SUMMARY

Inter-agency birth registration and issuance of health insurance cards for children under 6 years of age

On August 4, 2014, the Prime Minister issues the Decision No. 1299/QD-TTg approving “the Scheme for implementing inter-agency administrative procedures: birth registration, permanent residence registration, issuance of health insurance cards for children under 6 years of age”.

Inter-agency administrative procedures of birth registration - permanent residence registration - issuance of health insurance cards for children under 6 years of age are applicable to cases where birth registration falls under the jurisdiction of commune-level People’s Committees and other agencies in charge of handling administrative procedures in the same district, town, or provincial city (hereinafter referred to as district-level locality); children under 6 years of age whose parents or caregivers have registered their permanent residence in such district-level locality.

Inter-agency administrative procedures of birth registration - issuance of health insurance cards for children under 6 years of age are supplied to cases where birth registration falls under the jurisdiction of commune-level People’s Committees and other agencies in charge of handling administrative procedures in the same district-level locality; children under 6 years of age whose parents or caregivers have registered their permanent residence in such district-level locality.

After a maximum time limit of 20 (twenty) working days since the complete application dossiers for inter-agency administrative procedures: birth registration, permanent residence registration, issuance of health insurance cards for children under 6 years of age are filed as prescribed, the applicants shall come to the sections in charge of receiving application dossiers and giving off outcomes of the commune-level People’s Committees where the application dossiers were filed to receive the outcomes.

This Decision takes effect on the signing date.

APPROVING “THE SCHEME FOR IMPLEMENTING INTER-AGENCY ADMINISTRATIVE PROCEDURES: BIRTH REGISTRATION, PERMANENT RESIDENCE REGISTRATION, ISSUANCE OF HEALTH INSURANCE CARDS FOR CHILDREN UNDER 6 YEARS OF AGE”

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to Resolution No. 01/NQ-CP dated November 8, 2014 of the Government on major tasks and solutions guiding and directing the realization of the plan for socio-economic development and state budget estimate in 2014;

At the proposal of the Minister of Justice,

 

DECIDES:

 

Article 1. To approve “the Scheme for implementing inter-agency administrative procedures: birth registration, permanent residence registration, issuance of health insurance cards for children under 6 years of age” with the following contents:

I. GUIDING PERSPECTIVES

1. To thoroughly implement the guidelines and policies of the Party and the State on reforming administrative procedures, creating favorable conditions for individuals and organizations in the exercise of rights and obligations related to civil status, residence, health insurance, and social insurance. At the same time, to ensure the rigor and accuracy in State governance of the above-mentioned fields.

2. To thoroughly follow the principle of implementing the single-window and inter-agency single-window mechanisms in handling administrative procedures at the request of individuals and organizations.

3. To ensure the close coordination among relevant agencies in organizing the implementation of inter-agency administrative procedures.

II. OBJECTIVES, SCOPE OF REGULATION AND SUBJECTS OF APPLICATION

1. Overall objectives

To reform administrative procedures, ensure the implementation of the inter-agency mechanism in the fields of civil status and residence registration and health insurance in order to gradually improve the quality of public services under the responsibility of the judiciary sector, the Public Security Forces, the social insurance sector and, at the same time, contribute to improving the efficiency of State governance over such fields.

2. Specific objectives

- To simplify, publicize and clarify procedures; reduce paperwork, shorten the time for handling, reduce the costs, and create the maximum convenience for citizens in carrying out the administrative procedures: birth registration, permanent residence registration, insurance of health issuance cards for children under 6 years of age;

- To enhance the sense of responsibility as well as the initiative and positivity of cadres, civil servants and State agencies; contributing to eradicating their wrongdoings and corrupt behaviors in solving citizens’ requests;

- To ensure the timeliness, accuracy and consistency of identity information of individuals as well as to limit troubling or causing difficulties for citizens, thus better contribute to the State governance over the fields of civil status, residence, and health insurance.

