CIRCULAR
Guiding the implementation of trade promotion activities to develop foreign trade under the National Program on Trade Promotion
Pursuant to the Law on Foreign Trade Management dated June 12, 2017;
Pursuant to the Decree No. 98/2017/ND-CP dated August 18, 2017 of the Government defining the functions, tasks, powers and organizational structure of the Ministry of Industry and Trade;
Pursuant to the Decree No. 28/2018/ND-CP dated March 1, 2018 of the Government detailing the Foreign Trade Management Law regarding a number of measures to develop foreign trade;
Pursuant to the Decision No. 72/2010/QD-TTg dated November 15, 2010 of the Prime Minister promulgating the Regulation on formulation, management and implementation of the national trade promotion program;
Pursuant to the Decision No. 12/2019/QD-TTg dated February 26, 2019 of the Prime Minister amending and supplementing a number of articles of the Regulation on developing, managing and implementing the national trade promotion program, issued together with the Decision No. 72/2010/QD-TTg dated November 15, 2010 of the Prime Minister;
At the proposal of the Director of Vietnam Trade Promotion Agency,
The Minister of Industry and Trade issues a circular guiding the implementation of trade promotion activities to develop foreign trade under the National Program on Trade Promotion.
Chapter I
General provisions
Article 1. Scope of adjustment
This Circular prescribes specific criteria, contents and funding to support trade promotion activities of foreign trade development within the framework of the National Program on Trade Promotion (hereinafter referred to as the “Program”).
Article 2. Subjects of application
This Circular applies to the units presiding over the implementation of the Program (hereinafter referred to as the “presiding units”), the units participating in the project under the Program (hereinafter referred to as the “participating units”), the program implementation management agency, support funding agency, organizations and individuals providing funds related to the National Program on Trade Promotion.
Article 3. Criteria for development and implementation of the project under the National Program on Trade Promotion
1. The project must conform to the provisions of Article 8 of Decree 28/2018/ND-CP dated March 1, 2018 of the Government.
2. The project is a trade promotion activity for goods and products of export potential of a country, economic region or two or more centrally-run provinces/cities; or products protected by geographical indications, collective marks, certification marks.
Article 4. Evaluation and approval of the project
1. The project is appraised according to the criteria specified in the Annex issued together with this Circular.
2. The project eligible for approval is the one with a total of 85 points or more.
3. Principles for approving the project
a) The appraised project shall comply with the provisions of Clause 2 of this Article;
b) On the basis of the budget expenditure estimates for the Program announced by the Ministry of Finance, the Minister of Industry and Trade shall decide to approve the project and the funding is supported on the principle of total funding support to implement the projects without exceeding the total given cost estimate.
Chapter II
THE CONTENT OF TRADE PROMOTION ACTIVITIES TO DEVELOP FOREIGN TRADE UNDER THE NATIONAL PROGRAM ON TRADE PROMOTION
Section 1
CONNECTING TRADE, PARTICIPATING IN DISTRIBUTION SYSTEM IN FOREIGN COUNTRIES AND IN VIETNAM
Article 5. Organizing and participating in international fairs and exhibitions in foreign countries
1. Content of implementation
a) Information dissemination and promotion:
- Disseminating and promoting on the media or through forms of promotion of fairs and exhibitions;
- Organizing the introduction of information on fairs, exhibitions, business delegations participating in fairs and exhibitions;
- Organizing cultural shows to attract visitors to fairs and exhibitions organized by Vietnam or co-organized in foreign countries with scale of 100 or more booths (if any).
b) Organizing and staging of the national exhibition area (if any);
c) Organizing and staging of booths:
- Overall and detailed design;
- Premises, services of electricity, water, security, protection, sanitation and environment;
- Staging of areas of general trade promotion and product demonstration (if any);
- Staging of the booths;
- General decoration.
