CIRCULAR
Guiding the implementation of trade promotion activities to develop foreign trade under the National Program on Trade Promotion
Pursuant to the Law on Foreign Trade Management dated June 12, 2017;
Pursuant to the Decree No. 98/2017/ND-CP dated August 18, 2017 of the Government defining the functions, tasks, powers and organizational structure of the Ministry of Industry and Trade;
Pursuant to the Decree No. 28/2018/ND-CP dated March 1, 2018 of the Government detailing the Foreign Trade Management Law regarding a number of measures to develop foreign trade;
Pursuant to the Decision No. 72/2010/QD-TTg dated November 15, 2010 of the Prime Minister promulgating the Regulation on formulation, management and implementation of the national trade promotion program;
Pursuant to the Decision No. 12/2019/QD-TTg dated February 26, 2019 of the Prime Minister amending and supplementing a number of articles of the Regulation on developing, managing and implementing the national trade promotion program, issued together with the Decision No. 72/2010/QD-TTg dated
November 15, 2010 of the Prime Minister;
At the proposal of the Director of Vietnam Trade Promotion Agency,
The Minister of Industry and Trade issues a circular guiding the implementation of trade promotion activities to develop foreign trade under the National Program on Trade Promotion.
Chapter I
General provisions
Article 1. Scope of adjustment
This Circular prescribes specific criteria, contents and funding to support trade promotion activities of foreign trade development within the framework of the National Program on Trade Promotion (hereinafter referred to as the “Program”).
Article 2. Subjects of application
This Circular applies to the units presiding over the implementation of the Program (hereinafter referred to as the “presiding units”), the units participating in the project under the Program (hereinafter referred to as the “participating units”), the program implementation management agency, support funding agency, organizations and individuals providing funds related to the National Program on Trade Promotion.
Article 3. Criteria for development and implementation of the project under the National Program on Trade Promotion
1. The project must conform to the provisions of Article 8 of Decree 28/2018/ND-CP dated March 1, 2018 of the Government.
2. The project is a trade promotion activity for goods and products of export potential of a country, economic region or two or more centrally-run provinces/cities; or products protected by geographical indications, collective marks, certification marks.
Article 4. Evaluation and approval of the project
1. The project is appraised according to the criteria specified in the Annex issued together with this Circular.
2. The project eligible for approval is the one with a total of 85 points or more.
3. Principles for approving the project
a) The appraised project shall comply with the provisions of Clause 2 of this
Article;
b) On the basis of the budget expenditure estimates for the Program announced by the Ministry of Finance, the Minister of Industry and Trade shall decide to approve the project and the funding is supported on the principle of total funding support to implement the projects without exceeding the total given cost estimate.
Chapter II
THE CONTENT OF TRADE PROMOTION ACTIVITIES TO DEVELOP
FOREIGN TRADE UNDER THE NATIONAL PROGRAM ON TRADE PROMOTION
Section 1
CONNECTING TRADE, PARTICIPATING IN DISTRIBUTION SYSTEM
IN FOREIGN COUNTRIES AND IN VIETNAM
Article 5. Organizing and participating in international fairs and exhibitions in foreign countries1. Content of implementation
a) Information dissemination and promotion:
- Disseminating and promoting on the media or through forms of promotion of fairs and exhibitions;
- Organizing the introduction of information on fairs, exhibitions, business delegations participating in fairs and exhibitions;
- Organizing cultural shows to attract visitors to fairs and exhibitions organized by Vietnam or co-organized in foreign countries with scale of 100 or more booths (if any).
b) Organizing and staging of the national exhibition area (if any);
c) Organizing and staging of booths:
- Overall and detailed design;
- Premises, services of electricity, water, security, protection, sanitation and environment;
- Staging of areas of general trade promotion and product demonstration (if any);
- Staging of the booths; - General decoration.
d) Opening ceremony (for fairs and exhibitions organized or co-organized by Vietnam with the scale of 100 or more Vietnamese enterprises
booths or for overseas fairs and exhibitions with the participation of Vietnamese enterprises with the scale of 30 or more booths): Inviting guests, reception, decoration, art, performance stage, sound and light;
dd) Working expenses for persons of the presiding units participating in the organization;
e) Organization of seminars: Hall, equipment, decoration, sound, lighting, interpreter, security, reception, beverage during the break time, documentary, speaker (if any);
g) Advice on selection of participating products (if any).
