RESOLUTION

On the promulgation of a number of mechanisms to handle difficulties and obstacles arising from legal regulations on social housing development

Pursuant to Law No. 63/2025/QH15 on Organization of the Government;

Pursuant to Law No. 72/2025/QH15 on Organization of Local Administration;

Pursuant to Housing Law No. 27/2023/QH15;

Pursuant to Land Law No. 31/2024/QH15, which has a number of articles amended and supplemented by Laws No. 43/2024/QH15, No. 47/2024/QH15, No. 58/2024/QH15, No. 71/2025/QH15, No. 84/2025/QH15, No. 93/2025/QH15, No. 95/2025/QH15, No. 146/2025/QH15, and No. 147/2025/QH15;

Pursuant to the June 29, 2024 Law Amending and Supplementing a Number of Articles of Land Law No. 31/2024/QH15, Housing Law No. 27/2023/QH15, Law No. 29/2023/QH15 on Real Estate Business, and Law No. 32/2024/QH15 on Credit Institutions;

Pursuant to Law No. 47/2025/QH15 on Urban and Rural Planning;

Pursuant to the National Assembly’s Resolution No. 201/2025/QH15, on pilot implementation of a number of particular mechanisms and policies for social housing development;

Pursuant to the National Assembly’s Resolution No. 206/2025/QH15, on the special mechanism for handling of difficulties and obstacles arising from legal regulations;

At the proposal of the Minister of Construction;

The Government promulgates the Resolution on the promulgation of a number of mechanisms to handle difficulties and obstacles arising from legal regulations on social housing development.

Article 1. Scope of regulation and subjects of application

1. This Resolution provides a number of mechanisms and policies to remove difficulties and obstacles in social housing development.

2. This Resolution applies to state agencies, organizations and individuals involved in social housing development.

Article 2. Mechanisms on handling of difficulties and obstacles

1. The handling of difficulties and obstacles in planning for investment projects on construction of social houses and houses for the people’s armed forces shall be as follows:

a/ Regulations on handling of difficulties and obstacles in the formulation, adjustment and approval of zoning master plans for areas in which urban centers will be established upon the arrangement of administrative units at all levels and organization of the two-tier local administration must comply with the law on urban and rural planning;

b/ Detailed master plans shall be formulated and adjusted concurrently with the formulation and adjustment of zoning master plans or general master plans in case the formulation of zoning master plans is not required, and shall be approved after the general master plans and zoning master plans are approved;

c/ The approval of investment policy concurrently with assignment of a project owner in case a land parcel has not yet been identified or is not conformable with urban and rural planning must comply with provisions regarding on pilot implementation of a number of particular mechanisms and policies for social housing development.

2. In centrally-run cities and areas within the administrative boundaries of wards in provinces, social houses and houses for the people’s armed forces are condominiums. For other areas, the provincial-level People's Councils shall decide on the types of social houses and houses for the people’s armed forces, meeting localities’ actual states in accordance with law

3. Households and individuals whose land and houses are recovered by the State for national defense or security purposes, or socio-economic development for national and public interests in accordance with law, but have not yet received compensation in house or residential land from the State, may purchase or lease-purchase social houses without having to draw lots and meet the prescribed housing or income conditions.

4. Indefinite-term contract employees who are salaried by the state budget in public security units may purchase, lease-purchase or rent houses for the people's armed forces.

The housing and income conditions for these subjects to be eligible for housing support policies shall be applied like those prescribed in Clause 5, Article 76 of the Housing Law.

Article 3. Effect

 1. This Resolution takes effect on February 13, 2026, and shall be implemented until February 28, 2027.

2. In case laws or resolutions of the National Assembly, ordinances or resolutions of the National Assembly Standing Committee which are amended, supplemented or promulgated take effect after the adoption of this Resolution and before February 28, 2027, the corresponding provisions in this Resolution shall cease to be effective.

3. In case legal documents referred to in this Resolution are amended, supplemented or replaced, the corresponding provisions of the amending, supplementing or replacing documents shall apply.

4. During the effective period of this Resolution, if the provisions on the competence, state management responsibilities, order and procedures in this Resolution are different from relevant legal documents, the provisions of this Resolution shall prevail.

Article 4. Implementation responsibility

1. Ministers, heads of ministerial-level agencies, heads of government-attached agencies, and chairpersons of provincial-level People's Committees shall implement this Resolution.

2. The Ministry of Construction shall advise the Government on reports to the National Assembly Standing Committee and the National Assembly at the upcoming session or meeting after the Resolution is promulgated; and, within the ambit of its functions and tasks, review and propose amendments and supplementations to relevant contents of the Housing Law to ensure its consistency and uniformity.

3. The Ministry of Agriculture and Environment shall, within the ambit of its functions and tasks, review and propose amendments to the Land Law to ensure its consistency and uniformity.

4. Provincial-level People's Committees shall direct the organization of implementation of this Resolution, ensuring publicity, transparency and effectiveness; preventing loopholes, corruption, negative practices, policy abuse, losses, and waste.

5. People's Councils, Committees of People's Councils, People's Council deputies, and the Vietnam Fatherland Front at all levels shall, within the ambit of their respective tasks and powers, strengthen the oversight of the implementation of this Resolution.

The Ministry of Construction, related ministries and sectors, and People's Committees at all levels shall strictly comply with the results of the National Assembly's oversight of this Resolution (if any).-
