SUMMARY

Energy information shall be publicized on the website www.veis.erea.gov.vn

Energy information shall be publicized on the website of the energy information system at www.veis.erea.gov.vn for sharing to the public; providing to international organizations according to the obligations and responsibilities in the agreements between the Socialist Republic of Vietnam and these organizations; concurrently for providing upon request of related organizations and individuals to serve state management work in accordance with law.

Contents of energy information include: Information on energy supply-demand balance; Information on technical properties of energy infrastructure facilities of power plants; oil refineries; natural gas processing plants; biofuel production plants and blending stations…; Information on annual average energy prices including coal, natural gas, petroleum oil products, electricity and other forms of energy.

Energy information shall be collected on the basis of reporting units’ reports according to the forms of paper documents, which must bear the signatures and seals of heads or at-law representatives of reporting units or authorized persons or electronic documents, which shall be submitted to the website of the energy information system using the electronic reporting software at www.veis.erea.gov.vn or emailed to [email protected]. The deadline for sending an annual report is March 31 of the year following the reporting year.

The above contents are prescribed in the Circular No. 34/2019/TT-BCT providing the energy information system dated November 28, 2019 of the Ministry of Industry and Trade; which takes effect on April 01, 2020.

CIRCULAR

Providing the energy information system[1]

Pursuant to the June 28, 2010 Law on Energy Efficiency and Conservation, which was amended and supplemented by Law No. 28/2018/QH14 of June 15, 2018;

Pursuant to the November 23, 2015 Law on Statistics;

Pursuant to the Government’s Decree No. 98/2017/ND-CP of August 18, 2017, defining the functions, tasks, powers and organizational structure of the Ministry of Industry and Trade;

Pursuant to the Government’s Decree No. 21/2011/ND-CP of March 29, 2011, detailing, and providing measures to implement, the Law on Energy Efficiency and Conservation;

Pursuant to the Government’s Decree No. 09/2019/ND-CP of January 24, 2019, providing the reporting regime applicable to state administrative agencies;

At the proposal of the Director of the Electricity and Renewable Energy Authority;

The Minister of Industry and Trade promulgates the Circular providing the energy information system.

Chapter I

GENERAL PROVISIONS

Article 1.Scope of regulation

This Circular provides the establishment and operation management of the energy information system and the organization, building and exploitation of the energy database.

Article 2.Subjects of application

1. Agencies, organizations and individuals engaged in the provision, collection, management, exploitation and use of energy information.

2. Ministries and ministerial-level agencies involved in the collection, management, exploitation and use of energy information (below referred to as ministries and sectors).

3. Other agencies, organizations and individuals involved in energy information.

Article 3.Interpretation of terms

1. Energy information means figures, data and information on the supply, conversion and use of energy; technical properties of energy infrastructure facilities; energy prices; energy statistical indexes and other information relating to energy.

2. Energy information system means the system for collecting, processing, storing, exploiting and providing energy information serving the state management of energy and socio-economic development.

3. Energy database means the structured assembly of energy data and information which are systematically compiled, stored and arranged following a certain method so as to be accessible, exploitable, manageable and updatable via electronic devices.

4. Focal point of the energy information system (below referred to focal point) means the unit assigned by the Ministry of Industry and Trade the functions and tasks of collecting, processing, storing and disclosing energy information and managing the energy database.

5. Energy information-reporting and -providing units (below referred to as reporting units) mean agencies and organizations providing energy information according to the reporting regime prescribed in Article 7 of this Circular.

6. Units coordinating in exchanging and providing energy information (below referred to as coordinating units) mean units assigned by ministries and sectors the functions of managing and processing information and data relating to energy information regulated by this Circular.

7. Beginning inventory means the quantity of materials or products stored in an enterprise’s warehouses as of January 1 of the reporting year.

8. Ending inventory means the quantity of materials or products stored in an enterprise’s warehouses as of December 31 of the reporting year.

Article 4.General principles

1. To collect energy information in a sufficient, comprehensive and accurate manner.

2. To manage, store and preserve energy information and build the energy database, ensuring long-term use and information safety.

3. To ensure efficiency, feasibility and cost and resource saving.

4. To publicize and provide information to the subjects as prescribed by law, ensuring convenient and timely exploitation and use.