2. Scale: Multidisciplinary fairs and exhibitions with a minimum of 12 booths and a minimum of 12 participating enterprises. Specialized fairs and exhibitions have the scale of at least 06 booths and at least 06 participating enterprises.
3. Contents of support: The State shall support up to 100% of the funding for implementation of the contents specified at Points a, b, c, d and e, Clause 1 of this Article.
Article 6. Organization of international fairs and exhibitions in Vietnam for export products
1. Content of implementation
a) Information dissemination and promotion:
- Disseminating and promoting in the media;
- Organizing introduction and information on fairs and exhibitions.
b) Organizing and staging of booths:
- Overall and detailed design; - Staging of the booths;
- General decoration.
c) Premises for fairs and exhibitions;
d)Services: electricity, water, sanitation, environment, security, protection, fire protection, health, internet;
dd) Opening ceremonies and related events within the framework of fairs and exhibitions;
e) Activities of organizing and managing fairs and exhibitions.
2. Scale
a) Multidisciplinary fairs and exhibitions with a minimum scale of 300 booths according to standard booths (3m x 3m) and 150 participating units of Vietnam when organized in centrally-run cities, or with a minimum scale of 200 standard booths and 100 participating units of Vietnam when organized in other localities;
b) Specialized fairs and exhibitions with the size of at least 100 booths of Vietnamese enterprises according to standard booths (3m x 3m) when organized in centrally-run cities or with 80 booths of Vietnamese enterprises according to standard booths (3m x 3m) when organized in other localities.
3. Supporting contents: Supporting up to 100% of the funding for implementation of the contents specified at Points a and b, Clause 1 of this Article.
Article 7. Organization of international fairs and exhibitions in Vietnam for products of foreign enterprises who want to import from Vietnam
1. Content of implementation
a) Information dissemination and promotion:
- Disseminating and promoting in the media;
- Organizing introduction and information on fairs and exhibitions.
b) Organizing and staging of booths:
- Overall and detailed design; - Staging of the booths;
- General decoration.
c) Premises for fairs and exhibitions;
d) Services: electricity, water, sanitation, environment, security, protection, fire protection, health, internet;
dd) Opening ceremonies and related events within the framework of fairs and exhibitions;
e) Activities of organizing and managing fairs and exhibitions.
2. Scale: Fairs and exhibitions with a minimum scale of 60 booths according to standard booths (3m x 3m), including at least 15 booths of foreign enterprises with import demands.
3. Supporting contents: Supporting up to 100% of the funding for implementation of the contents specified in Clause 1 of this Article.
Article 8. Organization of fairs and exhibitions in Vietnam for imported products, raw materials and equipment in service of production of export goods, technological products and raw materials for production of products with a competitive advantage that are produced in the country
1. Content of implementation
a) Information dissemination and promotion:
- Disseminating and promoting in the media;
- Organizing introduction and information on fairs and exhibitions.
b) Organizing and staging of booths:
- Overall and detailed design; - Staging of the booths;
- General decoration.
c) Premises for fairs and exhibitions;
d) Services: electricity, water, sanitation, environment, security, protection, fire protection, health, internet;
dd) Opening ceremonies and related events within the framework of fairs and
exhibitions;
e) Activities of organizing and managing fairs and exhibitions.
2. Scale: Fairs and exhibitions with a scale of at least 50 enterprises and 100 booths according to standard booths (3m x 3m).
3. Supporting contents: Supporting up to 100% of the funding for implementation of contents specified at Point a, Clause 1 of this Article.
