Pursuant to the Decree No. 106/2012/ND-CP dated December 20, 2012 of the Government defining the functions, tasks, powers and organizational structure of the Ministry of Labor, War Invalids and Social Affairs.

Pursuant to the Decision No. 31/2009/QD-TTg dated February 24, 2009 of the Prime MinisterPrime Minister on approving the project of propaganda, dissemination and education of labor laws for workers and employers in the types of enterprisein period 2009 - 2012.

Pursuant to the Decision No. 409/QD-TTg dated April 09, 2012 of the Prime Minister promulgating the action program to implement the Conclusions No. 04-KL/TW dated April 19, 2019 of the Secretariat of the Communist Party of Vietnam Central Committee (XI).

At the proposal of the Director of Department of Legal Affairs,

DECIDES

Article 1.To promulgate together with this Decision the implementation plan of the projectof propaganda, dissemination and education of labor laws for workers and employers in the types of enterprisein period 2013 – 2016.

Article 2.This Decision takes effect on its singing date.

Article 3.The Chief of Office, the Director of Planning and Finance Department, the Department of Legal Affairs, the Director of Labor, War Invalids and Social Affairs Department in centrally run cities and provinces.

IMPLEMENTATION PLAN

THE PROJECTOF PROPAGANDA, DISSEMINATION AND EDUCATION OF LABOR LAWS FOR WORKERS AND EMPLOYERS IN THE TYPES OF ENTERPRISEIN PERIOD 2013 – 2016

(Promulgating together with the Decision No. 579/QD/LDTBXH dated April 10, 2013 of the Minister of Labor, War Invalids and Social Affairs)

A. ACTION PLAN

I. PURPOSES AND REQUIREMENTS

1. Purposes

1.1. Continue to implement the objectives of the project approved by the Prime Minister in 2009 synchronously and effectively; Strive to  achieve the general objectives by 2016, creating the dramatic changes on awareness in complying the law in general and the labor law specifically forworkers and employers, building the labor relationship harmoniously in enterprises and contributing to promote the production and stabilize the society, building and completing the socialist state governed by law and of the people, by the people and for the people.

1.2. Based on the assigned tasks, ministries, sectors and localities realize the specific tasks in accordance with the conditions of each sector, locality and strive to achieve the specific targets approved by the Prime Minister under the Decision No. 31/2009/QD-TTg dated February 24, 2009 (the Project 31) by the end of 2016.

2. Requirements

2.1. Ministries and localities must continue to grasp thoroughly the viewpoints of the Party and the State law onpropaganda, dissemination and education of laws:dissemination and education of lawsis the responsibility of the whole political system, of which, the State keeps the key role. The State ensures the necessary resources for thedissemination and education of laws; Implement the socialization ofdissemination and education of laws.

2.2. Ministries, sectors take the main responsible for the sub-project and localities must seriously assess and point out the existing weaknesses in the implementation of the project phrase 1 in order to set up activities that are coherent with the contents and tasks of the project, actual requirements of localities, establishments and the demand of each subject. Ensure the rate of progress, exploit the current human resources; propose the general measurements to overcome the existing weaknesses in recent times; Implementing the key activities that are not overlapped with other activities , projects and programs that are or being implemented at ministries, sectors and localities.

II. ACTIVITIES TO IMPLEMENT THE PROJECT PERIOD 2013 – 2016

1. Building and completing the policies

The policy of encouraging the enterprises to implement thepropaganda, dissemination and education of labor lawsand other relevant laws related to the operation of enterprises and rights, obligations of people and workers at enterprises.

The policy of encouraging the enterprises to put thepropaganda, dissemination and education of labor lawsand other relevant laws related to the operation of enterprises and rights, obligations of people into one of the contents in collective labor agreement and into one of enterprise assessment criteria.

2. Compiling the documents

The Ministry of Labor, War Invalids and Social Affairs take the responsibility and cooperate with the subproject to compile the documents to ensure the unity. The responsible agency of each subproject will base on compiled documents to compile the detailpropagandadocuments for each subject that the subproject takes responsibility.

- Subproject 1: Compile the document to organize thepropaganda,dissemination and education of labor lawsand relevant laws related to the operation of enterprises and rights, obligations of the people and workers;

- Subproject 3: Compile and provide documents on labor laws, trade union laws, social insurance laws, health Insurance law and relevant laws related to rights, obligations of the people and workers at private enterprises and foreign investment enterprises;

- Subproject 4: Compile thepropagandaanddisseminationdocuments related to the operation of enterprises for employers in private enterprises and foreign investment enterprises;

- Subproject 5: Compile thepropagandaanddisseminationdocuments of labor laws for workers, employers in the cooperative.  

3. Improving the capacity of the key staff performing thepropagandaanddisseminationof labor laws and relevant laws related to the operation of enterprises and right, obligations of the people.

- Subproject 1: Annually cooperate with the Ministry of Justice, Vietnam General Confederation of Labor, Vietnam Cooperative Alliance, Vietnam Chamber of Commerce and Industry in order to:

+ Train; improve the skills and professional skills for the provincial reporter staff of the Department of Labor, War Invalids and Social Affairs, Labor Unions, Cooperative Alliance, branch of Vietnam Chamber of Commerce and Industry;

+ Train; improve the skills and professional skills for the reporter staff of State enterprises;

+ Train; improve the skills and professional skills for the staff performing thepropagandaanddisseminationof laws at enterprises taking workers working abroad.

- Subproject 3: Organize the training conference to improve the skills for the provincial trade union officers and trade union officer in big enterprises having many workers.

- Subproject 4: Organize the training conference for employers at private enterprises and foreign investment enterprises.

