SUMMARY

The Government approves the task of formulating the national master plan

On May 12, 2020, the Government issues the Resolution No. 67/NQ-CP on approving the task of formulating the national master plan on land use for the 2021-2030 period, with a vision toward 2050.

Accordingly, national master plan on land use for the 2021-2030 period, with a vision toward 2050 and the national land use plan for 05 years (from 2021 - 2025) shall be implemented on the whole natural land area of the country.

With the viewpoint that land is a special natural resource of the country, the master plan aims to concretize the national overall master plan on distribution and zoning of land areas for sectors and localities; use land properly, economically and effectively; protect the eco-environment, prevent and combat natural disasters, adapt to climate change, and ensure sustainable development with a view to tapping to the utmost land potential and resources, meeting industrialization and modernization requirements, restructuring the economy, ensuring national food security and achievement of socio-economic development, national defense and security objectives of the country.

The Government requests that, the time limit for formulating the Master Plan is 30 months from the date of approval of the task of formulating the master plan.

RESOLUTION

Approving the task of formulating the national master plan on land use for the 2021-2030 period, with a vision toward 2050[1]

 

THE GOVERNMENT

Pursuant to the June 19, 2015 Law on Organization of the Government;

Pursuant to the November 24, 2017 Planning Law;

Pursuant to the November 20, 2018 Law Amending and Supplementing a Number of Articles of 37 Laws concerning Planning;

Pursuant to the National Assembly Standing Committee’s Resolution No. 751/2019/UBTVQH14 of August 16, 2019, on explanation of a number of articles of the Planning Law;

Pursuant to the Government’s Decree No. 37/2019/ND-CP of May 7, 2019, detailing a number of articles of the Planning Law;

Pursuant to the Government’s Decree No. 138/2016/ND-CP of October 1, 2016, promulgating the Working Regulation of the Government;

Based on the report appraising the task of formulating the national master plan on land use for the 2021-2030 period, with a vision toward 2050;

At the proposal of the Ministry of Natural Resources and Environment in Report No. 105/TTr-BTNMT of December 31, 2019, and Official Letter No. 2230/BTNTM-TCQLDD of April 23, 2020, on assimilation and explanation of opinions of the cabinet members on the draft resolution approving the task of formulating the national master plan on land use for the 2021-2030 period, with a vision toward 2050,

 

RESOLVES:

Article 1.To approve the task of formulating the national master plan on land use for the 2021-2030 period, with a vision toward 2050 (below referred to as the Master Plan), with the following principal contents:

1. Title, boundaries and period of the Master Plan

a/ Title of the Master Plan: National master plan on land use for the 2021-2030 period, with a vision toward 2050.

b/ Boundaries and period of the Master Plan

- Boundaries of the Master Plan: The Master Plan and the five-year (2021-2025) national land use plan shall be implemented on the whole natural land area of the country.

- Period of the Master Plan: 2021-2030, with a vision toward 2050.

2. Viewpoints, objectives and principles

a/ Viewpoints

- Land is a special resource of the country, and an important resource for national development. Therefore, the land use master plan must ensure economical, effective and sustainable land use, thereby increasing economic and financial value of land, so as to bring about the highest land use efficiency while achieving both immediate and long-term objectives of socio-economic development and national defense and security assurance.

- The land use master plan serves as a fundamental master plan,  conforms to the national overall master plan, and is associated with sectoral, regional and local master plans in order to create inter-regional and inter-provincial connectivity with a view to tapping land-related advantages and potential of each region or locality; and serves as a basis for land use restructuring together with economic restructuring and labor distribution to meet industrialization, modernization and international economic integration requirements.

- To strictly protect land areas for paddy, protection forests, special-use forests, nature reserves, production forests being natural forests, and relics and tourist attractions in order to ensure national food security and manage forest areas in a sustainable manner; to ensure harmony of socio-economic development and national defense and security objectives; to protect eco-environmental landscapes and biodiversity; to protect water sources, and adapt to climate change and sea level rise.

- To develop land areas through reclamation and sea-encroaching activities; to build underground works in areas where conditions permit; to build infrastructure facilities and develop industries, services and tourism for exploiting and effectively using land potential in midland, mountainous, border and coastal areas and on islands. To permit the use of current paddy land in areas affected by saltwater intrusion, drought or flood for other purposes, and relocate polluting production establishments out of city centers with a view to raising land use efficiency and mitigating environmental pollution.

- To reserve sufficient land areas for building complete infrastructure facilities with a focus on development of key infrastructure facilities with spillover effect; to meet the demand for land for urban, industrial and service development in the process of industrialization, modernization and new-style countryside building, particularly in mountainous and border areas and on islands, with a view to attracting all resources for efficiently exploiting land areas.

