RESOLUTION
Approving the 2020 law- and ordinance-making program and adjusting the 2019 law- and ordinance-making program[1]
THE NATIONAL ASSEMBLY OF THE SOCIALIST REPUBLIC
OF VIETNAM
Pursuant to the Constitution of the Socialist Republic of Vietnam;
Pursuant to Law No. 57/2014/QH13 on Organization of the National Assembly;
Pursuant to Law No. 80/2015/QH13 on Promulgation of Legal Documents;
Considering the National Assembly Standing Committee’s Report No. 386/TTr-UBTVQH14 of May 6, 2019, on the tentative 2020 law- and ordinance-making program and adjustments to the 2019 law- and ordinance-making program, and the National Assembly Standing Committee’s Report No. 409/BC-UBTVQH14 of June 10, 2019, explaining about, assimilating opinions on, and revising, the draft resolution approving the 2020 law- and ordinance-making program and adjustments to the 2019 law- and ordinance-making program;
RESOLVES:
Article 1.Toadjust the 2019 law- and ordinance-making program
1. To add the following drafts to the 2019 law- and ordinance-making program:
a/ The Law Amending and Supplementing a Number of Articles of the Law on Judicial Expertise(for discussion at the 8thsession);
b/ The Law Amending and Supplementing a Number of Articles of the Law on Disaster Prevention and Control and the Law on Dykes(for discussion at the 8thsession);
c/ The Law Amending and Supplementing a Number of Articles of the Law on Construction(for discussion at the 8thsession);
d/ The (amended) Ordinance on Preferential Treatment toward People with Meritorious Services to the Revolution(for submission to the National Assembly Standing Committee at the December 2019 session).
2. To adjust the time for submission of the following drafts:
a/ The Law Amending and Supplementing a Number of Articles of the Law on Investment and the Law on Enterprises(to shift from the list of those to be discussed at the 7thsession to list of those to be discussed at the 8thsession for passage at the 9thsession);
b/ The (amended) Law on Medical Examination and Treatment(to shift from the list of those to be discussed at the 7thsession to list of those to be discussed at the 9thsession for passage at the 10thsession);
c/ The Law Amending and Supplementing a Number of Articles of the Land Law(to shift from the list of those to be discussed at the 7thsession to list of those to be discussed at the 9thsession for passage at the 10thsession).
3. To withdraw the Law Amending and Supplementing a Number of Articles of the Law on Environmental Protection Tax from the 2019 law- and ordinance-making program.
Article 2.The 2020 law- and ordinance-making program
1. At the 9thsession:
a/ To submit to the National Assembly for passage:
1. The Law Amending and Supplementing a Number of Articles of the Law on Promulgation of Legal Documents;
2. The (amended) Youth Law;
3. The Law on Investment in the Form of Public-Private Partnership;
4. The Law on Mediation and Dialogue at Court;
5. The Law Amending and Supplementing a Number of Articles of the Law on Judicial Expertise;
6. The Law Amending and Supplementing a Number of Articles of the Law on Disaster Prevention and Control and Law on Dykes;
7. The Law Amending and Supplementing a Number of Articles of the Construction Law;
8. The Law Amending and Supplementing a Number of Articles of the Law on Investment and Law on Enterprises;
9. The Resolution on the 2021 law- and ordinance-making program.
b/ To submit to the National Assembly for discussion:
1. The (amended) Law on Vietnamese Guest Workers;
2. The Law on the Vietnam Border Guard;
3. The Law on International Agreements;
4. The Law Amending and Supplementing a Number of Articles of the Law on Environmental Protection;
5. The Law Amending and Supplementing a Number of Articles of the Law on Handling of Administrative Violations;
6. The (amended) Law on Medical Examination and Treatment;
7. The Law Amending and Supplementing a Number of Articles of the Land Law.
2. At the 10thsession:
a/ To submit to the National Assembly for passage:
1. The (amended) Law on Vietnamese Guest Workers;
2. The Law on the Vietnam Border Guard;
3. The Law on International Agreements;
4. The Law Amending and Supplementing a Number of Articles of the Law on Environmental Protection;
5. The Law Amending and Supplementing a Number of Articles of the Law on Handling of Administrative Violations;
6. The (amended) Law on Medical Examination and Treatment;
7. The Law Amending and Supplementing a Number of Articles of the Land Law.
b/ To submit to the National Assembly for discussion:
1. The Law Amending and Supplementing a Number of Articles of the Law on HIV/AIDS Prevention and Control;
2. The (amended) Law on Emulation and Commendation.
Article 3.Organization of implementation
1. Competent agencies, organizations and persons shall uphold their sense of responsibility, strictly complying with the Law on Promulgation of Legal Documents; ensure the legality, accuracy, and adequacy of documents included in dossiers of drafts and use clear syntax and wording; refrain from submitting drafts which fail to meet quality requirements; redress delayed submission of dossiers; and clearly identify reasons and responsibilities of each agency, organization or individual for failure to complete the law- and ordinance-making program for reporting to the National Assembly.
2. Agencies taking the prime charge of drafting, appraisal and verification of drafts and related agencies shall provide sufficient information, dossiers and documents for National Assembly deputies to soon access and give opinions on drafts, thus bringing into full play their role and responsibility in and positively contribute to legislative work.
3. The Government shall further devote appropriate time to discussing and giving opinions on drafts before submitting them to the National Assembly and National Assembly Standing Committee, take measures for directing, urging and examining to ensure the quality and progress of drafts; clearly identify responsibilities of, and take measures to handle, heads of agencies and organizations that fail to fulfill their legislative tasks; comply with regulations on organization of consultation and improve the participation in consultation by related ministries and sectors in order to ensure the quality of drafts; in the course of explaining about, assimilating opinions on, and revising, drafts, if holding opinions different from those of the National Assembly Standing Committee, report such to the National Assembly for consideration and decision; and ensure that implementing texts are promulgated and take effect in concurrence with relevant laws, ordinances and resolutions.
4. The Ethnic Council and Committees of the National Assembly shall proactively coordinate with proposing agencies, drafting agencies and appraising agencies right from the beginning; and enhance the responsibilities of themselves as well as their standing bodies in appraisal and participation in appraisal of, and assimilation of opinions on, and revision of, drafts; monitor and urge the preparation of drafts in the fields under their management and oversee the implementation of these documents after they are approved, including the promulgation of implementing texts.
5. National Assembly deputies’ delegations and National Assembly deputies shall devote appropriate time to studying and seeking opinions of related agencies and organizations, experts, scientists and those who are directly affected by drafts; and increase their involvement in discussions, thus contributing to improving drafts.
6. The Government, the Vietnam General Confederation of Labor and other agencies and organizations shall, within the ambit of their tasks and powers, promptly prepare drafts to implement the Party Central Committee’s resolutions as planned and soon propose the inclusion of these drafts to the law- and ordinance-making program of 2019 or 2020.
7. The Government shall direct ministries and ministerial-level agencies to, within the ambit of their tasks and powers, urgently review laws, ordinances, resolutions of the National Assembly and National Assembly Standing Committee, and other legal documents that have revealed problems or shortcomings so as to promptly propose competent agencies to amend or supplement them or promulgate new ones or to do so by themselves according to their competence, with a view to timely institutionalizing the Party’s policies and resolutions and the Strategy on formulation and improvement of the legal system and implementing the Plan on implementation of the Constitution, thus meeting the country’s development and integration requirements.
The National Assembly Standing Committee, the Government, and related agencies, organizations and individuals shall closely coordinate with one another to effectively implement this Resolution.
This Resolution was adopted on June 11, 2019, by the XIVthNational Assembly of the Socialist Republic of Vietnam at its 7thsession.-
