CIRCULAR
Guiding the amendment of pension, social insurance allowance and monthly allowance to the subjects prescribed at Clause 1, 2, 3 and Clause 8, Article 1 of the Decree No. 44/2019/ND-CP dated May 20, 2019 of the Government
Pursuant to the Decree No. 14/2017/ND-CP dated February 17, 2017 of the Government on functions, tasks, powers and organizational structure of the Ministry 0f Labor, War Invalids and Social Affairs;
Pursuant to the Decree No. 44/2019/ND-CP dated May 20, 2019 of the Government prescribing the pension, social insurance allowance and monthly allowance (Hereafter called the Decree No. 44/2019/ND-CP);
At the proposal of the Manager of the Social Insurance Department;
The Minister of Labor, War Invalids and Social Affairs issues the Circular on guiding the amendment of pension, social insurance allowance and monthly allowance to the subjects prescribed at Clause 1, 2, 3 and Clause 8, Article 1 of the Decree No. 44/2019/ND-CP dated May 20, 2019 of the Government.
Article 1. Subject of application
This Circular is applicable to the subjects prescribed at Clause 1, 2, 3 and Clause 8, Article 1 of the Decree No. 44/2019/ND-CP.
Article 2. Amendment of pension, social insurance allowance and monthly allowance
From July 01, 2019, amendment of pension, social insurance allowance and monthly allowance to the subjects prescribed at Article 1 of this Decree shall be increased by 7.19% compared with the pension, social insurance allowance and monthly allowance on June of 2019. Specifically:

Article 3. Implementation organization
1. People’s Committees of provincial and central-affiliated cities shall be responsible for directing the Department of Labor, War Invalids and Social Affairs and other functional agencies relating to communication, publication, investigation and urge this Circular’s implementation.
2. Vietnam Social Insurance shall be responsible for the implementation of pension, social insurance allowance and monthly allowance prescribed at the Decree No. 44/2019/ND-CP and guidance at this Circular; make report in accordance with this Circular and send to the Ministry of Labor, War Invalids and Social Affairs before January 15, 2020.
3. For the subjects under management, the Social Insurance Departments of the Ministry of National Defense, Public Security shall be responsible for implementing and adjusting the social insurance and monthly allowances prescribed at the Circular.
Article 4. Implementation effect
1. This Circular shall take effect on August 15, 2019. All regulations and regimes prescribed at this Circular shall be implemented from July 01, 2019.
2. Circular No. 05/2018/TT-BLDTBXH dated June 29, 2018 of the Minister of Labor, War Invalids and Social Affairs guiding the amendment of pension, social insurance allowance and monthly allowance to the subjects enjoying pension, social insurance allowance and monthly allowance for the subjects prescribed at Clause 1, 2, 3 and Clause 8, Article 1 of the Decree No. 88/2018/ND-CP dated June 15, 2018 of the Government shall be expired from the effective date of this Circular.
Any problems or proposal arising in the course of implementation shall be reported to the Ministry of Labor, War Invalids and Social Affairs for research and resolution.
