NOTICE

On Deputy Prime Minister Tran Luu Quang’s conclusion at the meeting on reforming administrative procedures and improving the effectiveness of policy consultancy for the Government and the Prime Minister

On June 19, 2023, Deputy Prime Minister Tran Luu Quang chaired a meeting on reforming administrative procedures and improving the effectiveness of policy advice for the Government and the Prime Minister. Participants to the meeting include Minister, Chairman of the Office of the Government Tran Van Son, Minister of Home Affairs Pham Thi Thanh Tra and leaders of the Ministry of Justice, Ministry Planning and Investment.

After hearing the Report of the Office of the Government, the Ministry of Home Affairs, and the comments of the agencies attending the meeting, Deputy Prime Minister Tran Luu Quang concluded as follows:

1. Implementation situation

Administrative procedure reform is an important task that must be implemented strongly, regularly and synchronously to satisfy the people and enterprises as a measure of effectiveness. The Government and the Prime Minister have promulgated important programs, plans and schemes to focus on implementation in the period of 2021-2025 such as: (1) Program to reduce and simplify regulations related to business activities in the period of 2020-2025; (2) Plan to review and simplify internal administrative procedures in the state administrative system for the period of 2022-2025; (3) Plan on decentralization of settlement of administrative procedures; (4) Scheme to renew the implementation of the single-window mechanism, inter-agency single-window mechanism in the settlement of administrative procedures; (5) Scheme on Development of application of population data, electronic identification and electronic authentication for national digital transformation in the period of 2022-2025, with a vision to 2030 (Scheme 06).

From 2021 to now, under the drastic direction of the Government and the Prime Minister, ministries, agencies and localities have actively implemented and achieved a number of outstanding results such as: 2,229 regulations related to business activities have been reduced and simplified; putting into operation the Business Regulation Consultation and Information Portal; implementing decentralization and settlement of 81/699 administrative procedures, of which many administrative procedures are decentralized from the central to local levels; actively statisticizing and announcing the internal administrative procedures among state administrative agencies and focus on reviewing and simplifying 59 priority groups of internal administrative procedures in 2023. The renewal of the implementation of the single-window mechanism, inter-agency single-window mechanism in the settlement of administrative procedures and the provision of online public services to serve people and businesses has been focused on implementation, 31.16% of the results of the administrative procedure settlement has been issued in legal valid electronic copies for reuse; 66.48% of administrative records are digitized; 62/63 localities and 10/21 ministries and branches have consolidated the Public Service Portal and the Electronic Single Window Information System; more than 4,400 online public services were provided on the National Public Service Portal and completing the integration of 21/25 essential public services under Scheme 06. Inspection and examination of official duties have been focused on implementation. The Advisory Council on Administrative Procedure Reform has promoted the role of the "bridge" between the Government and people and enterprises in the reform of administrative procedures, promoting the modernization of state administration.

In addition to the achieved results, there are still some shortcomings and limitations in the reform of the administrative procedures such as the heads of some agencies have not really paid attention and drastically directed; the review, submission and implementation of the plan to reduce and simplify regulations related to business activities is still slow (714/1,146 regulations that have been approved for reduction and simplification plans have not been implemented) and have not focused on consulting and collecting opinions from associations,  enterprises and subjects affected when promulgating administrative procedures and business regulations; 618/699 administrative procedures have not been implemented with the decentralization plan; 808/1,146 administrative procedures have not been simplified according to 19 specialized resolutions on simplification of administrative procedures, citizen documents related to resident management; the announcement of internal administrative procedures at some agencies is behind schedule, the scope is incomplete; deploying the digitization of dossiers, the results of the settlement of administrative procedures have not met the set requirements; the restructuring of the process and provision of online public services is not convenient for users. In addition, the number of interdisciplinary coordination organizations is still large, in which, some organizations have not operated effectively and have not met the set goals and requirements.

