SUMMARY

Tasks and powers of coordinating councils for law dissemination and education

On June 21, 2021, the Prime Minister issues the Decision No. 21/2021/QD-TTg defining the composition, tasks and powers of coordinating councils for law dissemination and education.

Specifically, the Central Coordinating Council for Law Dissemination and Education shall be established by the Prime Minister and composed of the Chairperson - A Deputy Prime Minister; a Standing Vice Chairperson - the Minister of Justice; Vice Chairpersons including a Deputy Minister of Justice; a Vice Chairperson of the Government Office; a Vice President of the Vietnam Fatherland Front Central Committee, who is invited to the post of Vice Chairperson of the Council.

The Central Coordinating Council for Law Dissemination and Education shall advise the Government and Prime Minister on directing and coordinating the performance of the following tasks: Devising and implementing solutions to strengthen the Party’s leadership over law dissemination and education work; Implementing solutions to intensify mobilization of all social resources as well as organizations and individuals to participate in law dissemination and education and public communication about policies and law; etc.

Members of coordinating councils for law dissemination and education shall work on a part-time basis. Operating funds of coordinating councils for law dissemination and education at all levels and their secretarial teams shall be allocated from the state budget and included in current expenditure estimates of standing bodies of coordinating councils for law dissemination and education and mobilized from other lawful support and funding sources.

This Decision takes effect on the signing date.

DECISION

Defining the composition, tasks and powers of coordinating councils for law dissemination and education[1]

Pursuant to the June 19, 2015 Law on Organization of the Government; and the November 22, 2019 Law Amending and Supplementing a Number of Articles of the Law on Organization of the Government and the Law on Organization of Local Administration;

Pursuant to the June 20, 2012 Law on Law Dissemination and Education;

At the proposal of the Minister of Justice;

The Prime Minister promulgates the Decision defining the composition, tasks and powers of coordinating councils for law dissemination and education.

 

Article 1. Composition of coordinating councils for law dissemination and education

1. The Central Coordinating Council for Law Dissemination and Education shall be established by the Prime Minister and composed of:

a/ The Chairperson: A Deputy Prime Minister.

b/ A Standing Vice Chairperson: The Minister of Justice.

c/ Vice Chairpersons:

- A Deputy Minister of Justice;

- A Vice Chairperson of the Government Office;

- A Vice President of the Vietnam Fatherland Front Central Committee, who is invited to the post of Vice Chairperson of the Council.

d/ Council members who are representatives of the leaderships of the following agencies and organizations: the Ministry of National Defense, Ministry of Public Security, Ministry of Home Affairs, Government Inspectorate, Ministry of Information and Communications, Ministry of Education and Training, Ministry of Labor, Invalids and Social Affairs, Ministry of Culture, Sports and Tourism, Ministry of Transport, Ministry of Agriculture and Rural Development, Ministry of Natural Resources and Environment, Ministry of Health, Ministry of Finance, Ministry of Industry and Trade, Ministry of Planning and Investment, Ministry of Construction, Ministry of Foreign Affairs, Committee for Ethnic Minority Affairs, Vietnam News Agency, Vietnam Television, and Voice of Vietnam.

Representatives of the leaderships of the Party Central Committee’s Commission for Internal Affairs, Party Central Committee’s Commission for Communication and Education, Party Central Committee’s Mass Mobilization Commission, Supreme People’s Court, Supreme People’s Procuracy, Central Committee of the Veterans Association of Vietnam, Vietnam General Confederation of Labor, Central Committee of the Vietnam Farmers’ Union, Central Committee of the Vietnam Women’s Union, Central Committee of the Ho Chi Minh Communist Youth Union, Central Committee of the Vietnam Lawyers’ Association, Vietnam Bar Federation, Vietnam Chamber of Commerce and Industry (VCCI) who are  invited to the post of Council Member.

2. Based on the composition of the Central Coordinating Council for Law Dissemination and Education and local practical requirements, the chairperson of the People’s Committee of each province or centrally run city (below referred to as provincial-level People’s Committee) or the chairperson of the People’s Committee of each rural district, urban district, town, provincial city or municipal city (below referred to as district-level People’s Committee) shall decide on the composition and number of members of the provincial- or district-level coordinating council for law dissemination and education, of whom a representative of the leadership of the provincial-level People’s Committee or district-level People’s Committee shall act as the council chairperson.

