CIRCULAR

Prescribing border gates of import of under-16 seat passenger cars^[1]

Pursuant to the June 12, 2017 Law on Foreign Trade Management;

Pursuant to the Government’s Decree No. 98/2017/ND-CP of August 18, 2017, defining the functions, tasks, powers and organizational structure of the Ministry of Industry and Trade;

Pursuant to the Government’s Decree No. 116/2017/ND-CP of October 17, 2017, prescribing the conditions for manufacture, assembly and import of automobiles and provision of automobile warranty and maintenance services;

At the proposal of the Director General of the Agency of Foreign Trade,

The Minister of Industry and Trade promulgates the Circular prescribing border gates of import of under-16 seat passenger cars.

Article 1.Scope of regulation

1. This Circular prescribes border gates of import of under-16 seat passenger cars.

2. This Circular does not apply to the following cases:

a/ Import and temporary import for re-export by subjects entitled to privileges and immunities under separate regulations of the Government or Prime Minister;

b/ For national defense and security purposes under plans approved by the Prime Minister;

c/ For special purposes under the Prime Minister’s decisions;

d/ Transit to countries sharing borders and conducting border-gate transfer business.

Article 2.Subjects of application

This Circular applies to traders importing under-16 seat passenger cars, and related agencies, individuals and organizations.

Article 3.Regulations on border gates of import

1. Under-16 seat passenger cars may be imported in Vietnam only through seaport border gates, including Quang Ninh (Cai Lan), Hai Phong, Da Nang, Ho Chi Minh City, and Ba Ria-Vung Tau.

2. Import procedures must comply with relevant laws.

Article 4.Effect

1. This Circular takes effect on May 8, 2019.

2. This Circular annuls:

- Article 1 of Joint Circular No. 25/2010/TTLT-BCT-BGTVT-BTC of June 14, 2010, of the Ministries of Industry and Trade, Transport, and Finance, prescribing the import of brand-new under-16 seat passenger cars;

- Clause 1, Section I and Clause 2, Section III of Joint Circular No. 03/2006/TTLT-BTM-BGTVT-BTC-BCA of March 31, 2006, of the Ministries of Trade, Transport, Finance, and Public Security, guiding the import of used under-16 seat passenger cars under the Government’s Decree No. 12/2006/ND-CP of January 23, 2006;

- The Ministry of Industry and Trade’s Circular No. 19/2009/TT-BCT of July 7, 2009, amending and supplementing Joint Circular No. 03/2006/TTLT-BTM-BGTVT-BTC-BCA of March 31, 2006, of the Ministries of Trade, Transport, Finance, and Public Security, guiding the import of used under-16 seat passenger cars under the Government’s Decree No. 12/2006/ND-CP of January 23, 2006.-