The reason for the above shortcomings and limitations is that some agencies and units have not raised the sense of responsibility, especially the role of the head; the coordination between agencies and units is still lacking in initiative, closeness and timeliness; there is also the situation of holding on to local interests of sectors and fields, lack of decentralization; the legal basis stipulates that the portal for consultation and lookup of business regulations has not yet been issued; some cadres and civil servants performing official duties are not serious, their capacity and qualifications are still limited; lack of connection and sharing of information and data between information systems and databases; the allocation of resources for deployment is still not synchronous.

2. Directions, solutions

- Steadfastly and persistently organizing the implementation of the tasks assigned in the Decrees, Resolutions, Decisions and directions of the Prime Minister on the reform of the administrative procedure, especially the above-mentioned Programs, Plans and Schemes that have been directed and promoted by the Prime Minister in Document No. 493/TTg-KSTT dated June 1, 2023. At the same time, promoting inspection, examination of official duties and urging implementation.

- Selecting regulations, administrative procedures that are barrier to focus on reforming, in the immediate future, to focus on prioritizing urgent issues that need to be removed, especially the reduction and simplification of regulations and regulations on investment, business and tax in sectors and fields directly related to the people,  enterprises such as: construction, real estate, tax, customs, electricity, energy, production, processing of agricultural products, import and export, education and training, health...

- Improving the capacity of direction, administration, strengthen administrative discipline and policy responses of ministries, sectors and localities.

- Carrying out periodic briefings and direct work of Government leaders, the Administrative Reform Working Group, the Office of the Government with departments, branches, localities, and business associations to identify difficulties and obstacles and promptly remove and promote implementation; urging the implementation of approved reduction and simplification plans and decentralization plans, focusing on 714 regulations that have approved reduction and simplification plans that have not yet been implemented, 618 administrative procedures that have been approved decentralization plans but not yet been implemented, 808 administrative procedures related to citizen papers that have not yet been simplified according to 19 specialized resolutions and the reduction and simplification of internal administrative procedures at ministries, agencies and localities.

- Periodically or irregularly organizing work and dialogue with groups, associations, enterprises and peoples, promoting the role of the Prime Minister's Advisory Council on Administrative Reform to grasp difficulties and obstacles that are barriers in production and business activities and people's lives in order to promptly synthesize, reporting to the Prime Minister for consideration and direction of removal.

- Promoting the role of appraisal and verification of regulations and administrative procedures in the formulation of legal documents, proposing plans to reduce, simplifying and promoting decentralization and authorization in the settlement of administrative procedures.

3. Specific tasks

a) Ministries, sectors and localities

- To immediately review, reduce and simplify regulations and administrative procedures (including internal administrative procedures and decentralization and authorization in the settlement of administrative procedures) related to investment, production, business and people's lives, especially regulations and administrative procedures under the direction of the Government Leader in Document No. 547/TTg-KSTT dated June 15, 2023.

- To strictly implement the publication, publicity, transparency, completeness, accuracy and timely information on administrative procedures on the National Database on Administrative Procedures and receive and process feedback and proposals from individuals and organizations on regulations and administrative acts on the National Public Service Portal.

- To assess the quality of service for people and businesses in the settlement of administrative procedures, provision of public services based on data on the National Public Service Portal; strengthen administrative discipline and discipline, regularly inspect and strictly handle and announce and publicize cadres, civil servants, public employees, agencies and units to cause delays and troubles.

- To strictly implement the assessment of the impact of regulations and administration procedures in formulation proposals, projects and draft legal documents, in which resolutely only promulgate administration procedures and regulations related to new business activities in case of real necessity, ensuring reasonableness, legal with low compliance costs.

- To proactively implement the tasks of reforming the National Digital Transformation Program in association with the implementation of Scheme 06 and the National Digital Transformation Program; strengthen communication to raise awareness and create consensus in implementation.

