DECISION

Prescribing the roadmap for application of exhaust emission standards for in-use automobiles and imported used automobiles^[1]

Pursuant to the June 19, 2015 Law on Organization of the Government;

Pursuant to the November 13, 2008 Law on Road Traffic;

Pursuant to the June 23, 2014 Law on Environmental Protection;

At the proposal of the Minister of Transport;

The Prime Minister promulgates the Decision prescribing the roadmap for application of exhaust emission standards for in-use automobiles and imported used automobiles.

Article 1. Scope of regulation

This Decision prescribes the roadmap for application of exhaust emission standards for in-use automobiles and imported used automobiles.

Article 2. Subjects of application

1. This Decision applies to organizations and individuals that use, manage, examine and inspect in-use automobiles and imported used automobiles.

2. This Decision does not apply to automobiles of the army and public security forces in service of national defense or security purposes.

Article 3. Interpretation of term

Emission standards (Tier 1, Tier 2, Tier 3 and Tier 4) are maximum allowable emission limits of automobiles’ pollutants and exhaust fumes prescribed in TCVN 6438:2018 “Road vehicles - Maximum allowable emission limits of exhaust fumes”.

Article 4. Roadmap for application of exhaust emission standards for in-use automobiles

1. Tier 1shall be applied to in-use automobiles fitted with spark ignition engines and those fitted with compression ignition engines manufactured before 1999.

2. Tier 2 shall be applied from January 1, 2021, to in-use automobiles fitted with spark ignition engines and those fitted with compression ignition engines manufactured between1999 and 2008.

3. Tier 2 shall be applied from January 1, 2020, to in-use automobiles fitted with spark ignition engines and those fitted with compression ignition engines manufactured after 2008.

Article 5. Roadmap for application of exhaust emission standards to imported used automobiles

1. Tier 4 shall be applied from the effective date of this Decision to imported used automobiles fitted with spark ignition engines and those fitted with compression ignition engines.

2. For imported used automobiles that had the time of opening import declarations under the Customs Law or arrived at Vietnam’s ports or border gates before the effective date of this Decision, the Prime Minister’s Decision No. 249/2005/QD-TTg of October 10, 2005, prescribing the roadmap for application of exhaust emission standards for road motor vehicles, may apply.
