 CIRCULAR

On promulgation of the National technical regulation for fluid milk products

Pursuant to the Law on Promulgation of Legal Documents No. 64/2025/QH15, which was amended and supplemented under Law No. 87/2025/QH15;

Pursuant to the Law on Food Safety No. 55/2010/QH12;

Pursuant to the Law Amending and Supplementing a Number of Articles of the Law on Standards and Technical Regulations No. 70/2025/QH15;

Pursuant to the Law Amending and Supplementing a Number of Articles of the Law on Product and Goods Quality No. 78/2025/QH15;

Pursuant to the Government’s Decree No. 46/2026/ND-CP dated January 26, 2026, detailing a number of articles of, and providing measures for organizing and guiding the implementation of, the Law on Food Safety;

Pursuant to the Government's Resolution No. 09/2026/NQ-CP dated February 04, 2026, on suspension of effect and adjustment of the effective date of the Government’s Decree No. 46/2026/ND-CP dated January 26, 2026, detailing the implementation of a number of articles of, and providing measures for organizing and guiding the implementation of, the Law on Food Safety, and the Government’s Resolution No. 66.13/2026/NQ-CP dated January 27, 2026, on announcement and registration of food products;

Pursuant to the Government’s Decree No. 22/2026/ND-CP dated January 16, 2026, detailing a number of articles of, and providing measures for organizing and guiding the implementation of, the Law on Standards and Technical Regulations;

Pursuant to the Government’s Decree No. 37/2026/ND-CP dated January 23, 2026, detailing a number of articles of, and providing measures for organizing and guiding the implementation of, the Law on Product and Goods Quality;

Pursuant to the Prime Minister's Decision No. 309/QD-TTg dated February 23, 2026, approving the Strategy for Development of the Dairy Industry through 2030, with a vision towards 2045;

Pursuant to the Government’s Decree No. 40/2025/ND-CP dated February 26, 2025, defining the functions, tasks, powers and organizational structure of the Ministry of Industry and Trade, amended and supplemented under Decree No. 109/2025/ND-CP and Decree No. 193/2025/ND-CP;

At the proposal of the Director of the Agency for Innovation, Green Transition and Industry Promotion;

The Minister of Industry and Trade hereby promulgates the Circular on promulgation of the National technical regulation for fluid milk products.

Article 1. To promulgate together with this Circular the National technical regulation for fluid milk products.

Article 2. Effect

This Circular takes effect from September 01, 2026.

Article 3. Transitional provisions

For fluid milk products that have been self-declared prior to the effective date of this Circular, organizations and individuals may continue to manufacture, trade in, and import such products until the registration of the declaration of conformity has been completed.

Organizations and individuals shall be responsible for completing the registration of the declaration of conformity for fluid milk products within the time limit prescribed under the applicable regulations.

Article 4. Where the provisions of law referred to in this Circular are amended or replaced, the new legal documents shall prevail.

Article 5. Implementation organization

1. The Director of the Industry Agency shall organize, guide, disseminate, communicate, and implement this Circular.

2. Ministers, Heads of ministerial-level agencies, Heads of Government-attached agencies, Chairpersons of the People’s Committees of provinces and centrally-run cities; Heads of agencies and units under and attached to the Ministry of Industry and Trade; and organizations and individuals involved in the manufacture, importation, trading, circulation, and exportation of fluid milk products shall implement this Circular.

3. Any difficulties arising in the course of implementation should be promptly reported to the Ministry of Industry and Trade (the Industry Agency) for guidance or study for appropriate amendment and supplementation./.