Article 2. Tasks and powers of coordinating councils for law dissemination and education

1. The Central Coordinating Council for Law Dissemination and Education shall advise the Government and Prime Minister on directing and coordinating the performance of the following tasks:

a/ Devising and implementing solutions to strengthen the Party’s leadership over law dissemination and education work;

b/ Improving institutions and law on law dissemination and education; formulating, promulgating, and urging and inspecting the implementation of, the Government’s programs and plans on law dissemination and education;

c/ Carrying out public communication about policies and law so as to create social consensus and mobilize the people to participate in the formulation and improvement of law and organize the implementation of law in an effective manner;

d/ Carrying out law dissemination and education in fields and geographical areas and for subjects that require interdisciplinary coordination in order to fulfill socio-economic development objectives and maintain national defense and security; and carrying out digital transformation in law dissemination and education work nationwide;

dd/ Implementing solutions to intensify mobilization of all social resources as well as organizations and individuals to participate in law dissemination and education and public communication about policies and law;

e/ Performing other tasks as assigned by the Government or Prime Minister.

2. Provincial- and district-level coordinating councils for law dissemination and education shall advise same-level People’s Committees and People’s Committee chairpersons on performing the following tasks:

a/ Devising and implementing solutions to enhance the leadership of local Party Committees over law dissemination and education work;

b/ Proposing local Party Committees and administrations to promulgate documents on mechanisms and solutions to improve the effectiveness of law dissemination and education;

c/ Formulating programs, schemes and plans of same-level People’s Committees and People’s Committees chairpersons on law dissemination and education and public communication about policies and law in localities;

d/ Organizing law dissemination and education in fields and geographical areas and for subjects that require interdisciplinary coordination in order to fulfill socio-economic development objectives and maintain national defense and security in localities;

dd/ Guiding the organization of the Law Day of the Socialist Republic of Vietnam in localities; and carrying out digital transformation in law dissemination and education work in localities;

e/ Implementing solutions to intensify the mobilization of all social resources as well as organizations and individuals to participate in the law dissemination and education and public communication on policies and law;

g/ Performing other tasks as assigned by same-level People’s Committees and People’s Committee chairpersons.

Article 3. Tasks and powers of the Chairperson of a Coordinating Council for Law Dissemination and Education

1. To organize the performance of tasks of the Council; to be held responsible before the person competent to decide on the establishment of the Council and before law for operation of the Council.

2. To promulgate a list of members and the operation regulation of the Council; to approve operational programs and plans of the Council, conclusions and other documents of the Council at the request of the Standing Vice Chairperson of the Council.

3. To generally direct operation of the Council; to administer and assign the Standing Vice Chairperson, Vice Chairpersons and members of the Council to perform their tasks under their operational plans and fields of work; to urge and inspect the performance of assigned tasks.

4. To convene and chair meetings of the Council.

5. To mobilize experts, scientists, practitioners, and related enterprises and organizations to participate in the performance of tasks of the Council when necessary.

6. To make reports on organization and operation of the Council.

Article 4. Tasks, powers and responsibilities of the Standing Vice Chairperson and Vice Chairpersons of a Coordinating Council for Law Dissemination and Education

1. The Standing Vice Chairperson of a Coordinating Council for Law Dissemination and Education shall handle regular affairs of the Council and perform the following tasks:

a/ To perform the tasks assigned by the Chairperson; to be held responsible before the Council, the Chairperson and law for the performance of their assigned tasks;

b/ To assist the Chairperson in managing operation of the Council, directing, monitoring and urging the organization of operation of the Council under working plans and programs directed and approved by the Chairperson or directed by the Government or Prime Minister; the same-level People’s Committee or People’s Committee chairperson;

c/ To urge council members to organize the law dissemination and education within the ambit of their management under work programs and plans of the council;

d/ To propose and submit to the Chairperson for promulgation the operation regulation, programs and plans and other documents of the Council;

dd/ To perform the tasks and responsibilities and exercise the powers specified in Article 5 of this Decision;

e/ To perform other tasks assigned by the Chairperson.

2. A Vice Chairperson of a Coordinating Council for Law Dissemination and Education has the following tasks, powers and responsibilities:

a/ To perform tasks assigned or authorized by the Chairperson or Standing Vice Chairperson of the Council;

b/ To perform tasks and responsibilities and exercise powers specified at Point a, Clause 1 of this Article and Article 5 of this Decision.

