PLAN
On implementation of the Political Bureau’s Conclusion No. 19-KL/TW and the Scheme on orientations for the legislative program of the 15th National Assembly tenure
On October 14, 2021, the Political Bureau issued Conclusion No. 19-KL/TW on orientations for the legislative program of the 15th National Assembly tenure, according to which the Political Bureau approved the Scheme on orientations for the legislative program of the 15th National Assembly tenure which is submitted by the National Assembly Party Committee and assigned to the National Assembly Party Committee, relevant agencies and organizations to direct and develop plans to implement the Political Bureau's Conclusions and Project, and concretize it into the annual working and law-making programs.
For the implementation of the Political Bureau’s direction, the National Assembly Standing Committee promulgates the Plan for implementation of the Political Bureau’s Conclusion No. 19-KL/TW and the Scheme on orientations for the legislative program of the 15th National Assembly tenure, with the following main contents:
I. OBJECTIVES AND REQUIREMENTS
1. Objectives
- To determine the responsibilities of agencies of the National Assembly, the Government, the Supreme People's Court, the Supreme People's Procuracy, the State Audit Office of Vietnam, the Central Committee of the Vietnam Fatherland Front, and socio-political organizations, other agencies and organizations at the central level and local authorities in organizing and implementing the Political Bureau's conclusions and legislative orientations, tasks, and solutions determined in the Scheme on orientations for the legislative program of the 15th National Assembly tenure (hereinafter referred to as the Scheme).
- To focus on synchronously perfecting development institutions, creating a legal framework to successfully implement socio-economic development tasks for the 2021-2025 period, associated with 12 national development orientations, 06 key tasks and 03 strategic breakthroughs which were set out in the Resolution of the 13th National Congress of the Party and were specifically identified as legislative orientations and tasks in the Scheme; to proactively research and review to propose amendments, supplements and promulgation of new laws, ordinances and resolutions to submit to the National Assembly and the National Assembly Standing Committee during the 15th National Assembly tenure.
2. Requirements
- Ensuring the Party's leadership in the process of organizing and implementing the Political Bureau's Conclusions, Schemes and law-making work.
- The implementation of legislative tasks must be carried out in a timely, synchronous, comprehensive, consistent and effective manner; ensuring close coordination between relevant agencies and organizations. The heads of agencies and organizations must direct and take responsibility for the work of building and perfecting institutions and laws in the fields, scope and areas of responsibility.
- Determining specific work contents, deadlines, completion progress and responsibilities of relevant agencies and organizations in organizing and implementing the Political Bureau's Conclusion and the Scheme.
- Promoting the responsibility of agencies and organizations, improving the quality of the formulation and implementation of the law- and ordinance-making program; completing assigned legislative tasks. Regularly reviewing and promptly adjusting and supplementing according to the competence or proposing adjustments and supplements to legislative tasks to ensure compliance with the Party's policies and guidelines of the 13th Congress and meet practical requirements.
II. IMPLEMENTATION CONTENTS
1. Announcing the Political Bureau's Conclusion and Scheme
- Completing the Scheme according to the opinion of the Political Bureau; sending the Political Bureau's Conclusion and the Scheme to relevant agencies and organizations in the political system for implementation.
- Implementation duration: Completed on October 21, 2021[1].
2. Organizing a National Conference to implement the Political Bureau's Conclusion on orientations for the legislative program of the 15th National Assembly tenure
- Presiding agencies: The National Assembly Standing Committee, Standing Committee of the Secretariat.
- Coordinating agencies: The Government, Central Internal Affairs Committee, Party Central Committee Office.
- Form: Online conference.
- Implementation duration: Completed on March 3, 2021[2].
3. Developing a plan to implement the Political Bureau's Conclusion and the Scheme
3.1. For agencies and organizations outside the National Assembly
- Responsibility for developing and promulgating plans: The Government, Supreme People's Court, Supreme People's Procuracy, State Audit Office of Vietnam, Office of the President, Vietnam Fatherland Front Central Committee and socio-political organizations at central level, the Vietnam Lawyers Association.
