CIRCULAR
Promulgating the List of pesticides permitted for use in Vietnam and the List of pesticides banned from use in Vietnam
Pursuant to the Law on Plant Protection and Quarantine dated November 25, 2013;
Pursuant to the Government’s Decree No. 105/2022/ND-CP dated December 22, 2022, defining the functions, tasks, powers and organizational structure of the Ministry of Agriculture and Rural Development;
At the proposal of the Director of the Plant Protection Department;
The Minister of Agriculture and Rural Development hereby promulgates the Circular promulgating the List of pesticides permitted for use in Vietnam and the List of pesticides banned from use in Vietnam.
Article 1. To promulgate together with this Circular
1. The List of pesticides permitted for use in Vietnam, provided in Appendix I to this Circular, including:
a) Pesticides for use in agriculture:
- Insecticides: 712 active ingredients with 1,725 trade names.
- Fungicides: 683 active ingredients with 1,561 trade names.
- Herbicides: 260 active ingredients with 791 trade names.
- Rat killers: 08 active ingredients with 43 trade names.
- Growth regulators: 60 active ingredients with 178 trade names.
- Insect attractants: 08 active ingredients with 08 trade names.
- Snail killers: 31 active ingredients with 152 trade names.
- Adjuvants (spreaders): 05 active ingredients with 06 trade names.
b) Termiticides: 16 active ingredients with 23 trade names.
c) Forest product preservatives: 07 active ingredients with 08 trade names.
d) Warehouse disinfectants: 03 active ingredients with 09 trade names.
dd) Pesticides for use for golf courses:
- Fungicides: 02 active ingredients with 02 trade names.
- Herbicides: 01 active ingredients with 01 trade names.
- Growth regulators: 01 active ingredients with 01 trade names.
e) Seed treatments:
- Insecticides: 10 active ingredients with 16 trade names.
- Fungicides: 12 active ingredients with 12 trade names.
g) Post-harvest preservatives for agricultural products
- 01 active ingredients with 01 trade names.
2. The List of pesticides banned from use in Vietnam, provided in Appendix II to this Circular, including:
a) Insecticides and forest product preservatives: 23 active ingredients.
b) Fungicides: 06 active ingredients.
c) Rat killers: 01 active ingredients.
d) Herbicides: 01 active ingredients.
3. The table of HS codes for pesticides permitted for use or banned from use in Vietnam must comply with Sections 22 and 23 of Appendix I to the Minister of Agriculture and Rural Development’s Circular No. 11/2021/TT-BNNPTNT dated September 20, 2021, promulgating tables of HS codes for the list of goods falling under the state management by the Ministry of Agriculture and Rural Development and the list of imported and exported goods subject to specialized inspection in the field of agriculture and rural development. In case the legal documents promulgating tables of HS codes have been revised or replaced, the revising or replacing documents shall prevail.
Article 2. Effect
1. This Circular takes effect from December 08, 2023.
2. The Minister of Agriculture and Rural Development’s Circular No. 19/2022/TT-BNNPTNT dated December 2, 2022, promulgating the List of pesticides permitted for use in Vietnam and the List of pesticides banned from use in Vietnam, ceases to be effective from the date on which this Circular takes effect.
Article 3. Implementation responsibility
1. The Director of the Plant Protection Department and heads of units of the Ministry of Agriculture and Rural Development, directors of provincial-level Departments of Agriculture and Rural Development, and related organizations and individuals shall implement this Circular.
2. Any difficulties arising in the course of implementation of this Circular should be reported to the Ministry of Agriculture and Rural Development (via the Plant Protection Department) for consideration and timely settlement./.