Article 9. Organization of the display, introduction and export of goods through common stores on the e-commerce trading floor
1. Content of implementation
a) Opening an account on an e-commerce trading floor;
b) Maintaining the membership;
c) Developing a process, coding, managing warehouse of products intended to be sold through common stores on e-commerce trading floor;
d) Providing legal advice on product trademark registration;
e) Registering product labels in export markets at the request of e-commerce trading floors and export markets;
f) Rebuilding packages and labels according to the standards of e-commerce trading floors and export markets;
g) Taking photos according to the standards of e-commerce floor;
h) Online general store management: updating images, information, prices of each product according to the list of e-commerce floors, order confirmation, notification of goods delivery warehouses, receipt of information about the problems after sales;
i) Promoting common stores through social networks, internet search engines; k) Shipping orders;
l) Other activities:
- Researching consumer trends and competitors on e-commerce trading floor to develop marketing and promotion strategies;
- Building digital content (video clips) to promote common stores or products;
- Upgrading common stores on e-commerce trading floors to increase sales opportunities.
2. Scale: At least 15 participating units; each of them provides at least 03 products manufactured in Vietnam.
An e-commerce trading floor that is chosen to organize the booth must belong to the world
s top 20 e-commerce trading floors according to ratings from Alexa or similar web.
3. Contents of support: Supporting up to 100% of the implementation cost for maximum 12 months for the contents specified at Points a, b, h and Point i, Clause 1 of this Article.
Article 10. Organization of trade transaction missions in foreign countries
1. Content of implementation
a) Disseminating, promoting and inviting foreign organizations and enterprises to trade:
- Propagating and promoting in the media;
- Organizing introduction about the information on business delegation.
b) Organization of seminars and trade: Hall, equipment, decoration, sample product display area, interpreter, reception, refreshment, documents, name card, stationery;
c) Working expenses for people of the presiding unit participating in the
organization;
d) Organization and management activities of the presiding unit;
dd) Participants: Air tickets/train tickets/car tickets, sample transport, food, accommodation and travel costs.
2. Scale: At least 15 units participating in multidisciplinary delegations, 07 units participating in specialized delegations.
3. Supporting contents: Supporting up to 100% of the funding for implementation of the contents specified at Points a, b and c, Clause 1 of this Article and travel expenses, including airfare, train tickets, bus tickets from Vietnam to the working country and vice versa (including air tickets, train tickets within the working country) for 01 participant/unit.
Article 11. Organization of foreign business delegations to enter Vietnam to purchase goods
1. Content of implementation
a) Information dissemination and promotion:
- Inviting foreign and Vietnamese organizations, enterprises;
- Organizing introduction and information about foreign business delegations and Vietnamese enterprises.
b) Organization of seminars and trade: Hall, equipment, decoration, interpretation, translation, document printing, beverage during the break time;
c) Management organization of the presiding unit: Working expenses for the person(s) of the presiding unit participating in the organization, post, telephone, stationery;
d) Participating foreign enterprises: Meals, accommodation, and travel in Vietnam;
e) Round-trip air tickets, meals, accommodation and travel in Vietnam for people of the partner units who bring the delegations into Vietnam;
f) Domestic enterprises: Goods, equipment for display, transport, meals, accommodation, travel; organizing of foreign business delegations to visit factories, production facilities and raw material areas.
2. Scale
a) At least 07 foreign enterprises and 21 Vietnamese enterprises for specialized trade delegations;
b) At least 20 foreign enterprises and 60 Vietnamese enterprises for multidisciplinary trade unions.
3. Support content
a) Supporting up to 100% of the funding for implementation of the contents specified at Point a, Points b and c, Clause 1 of this Article;
b) Supporting up to 100% of the funding for implementation of the contents specified at Point d, Clause 1 of this Article for a period of time of not exceeding 4 days and 3 nights for 01 person/ foreign enterprise;
c) Supporting up to 100% of the funding for implementation of the contents
specified at Point e, Clause 1 of this Article for a period of time of not exceeding 4 days and 3 nights for 01 person/group of at least 07 foreign enterprises.
Article 12. Organization of international conferences in Vietnam on export products
1. Content of implementation
a) Information dissemination and promotion:
- Inviting foreign and Vietnamese organizations, enterprises;
- Organizing introduction and information on the international conference of goods industry.
b) Hall, equipment, decoration, interpretation, translation, document printing, beverage during the break time;
c) Reporters, presenters: Remuneration, food, accommodation and travel in Vietnam;
d) Management organization of the presiding unit: Working expenses for the person(s) of the presiding unit participating in organization, post, telephone, stationery.
