political organizations and socio-political organizations; the framework program on national defense and security knowledge training for typical persons and prestigious persons in communities; and programs and contents on national defense and security knowledge training for persons of state agencies and organizations, political organizations, socio-political organizations, non-state enterprises and non-state non-business units;

b/ Providing criteria for national defense and security communicators;

c/ Compiling manuals and materials for popularization of national defense and security knowledge suitable to the situation and tasks of national construction and defense in each period.

4. To assume the prime responsibility for, and coordinate with ministries, ministerial-level agencies, government-attached agencies and related central agencies and organizations in, training national defense and security knowledge for target groups in accordance with law; to determine national defense and security education-related tasks and powers of their attached agencies and units and military commands of ministries and sectors.

5. To coordinate with the Ministry of Education and Training and related ministries and ministerial-level agencies in training teachers, lecturers, communicators, managers and part-time officers of national defense and security education; seconding staff to national defense and security education centers, tertiary education institutions and state management agencies of education.

6. To assure weapons, technical equipment, specialized military teaching aids for national defense and security education for educational institutions nationwide; to assure facilities for national defense and security education for agencies, units and army schools assigned to conduct national defense and security education.

7. To guide, inspect, examine, conduct preliminary and final reviews and commendation; settle complaints and denunciations and handle violations of the law on national defense and security education according to its competence.

8. To carry out international cooperation in national defense and security education.

Article 35. Tasks and powers of the Ministry of Public Security

1. To promulgate according to its competence or propose competent authorities to promulgate legal documents on national defense and security education.

2. To coordinate with the Ministry of National Defense, the Ministry of Education and Training, ministries, ministerial-level agencies, government-attached agencies and related central agencies and organizations in conducting national defense and security education in accordance with this Law; to compile manuals and materials for national defense and security education and training and popularization of national defense and security knowledge.

3. To second its staff to national defense and security education centers, tertiary education institutions and state management agencies of education.

4. To assure facilities for agencies, units and public security schools assigned to conduct national defense and security education.

Article 36. Tasks and powers of the Ministry of Education and Training

1. To promulgate according to its competence or propose competent authorities to promulgate legal documents on national defense and security education.

2. To assume the prime responsibility for, and coordinate with the Ministry of National Defense and the Ministry of Public Security in, guiding national defense and security education in primary and lower secondary schools; providing programs and contents of national defense and security education for students from the upper secondary to tertiary education level, except vocational training institutions, and organizing the implementation of these programs.

3. To assume the prime responsibility for, and coordinate with the Ministry of National Defense, the Ministry of Public Security, the Ho Chi Minh Communist Youth Union, ministries, ministerial-level agencies, government-attached agencies and related central agencies and organizations in, conducting national defense and security education in educational institutions of the national education system.

4. To assume the prime responsibility for, and coordinate with the Ministry of National Defense, the Ministry of Home Affairs and the Ministry of Labor, War Invalids and Social Affairs in, providing numbers of national defense and security teachers and lecturers at upper secondary schools, vocational education institutions and tertiary education institutions; and schools of state agencies and socio-political organizations and national defense and security education centers.

5. To assume the prime responsibility for, and coordinate with the Ministry of Home Affairs, the Ministry of Finance and related ministries and ministerial-level agencies in, providing regimes and policies for administrators, teachers and lecturers of national defense and security.

6. To assure facilities for national defense and security education for its attached agencies, units and educational institutions.

7. To decide on the establishment of national defense and security education centers under tertiary education institutions.

Article 37. Tasks and powers of the Ministry of Home Affairs

1. To coordinate with the Ministry of National Defense, the Central Vietnam Fatherland Front Committee and related agencies and organizations in guiding national defense and security knowledge training for typical persons and prestigious persons in communities.

2. To assure facilities for national defense and security education for its attached agencies, units and educational institutions.

Article 38. Tasks and powers of the Ministry of Labor, War Invalids and Social Affairs

1. To assume the prime responsibility for, and coordinate with the Ministry of National Defense, the Ministry of Public Security and the Ministry of Education and Training in, providing the program and contents of national defense and security education for learners of vocational training institutions and organizing the implementation of this program.

