CIRCULAR
Promulgating the list of mandatory standards on digital signatures and digital signature certification services after models of mobile signing and remote signing[1]
Pursuant to the November 29, 2005 Law on E-Transactions;
Pursuant to the Government’s Decree No. 130/2018/ND-CP of September 27, 2018, detailing the Law on E-Transactions regarding digital signatures and digital signature certification services;
Pursuant to the Government’s Decree No. 17/2017/ND-CP of February 17, 2017, defining the functions, tasks, powers and organizational structure of the Ministry of Information and Communications;
At the proposal of the Director of the Department of Science and Technology,
The Minister of Information and Communications promulgates the Circular promulgating the list of mandatory standards on digital signatures and digital signature certification services after models of mobile signing and remote signing.
Article 1.Scope of regulation
This Circular prescribes the list of mandatory standards on digital signatures and digital signature certification services after models of mobile signing and remote signing (provided in the Appendix to this Circular).
Article 2.Subjects of application
This Circular applies to public digital signature certification service providers and specialized digital signature certification service providers that are granted certificates of eligibility for securing specialized digital signatures of agencies and organizations, foreign digital signature certification service providers that have digital certificates recognized by the Ministry of Information and Communications in Vietnam and provide digital signature certification services after models of mobile signing and remote signing; organizations and individuals that develop applications using digital signatures, and provide digital signature solutions after models of mobile signing and remote signing.
Article 3.Organization of implementation
1. The Ministry of Information and Communications shall review, amend and supplement the list of mandatory standards on digital signatures and digital signature certification services after models of digital signatures on mobile devices and remote digital signatures as prescribed in Article 1 of this Circular in compatibility with the technological development and the State’s management policies.
2. The Department of Science and Technology shall assume the prime responsibility for reviewing and updating the list of standards on digital signatures and digital signature certification services after models of mobile signing and remote signing prescribed in Article 1 of this Circular.
3. The National Electronic Authentication Center shall guide, inspect and assess the application of standards on the list of mandatory standards on digital signatures and digital signature certification services after models of mobile signing and remote signing prescribed in Article 1 of this Circular.
Article 4.Implementation provisions
1. This Circular takes effect on April 1, 2020.
2. In case of a difference between this Circular and Circular No. 39/2017/TT-BTTTT of December 15, 2017, promulgating the list of technical standards on application of information technology in state agencies regarding the same standard related to the use of digital signatures and digital signature certification services provided by digital signature certification service providers in state agencies, this Circular prevails.
3. The Chief of the Office, Director of the Department of Science and Technology, Director of the National Electronic Authentication Center, and heads of agencies and units of the Ministry, and related organizations and individuals shall implement this Circular.
4. Any difficulties or problems arising in the course of implementation of this Circular should be promptly reported to the Ministry of Information and Communications for consideration and settlement.-
