CIRCULAR
Guiding a number of articles of the Law on Animal Husbandry regarding animal husbandry activities[1]
Pursuant to the Government’s Decree No. 15/2017/ND-CP of February 17, 2017, defining the functions, tasks, powers and organizational structure of the Ministry of Agriculture and Rural Development;
Pursuant to the November 19, 2018 Law on Animal Husbandry;
At the proposal of the Director of the Department of Livestock Production;
The Minister of Agriculture and Rural Development promulgates the Circular guiding a number of articles of the Law on Animal Husbandry regarding animal husbandry activities.
Chapter I
GENERAL PROVISIONS
Article 1.Scope of regulation
1. This Circular guides Clause 3, Article 8; Point a, Clause 2, Article 23; Clause 2, Article 54; Clause 3, Article 55; and Clause 3, Article 65, of the Law on Animal Husbandry.
2. Criteria for and recognition of epidemic-free animal husbandry zones must comply with the Minister of Agriculture and Rural Development’s Circular No. 14/2016/TT-BNNPTNT of June 2, 2016, on animal epidemic-free zones and facilities.
Article 2.Subjects of application
This Circular applies to domestic and foreign organizations and individuals involved in animal husbandry activities in Vietnam.
Chapter II
SPECIFIC PROVISIONS
Article 3.Certificates of training in artificial insemination or training in domestic animal breeding embryo transplantation techniques
1. The Department of Livestock Production shall formulate framework training contents, programs and duration of artificial insemination or embryo transplantation techniques for buffaloes, cows, goats, sheep and horses.
2. Organizations with the function of training in the field of animal husbandry shall formulate detailed training contents and programs based on framework training contents and programs of the Department of Livestock Production; and organize training and grant certificates of training in artificial insemination or training in domestic animal breeding embryo transplantation techniques according to the form provided in Appendix I to this Circular.
Article 4.Declaration of animal husbandry activities
1. Organizations and individuals engaged in animal husbandry shall declare their animal husbandry activities regarding types and number of domestic animals specified in Appendix II to this Circular.
2. Organizations and individuals engaged in animal husbandry shall declare their animal husbandry activities from the 25thto the 30thday of the last month of a quarter according to the form provided in Appendix III to this Circular.
Article 5.Safety distances in farm-based animal husbandry
1. Principles of determining distances in farm-based animal husbandry
a/ The distance from an animal husbandry farm to subjects affected by animal husbandry activities shall be the shortest distance from a stable or an area storing animal wastes to fences or boundaries of affected subjects;
b/ The distance from one animal husbandry farm to another shall be the shortest distance from one stable or area containing animal wastes to another.
2. The distance from a small-sized animal husbandry farm to a concentrated area for treatment of household and industrial wastes or a residential area must be at least 100 meters; or at least 150 meters, to a school, hospital, market or water supply source for the residential community.
3. The distance from a medium-sized animal husbandry farm to a concentrated area for treatment of household and industrial wastes or a residential area must be at least 200 meters; or at least 300 meters, to a school, hospital or market.
4. The distance from a large-sized animal husbandry farm to a concentrated area for treatment of household and industrial wastes or a residential area must be at least 400 meters; or at least 500 meters, to a school, hospital, market or water supply source for the residential community.
5. The distance between 2 breeding farms of 2 different entities must be at least 50 meters.
Article 6.Distance between honeybee hive locations and methods of moving honeybee colonies
1. Distance between honeybee hive locations
a/ A honeybee hive location must have at least 50 domestic or 100 foreign bee colonies;
b/ The minimum distance between 2 domestic bee hive locations is one kilometer; oe 2 kilometers between 2 foreign bee hive locations or between a domestic bee hive location and a foreign bee hive location.
2. Methods of moving honeybee colonies
A moving honeybee colony must have clear origin; a schedule before the move; and appropriate means to ensure biosafety for bee colonies and safety for people and the environment.
Chapter III
ORGANIZATION OF IMPLEMENTATION
Article 7.Responsibilities of organizations and individuals
1. The Department of Livestock Production shall:
a/ Organize the declaration of animal husbandry activities and contents related to animal husbandry activities nationwide.
b/ Develop framework programs (contents and time) on training in artificial insemination or embryo transplantation techniques for buffaloes, cows, goats, sheep and horses.
c/ Carry out inspection and examination of animal husbandry activities nationwide.
2. Provincial-level Departments of Agriculture and Rural Development shall:
a/ Organize the implementation of contents related to animal husbandry activities specified in this Circular in their localities;
b/ Carry out inspection and examination of animal husbandry activities in their localities;
c/ Summarize and report on results of the declaration of animal husbandry activities in their localities to the Department of Livestock Production before the 10thof the first month of a subsequent quarter or at the request of competent agencies.
3. Organizations and individuals engaged in animal husbandry shall comply with this Circular and relevant regulations.
Article 8.Transitional provisions
Certificates of training in artificial insemination or training in embryo transplantation techniques granted before the effective date of this Circular remain valid.
Article 9.Effect
This Circular takes effect on January 15, 2020.
Any problems arising in the course of implementation of this Circular should be promptly reported in writing to the Ministry of Agriculture and Rural Development for amendment and supplementation.-