- Contents: determining the contents of work that need to be implemented to implement the Political Bureau's Conclusion and the Scheme in the field within the scope of responsibility (documents associated with legislative tasks within the scope of responsibility; affiliated agencies and units assigned to preside over research, review or formulation; coordinating agencies and units; requirements for researching, reviewing or researching and formulating, and reporting results; deadline for reporting results of research, review or formulation for each year during the term, in which it is necessary to clearly and specifically determine the implementation plan for 2022; specific solutions and implementation responsibilities to strengthen the capacity of agencies, units, and teams of civil servants working on law-making, conditions for law-making work and strengthening discipline in law-making work).
- Implementation duration: Complete before November 30, 2021.
3.2. For agencies under the National Assembly
- Responsibility for developing and promulgating plans: The Ethnic Council and Committees of the National Assembly, agencies of the National Assembly Standing Committee, Secretary General of the National Assembly, and National Assembly Office.
- Contents: determining the content of work that needs to be implemented for the performance of the Political Bureau's Conclusion and the Scheme associated with the legislative tasks assigned by the National Assembly Standing Committee; monitoring, urging and supervising the implementation of legislative tasks in the areas of responsibility carried out by the Government, agencies and organizations outside the National Assembly; organizing and implementing the solutions proposed in the Political Bureau's Conclusions and the Scheme according to the assignment by the National Assembly Standing Committee and the tasks and powers as prescribed by law.
- Implementation duration: Complete before November 30, 2021.
4. Organizing the research and review to propose amendments, supplements or formulation of new laws, ordinances and resolutions
4.1. Requirements
- Implementing comprehensively and synchronously the legislative tasks identified in the Scheme; strictly complying with the process and requirements according to the provisions of the Law on Promulgation of Legal Documents; ensuring close coordination with the Ethnic Council, National Assembly Committees and relevant agencies and organizations.
- Ensuring the quality and progress of completing research, review or formulation of new laws, ordinances and resolutions.
- Results of research, review or formulation shall be sent to the National Assembly Standing Committee (through the Standing Committee on Law), and at the same time sent to the Ethnic Council and National Assembly Committees according to the managed areas to monitor, urge and supervise the implementation.
4.2. Responsibilities and implementation progress
The responsibilities of agencies and organizations and the progress of implementing legislative tasks are specifically determined in the Appendices to this Plan.
5. Reporting the results of research, review and formulation to the National Assembly Standing Committee
5.1. Reporting time
The agencies and organizations specified in Section II.3 of this Plan shall responsible for reporting to the National Assembly Standing Committee on the results of research, review, and formulation as follows:
- For legislative tasks according to regulations that need to complete research, review and formulation before June 30, 2022, the results shall be reported no later than July 15, 2022;
- For legislative tasks according to regulations that need to complete research, review, and formulation in 2022, 2023, 2024 and 2025, the results shall be reported no later than March 1 of the following year. In case through research, it is necessary to amend, supplement or promulgate new laws, ordinances and resolutions, promptly make a request to include them in the annual Law- and Ordinance-Making Program in accordance with the Law on Promulgation of Documents.
5.2. Requirements for reporting contents
Report on the results of research, review, and formulation should include following basic contents:
- Evaluating the appropriateness, feasibility and practical effectiveness of regulations in laws, ordinances and resolutions regulating issues related to the orientation content. Clearly identifying inadequacies, limitations, conflicts, overlaps, difficulties and obstacles in the implementation process and causes, especially subjective causes.
- In case the content stated in the orientation is an issue that is being piloted or a new issue that is not yet regulated in laws, ordinances, or resolutions, it is necessary to summarize the results of the pilot implementation or relevant under-law regulations; clarifying the need for provisions of laws, ordinances or resolutions for adjustment and international experience.
- Proposing specific solutions to handle research results in one of the following two directions:
+ It is not necessary to amend, supplement, or promulgate new laws, ordinances, or resolutions but still ensure the implementation of the determined orientation because: only need to amend, supplement, and promulgate under-law documents; improve the quality and efficiency of implementing applicable laws, ordinances, resolutions or other solutions.
+ It is necessary to amend, supplement, or promulgate new laws, ordinances, or resolutions for the implementation of the determined orientations. Accordingly, it is necessary to clearly determine the content and title of the document that needs to be amended, supplemented or newly promulgated and the direction for amendment, supplementation or new promulgation (in case of amending or supplementing many documents, propose to amend each document separately or develop one document to amend multiple documents; in case of promulgation of new documents, must applicable related documents should be amended and supplemented or not); estimated time limit for completing dossiers requesting the making of laws, ordinances, resolutions and time limit for submitting to the National Assembly and the National Assembly Standing Committee for comments and approval.