3. Scope of regulation

The inter-agency administrative procedures shall be carried out in the following specific cases:

a) Birth registration - permanent residence registration - issuance of health insurance cards for children under 6 years of age: Applicable to cases where birth registration falls under the jurisdiction of commune-level People’s Committeeand other agencies in charge of handling administrative procedures in the same district, town, or provincial city (hereinafter referred to as district-level locality); children under 6 years of age whose parents or caregivers have registered their permanent residence in such district-level locality.

b) Birth registration - issuance of health insurance cards for children under 6 years of age: Applicable to cases where birth registration falls under the jurisdiction of commune-level People’s Committeeand other agencies in charge of handling administrative procedures in the same district-level locality; children under 6 years of age whose parents or caregivers have registered their permanent residence in such district-level locality.

c) The inter-agency administrative procedures: birth registration, permanent residence registration, and issuance of health insurance cards for children under 6 years of age shall be implemented nationwide.

4. Subjects of application

a) State management agencies in charge of civil status, residence and health insurance.

b) Agencies that carry out birth registration and permanent residence registration, as well as issue health insurance cards for children under 6 years of age.

c) Individuals who request to carry out administrative procedures: Birth registration, permanent residence registration, issuance of health insurance cards for children under 6 years of age.

III. REQUIREMENTS, PRINCIPLES AND ORDER OF CARRYING OUT INTER-AGENCY ADMINISTRATIVE PROCEDURES: BIRTH REGISTRATION, PERMANENT RESIDENCE REGISTRATION, ISSUANCE OF HEALTH INSURANCE CARDS FOR CHILDREN UNDER 6 YEARS OF AGE

1. Requirements

a) A person who requests to carry out inter-agency administrative procedures for birth registration, permanent residence registration, and issuance of health insurance cards for children under 6 years of age must only file an application once and may receive multiple outcomes of his/her administrative procedures at the section in charge of receiving application dossiers and giving off outcomes of the commune-level People’s Committee.

b) To apply the principle of re-using outcomes of handled administrative procedures to create favorable conditions and reduce costs for citizens in terms of preparing application dossiers and qualifying the requirements and criteria for handling of their administrative procedures by the State management agencies.

c) To implement the administrative procedures in a timely manner as prescribed by the law provisions.

d) To uphold the responsibility of cadres, civil servants and civil servants of the competent agencies for serving citizens.

2. Principles of handling administrative procedures

a) The People’s Committeeof communes, wards and townships (hereinafter collectively referred to as the commune-level People’s Committees) shall be responsible for the completeness and suitability of the dossiers related to the inter-agency administrative procedures. If the dossiers are not correct or sufficient as prescribed, they shall specifically guide the citizens once to supplement or complete.

b) The commune-level People’s Committees, the police stations of districts, towns and provincial cities (hereinafter collectively referred to as district-level police stations) and the social insurance agencies of districts, towns and provincial cities (hereinafter collectively referred to as district-level social insurance agencies), the police posts of communes and townships (hereinafter collectively referred to as the commune- level police posts) shall be responsible for the handling of each administrative procedure falling under their jurisdiction; jointly solving problems arising in the course of carrying out inter-agency administrative procedures.

c) Individuals who request the handling of administrative procedures on birth registration, permanent residence registration, issuance of health insurance cards for children under 6 years of age many choose whether to carry out such inter-agency administrative procedures or not.

3. Agencies in charge of receiving application dossiers and giving off outcomes

a) Sections of the commune-level People’s Committees in charge of receiving application dossiers and giving off outcomes shall be the agencies in charge of receiving application dossiers and giving off outcomes of inter-agency administrative procedures.

Civil servants at the sections in charge of receiving application dossiers and giving off outcomes of the commune-level People’s Committees shall be responsible for guiding citizens to prepare application dossiers for their inter-agency administrative procedures; and selecting the places of initial medical examination and treatment based on the notice of the social insurance agencies.

b) District-level police stations and social insurance agencies, commune-level police posts shall receive application dossiers transferred by cadres and civil servants of the sections in charge of receiving application dossiers and giving off outcomes of the commune-level People’s Committees, and then handle those within their ambit of jurisdiction, and at the same time send the outcomes to the cadres and civil servants of the sections to provide them to the citizens within the prescribed time limit.

