DECISION
On work assignment for the Prime Minister and
Deputy Prime Ministers[1]
THE PRIME MINISTER
Pursuant to the 2013 Constitution of the Socialist Republic of Vietnam;
Pursuant to the June 19, 2015 Law on Organization of the Government;
At the proposal of the Minister-Chairperson of the Government Office,
DECIDES:
Article 1.Principles of assignment and work relation between the Prime Minister and Deputy Prime Ministers
1. The Prime Minister shall fully perform his/her tasks and exercise powers in accordance with the Constitution and the Law on Organization of the Government; comprehensively lead and administer the works of the Government, Government members, heads of government-attached agencies and chairpersons of People’s Committees at all levels; and directly direct and administer key and important affairs and strategic issues in all working fields within the functions, tasks and powers of the Government.
The Prime Minister shall assign Deputy Prime Ministers to assist him/her in monitoring, directing and handling regular affairs under his/her competence within each working field of the Government.
2. Deputy Prime Ministers shall assist the Prime Minister in performing his/her tasks as assigned by the latter, promptly report to and ask for opinions of the Prime Minister on important issues, and proactively coordinate with other Deputy Prime Ministers in settling affairs related to them in a cooperative manner, and report to the Prime Minister in case of divergent opinions.
3. Deputy Prime Ministers shall, within the ambit of their assigned fields, have the responsibilities and powers on behalf of the Prime Minister to:
- Direct ministries and sectors to elaborate development strategies, master plans and plans; and mechanisms, policies and legal documents for promulgation in accordance with their competence or submission to the Government or the Prime Minister.
- Examine and urge the organization of implementation of guidelines, policies and laws and tasks of ministries and agencies.
- Assume the prime responsibility for handling issues requiring interdisciplinary coordination and consider and handle proposals of ministries, sectors and localities under the competence of the Prime Minister as assigned.
- Supervise and direct the settlement of internal affairs of ministries and agencies as assigned.
4. In the absence of the Prime Minister, a Deputy Prime Minister delegated by the Prime Minister shall, if necessary, lead the work of the Government on behalf of the Prime Minister.
5. In case of necessity or in the absence of Deputy Prime Ministers, the Prime Minister shall directly direct and settle affairs assigned to Deputy Prime Ministers.
6. Based on the practical situation, the Prime Minister shall consider and adjust the work assignment for himself/herself and Deputy Prime Ministers to ensure the performance of tasks and exercise of powers of the Government.
Article 2.Assignment of tasks of the Prime Minister and Deputy Prime Ministers
1. Prime Minister Nguyen Xuan Phuc, Secretary of the Party Civil Affairs Committee of the Government
a/ To comprehensively lead and manage all activities within the functions, tasks and powers of the Government.
b/ To directly direct and administer the following fields of work:
- National and regional socio-economic development strategies and plans (including land use master plans and plans).
- National financial, credit and monetary strategies and policies.
- State budget expenditures and use of state budget reserves, the financial reserve fund, the foreign exchange reserve fund and other state funds; issuance of government debentures and bonds; and annual money supply plans.
- Strategies for climate change response.
- National defense, security and foreign relation strategies.
- Establishment of institutions; organization of the apparatus and personnel work; state administrative borders; agricultural and rural development; and general issues on ethnic affairs, religions, emulation and commendation.
- Unexpected and important tasks and breakthrough solutions in all fields.
- Cooperative relations between the Government and party agencies, the National Assembly, the President, the Central Committee of the Vietnam Fatherland Front and other socio-political organizations.
c/ To monitor and direct the Ministry of Defense, the Ministry of Public Security, the Ministry of Agriculture and Rural Development, the Vietnam News Agency, Vietnam Television, Voice of Vietnam and the management board of Ho Chi Minh Mausoleum;
d/ To directly act as Head of the State Steering Committee for the East Sea and Islands, Head of the National Steering Committee for International Integration, Chairman of the Central Emulation and Commendation Committee, Chairman of the National Council of Education and Human Resources Development, and chairman of other national committees and councils and head of other steering committees.
2. Deputy Prime Minister Truong Hoa Binh
a/ To act as Deputy Secretary of the Party Civil Affairs Committee of the Government.
b/ To assist the Prime Minister in monitoring and directing the following fields of work:
- Administrative reform.
- Anti-smuggling and trade fraud prevention and control.
- Anti-corruption; inspection and settlement of complaints and denunciations.
- Traffic order and safety.
- Crime prevention and combat.
- Special amnesty.
- Judicial reform.
- Settlement of regular issues on ethnic affairs, religions, emulation and commendation.
- Coordination between the Government and the Supreme People’s Court and the Supreme People’s Procuracy.
c/ To assist the Prime Minister in monitoring and directing the Ministry of Home Affairs, the Ministry of Justice, the Government Inspectorate, the Committee for Ethnic Minorities Affairs, the Government Office and the Ho Chi Minh National Academy of Politics;
d/ To act as Head of the Steering Committee for Administrative Reform; Head of the Steering Committee for Combating Smuggling, Trade Frauds and Counterfeit Goods; Chairman of the National Traffic Safety Committee; Head of the National Steering Committee for crime prevention and control; and chairman of other related national committees and councils and head of other steering committees of related fields;
e/ Other affairs as assigned and authorized by the Prime Minister.