- To absorb and apply scientific and technological advances of foreign countries in the world and the region; to inherit existing achievements for increasing quality, efficiency and feasibility and meeting the requirement for renewal of the mechanism for management of the socialist-oriented market economy.

b/ Objectives

The Master Plan aims to concretize the national overall master plan on distribution and zoning of land areas for sectors and localities; use land properly, economically and efficiently; protect the eco-environment, prevent and control natural disasters, adapt to climate change, and ensure sustainable development with a view to tapping to the utmost land-related potential and resources, meeting industrialization, modernization and economic restructuring requirements, ensuring national food security and achievement of national socio-economic development and national defense and security objectives.

c/ Principles

- To ensure uniformity and consistency between the Master Plan and relevant socio-economic development strategies and plans and combination of sector-based management with territory-based management; to ensure national defense and security and environmental protection.

- To ensure compliance, perpetuity, stability and hierarchy in the system of national master plans.

- To ensure participation of the people as well as agencies, organizations, communities and individuals; to ensure harmony of interests of the country, regions, localities and the people, with the national interests being the supreme; to adhere to the gender equality principle.

- To ensure scientificity applicability of modern technologies, connectivity, forecast, feasibility, and efficiency of resources of the country; to ensure objectivity, publicity, transparency and conservation.

- The national master plan on land use must ensure specific characteristics of and connectivity among regions. To ensure balance between land use demand of sectors and localities and capacity of national land areas for the purpose of ensuring economical and efficient land use.

- Contents on land distribution and use in national-level sectoral master plans, regional master plans and provincial master plans must be conformable with the national master plan on land use.

- To ensure resources for implementation of the Master Plan.

3. Contents of the Master Plan

a/ Regarding the national master plan on land use for the 2021-2030 period

- Survey, collection and general evaluation of land use information, documents and status.

- Analysis and evaluation of natural elements and conditions, resources and circumstances with direct impacts on, and land use status of, sectors.

- Forecast of possible changes in land use in the period.

- Identification of land use viewpoints and objectives in the period.

- Formulation of land use option plans through 2030 which must meet national goals on socio-economic development, national defense and security maintenance, environmental protection, disaster prevention and control, and climate change response.

- Identification and zoning of land areas based on national-level land use criteria through 2030: paddy land areas (including land areas exclusively for wet rice cultivation to be strictly protected); land areas under protection forests; land areas under special-use forests; land areas under production forests (including land areas under production forests being natural forests); land areas for industrial parks; land areas for economic zones; land areas for hi-tech parks; urban land areas; land areas for national defense purposes; land areas for security purposes; land areas for national-level infrastructure development, including land areas for traffic, land areas for construction of cultural facilities, land areas for construction of health facilities, land areas for construction of education and training institutions, land areas for construction of physical training and sports facilities, land areas for energy facilities, and land areas for post and telecommunications works; land areas for construction of national reserves storehouses, and land areas with historical-cultural relics; land areas for landfills or waste treatment facilities; and unused land areas, including unused land areas to be used in the planning period and other unused land areas.

- Drawing of maps of the national master plan on land use.

- Assessment of economic, social, environmental and national defense and security impacts of option plans on distribution and organization of land use space.

- Proposal of solutions and resources for implementation of the Master Plan.

b/ Regarding the five-year (2021-2025) national land use plan:

- Analysis and evaluation of results of implementation of the national land use plan of the previous period.

- Determination of areas of land of different categories in the national master plan on land use in each period of the five-year (2021-2025) national land use plan.

- Five-year (2021-2025) land use plans for socio-economic regions and provincial-level administrative units.

- Solutions for implementation of the land use plan.

c/ Land use vision toward 2050

- Identification of land use viewpoints and objectives based on forecasts about socio-economic development, population and urban areas, and industrialization and modernization requirements.

- Identification of land use vision toward 2050 which must meet development requirements of the country and adapt to climate change: paddy land areas; land areas under protection forests; land areas under special-use forests; land areas under production forests; land areas for industrial parks; land areas for economic zones; land areas for hi-tech parks; urban land areas; land areas for national defense purposes; land areas for security purposes; and land areas for national-level infrastructure development.

d/ Strategic environmental assessment for the Master Plan

- Survey and collection of information, documents and figures on status of the natural environment, and causes of environmental changes which are related to the formulation of the national-level master plan on land use through 2030.

- Determination of legal and technical grounds for strategic environmental assessment; organization of strategic environmental assessment; summarization of contents of the Master Plan.

- Scope of strategic environmental assessment, and natural environmental and socio-economic conditions.

- Evaluation of the Master Plan’s environmental impacts.

- Proposal of solutions to maintain positive trends and minimize negative trends of major environmental issues in the course of implementation of the Master Plan.

- Environment management and monitoring plans.

- Consultation in the course of strategic environmental assessment.