- In the process of implementing legislative tasks, regularly reviewing and promptly adjusting and supplementing according to the competence or proposing adjustments and supplements to legislative tasks to ensure compliance with the guidelines of the 13th Congress and meet practical requirements.
6. Responsibility for implementing solutions to ensure the implementation
6.1. The Government, other agencies and organizations specified in Section II.3.1 of this Plan shall, within the scope of their functions and competence, be responsible for synchronously and effectively implementing the solutions proposed in the Conclusion of the Political Bureau and the Scheme:
- Strengthening direction of building and perfecting institutions; innovating methods, drastically directing, urging and inspecting to ensure the quality and progress of preparing assigned draft laws, ordinances and resolutions; tightening discipline, promoting responsibility, especially the responsibility of leaders in law-making work; paying attention to preventing negativity in this work, avoiding the integration of “group interests” and “local interests” of state management agencies in legal documents; strongly applying the results of legal science research, scientific and technological achievements, modernizing methods and means to serve the implementation of legislative tasks; consolidating legal organizations, innovating training and professional development, increasing capacity, and ensuring appropriate policies for staff working in law making; increasing investment, innovating allocation mechanisms and effectively using funds for law-making work, ensuring sufficient resources to carry out all stages of the entire legislative process; clearly identifying funding to ensure the construction and improvement of the law as investment in legal infrastructure development.
- Innovating the way to organize consultation with the people, subjects affected by draft laws, ordinances and resolutions, agencies, organizations, experts, and scientists, especially in soliciting opinions on the e-portals of agencies and organizations in an efficient manner, and avoiding formality, in which it is necessary to clearly state the major contents of the document that need opinions, issues on which there are many different opinions, and other issues need to be consulted in accordance with each target group, accompanied by brief and clear arguments on each issue and each different type of opinion; specifying the time limit for collecting comments, the address to receive comments, and the agency in charge of synthesizing, receiving, and explaining comments.
The Vietnam Chamber of Commerce and Industry shall promote its role as representative of the enterprise community, proactively solicit opinions from enterprise associations, large enterprises, and businessmen; actively participate in the making of laws, ordinances, and resolutions submitted to the National Assembly and the National Assembly Standing Committee.
- Organizing the implementation or directing affiliated agencies to conduct 5-year preliminary reviews and 10-year general reviews the implementation of laws, ordinances and resolutions of the National Assembly and the National Assembly Standing Committee.
6.2. Agencies of the National Assembly, agencies under the National Assembly Standing Committee, the Secretary General of the National Assembly, and the National Assembly Office shall, within the scope of assigned tasks, take responsibility for synchronous and effective implementation of solutions proposed in the Political Bureau's Conclusions and the Scheme; based on the Action Program of the National Assembly’s Party Committee to implement the Resolution of the 13th National Party Congress, programs and plans of the National Assembly, the National Assembly Standing Committee, and the leadership and direction of the National Assembly’s Party Committee, the National Assembly Standing Committee, urgently focus on researching, developing and implementing projects, documents, tasks, ensuring quality and progress, including:
- Topics assigned by the Central Steering Committee to be implemented by the National Assembly’s Party Committee under the Scheme “Strategy for building and improvement of the socialist law-ruled state of Vietnam through 2030, with a vision to 2045”:
+ Topic “Strategy for building and perfecting the legal system and organizing law enforcement until 2030, with a vision to 2045 to meet the requirements of building and improvement of the socialist law-ruled state of Vietnam”;
+ Topic “Innovating the organization and improving the quality of operations of the National Assembly to meet the requirements of building and improvement of the socialist law-ruled state of Vietnam”;
+ Topic “Improving the Constitutional protection mechanism to meet the requirements of building and improvement of the socialist law-ruled state of Vietnam”;
+ Topic “Improving the mechanism of assignment, coordination and control between state agencies in the exercise of judicial rights and between agencies and organizations in judicial activities to meet the requirements of building and improvement of the socialist law-ruled state of Vietnam”[3];
- Project to continue improving and enhancing the quality of operations of the National Assembly sessions, amending and supplementing the Rules of the National Assembly sessions;
- Project “Continuing to innovate the National Assembly's supervision activities”; researching and improving legal regulations on supervision activities of the National Assembly, National Assembly’s agencies, and National Assembly deputies; developing instructions on organizing a number of supervision activities of the Ethnic Council and Committees of the National Assembly (including activities of supervising legal documents, organizing explanation sessions, etc.);
- Electronic National Assembly Project;
- Tasks to research and propose amendments and supplements to the Working Regulations of the National Assembly Standing Committee;
- Projects to innovate and improve the quality and operational efficiency of the Ethnic Council, Committees of the National Assembly, agencies under the National Assembly Standing Committee, the National Assembly Office;
- Project to arrange the internal organizational structure of the National Assembly Office and the Institute for Legislative Studies;
- Project to enhance the quality and improve the operational capacity of National Assembly deputies, especially full-time National Assembly deputies;
- Project to strengthen the direction and responsibility for supervision and guidance of the National Assembly Standing Committee for the activities of the People's Councils at all levels, strengthening the connection of National Assembly’s agencies with the People's Councils at all levels;
- Other projects and tasks as assigned by the National Assembly’s Party Committee and the National Assembly Standing Committee.