2. Scale: At least 60 Vietnamese enterprises, 20 foreign manufacturing and trading enterprises and organizations operating in related industries.
3. Supporting content: Supporting up to 100% of the funding for implementation of contents specified at Points a, b and d, Clause 1 of this Article.
Article 13. Connection of trade relations in Vietnam between suppliers and export enterprises and trade promotion organizations
1. Content of implementation
a) Disseminating, promoting, inviting organizations and businesses to make transactions;
b) Trade organization:
- Hall, equipment, decoration, interpretation, translation, document printing, beverage during the break time;
- Organizing booths, product display areas/showrooms.
c) Management organization of the presiding unit: Working expenses for the person(s) of the presiding unit participating in organization, post, telephone, stationery.
2. Scale: At least 21 suppliers and 07 exporters.
3. Supporting content: Supporting up to 100% of the funding for implementation of the contents specified in Clause 1 of this Article.Section 2
SUPPORT OF DEVELOPMENT, OPERATION OF COMMERCIAL INFRASTRUCTURE, LOGISTICS TO SERVE FOREIGN TRADE ACTIVITIES
Article 14. Organization and participation of overseas trade fairs and exhibitions on logistics
The content of support is provided for in Article 5 of this Circular.
Article 15. Inviting of foreign business delegations to Vietnam for exchange of investment opportunities, cooperation in development of logistics services, logistics centers for foreign trade activities
The content of support is provided in Article 11 of this Circular.
Article 16. Organization of Vietnam logistics forums, international fairs and exhibitions on logistics in Vietnam
1. Organization of international forums for logistics in Vietnam
a) The content of support is specified in Clauses 1 and 3, Article 12 of this Circular;
b) Scale: At least 50 Vietnamese enterprises, 10 foreign enterprises and organizations operating in logistics.
2. Organization of international fairs and exhibitions on logistics in Vietnam The content of support is prescribed in Article 6 of this Circular.
Section 3
ACTIVITIES TO SUPPORT RESEARCH, DEVELOPMENT, IMPROVE
PRODUCT AND GOODS QUALITY
Article 17. Development and publication of information and databases on products, goods and markets
1. Content of implementation
a) Collecting, buying information and databases on goods industry, markets
and domestic and foreign products;
b) Summarizing, analyzing and processing the information and data;
c) Editing, building reports, databases and other information products;
d) Publishing the information and data in the form of printed copies (printed,
published), electronic publications; or disseminating the information at conferences, seminars, and training courses.
2. Supporting content: Supporting up to 100% of the funding for implementation of the contents specified at Points a, b and c, Clause 1 of this Article.
Article 18. Guiding and supporting of enterprises to access, apply and comply with regulations, standards, conditions of importing organizations, international commitments on imported and exported products
1. Content of implementation
a) Developing documents to guide the implementation of regulations, standards, conditions of importing organizations, international commitments on imported and exported products;
b) Dissemination and training:
- Hall, equipment, decoration, interpretation, translation, document printing, beverage during the break time;
- Disseminating the information in the mass media;
- Lecturers and reporters: Remuneration, meals, accommodation and travel.
c) Management organization of the presiding unit: Working expenses for the person(s) of the presiding unit participating in organization, post, telephone, stationery.
2. Scale: At least 70 participating units.
3. Supporting content
a) Supporting up to 100% of the funding for implementation of the contents
specified in Clause 1 of this Article;
b) No more than two people of each participating unit will be supported.
Article 19. Organization and participation in survey programs; learning of information about products, goods industry and markets
1. Content of implementation
a) Collecting information and researching on products, goods and markets;
b) Organizing the field research in Vietnam and/or foreign countries;
c) Developing research reports on products, goods industry and markets;
d) Issuing research reports in the form of printed copies (printed, published)
or electronic publications; or disseminating the information at conferences, seminars, and training courses;
dd) Management organization of the presiding unit: Post, telephone, stationery.
2. Supporting content: Supporting up to 100% of the funding for implementation of the contents specified at Points c and e, Clause 1 of this Article.