3. Deputy Prime Minister and Minister of Foreign Affairs Pham Binh Minh, member of the Party Civil Affairs Committee of the Government
a/ To directly act as Deputy Prime Minister and Minister of Foreign Affairs;
b/ To assist the Prime Minister in monitoring and directing the following fields of work:
- Diplomacy and external relations (including Party, State and people-to-people external affairs).
- Official development assistance (ODA) and non-governmental aid.
- International integration; monitoring and direction of negotiations and implementation of multilateral and bilateral international commitments (excluding the areas specified at Point a, Clause 4 of this Article).
- Relations with international and regional organizations and foreign non-governmental organizations.
- Border work and East Sea and Islands issues.
- Overseas Vietnamese affairs.
- Human right affairs.
c/ To act as Chairman of the Vietnam-Laos Intergovernmental Committee and the Vietnam-Cambodia Intergovernmental Committee, Head of the Steering Committee for Land Border Demarcation and Border Marker Planting, Head of the Vietnam Committee for Human Rights, and chairman of other national councils and head of other steering committees of related fields.
d/ Other affairs as assigned and authorized by the Prime Minister.
4. Deputy Prime Minister Vuong Dinh Hue, member of the Party Civil Affairs Committee of the Government
a/ To assist the Prime Minister in monitoring and directing the following fields of work:
- General economic bloc, including planning; finance and pricing; banking and currency; stock market and financial investment resources; and macro-economic forecasts and policies.
- Arrangement and renewal of state-owned enterprises.
- International economic integration; monitoring and direction of negotiations and implementation of multilateral and bilateral economic agreements.
- Wage and social insurance policies; hunger eradication and poverty reduction.
- Development of types of enterprises.
- Cooperation and cooperative economies.
b/ To assist the Prime Minister in monitoring and directing the Ministry of Planning and Investment, the Ministry of Finance, the State Bank of Vietnam, the National Financial Supervisory Commission of Vietnam, Vietnam Social Security, the Vietnam Development Bank, the Vietnam Bank for Social Policies and the State Capital Investment Corporation;
c/ To act as Chairman of the National Monetary and Financial Policy Advisory Council; Head of the National Steering Committee for Wage Reform; Head of the Steering Committee for Enterprise Renewal and Development; and chairman of other national councils and head of other steering committees of related fields;
d/ Other affairs as assigned and authorized by the Prime Minister.
5. Deputy Prime Minister Vu Duc Dam, member of the Party Civil Affairs Committee of the Government
a/ To assist the Prime Minister in monitoring and directing the following fields of work:
- Education and training.
- Science and technology.
- Labor, employment and social affairs.
- Information and communications.
- Culture, tourism; physical training and sports.
- Health, population, family and children.
b/ To assist the Prime Minister in monitoring and directing the Ministry of Education and Training; the Ministry of Labor, War Invalids and Social Affairs; the Ministry of Information and Communications; the Ministry of Science and Technology; the Ministry of Health; the Ministry of Culture, Sports and Tourism; the Vietnam Academy of Science and Technology; the Vietnam Academy of Social Sciences; and Vietnam National Universities of Hanoi and Ho Chi Minh City;
c/ To act as Chairman of the National Defense and Security Education Central Council; Chairman of the National Council for Sustainable Development and Competitiveness Improvement; Head of the State Steering Committee for Tourism; Head of the Central Inter-sector Steering Committee for Food Safety; Chairman of the National Committee for AIDS, Drugs and Prostitution Prevention and Control; and chairman of other national councils and head of other steering committees of related fields;
d/ Other affairs as assigned and authorized by the Prime Minister.
6. Deputy Prime Minister Trinh Dinh Dung, member of the Party Civil Affairs Committee of the Government
a/ To assist the Prime Minister in directly monitoring and directing the following fields of work:
- Industry, trade, import and export, construction, transport, natural resources and environment.
- Foreign direct investment (FDI).
- Direction for ensuring energy and energy saving.
- National key works and capital construction investment projects as decentralized under the Law on Investment and the Law on Public Investment.
- Economic zones, industrial parks and export processing zones.
- Flood and storm prevention and control and search and rescue.
b/ To assist the Prime Minister in monitoring and directing the Ministry of Industry and Trade; the Ministry of Construction; the Ministry of Transport; and the Ministry of Natural Resources and Environment;
c/ To act as Chairman of the National Council on Water Resources; Head of the National Steering Committee for Key Petroleum Projects; Head of the Steering Committee for coordinating development of key economic zones; Head of the Steering Committee for National Target Program on response to climate change; Head of the Central Steering Committee for Housing Policies and Real Estate Market; and chairman of national committees and head of national councils and other steering committees of related fields;
d/ Other affairs as assigned and authorized by the Prime Minister.
Article 3.This Decision takes effect on the date of its signing; all previous provisions contrary to this Decision are annulled.
Government members, heads of government-attached agencies, and chairpersons of provincial-level People’s Councils and provincial-level People’s Committees shall implement this Decision.-
