DECISION
On the implementation of agricultural insurance support policy[1]
Pursuant to the June 19, 2015 Law on Organization of the Government;
Pursuant to the December 9, 2000 Law on Insurance Business; and the November 24, 2010 Law Amending and Supplementing a Number of Articles of the Law on Insurance Business;
Pursuant to the National Assembly’s Resolution No. 32/2016/QH14 of November 23, 2016, on further raising the capacity for and effectiveness of implementation of the national target program on building a new countryside associated with agriculture restructuring;
Pursuant to the Government’s Decree No. 58/2018/ND-CP of April 18, 2018, on agricultural insurance;
At the proposal of the Minister of Finance and Minister of Agriculture and Rural Development;
The Prime Minister promulgates the Decision on the implementation of agricultural insurance support policy.
Chapter I
GENERAL PROVISIONS
Article 1.Scope of regulation
This Decision prescribes the implementation of agricultural insurance support policy prescribed in Government’s Decree No. 58/2018/ND-CP of April 18, 2018, on agricultural insurance, covering support-eligible organizations and individuals engaged in agricultural production; plants, livestock and cultured aquatic animals eligible for support, insured risks eligible for support; support levels; period of provision of support; geographical areas eligible for support; and levels of support from the central budget to local budgets for agricultural insurance premiums.
Article 2.Subjects of application
This Decision applies to:
1. Organizations and individuals growing rice; or raising buffaloes, cows, black tiger shrimps or white leg shrimps as prescribed in Clause 2, Article 22 of the Government’s Decree No. 58/2018/ND-CP of April 18, 2018, on agricultural insurance.
2. Non-life insurance enterprises, branches of foreign non-life insurance enterprises and reinsurance enterprises established, organized and operating under the Law on Insurance Business and relevant laws.
3. Agencies, organizations and individuals involved in the implementation of agricultural insurance support policy.
Chapter II
AGRICULTURAL INSURANCE SUPPORT POLICY
Article 3.Insured objects eligible for agricultural insurance premium support
1. Crop: rice.
2. Livestock: buffaloes and cows.
3. Aquatic animals: black tiger shrimps and white leg shrimps.
Article 4.Agricultural insurance premium support levels
1. The support level of 90% of agricultural insurance premiums shall be provided for individuals engaged in agricultural production who are members of poor households (including poor households classified based on income criterion and poor households classified based on multidimensional poverty criterion) or households just above the poverty line under the Prime Minister’s Decision No. 59/2015/QD-TTg of November 19, 2015, promulgating multidimensional poverty standards for the 2016-2020 period.
2. The support level of 20% of agricultural insurance premiums shall be provided for individuals engaged in agricultural production who are not members of poor households or households just above the poverty line.
3. The support level of 20% of agricultural insurance premiums shall be provided for organizations engaged in agricultural production defined in Clause 3, Article 19 of Decree No. 58/2018/ND-CP when they fully meet the following conditions:
- Being enterprises established under the Law on Enterprises or cooperatives established under the Law on Cooperatives;
- Having contracts associated with agricultural products which are eligible for agricultural insurance support policy, and complying with Articles 4 and 5 of the Government’s Decree No. 98/2018/ND-CP of July 5, 2018, on policies to encourage the development of cooperatives and linkage in production and sale of agricultural products, and amending, supplementing or replacing documents (if any);
- Having agricultural products which are entitled to agricultural insurance support policy and certified as meeting food quality and safety requirements by competent agencies, or being recognized as hi-tech agricultural enterprises under the Prime Minister’s Decision No. 19/2018/QD-TTg of April 19, 2018, prescribing criteria, competence, order and procedures for recognition of entities as hi-tech agricultural enterprises, and amending, supplementing or replacing documents (if any).
Article 5. Insured risks eligible for agricultural insurance premium support
1. For rice, insured risks eligible for support include:
a/ Disasters, including storm, tropical low pressure, cyclone, lightning, heavy rain, flood, flash flood, inundation, landslide due to flood or water flow, land subsidence due to flood or water flow, water level rise, saltwater intrusion, hot spell, drought, cold, hail, hoarfrost, earthquake and tsunami. Disasters must be announced or certified by a competent state agency;
b/ Epidemics, including rice grassy stunt virus, rice ragged stunt virus, rice black-streaked dwarf virus, magnaporthe grisea, and bacterial leaf blight disease; and brown plant hopper and chilo suppressalis. Epidemics must be announced or certified by a competent state agency.
2. For buffaloes and cows, insured risks eligible for support include:
a/ Disasters, including storm, tropical low pressure, cyclone, lightning, heavy rain, flood, flash flood, inundation, landslide due to flood or water flow, land subsidence due to flood or water flow, hot spell, drought, cold, hail, hoarfrost, earthquake and tsunami. Disasters must be announced or certified by a competent state agency;
b/ Epidemics, including foot-and-mouth disease and anthrax. Epidemics must be announced or certified by a competent state agency.
3. For black tiger shrimps and white leg shrimps, insured risks eligible for support include:
a/ Disasters, including storm, tropical low pressure, cyclone, lightning, heavy rain, flood, inundation, landslide due to flood or water flow, land subsidence due to flood or water flow, water level rise, saltwater intrusion, hot spell, drought, hail, earthquake and tsunami. Disasters must be announced or certified by a competent state agency;
b/ No support shall be provided for epidemic-related risks for black tiger shrimps and white leg shrimps.
Article 6.Geographical areas eligible for agricultural insurance premium support
1. For rice: Thai Binh, Nam Dinh, Nghe An, Ha Tinh, Binh Thuan, An Giang and Dong Thap provinces.
2. For buffaloes and cows: The provinces and centrally run cities of Ha Giang, Vinh Phuc, Hanoi, Thanh Hoa, Nghe An, Binh Dinh, Dong Nai and Binh Duong.
3. For black tiger shrimps and white leg shrimps: Ben Tre, Tra Vinh, Soc Trang, Bac Lieu and Ca Mau provinces.
The provincial-level People’s Committees of the localities prescribed in Clauses 1, 2 and 3 of this Article shall organize the selection of geographical areas eligible for agricultural insurance premium support as prescribed in Clause 2, Article 21 of the Government’s Decree No. 58/2018/ND-CP of April 18, 2018, on agricultural insurance.
Article 7.Period of provision of agricultural insurance premium support
The period of provision of agricultural insurance premium support lasts from the effective date of this Decision through December 31, 2020.
Article 8.Levels of support from the central budget to local budgets for agricultural insurance premiums
To apply the maximum support levels prescribed in Decision No. 579/QD-TTg of April 28, 2017, prescribing the principle of targeted support from the central budget to local budgets for implementation of social welfare policies during 2017-2020, and amending, supplementing or replacing documents (if any).
The provincial-level People’s Committees of the localities prescribed in Clauses 1, 2 and 3, Article 6 of this Decision shall allocate local budget funds as agricultural insurance premium support in accordance with this Decision.
Chapter III
IMPLEMENTATION PROVISIONS
Article 9.Effect
1. This Decision takes effect on the date of signing.
2. The Ministry of Finance shall assume the prime responsibility for, and coordinate with related agencies in, summarizing and assessing the implementation of this Decision and proposing the formulation of a draft decision of this kind for the period after 2020.
3. The Minister of Finance, Minister of Agriculture and Rural Development, heads of ministerial-level agencies and government-attached agencies, and chairpersons of provincial-level People’s Committees shall implement this Decision.-