- Assigning the Secretary General of the National Assembly to assume the prime responsibility for, and coordinate with the Ethnic Council, National Assembly Committees, agencies under the National Assembly Standing Committee and the National Assembly Office to research and propose innovations in the method of collecting comments on the National Assembly's e-portal for draft laws, ordinances, and resolutions; reporting to the National Assembly Standing Committee for comments before December 31, 2021, and implementing, ensuring quality, efficiency, and compliance with the Law on Promulgation of Legal Documents.
III. ORGANIZATION OF IMPLEMENTATION
1. Based on the Political Bureau's Conclusion, the Scheme on orientations for the legislative program of the 15th National Assembly tenure and this Plan, agencies of the National Assembly, the Government, the Supreme People's Court, the Supreme People's Procuracy, State Audit Office of Vietnam, Office of the President, Central Committee of the Vietnam Fatherland Front, central socio-political organizations, Vietnam Lawyers Association and relevant agencies and organizations shall urgently develop and promulgate plans and organize the implementation of legislative tasks as assigned and solutions proposed in the Conclusions of the Political Bureau and the Scheme. The promulgated plan shall be sent to the National Assembly Standing Committee (through the Standing Committee on Law) to report and serve the work of monitoring, urging, and supervising the implementation.
2. The Standing Committee of the Ethnic Council and the National Assembly Committees assigned to monitor and urge in Appendix 1 shall be responsible for closely coordinating with agencies and organizations assigned to perform legislative tasks to give opinions and monitor the implementation, ensuring quality and progress; summarize the implementation results of agencies and organizations to report to the National Assembly Standing Committee (through the Standing Committee on Law) before August 1, 2022, and March 30 every year (starting from 2023).
3. Provincial Party Committees, City Party Committees, National Assembly deputies’ delegations, People's Councils, People's Committees, Fatherland Front Committees of provinces and centrally-run cities, and National Assembly deputies shall be responsible for proactively organizing Research and thoroughly grasping the Political Bureau's Conclusions and the Scheme; coordinate in researching, reviewing, summarizing, surveying practice, and providing opinions at the request of the National Assembly Standing Committee, the Government, ministries, branches, central agencies, the Ethnic Council, Committees of the National Assembly, agencies under the National Assembly Standing Committee, Secretary General of the National Assembly, the National Assembly Office in the process of implementing legislative solutions and tasks according to the Conclusion of the Political Bureau and Scheme. National Assembly deputies’ delegations and National Assembly deputies shall uphold their responsibility in researching, reviewing, and giving opinions on draft laws, ordinances and resolutions; be more proactive in legislative work through exercising the right to legislative initiatives in accordance with the law; actively participate and coordinate with the Ethnic Council and National Assembly Committees in monitoring, urging and supervising the implementation of the Political Bureau's Conclusions and the Scheme.
4. The Standing Committee on Law shall act as the focal point to advise and assist the National Assembly Standing Committee in monitoring the implementation of the Political Bureau's Conclusions and the Scheme; receiving and synthesizing reports from agencies and organizations to report to the National Assembly Standing Committee and send to the Central Committee of Internal Affairs to summarize and report to the Political Bureau according to regulations.