Article 5. Tasks, powers and responsibilities of members of a Coordinating Council for Law Dissemination and Education

1. To fully participate in operation of the Council; to perform tasks assigned by the Chairperson and to be held responsible before the Council, Chairperson and law for the performance of their tasks. They shall act as official representatives of agencies or organizations where they work in the performance of functions, tasks and other activities of the Council.

2. To advise and propose to the Chairperson and the Council key solutions and tasks regarding the dissemination and education of specialized laws within the ambit of their management and coordination among them in organizing the implementation of such solutions and tasks.

3. To assist heads of agencies and organizations for which they act as representatives in the Council in directing and guiding, or personally direct and guide law dissemination and education work within the ambit of their management, and digital transformation in law dissemination and education work in the sectors and fields under their charge; to biannually and annually report to the Council and propose solutions to address problems and shortcomings arising from law dissemination and education work within the ambit of their management.

4. To be provided with information and documents related to operation of the Council.

Article 6. Standing Body of a Coordinating Council for Law Dissemination and Education and its secretarial team

1. The Ministry of Justice shall act as the Standing Body of the Central Coordinating Council for Law Dissemination and Education; provincial-level Departments of Justice and district-level Divisions of Justice shall act as standing bodies of provincial- and district-level coordinating councils for law dissemination and education, respectively.

2. The Standing Body of a Coordinating Council for Law Dissemination and Education has the following tasks and powers:

a/ To act as the focal point to advise the Council and its Chairperson and Standing Vice Chairperson on performing the tasks and exercising the powers specified in Articles 2 and 3, and Clause 1, Article 4 of this Decision;

b/ To assume the prime responsibility for, and give advices on, the formulation of operational programs and plans, making of conclusions and other documents of the Council; to monitor and summarize the actual implementation of these documents;

c/ To advise and assist the Council in giving opinions on draft programs, plans and schemes on law dissemination and education to be promulgated by the Government, Prime Minister, and same-level People’s Committee and People’s Committee chairperson;

d/ To ensure operation conditions of the Council; to assign its attached functional units to perform tasks of the Council;

dd/ To manage funds, physical foundations and facilities of the Council in accordance with law;

e/ To decide on the establishment, composition, tasks and powers of a secretarial team to assist the Council;

g/ To perform other tasks assigned by the Chairperson, Standing Vice Chairperson or Vice Chairpersons of the Ccouncil.

3. Secretarial teams assisting coordinating councils for law dissemination and education shall work on a part-time basis.

Article 7. Working regime and information and reporting regime applicable to coordinating councils for law dissemination and education

1. Members of coordinating councils for law dissemination and education shall work on a part-time basis.

2. The Chairperson of the Central Coordinating Council for Law Dissemination and Education may use the seal of the Prime Minister; Chairpersons of provincial- and district-level coordinating councils for law dissemination and education may use seals of same-level People’s Committees; Standing Vice Chairpersons, respectively, and Vice Chairpersons and members of councils may use seals of agencies or organizations where they work.

3. Councils shall report on their operations on a regular basis and when requested by competent authorities.

Article 8. Operating funds of coordinating councils for law dissemination and education and their secretarial teams

Operating funds of coordinating councils for law dissemination and education at all levels and their secretarial teams shall be allocated from the state budget and included in current expenditure estimates of standing bodies of coordinating councils for law dissemination and education and mobilized from other lawful support and funding sources in accordance with law.

Article 9. Effect and transitional provisions

1. This Decision takes effect on August 8, 2021, and replaces the Prime Minister’s Decision No. 27/2013/QD-TTg of May 19, 2013, providing the composition, tasks and powers of  coordinating councils for law dissemination and education (below referred to as Decision No. 27/2013/QD-TTg), and the Prime Minister’s Decision No. 42/2017/QD-TTg of September 20, 2017, amending and supplementing a number of articles of Decision No. 27/2013/QD-TTg (below referred to as Decision No. 42/2017/QD-TTg).

Coordinating councils for law dissemination and education at all levels established under Decision No. 27/2013/QD-TTg and Decision No. 42/2017/QD-TTg must be consolidated according to this Decision within three months from the effective date of this Decision.

2. Based on requirements on direction and coordination in carrying out law dissemination and education in sectors and fields within the ambit of their management, ministers and heads of ministerial-level agencies shall decide on, and take responsibility for, the establishment or continued operation of coordinating committees for law dissemination and education of their ministries and agencies.

Article 10. Implementation responsibility

Ministers, heads of ministerial-level agencies, heads of government-attached agencies, chairpersons of provincial-level People’s Committees, and heads of related agencies and organizations shall implement this Decision.-