4. Time limit for handling

a) After a maximum time limit of 20 (twenty) working days since the complete application dossiers for inter-agency administrative procedures: birth registration, permanent residence registration, issuance of health insurance cards for children under 6 years of age are filed as prescribed, the applicants shall come to the sections in charge of receiving application dossiers and giving off outcomes of the commune-level People’s Committees where the application dossiers were filed to receive the outcomes.

After a maximum time limit of 15 (fifteen) working days since the complete application dossiers for inter-agency administrative procedures: birth registration, issuance of health insurance cards for children under 6 years of age are filed as prescribed, the applicants shall come to the sections in charge of receiving application dossiers and giving off outcomes of the commune-level People’s Committees where the application dossiers were filed to receive the outcomes.

b) If the sections in charge of receiving application dossiers and giving off outcomes of the commune-level People’s Committees has to re-complete the application dossiers at the request of the police or social insurance agencies, the time limit for handling may be extended, but by no more than 02 (two) working days.

c) If the citizens request to receive the outcomes of each kind of administrative procedures directly at the agency in charge of handling such procedure, when filing the application dossiers at the sections in charge of receiving application dossiers and giving off outcomes of the commune-level People’s Committees, they must give their specific requests in order to be written down the appointment letters and then can receive the outcomes directly at the respective agencies as they request.

d) If the citizens wish to receive the outcomes via the postal service, they shall register with the sections in charge of receiving application dossiers and giving off outcomes of the commune-level People’s Committees. When citizens receive the outcomes at home, they shall pay the postal fees to the postal agencies.

5. The order of carrying out inter-agency administrative procedures: Birth registration, permanent residence registration, issuance of health insurance cards for children under 6 years of age

a) Birth registration - permanent residence registration - issuance of health insurance cards for children under 6 years of age

- Filing application dossiers:

+ Citizens shall file their application dossiers directly at the sections in charge of receiving application dossiers and giving off outcomes of the commune-level People’s Committees and select the places of initial medical examination and treatment for their children based on the notice of the social insurance agencies.

+ A citizen shall file 01 (one) set of documents needed to carry out the procedures for birth registration, permanent residence registration, issuance of health insurance cards for children under 6 years of age, present other relevant papers, and pay initial fees for permanent residence registration as prescribed at the section in charge of receiving application dossiers and giving off outcomes of the commune-level People’s Committee which has the jurisdiction for birth registration. The copy of the child’s birth certificate will be added to the citizen’s application dossier by the cadres or civil servants of the section in charge of receiving application dossiers and giving off outcomes after the commune-level People’s Committee completes the birth registration procedures.

- Receiving application dossiers:

+ Cadres and civil servants of the sections in charge of receiving applications and giving off outcomes of the commune-level People’s Committees, when receiving the application dossiers, shall check the validity and completeness of the documents. If the application dossiers are complete and correct, they will be accepted and the cadres or civil servants shall collect the initial fees for children's permanent residence registration, then make records on receipt of the application dossiers and appointment letters for the citizens to come back for outcomes. The appointment letters must clearly state the citizens’ requests, the documents filed and the time limit for giving off outcomes.

The cadres or civil servants shall also receive requests of citizens on the places of initial medical examination and treatment, which serve as a basis for completing the application dossiers for issuance of the children's health insurance cards

+ If the dossiers are not completed as prescribed, they shall immediately guide citizens to complete them. The instructions for each type of documents that need to be supplemented must be sufficient and clear.

- Handling application dossiers:

+ Handling of administrative procedures by the commune-level People’s Committee:

Immediately after receiving the application dossiers, the cadres and civil servants of the sections in charge of receiving application dossiers and giving off outcomes of the commune-level People’s Committees shall make birth registration dossiers consisting of documents as prescribed by current law provisions and transfer them to the civil servants in charge of civil status and justice.