- Subproject 5: Train the reporter staff and collaborator performing thepropagandaanddisseminationof labor laws and other laws related to the operation of the cooperative and rights, obligations of the people in the cooperative.

4. Communication activities andpropagandaanddisseminationactivities of labor laws and other laws related to the operation of enterprises and rights, obligations of people for workers and employers at enterprises.

a) Organize thepropagandaanddisseminationactivities in mass media: TV, radio, newspaper, electronic newspaper.

b) Provide the legal documents and documents guiding the implementation through newspaper, documents, internet and combine with the organization of discussion by subject and give the answer to the inquiries.

c) Promote the examination of complying with labor law and other laws related to the operation of enterprises and rights, obligations of the people and workers quarterly; reward and give the discipline appropriately;

d) Put the contents ofpropagandaanddisseminationof labor laws and other laws related to rights, obligations of the people into one of the criteria in the annual task plan of the enterprise. Building the “culture of respecting for the law” in State enterprises to set an example for the enterprise community.

dd) Promote the traditional forms being applied effectively; paying attention to the forms such as: folding sheet, pocket law inquiry book,  “legal book”, 15 minute legal radio at the lunch time….

e) Promote the introduction,propagandaanddisseminationof regulations on labor laws and relevant laws related to rights, obligations of the people in the form word of mouth; through labor dispute settler, legal reporter, trade union officer, human resource officer of industrial zones. Propagandaon the loudspeaker system, news, poster, or through the life activities such as Party, trade union meeting…

g) Organize for workers at State enterprises to take part in the competition on learning the labor law and other laws related to rights and obligations of the people on TV, newspaper, on the radio and at the localities.

5. Key activities

To get the foundation to judge and get experience from a number of effective and appropriate models and methods to multiply in the next years, the managing board of the project selects some locality to implement and in each region, there will be over two localities.

6. Examining the implementation of the project

The Ministry of Labor, War Invalids and Social Affairs and the standing agency of the project 31 annually cooperate with the agency holding the responsibility of each subproject to build and promulgate the examination plan the implementation of the project phrase II, assign the agency holding the responsibility of each subproject to take turns to work as the chief controller to seize the implementation of the project at the locality.

Based on the general plan, the agency holding the responsibility of each subproject actively organize the direct examination team or combine with other programs of the agency with a view to making judgment on the results of implementing the project at the central and locality.

Time for conducting the examination is at the beginning of Quarter IV.

7. Preliminary Conference and Summary conference

- Annually, the agency holding the responsibility of each subproject shall organize the Preliminary Conference, and it can be combined with the summary conference of the sector.

- The Ministry of Labor, War Invalids and Social Affairs and standing agency of the project organize the meeting of the project managing board at the end of each year to reach a mutual agreement in guiding and promptly adjust and overcome the weaknesses. Coordinate with the agency holding the responsibility of each subproject and locality to build the assessment criteria of the efficiency of the project.

- In 2016, to summarize the period 2013-2016.

III. EXPENDITURE TO IMPLEMENT THE SCHEME PERIOD 2013 – 2016

1. At the central

The expenditure to implement the project as approved under the project 31 by the Prime Minister and the Dispatch No. 6455/BTP-PBGDPL dated August 14, 2012 of the Ministry of Justice on implementing the Decision No. 409/QD-TTg dated April 09, 2012 of the Prime Minister.

The agencies holding the responsibility of each subproject actively implement according to the Decision No. 409/QD-TTg dated April 09, 2012 of the Prime Minister (Section I, Part IV organization implementation): Ministries, sectors taking the responsibility of the project in this action program base on the contents, rate of progress of each project and the current expenditure regime to build the expenditure estimate, summarize the annual budget estimates of ministries, sectors and send to the Ministry of Finance for general summary”.

2. At the local

The expenditure to implement the project at the local is allocated by the local budget.  Annually, the People’s Committee of provinces and central run cities base on the operation contents of the project to build the expenditure estimate and submit to the People’s Councils at the same level for approval.

B. IMPLEMENTATION APPOINTMENT

I. At the central

1. The managing board of the project directs and guides ministries, sectors, localities to implement the project promptly and effectively; monitor the implementation of the plan nationwide.

Organize the meetings of the managing board, the project secretary team to inform about the results of implementing the project; Making judgment on the implementation of the project.

2. Agencies, organizations holding the subproject base on this plan and the contents of the project 31, annually build the detail plan of sector (determine specifically the rate of progress, location…); organize the examination and making judgment on the efficiency of implementing the project and quarterly report the result to the managing board before 25th of the final month in the quarter and annually before December 25th.

Actively build the finance plan and finalize the assigned expenditure with the Ministry of Finance and at the same time, send the report to the Ministry of Labor, War Invalids and Social Affairs to summarize and report to the Prime Minister.

II. At the local

1. The People’s Committee in provinces and central run cities build the plan to implement the project 31 period 2013 – 2016, ensure the implementation expenditure of project 31 as stipulated under the State Budget Law;

Organize the examination and summary of implementing the project 31 and report to the managing board of the project 31 before December 15th annually.

2. The Department of Labor, War Invalids and Social Affairs is the agency holding the responsibility of the project; building and submitting the implementation plan of the project 31 in the period 2013-2016 to the People’s Committees in provinces and central run cities.

Each 6 months (before June 15), annually (before November 15 report the implementation result to the Ministry of Labor, War Invalids and Social Affairs (through the Department of Legal Affairs).

3. Departments, sectors that are assigned to hold the responsibility of implementing the subproject are responsible for coordinating with the Department of Labor, War Invalids and Social Affairs to build the implementation plan.

At the same time, strictly comply with the responsibility of informing, reporting and making recommendations for the project standing board to seize, direct and guide timely.

Coordinate with relevant agencies to organize the implementation of the project 31.