Article 20. Organizing conferences, seminars, seminars, forums providing information on product development, industry and market
1. Content of implementation
a) Disseminating, promoting, inviting organizations and enterprises to participate;
b) Hall, equipment, decoration, interpretation, translation, document printing, beverage during the break time;
c) Reporters: Remuneration, meals, accommodation and travel;
d) Management organization of the presiding unit: Working expenses for the person(s) of the presiding unit participating in organization, post, telephone, stationery.
2. Scale
a) At least 100 participating units for the programs providing information on
product development, export markets;
b) At least 50 foreign enterprises for programs providing information to
promote products and goods industry of Vietnam.
3. Supporting content: Supporting up to 100% of funding for implementation of the contents specified at Points a, c and d, Clause 1 of this Article.
Article 21. Training and dissemination of knowledge to raise the capability of designing and developing export products for enterprises
The content shall comply with the provisions of Article 26 and Article 27 of this Circular.
Article 22. Organization of consultancy activities; hiring of consultants; supporting of the product design and development
1. Content of implementation
a) Product consultancy, design and development activities for products/product groups:
- Specialists: Remuneration, meals, accommodation, travel or package contracts;
- Consultation organization: Hall, equipment, decoration, interpretation, translation, document printing, beverage during the break time.
b) Implementing the results of product consultancy, design and development
to enterprises (if any);
c) Management organization of the presiding unit: Working expenses for the
person(s) of the presiding unit participating in organization, post, telephone, stationery.
2. Scale: At least 50 participating enterprises.
3. Supporting content: Supporting up to 100% of the funding for implementation of the contents specified at Points a and c, Clause 1 of this Article.
Article 23. Organization of activities to connect enterprises with designers
1. Content of implementation
a) Disseminating, promoting, inviting organizations and enterprises to
participate;
b) Hall, equipment, decoration, interpretation, translation, document printing,
beverage during the break time;
c) Management organization of the presiding unit: Working expenses for the
person(s) of the presiding unit participating in organization, post, telephone, stationery;
d) Organization of display area for design products (if any). 2. Scale: At least 50 enterprises and 10 design service providers.
3. Supporting content: Supporting up to 100% of the funding for implementation of the contents specified at Points a and c, Clause 1 of this Article.
Article 24. Organization of information dissemination and promotion of goods industry, geographical indications, collective marks, and certification marks of Vietnam in foreign countries
1. Content of implementation
a) Hiring consultants to elaborate content and plans, propaganda and
promotion strategies;
b) Implementing information dissemination products:
- Making information dissemination and promotion products: Making designs, collecting materials, writing articles, producing films, photos and communication products;
- Implementing the information dissemination, promotion, release at trade promotion events and on the media.
2. The program is developed and implemented for minimum 03 years, maximum 5 years for a target market.
3. Supporting contents: Supporting up to 100% of the funding for implementation of the contents specified in Clause 1 of this Article.
Article 25. Inviting of foreign media organizations and experts into
Vietnam to produce communicationand promotion products for promoting
Vietnamese export goods in foreign countries
1. Content of implementation
a) Developing communication plans and contents;
b) Package contracts with foreign media organizations and experts: Writing articles, reporting on newspapers, specialized magazines, radio, television and internet;
c) Management organization of the presiding unit: Working expenses for the person(s) of the presiding unit participating in organization, post, telephone, stationery.
2. Supporting content: Supporting up to 100% of the funding for implementation of the contents specified in Clause 1 of this Article.
Section 4
TRAINING AND ENHANCEMENT OF THE CAPACITY ON TRADE
PROMOTION AND MARKET DEVELOPMENT
Article 26. Organization of training and enhancement of the capacity on trade promotion and market development
1. Content of implementation
a) Compiling of training contents;
b) Translation and interpretation;
c) Printing of documents and stationery;
d) Lecturers and reporters: Remuneration, meals, accommodation and travel; dd) Hall, equipment, decoration, beverage during the break time;
e) Management organization of the presiding unit: Working expenses for the
person(s) of the presiding unit participating in organizing, promoting, inviting, post and telephone.
2. Scale: Minimum 50 participating units.
3. Supporting content:
a) Supporting up to 100% of the funding for implementation of the contents
specified in Clause 1 of this Article;
b) No more than two people of each participating unit will be supported.