- Ministries and agencies in charge of standing agencies of interdisciplinary coordinating organizations shall proactively assess operational efficiency, propose plans for consolidation and dissolution of interdisciplinary coordinating organizations (including policy consultancy organizations for the Prime Minister) and send them to the Ministry of Home Affairs before July 20, 2023, for synthesizing, reporting to the Prime Minister.

- To make electronic reports on the situation and results of the reform of the administrative procedures, modernize the mode of direction and administration to serve people and businesses on the Reporting Information System of the Office of the Government under the guidance of the Office of the Government.

b) The Ministry of Justice, legal organizations under ministries, ministerial-level agencies, and provincial-level Justice Departments under the People's Committees of provinces and centrally-run cities shall further strengthen the appraisal of regulations on administrative procedures in proposals, bills and draft legal documents to ensure that only the promulgation of administrative procedures is absolutely necessary; reasonable, legal, and have lowest compliance costs.

c) The Ministry of Home Affairs

- To assume the prime responsibility for, and coordinate with the Office of the Government and relevant agencies and units in, organizing inspection and examination of official duties, focusing on the implementation of tasks and solutions on reform of Administration procedure, promptly proposing to the Prime Minister to commend and criticize agencies, organizations and individuals that perform this work well or poorly in accordance with law.

- On the basis of the review of ministries, sectors and localities, the Ministry of Home Affairs shall assume the prime responsibility for, and coordinate with the Office of the Government and relevant ministries and agencies in, synthesizing, reviewing and proposing plans to consolidate inter-sectoral coordination organizations, including the Prime Minister's policy advisory group. The submission time is in July 2023.

d) The Office of the Government

- To assume the prime responsibility for, and coordinate with relevant ministries and agencies in, formulating and submitting to the Prime Minister for promulgation a key administrative reform plan from now until the end of December 31, 2023 to focus on reducing, simplifying and improving the quality of regulations and administrative procedures (including internal administrative procedures,  decentralization and authorization in the settlement of administrative procedures and administrative procedures related to citizen papers), in which the responsibilities of each agency are specifically assigned, with specific results and products, and submitted to the Prime Minister in July 2023.

- To submit to the Prime Minister the consolidation of the Advisory Council on Administrative Reform of the Prime Minister in the direction of compactness, substance and effectiveness; members are representatives of agencies, associations, associations and organizations chaired by the Minister and Chairman of the Office of the Government. The Council must promptly provide information and report to the Government and the Prime Minister on the reflections and recommendations of enterprises; periodically or irregularly organize dialogues with the enterprise community to promptly resolve difficulties and obstacles.

- To submit to the Prime Minister the establishment of the Prime Minister's Administrative Reform Working Group, consisting of 10-12 members headed by the Deputy Prime Minister as the Team Leader, the Chairman of the Office of the Government as the Standing Deputy Team Leader, the Minister of Home Affairs as the Deputy Team Leader, the Deputy Minister of Public Security - the Standing Deputy Team Leader of the Scheme 06 Implementation Working Group as the Deputy Team Leader,  leaders of a number of ministries and agencies as members and the Director of the Administrative Control Department as a standing member. The working group has the mission of directing, inspecting and urging the implementation of programs, plans and schemes on the reform of the administrative procedures; administrative discipline and identification of difficulties and obstacles, promptly resolving and promoting implementation, focusing on reducing and simplifying plans, decentralizing plans that have been approved but have not yet been implemented.

- To upgrade the National Database on Administrative Procedures to update, publicly monitor and evaluate internal administrative procedures and administrative procedures at 4 levels of government. To complete in Quarter 3, 2023.

- The Department of Administrative Procedure Control shall strengthen coordination between specialized departments in verifying projects and draft legal documents that provide for administrative procedures. Organize the implementation of electronic reports on the situation and results of the reform of the administrative procedures, modernize the method of directing and administering services for people and enterprises on the Reporting Information System of the Office of the Government; guide and urge ministries, sectors and localities to implement and periodically synthesize and report to the Government at regular monthly Government meetings.

The Office of the Government shall notify relevant ministries and agencies to know and implement./.
