DECISION

Regarding the assignment of works of the Minister and Deputy Ministers

THE MINISTER OF LABOR, INVALIDS AND SOCIAL AFFAIRS

Pursuant to the Government's Decree No. 14/2017/ND-CP dated February 17, 2017 defining the functions, tasks, powers and organizational structure of the Ministry of Labor, Invalids and Social Affairs;

Pursuant to the Decision No. 486/QD-LDTBXH dated March 29, 2017 of the Minister of Ministry of Labor, Invalids and Social Affairs on promulgating the Working regulations of the Ministry of Labor, Invalids and Social Affairs;

At the request of the Director of the Department of Organization and Personnel.

DECIDES:

Article 1. Principle for assigning of works and working relationship between Ministers and Deputy Ministers

1. The Minister shall be a member of the Government, the head of the Ministry, and shall take responsibility before the Government, the Prime Minister and the National Assembly for the State management in the field of labor, people with meritorious services and the society; perform duties and powers as prescribed by law provisions; provide direct directions and manage major, important and strategic issues in all working fields within the functions, tasks and powers of the Ministry.

2. The Deputy Ministers shall be responsible for assisting the Minister in monitoring and directing the working fields as assigned by the Minister. Within the scope of their assigned powers and duties, the Deputy Ministers shall actively handle affairs; take responsibility before the Minister and the law for their assigned tasks; for important, unexpected, complicated and sensitive issues, such issues must be promptly reported and consulted with the Minister before handling and deciding.

3. In the process of performing their tasks, the Deputy Ministers shall coordinate, exchange and support each other in order to ensure that all activities of the Ministry are carried out in accordance with law regulations, in an effective manner and in accordance with the approved plans. In cases where the Deputy Ministers have different opinions when handling their work, the Deputy Minister who is assigned to assume the prime responsibility for handling such work shall report to the Minister for consideration and decision.

4. In case of necessity or when one Deputy Minister is absent, the Minister shall directly direct the handling of the work assigned to such Deputy Minister or assign another Deputy Minister to direct the handling of these works. The assignment of works among the Deputy Ministers shall be specified in Article 2 of this Decision and may be changed upon the decision of the Minister.

5. When necessary, the Minister shall authorize a Deputy Minister to act on behalf of the Minister to direct and handle the affairs of the Ministry in accordance with law regulations.

6. The Ministry Office shall directly assist the Ministry leaders in performing specific tasks as assigned by the Minister.

Article 2. Assignment of works among the Minister and Deputy Ministers:

1. The Minister:

1.1. To lead, direct, manage and administer all aspects of activities of the Ministry and of the Labor, Invalids and Social Affairs sector in accordance with the functions, tasks and powers of the Ministry, works under the competence and responsibility of the Ministry and the Minister which are specified in the Law on Governmental Organization, the Working Regulations of the Government and other relevant legal documents.

1.2. To provide direct directions in the following fields:

- Developing institutions, policies, strategies, master plans and plans; National Target Programs and the Ministry’s programs and targets, submitting to competent authorities and direct the organization of implementation after being approved;

- Deciding on issues related to the strategy, planning, plans, programs, objectives of the Ministry, works, projects and other important issues under the deciding competence of the Ministry.

- Providing directions on the protection of internal politics; organization, personnel; planning and finance; international cooperation; legislation; and inspection;

- Performing other duties and powers of the Minister in accordance with the law.

1.3. To be directly in charge of the following units: Department of Organization and Personnel; Department of Planning and Finance; Department of International Cooperation; Department of Legal affairs, Ministry Inspectorate.

1.4. To take part in steering committees, committees, and councils as assigned by the Government, the Prime Minister.

1.5. To perform as the account holder of the Ministry.

2. Deputy Minister Le Tan Dung:

2.1. To assist the Minister in directing the fields of: vocational education and universities under the Ministry; Office work; Party – Union work; the project management boards under the Ministry and monitor associations and non-governmental organizations operating in the fields within the scope and responsibility of the Ministry.

2.2. To be in charge of the following units: Directorate of Vocational education (including non-business units under the Directorate); the Ministry Office (including non-business units under the Ministry Office); the Office of Party affairs, the Communist Party and Trade Union Office; University of Labor and Social Affairs; Nam Dinh University of Technology Education; Vinh University of Technology Education; Vinh Long University of Technology Education; Vocational College of Technology; Dung Quat College of Technology; College of Technology II, construction investment project management boards under the Ministry.

2.3. To take part in steering committees, councils and committees under decisions of the Prime Minister and a number of other councils and steering committees as assigned by the Minister.

- Vice Chairperson of the National Committee for the Advancement of Women in Vietnam.

- Chairperson of the Ministry's Civil Servant and Public Employee Recruitment Council.

- Chairperson of the Emulation, Commendation and Discipline Council of the Ministry.

3. Deputy Minister Nguyen Thi Ha:

3.1. To assist the Minister in directing the fields of: children; gender equality; journalism; training and retraining of cadres, civil servants and public employees; to keep track of associations, non-governmental organizations operating in the fields within the scope and responsibility of the Ministry.