The civil servants in charge of civil status and justice shall check the application dossiers and conduct birth registration within 01 (one) working day after they receive the complete and valid application dossiers from the sections. After completing the birth registration, the civil servants in charge of civil status and justice shall transfer the original and 02 (two) copies of the birth certificate to the sections in charge of receiving application dossiers and giving off outcomes in order for them to handle other administrative procedures: permanent residence registration and issuance of health insurance cards for children under 6 years of age.

Within 01 (one) working day after they receive the outcomes of birth registration, the sections in charge of receiving application dossiers and giving off outcomes of the commune-level People’s Committees shall: Make permanent residence registration dossiers consisting of documents as prescribed by the current law provisions and transfer the application dossiers and fees to the police stations in charge of children's permanent residence registration, as follows: In the provinces, the application dossiers shall be filed at the police posts of communes and townships in the districts or the police stations of the towns and cities of the provinces; In municipalities, the application dossiers shall be filed at the police stations of districts and towns; prepare application dossiers for issuance of health insurance cards for children under 6 years of age and transfer them to the district-level social insurance agencies.

Depending on actual conditions, the sections in charge of receiving application dossiers and giving off outcomes the commune-level People’s Committees may forward information to the district-level social insurance agencies on electronic networks.

+ Permanent residence registration for children under 6 years of age at the police stations or police posts:

Immediately after receiving the application dossiers transferred by the sections in charge of receiving application dossiers and giving off outcomes the commune-level People’s Committees, the police stations or police posts shall check the legality and completeness of the application dossiers. If the dossiers and fees are complete and in accordance with the law provisions, within 15 (fifteen) working days after they receive the dossiers from the sections in charge of receiving application dossiers and giving off outcomes the commune-level People’s Committees, the police stations or police posts shall conduct permanent residence registration for the children; send outcomes of permanent residence registration and receipts of permanent residence registration fees to cadres and civil servants of the sections in charge of receiving application dossiers and giving off outcomes the commune-level People’s Committees to provide them to the citizens. Cadres and civil servants of the sections in charge of receiving application dossiers and giving off outcomes the commune-level People’s Committees shall check the information about the permanent residence registration outcomes.

If the dossiers are not in compliance with the law provisions, the dossiers shall not be accepted, and the reasons shall be clearly stated in writing enclosed with the dossiers returned to the cadres and civil servants of the sections in charge of receiving application dossiers and giving off outcomes the commune-level People’s Committees.

+ Issuance of health insurance cards for children at the district social insurance agencies:

Immediately after receiving the application dossiers or the information via the electronic networks (hereinafter referred to as the dossiers) sent by the cadres and civil servants of the sections in charge of receiving application dossiers and giving off outcomes the commune-level People’s Committees, the district-level social insurance agencies shall check the legality and completeness of the dossiers. If the dossiers are complete and correct, the health insurance cards shall be issued for the children and within 10 (ten) working days after they receive the dossiers from the sections in charge of receiving application dossiers and giving off outcomes the commune-level People’s Committees, the social insurance agencies shall send the health insurance cards to the cadres and civil servants of the sections in charge of receiving application dossiers and giving off outcomes the commune-level People’s Committees in order for them to provide the cards to the citizens.

If the dossiers are not in compliance with the law provisions, the dossiers shall not be accepted, and the reasons shall be clearly stated in writing enclosed with the dossiers returned to the cadres and civil servants of the sections in charge of receiving application dossiers and giving off outcomes the commune-level People’s Committees.

b) Birth registration – issuance of health insurance cards for children under 6 years of age

The filing, receipt and handling of application dossiers shall comply with the provisions of Point a of this Clause, except for application dossiers for handling of permanent residence registration.

IV. SOLUTIONS

In order to ensure that citizens can enjoy the benefits from the Scheme as soon as possible without waiting for relevant laws (the Law on Civil Status, the Law on Citizen Identification, the Law on Health Insurance) and their guiding documents to be drafted, it is necessary to pay attention to a number of solutions to reform the handling of administrative procedures related to children under 6 years of age as follows:

1. Solutions for organization and implementation

a) Establishing a unified inter-agency single-window mechanism from central to local levels.