- Making of explanatory reports on strategic environmental assessment of the Master Plan.

dd/ Making of a report on the Master Plan.

e/ Processing and integration of strategic environmental assessment reports into the report on the Master Plan.

g/ Development of a database of the Master Plan.

h/ Organization of conferences and scientific workshops; consultation and collection of community opinions.

i/ Appraisal and approval of the Master Plan and national land use plan for the 2021-2030 period, with a vision toward 2050.

k/ Publicization of the Master Plan and national land use plan for the 2021-2030 period, with a vision toward 2050.

4. Approaches of formulating the Master Plan

The Master Plan shall be formulated by two-level (macro- and micro-level) approach with the participation of ministries, sectors and localities; objects of the Master Plan shall be placed in multidisciplinary and multi-sectoral relations of different factors impacting land use. In the process of formulating the Master Plan, the following approaches may be applied:

a/ Secondary and primary survey.

b/ Data synthesis, analysis and processing.

c/ Spatial analysis and multi-criteria analysis on the basis of application of Geographic Information System (GIS).

d/ Qualitative and quantitative analysis.

dd/ Combined macro- and micro-level analysis.

e/ Mathematical economics and forecast.

g/ Expert method.

5. Time limit for formulating the Master Plan

The time limit for formulating the Master Plan is 30 months from the date of approval of the task of formulating the Master Plan.

6. Composition, quantity, criteria and format of dossiers of the Master Plan

a/ The Government’s report to the National Assembly for approval of the Master Plan;

b/ The National Assembly’s resolution approving the Master Plan;

c/ A report on the Master Plan;

d/ A report summarizing opinions of agencies, organizations, communities and individuals on the Master Plan; copies of papers stating opinions of related ministries, ministerial-level agencies and localities; a report explaining and assimilating opinions on the Master Plan;

dd/ An explanatory report on strategic environmental assessment of the Master Plan.

e/ Maps

A map of national land use status; a map of national land use orientations and a map of the national land use master plan; for the scale of paper maps must be 1:1,000,000; for the scale of digital maps must be 1:100,000-1:1,000,000

Maps of national land use master plans by socio-economic region: for the scale of paper maps must be 1:250,000; the scale of digital maps must be 1:50,000-1:250,000

(The documents mentioned at Points a, b, c, d and dd include paper and digital ones).

A disk drive D for storing the database of the Master Plan.

7. Expenses for formulation of the Master Plan

a/ Expenses for activities of the Master Plan, and expenses for strategic environmental assessment of the Master Plan shall be covered by public investment funds.

b/ Expenses for formulation of the five-year (2021-2025) national land use plan shall be covered by the source of expenditures for economic activities.

Article 2.Organization of implementation

1. The Ministry of Natural Resources and Environment shall:

a/ Approve detailed cost estimates for, and select a unit to formulate, the Master Plan under current regulations.

b/ Formulate a plan on implementation of the Master Plan and promptly report to the National Planning Council on the formulation of the Master Plan as well as issues falling beyond its competence.

c/ Approve adjustments and supplementations to the task of formulating the Master Plan when there arise issues in the course of formulation of the Master Plan and the five-year (2021-2025) national land use plan, which, however, must not change the task’s objectives.

2. Ministries and sectors shall:

a/ Report on the land use status during 2011-2020 under their management; and propose land use needs for the 2021-2030 period, with a vision toward 2050, the five-year (2021-2025) land use plan, and the list of land-using key works and projects, to the Ministry of Natural Resources and Environment.

b/ Coordinate with the Ministry of Natural Resources and Environment in providing land use-related sectoral development strategies and master plans in the 2021-2030 period, with a vision to 2050 (including their drafts); and information, documents, figures and maps.

3. Provincial-level People’s Committees shall:

a/ Report on the implementation of the land use master plan and plan in the 2021-2020 period and propose their local land use needs for the 2021-2030 period, with a vision toward 2050, the five-year (2021-2025) land use plan, and the list of land-using key works and projects, to the Ministry of Natural Resources and Environment.

b/ Coordinate with the Ministry of Natural Resources and Environment in providing information, documents and figures of localities which are related to the formulation of the national land use master plan.

4. In the course of formulating the Master Plan and the five-year (2021-2025) land use plan, organizations providing consultancy on formulation of the Master Plan may select domestic and foreign experts in accordance with law.

5. Coordination mechanism: Ministries, sectors and localities shall, within the ambit of their functions and tasks, promptly exchange and provide accurate information in the fields under their management serving the formulation of the Master Plan and creation of framework data for the information system and database of the national master plan on land use.

Article 3.The Chairperson, vice chairpersons, members and Standing Body of the National Planning Council defined in the Prime Minister’s Decision No. 1226/QD-TTg of September 24, 2018; ministers, and heads of ministerial-level agencies and government-attached agencies shall implement this Resolution.