2. To assure facilities for national defense and security education for its attached agencies, units and educational institutions.

Article 39. Tasks and powers of the Ministry of Information and Communications

To assume the prime responsibility for, and coordinate with the Ministry of National Defense, the Ministry of Public Security, ministries, ministerial-level agencies, government-attached agencies and related central agencies and organizations in, guiding mass media agencies in formulating programs and contents to popularize national defense and security knowledge to the entire people.

Article 40. Tasks and powers of ministries, ministerial-level agencies, government-attached agencies and central agencies and organizations

1. Within the scope of their assigned tasks and powers, to coordinate with the Ministry of National Defense, the Ministry of Public Security, the Ministry of Education and Training, ministries, ministerial-level agencies, government-attached agencies and related central agencies and organizations in managing national defense and security education; to promulgate according to their competence or propose competent authorities to promulgate documents on national defense and security education in accordance with law.

2. To direct and organize national defense and security education associated with their task performance.

3. To assure facilities for national defense and security education for their attached agencies, units and educational institutions.

4. To perform other tasks and exercise other powers related to national defense and security education in accordance with law.

Article 41. Tasks and powers of People’s Councils at all levels

1. To decide on the budget for national defense and security education in their localities in accordance with law.

2. To supervise People’s Committees of the same level and state agencies in their localities in implementing the law on national defense and security education.

Article 42. Tasks and powers of People’s Committees at all levels

1. To promulgate legal documents, programs, plans and schemes on national defense and security education according to their competence.

2. To direct, guide and organize national defense and security education in their localities.

3. To train and manage national defense and security communicators, teachers and lecturers in their localities in accordance with law.

4. To coordinate with Vietnam Fatherland Front Committees of the same level and their member organizations in performing their tasks and exercising their powers related to national defense and security education; to create conditions for organizations and individuals to effectively conduct national defense and security education in their localities.

5. To inspect, examine and settle complaints and denunciations; to conduct preliminary and final reviews and commendation of the observance of the law on national defense and security education.

Article 43. Responsibilities of the Vietnam Fatherland Front and its member organizations

1. To popularize national defense and security knowledge to their members.

2. To coordinate with related agencies and organizations in disseminating and mobilizing people of all strata to regularly learn to improve their national defense and security knowledge; and training national defense and security knowledge for typical persons and prestigious persons in communities in accordance with law.

3. To supervise the implementation of policies and law on national defense and security education.

4. To mobilize organizations and individuals to participate in and support national defense and security education activities.

Article 44. National defense and security education councils at all levels

1. National defense and security education councils are established at central, military zone, provincial, district and commune levels.

2. National defense and security education councils shall work on a part-time basis, function to coordinate various sectors in advising the Party and local administrations at all levels on national defense and security education work.

3. The standing body of the central national defense and security education council is the Ministry of National Defense. Standing bodies of national defense and security education councils of military-zone level are military zone agencies, of provincial and district levels are military agencies of the same level, and of commune level are commune-level military commands.

4. The Prime Minister shall decide on the establishment of national defense and security education councils of central and military-zone levels; and define the functions, tasks and powers of national defense and security education councils at all levels. People’s Committees at all levels shall decide on the establishment of national defense and security education councils of the same level.

Article 45. Responsibilities of heads of agencies and organizations

1. To direct and organize the implementation of, and guide and urge their agencies and organizations in implementing, the law on national defense and security education.

2. To follow the direction and guidance on national defense and security education by People’s Committees of localities in which their agencies and organizations are headquartered.

Chapter VIII

IMPLEMENTATION PROVISIONS

Article 46. Effect

This Law takes effect on January 1, 2014.

Article 47. Implementation detailing and guidance

The Government and competent agencies shall detail and guide the Law’s articles and clauses as assigned to them.

This Law was passed on June 19, 2013, by the XIIIth National Assembly of the Socialist Republic of Vietnam at its 5th session.-