Based on the law provisions, the reality as well as the experiences drawn on from the implementation of inter-agency administrative procedures related to children in some localities, this draft Scheme standardizes the order of handling the inter-agency administrative procedures: birth registration, permanent residence registration, issuance of medical insurance cards for children under 6 years of age.

Based on the abovementioned order of handling the inter-agency administrative procedures, concerned ministries shall promulgate a joint circular guiding the implementation of the inter-agency administrative procedure: birth registration, permanent residence registration, issuance of medical insurance cards for children under 6 years of age.

b) The Ministry of Justice shall assume the prime responsibility for, coordinate with the Ministry of Home Affairs, the Ministry of Public Security and the Ministry of Health in directing the People’s Committeeof the provinces and municipalities to organize training courses for cadres and civil servants; give priority to investing in equipment and facilities of agencies in charge of receiving and handling administrative procedures nationwide.

c) Publicly and explicitly carrying out the administrative procedures related to children under 6 years of age

Announcing and publicizing the administrative procedures to serve as a basis for the implementation of them; publishing information on the outcomes of handling administrative procedures related to children under 6 years of age, especially the cases and reasons for requiring citizens to provide additional documents; extending the dissemination drives on mass media and websites of ministries, sectors and localities.

d) Guiding, urging, inspecting and supervising the continuous implementation of inter-agency administrative procedures related to children under 6 years of age.

Intensively guiding, urging, inspecting and supervising the implementation of inter-agency administrative procedures related to children under 6 years of age in the localities; promptly praising and rewarding individuals, agencies and units for good performance; correcting and taking measures to strictly handle individuals, agencies and organizations that do not properly publicize and clarify the administrative procedures, as well as delay and cause difficulties in the implementation of the above-mentioned inter-agency administrative procedures.

Quarterly, the local judicial agencies, police stations and posts, health authorities, social insurance agencies, finance agencies, departments of the interior, and other relevant agencies and units shall hold meetings to draw lessons.

2. Solutions for funding sources

In addition to the funding sources covered by the State budget, agencies and units assigned to the tasks in the Scheme shall actively seek and mobilize other funding sources to successfully implement the Scheme; accurately calculate the needed investment so as to find suitable funding sources, thus ensuring the feasibility, savings and efficiency of the Scheme.

V. ORGANIZATION OF IMPLEMENTATION

1. Building and improving the institutions to ensure the implementation of the inter-agency administrative procedures

Building a joint circular guiding the implementation of the inter-agency administrative procedures: birth registration, permanent residence registration, and issuance of health insurance cards for children under 6 years of age in a unified manner across the whole country.

- In-charge agencies: The Ministry of Justice shall assume the prime responsibility and coordinate with the Ministry of Public Security and the Ministry of Health.

- Coordinating agencies: Relevant ministries, sectors and units.

- Deadline: August 2014.

2. Organizing the implementation the joint circular after it is signed for promulgation.

a) The Ministry of Justice shall:

- Assume the prime responsibility for, and coordinate with the Ministry of Public Security, the Ministry of Health, and the Vietnam Social Security in directing the implementation of the circular as well as organize training courses and provide professional guidelines on the implementation of inter-agency administrative procedures under the jurisdiction of the justice sector, the Public Security Forces, the health sector, and the social insurance sector.

Time for performance: From September 2014 to October 2015.

- Assume the prime responsibility for, and coordinate with the Ministry of Health, the Ministry of Public Security and relevant ministries, sectors and units in inspecting and urging the implementation of the inter-agency administrative procedures. At the same time, assume the prime responsibility for, or coordinate with relevant agencies in promptly removing difficulties and solving problems arising in the course of implementation.

Time for performance: The inspection shall be conducted regularly and timely during the course of implementation of the inter-agency administrative procedures (From October 2014 to November 2015).

- Assume the prime responsibility for, and coordinate with the Ministry of Public Security, the Ministry of Health, and the Vietnam Social Security in preliminarily reviewing the implementation of the inter-agency administrative procedures.