3.2. To be in charge of the following units: Department of Children (including non-business units under the Department); National Fund for Vietnamese children; Department of Gender Equality; Newspaper of Labor and Social Affairs; Dan Tri Newspaper; Magazine of Labor and Social affairs; Training School for officials, civil servants on labor and social affairs; Thuyan Rehabilitation Center for People with Disabilities; Center of Rehabilitation and Assistance for handicapped children.

3.3. To take part in steering committees, councils and committees under decisions of the Prime Minister and a number of other councils and steering committees as assigned by the Minister.

- Permanent member of the National Committee for Children.

- Chairperson of SOS Children's Villages Vietnam.

- Permanent Vice Chairperson of the National Committee for the Advancement of Women in Vietnam; Head of the Committee for the Advancement of Women of the Ministry.

- Chairperson of the Council for salary increase, public servant rank promotion, public employee promotion of the Ministry.

4. Deputy Minister Le Van Thanh:

4.1. To assist the Minister in directing the fields of: employment and the National program on multidimensional and sustainable poverty reduction; labor relations and wages; labor safety; enterprises of the Ministry. To keep track of associations, non-governmental organizations operating in the fields of responsibility within the scope and responsibility of the Ministry. To assist and work with the Minister on the work of institutional building.

4.2. To be in charge of the following units: the Department of Employment (including non-business units under the Department); National Office for Poverty Reduction; Department of Industrial Relations and Wages (including non-business units under the Department); Department of Work safety (including non-business units under the Department); Center for Technical Safety Inspection Zone I; Center for Technical Safety Inspection Zone II; Center for Technical Safety Inspection Zone III; Vocational Education Equipment Single-Member Limited Liability Company.

4.3. To take part in steering committees, councils and committees under decisions of the Prime Minister and a number of other councils and steering committees as assigned by the Minister.

- Chairperson of the National Wage Council.

- Permanent member of Central Steering Committee of the National program on multidimensional and sustainable poverty reduction.

5. Deputy Minister Nguyen Ba Hoan:

5.1. To assist the Minister in directing the fields of: people with meritorious services; social insurance; management of overseas labor; to direct the resolution of petitions and letters of citizens and petitions of voters; to take charge of administrative reforms and information technology application and to keep track of associations, non-governmental organizations operating in the fields of their responsibility, within the scope and responsibility of the Ministry.

5.2. To be in charge of the following units: Department for People with Meritorious Contributions (including non-business units under the Department); Department of Social Insurance; Department of Overseas Labor; Center for Overseas Labor; Information Center; Vietnam National Mine Action Center; Vietnam Bomb and Mine Action Assistance Fund.

5.3. To take part in steering committees, councils and committees under decisions of the Prime Minister and a number of other councils and steering committees as assigned by the Minister.

- Head of the Ministry's Steering Committee of Administrative Reforms and Information Technology Application.

6. Deputy Minister Nguyen Van Hoi

6.1. To assist the Minister in directing the fields of: Social assistance; Prevention of social evils; scientific research; orthopedics and rehabilitation.

6.2. To be in charge of the following units: Department of Social Assistance, Department of Social Vice Prevention and Combat, the Institute of Labor Science and Social Affairs; the Hanoi Orthopedics and Rehabilitation Hospital; Da Nang Orthopedics and Rehabilitation Hospital; Quy Nhon Orthopedics and Rehabilitation Hospital; Orthopedic and Rehabilitation Hospital – Ho Chi Minh City; Can Tho Orthopedics and Rehabilitation Hospital; Ho Chi Minh City Center for Orthopedics and Rehabilitation; Viet Tri Center for Nursing – Psychiatric Rehabilitation.

6.3. To take part in steering committees, councils and committees under decisions of the Prime Minister and a number of other councils and steering committees as assigned by the Minister.

- Vice Chairperson of the National Committee for Vietnamese Persons with Disabilities.

- Permanent member of the National Committee on the Vietnamese Elderly.

- Chairperson of the Scientific Council of the Ministry.

Article 3. This Decision shall take effect from the date of its signing, and shall replace the Decision No. 1633/QD-LDTBXH dated October 16, 2017 of the Minister of Labor, Invalids and Social Affairs on the assignment of works of the Minister and Deputy Ministers, the Decision No. 446/QD-LDTBXH dated April 16, 2018 of the Minister of Labor, Invalids and Social Affairs on adjusting and supplementing the work assignment of Deputy Ministers, the Notice No. 4214/TB-LDTBXH dated October 01, 2019 of the Minister of Labor, Invalids and Social Affairs on adjusting and supplementing the work assignment of the Minister and Deputy Ministers, the Notice No. 3556/TB-LDTBXH dated September 15, 2020 of the Minister of Labor, Invalids and Social Affairs on adjusting and supplementing the work assignment of Deputy Ministers and previous regulations which are contrary to the provisions of this Decision.

Ministries leaders, heads of units under the Ministry and relevant organizations and individuals shall be responsible for implementing this Decision./.
