Circular No. 03/2019/TT-BXD dated July 30, 2019, of the Ministry of Construction on amending and supplementing a number of Articles of the Minister of Construction’s Circular No. 04/2017/TT-BXD of March 30, 2017, providing the management of occupational safety in work construction

CIRCULAR

Amending and supplementing a number of articles of the Minister of Construction’s Circular No. 04/2017/TT-BXD of March 30, 2017, providing the management of occupational safety in work construction^[1]

Pursuant to the June 18, 2014 Construction Law;

Pursuant to the June 25, 2015 Law on Occupational Safety and Health;

Pursuant to the Government’s Decree No. 81/2017/ND-CP of July 17, 2017, defining the functions, tasks, powers and organizational structure of the Ministry of Construction;

Pursuant to the Government’s Decree No. 46/2015/ND-CP of May 12, 2015, on quality management and maintenance of construction works;

Pursuant to the Government’s Decree No. 59/2015/ND-CP of June 18, 2015, on management of construction investment projects;

Pursuant to the Government’s Decree No. 44/2016/ND-CP of May 15, 2016, detailing a number of articles of the Law on Occupational Safety and Health regarding technical inspection of occupational safety, training in occupational safety and health, and working environment observation;

At the proposal of the Director of the State Authority for Construction Quality Inspection;

The Minister of Construction promulgates the Circular amending and supplementing a number of articles of the Minister of Construction’s Circular No. 04/2017/TT-BXD of March 30, 2017, providing the management of occupational safety in work construction.

Article 1.To amend and supplement Article 16 of the Minister of Construction’s Circular No. 04/2017/TT-BXD of March 30, 2017, providing the management of occupational safety in work construction, as follows:

“Article 16. Management of information on technical inspection of occupational safety

1. To publish the information on organizations granted a certificate of eligibility for technical inspection of occupational safety on the online software for management of technical inspection of occupational safety (below referred to as software), including names, addresses and identification numbers of the organizations carrying out the technical inspection of occupational safety; list of machines, equipment and supplies included in the certificate; date of grant and date of expiration of the certificate; and violations committed by the organizations (if any).

2. To publish the information on individuals granted an inspector certificate on the software, including full names and identification numbers of the inspectors; serial numbers of their people’s identity cards or citizen identity cards; list of machines, equipment and supplies fully satisfying the conditions for technical inspection of occupational safety; date of grant and date of expiration of the certificate; and violations committed by the inspector (if any).

3. The application of information technology in technical inspection of occupational safety is provided as follows:

a/ Address for access to the software:http://cucgiamdinh.gov.vn/CSDL-kiem-dinh-duoc-cong-bo.aspx

b/ Specialized agencies shall formulate, publish and update the information on the organizations and individuals prescribed in Clauses 1 and 2 of this Article in the software; and guide organizations and individuals engaged in the technical inspection of occupational safety in using the software;

c/ Organizations and individuals engaged in technical inspection of occupational safety may use the software prescribed at Point a of this Clause in their operations for management and implementation of technical inspection of occupational safety for machines, equipment and supplies subject to strict requirements on occupational safety used in construction.

Article 2.Effect

1. This Circular takes effect on September 15, 2019.

2. Any problems arising in the course of implementation of this Circular should be reported to the Ministry of Construction for study and settlement.-