Time for performance: The preliminary results of one (01) year of implementing the inter-agency administrative procedures: birth registration, permanent residence registration, issuance of health insurance cards for children under 6 years of age shall be reviewed in December 2015, and solutions to promote such mechanism shall be proposed at the same time in order to ensure the compliance with the Master Plan to simplify administrative procedures, citizenship papers and databases related to population management in the 2013 - 2020 period (also known as Master Plan 896) as well as the Law on Civil Status and the Law on Citizen Identification.

b) The Ministry of Public Security and the Ministry of Health shall:

- Cooperate with the Ministry of Justice in developing a joint circular guiding the implementation of the inter-agency administrative procedures: birth registration, permanent residence registration, and issuance of health insurance cards for children under 6 years of age;

- Direct and guide the implementation of the inter-agency administrative procedures within the ambit of their management, and at the same time assume the prime responsibility for, or coordinate with relevant agencies in promptly removing difficulties and solving problems arising in the course of implementation;

- Direct the Police Departments of provinces and municipalities, and the provincial/municipal Departments of Health to coordinate with the provincial/municipal Departments of Justice in organizing the implementation of the inter-agency administrative procedures in their respective localities;

- Coordinate in conducting inter-sectoral inspection of the implementation of the inter-agency administrative procedures in reality, whose results will serve as a basis for proposing measures to rectify or remove arising difficulties and problems.

c) The Vietnam Social Security shall:

- Direct the implementation and provide professional guidelines for implementing the administrative procedures within the sector. At the same time, assume the prime responsibility for, or coordinate with relevant agencies in promptly removing difficulties and solving problems arising in the course of implementation;

- Direct the social insurance agencies of provinces and municipalities to coordinate with the provincial/municipal Departments of Justice in organizing the implementation of inter-agency administrative procedures in their respective localities;

- Coordinate in conducting inter-sectoral inspection of the implementation of the inter-agency administrative procedures in reality, whose results will serve as a basis for proposing measures to rectify or remove arising difficulties and problems.

dd) The Ministry of Labor, Invalids and Social Affairs shall:

Direct relevant units in the sector to coordinate with relevant agencies and units in implementing the inter-agency administrative procedures: birth registration, permanent residence registration, issuance of health insurance cards for children under 6 years of age so as to well perform the tasks of child protection and care of the sector.

dd) ThMinistry of Information and Communications shall:

Coordinate with the provincial-level People’s Committees in promoting the application of information technology to implementing the inter-agency administrative procedures.

e) The Ministry of Finance shall:

Direct the provincial/municipal Departments of Finance to coordinate with functional agencies under the People’s Committeeof provinces and municipalities in ensuring the state budget for the implementation of the inter-agency administrative procedures in reality.

g) The Ministry of Home Affairs shall

- Coordinate with ministries, sectors and People’s Committees of provinces and municipalities (hereinafter referred to as provincial-level People’s Committees) in directing, urging and inspecting the implementation of the inter-administrative procedures in accordance with the Decision of the Prime Minister;

- Direct the provincial/municipal Departments of Home Affairs to advise the provincial-level People’s Committees to ensure the benefits and preferential policies for cadres and civil servants working at the single-window sections and inter-agency single-window sections.

h) The provincial-level People’s Committees shall:

- Direct and guide the district- and commune-level People’s Committees to implement the inter-agency administrative procedures: birth registration, permanent residence registration, issuance of health insurance cards for children under 6 years of age, thus ensuring the uniformity and consistency throughout their respective provincial-level localities;

- Organize training courses and provide professional guidelines for the implementation of the inter-agency administrative procedures: birth registration, permanent residence registration, issuance of health insurance cards for children under 6 years of age for the corps of local cadres and civil servants, public employees in charge of carrying out inter-agency administrative procedures in their respective provincial-level localities;

- Inspect the implementation and seek measures to remove difficulties and obstacles arising in the course of implementing the inter-agency administrative procedures;