Article 27. Organization of participation in training packages of training institutions (directly and online)1. Content of implementation
a) Package fees of the course;
b) Management organization of the presiding unit: Working expenses for the
person(s) of the presiding unit participating in organizing, promoting, inviting, post and telephone.
2. Scale: At least 10 units participate in direct courses and at least 20 units participate in online courses.
3. Supporting content:
a) Supporting up to 50% of the funding for implementation of the contents
specified at Point a, Clause 1 of this Article;
b) No more than two people of each participating unit will be supported.
Chapter III
Organization of implementation
Article 28. The contract assigns the task of implementing the project
1. Based on the Minister of Industry and Trade’s decision approving the Program, the Vietnam Trade Promotion Agency signs a contract for assignment of the project implementation to the presiding units and make payment and settlement of the support budget in accordance with the signed contract.
2. The presiding unit shall develop the implementation plan and financial plan, make detailed cost estimates for the implementation of the approved project attached together with relevant documents and then send them to the Vietnam Trade Promotion Agency for signing the contract for assignment of the project implementation. For projects that require the selection of contractors according to the provisions of the Bidding Law and relevant current guiding documents, the presiding unit must send the estimates and related dossiers to sign contracts for project implementation at least 45 days before the event.
3. The contents of the contract shall comply with Article 12 of Decree No. 28/2018/ND-CP dated March 1, 2018 of the Government.
Article 29. Responsibilities of the presiding unit
1. Formulating plans, making proposals and estimating proposal costs for the national program on trade promotion every year.
2. Consulting the regional trade promotion agencies for trade promotion projects for regional products; consulting the relevant goods industry association for the interdisciplinary trade promotion project.
3. Reporting project implementation results as prescribed in Article 14 of Decree No. 28/2018/ND-CP dated March 1, 2018 of the Government.
4. Being responsible for keeping records and documents related to the project of the national program on trade promotion according to the provisions of law.
5. Fully implementing the content of the contract signed with the Vietnam Trade Promotion Agency.
6. Making payment and settlement of funds in accordance with the project implementation schedule; complying with the provisions of the law on the use of the state budget, the provisions of this Circular and provisions in related documents.
Article 30. Responsibilities of Department of Industry and Trade
1. Advising the People
s Committees of the provinces and cities directly under the Central Government to promulgate a mechanism to coordinate and implement projects under the National Program on Trade Promotion in their localities.
2. Coordinating with the Vietnam Trade Promotion Agency, relevant agencies to supervise the implementation of projects under the National Program on Trade Promotion in localities.
Article 31. Responsibilities of units under the Ministry of Industry and Trade
1. The Vietnam Trade Promotion Agency is the focal point to assume the prime responsibility for managing and implementing the national program on trade promotion, and is responsible for:
a) Guiding units to assume the prime responsibility for elaborating plans,
projects and cost estimates of the annual program proposals;
b) Receiving the projects and making preliminary evaluation, appraisal before submission to the Minister of Industry and Trade for approval of the projects in the Program;
c) Organizing and guiding the implementation of the approved program plan; making advance, payment and settlement of funding for the Program;
d) Approving the contractor selection plan for projects with items that must apply the form of contractor selection;
e) Urging and supervising the contract performance for project
implementation; guiding the unit in charge of implementing the project in accordance with the approved objectives and contents as well as in compliance with the provisions of relevant laws;
f) Assuming the prime responsibility for, and coordinating with the concerned agencies and units in, organizing the inspection and assessment of the implementation of projects as well as for management and use of Program funding;
g) Summarizing, evaluating and reporting to the Ministry of Industry and Trade on the implementation of the Program.
2. The European-American Market Department, the Asia-Africa Market Department, the Domestic Markets Department, the Agency of Foreign Trade, and trade representatives of Vietnam in foreign countries shall take the responsibilities for coordinating with the Vietnam Trade Promotion Agency and the presiding units in effectively implementing the approved national program on trade promotion.
Article 32. Effect
1. This Circular takes effect on September 16, 2019.
2. In the course of implementing this Circular, if any difficulties or problems arise, concerned organizations and individuals are requested to promptly report them to the Ministry of Industry and Trade for consideration and resolution.