- Allocate funds to organize the implementation of the above-mentioned inter-agency administrative procedures from local funds for administrative reform and other sources as prescribed by the Law on Budget and other current laws. Intensify the investment in equipment and facilities for the commune-level People’s Committees for them to gradually modernize the reception and handling of administrative procedures for local citizens;

- Assign the provincial/municipal Departments of Justice to assume the prime responsibility for, and coordinate with the Police Departments and social insurance agencies of provinces and municipalities, the provincial/municipal Department of Health, Department of Home Affairs, Department of Finance in organizing, inspecting, urging, and preliminarily reviewing the implementation of the inter-agency administrative procedures in their respective localities;

- In the course of implementation, if there are any difficulties or problems arising, they shall report them to the Ministry of Justice to promptly remove and ensure the effective implementation of the tasks in the Scheme as scheduled.

i) The district-level People’s Committees shall

- Direct the commune-level People’s Committees, district-level police stations, commune-level police posts, and district-level social insurance agencies to implement the inter-agency administrative procedures: birth registration, permanent residence registration, issuance of health insurance cards for children under 6 years of age in their respective localities;

- Organize training courses and provide professional guidelines for the corps of local cadres and civil servants, public employees in charge of carrying out the above-mentioned inter-agency administrative procedures in their respective localities;

- Inspect, evaluate, promptly remove difficulties and solve problems arising in the course of implementing the above-mentioned inter-agency administrative procedures in their respective localities;

- Ensure funds and facilities for the commune-level People’s Committees to implement the inter-agency administrative procedures: birth registration, permanent residence registration, issuance of health insurance cards for children under 6 years of age;

k) The commune-level People’s Committees shall:

- Implement the inter-agency administrative procedures: birth registration, permanent residence registration, issuance of health insurance cards for children under 6 years of age in their respective localities;

- Sections of the commune-level People’s Committees in charge of receiving application dossiers and giving off outcomes shall be the agencies in charge of receiving application dossiers and giving off outcomes of inter-agency administrative procedures.

- Arrange qualified and capable staff to carry out the inter-agency administrative procedures;

- Pay attention to investing in equipment and facilities meeting the requirements of their assigned tasks;

- Publicize the order of handling the inter-agency administrative procedures: birth registration, permanent residence registration, issuance of health insurance cards for children under 6 years of age at the headquarters of the commune-level People’s Committees;

- Provide support for cadres and civil servants in charge of carrying out the above-mentioned administrative procedures in accordance with the law provisions;

- Promptly report to the district-level People’s Committees about the difficulties and problems arising in the course of implementation for consideration and solutions;

- Annually, based on the tasks assigned in this Circular, the commune-level People’s Committees shall summarize the estimates for task performance of the agencies and units under their management and send them to the financial agencies for summarization and submission to competent authorities so as to allocate funds. At the same time, they may raise funds from domestic and foreign organizations in accordance with the law provisions.

VI. RESOURCES FOR IMPLEMENTATION

1. In terms of funding sources

Funds for implementing the Scheme shall be covered by the State budget in accordance with current law provisions on decentralization of the State budget and other lawful funding sources. Annually, based on the tasks assigned in the Scheme, the agencies and units responsible for implementing the Scheme summarize the estimates for task performance and send them to the financial agencies for summarization and submission to competent authorities so as to allocate funds. At the same time, they may raise funds from domestic and foreign organizations in accordance with the law provisions.

The local authorities and units shall, depending on the actual situation, stipulate the level of support for cadres and civil servants in charge of carrying out inter-agency administrative procedures in their respective localities and units in accordance with the current law provisions.

2. In terms of human resources

Human resources for implementing the Scheme are cadres, civil servants and public employees of ministries, ministerial-level agencies, government-attached agencies, and relevant local agencies which are responsible for implementing the Scheme in accordance with their assigned tasks.

Article 2. This Decision takes effect from the date of signing for promulgation.

Article 3. Ministers, Heads of ministerial-level agencies, Heads of Government-attached agencies, Chairpersons of People’s Committees of provinces and municipalities shall be responsible for implementing this Decision./.