5. To ensure confidentiality of information for energy information providers.

 

Chapter II

COLLECTION, PROCESSING, SUMMING-UP AND PUBLICIZATION OF ENERGY INFORMATION

Article 5.Contents of energy information

1. Information on energy supply-demand balance

a/ Information and data on supply of primary energy;

b/ Information and data on energy production and conversion;

c/ Information and data on final energy consumption and non-energy consumption.

2. Information on technical properties of energy infrastructure facilities

a/ Power plants;

b/ Self-consumption or combined heat and power plants;

c/ Power lines and stations;

d/ Oil refineries and condensate processing plants;

dd/ Natural gas processing plants;

e/ Biofuel production plants and blending stations;

g/ Compressed natural gas (CNG) production plants;

h/ Other energy production and conversion plants.

3. Information on annual average energy prices

a/ Coal;

b/ Natural gas;

c/ Petroleum oil products;

d/ Electricity;

dd/ Other forms of energy.

4. Other information according to international standards on energy statistics to be publicized by the Ministry of Industry and Trade.

Article 6.Plans on collection of energy information

1. Grounds for formulation of plans on collection of energy information

a/ Requirements for state management of energy, socio-economic development and national defense and security assurance;

b/ Assigned functions, tasks and powers;

c/ Approved programs, schemes, projects, and tasks.

2. Energy information shall be collected on a periodical and unscheduled basis, including:

a/ Annual reports: To be made on an yearly basis with data in the period from January 1 through December 31.

b/ Unscheduled reports: To be made upon request to serve state management work.

Article 7.Collection of energy information of reporting units

1. Energy information shall be collected on the basis of reporting units’ reports prescribed in the appendices to this Circular.

2. The reports prescribed in Clause 1 of this Article shall be made according to the forms of data stored on the website of the energy information system.

3. Forms of reports

a/ Paper documents, which must bear the signatures and seals of heads or at-law representatives of reporting units or authorized persons and shall be sent to the focal unit;

b/ Electronic documents, which shall be submitted to the website of the energy information system using the electronic reporting software atwww.veis.erea.gov.vnor emailed to[email protected].

4. The deadline for sending an annual report is March 31 of the year following the reporting year.

Article 8.Collection of energy information of coordinating units

1. To-be-collected energy information includes:

a/ Information on consumption of energy in agriculture, forestry and fisheries per fuel type;

b/ Information on the number, average energy consumption, average mileage and total energy consumption of road, railway, waterway and airway vehicles per fuel type;

c/ Information on the volume and value of energy products imported and exported per HS code;

d/ Socio-economic targets; added value of economic sub-sectors; and data from business and household surveys;

e/ Information on the total floor area and energy consumption of commercial and civil-use buildings per type of building, fuel type and use purpose.

2. Forms of information provision:

a/ Paper documents, which must bear the certification of leaders of coordinating units and shall be sent to the focal unit;

b/ Electronic documents, which shall be submitted to the website of the energy information system using the electronic reporting software atwww.veis.erea.gov.vnor emailed to[email protected].

3. The deadline for provision of information must comply with cooperation agreements on information exchange.

Article 9.Collection of energy information via surveys

1. Energy information shall be collected on the basis of surveys held by the focal unit under plans in order to obtain information not yet collected under Articles 7 and 8 of this Circular.

2. Surveys shall be conducted in accordance with the regulations on statistical surveys.

Article 10.Mechanisms for coordination in collection of energy information

1. The focal unit shall sign agreements, accords or regulations on coordination in collection, exchange and provision of information with coordinating units according to the contents prescribed in Article 8 of this Circular and other relevant laws.

2. The focal unit shall sign contracts with capable units for the latter to conduct surveys and additionally collect necessary energy information in accordance with current law.

Article 11.Publicization, provision and use of energy information

1. Energy information shall be publicized in the form of publication, covering the following fundamental information:

a/ Overview on and trends of the national energy development;

b/ Energy balance sheets and supply-demand balance;

c/ Time-series data about the exploitation, import-export, production, conversion and consumption of electricity, coal, oil and gas, new energy and renewable energy;

d/ Time-series data about power source capacity and power output per fuel, power consumption output of economic sectors, maximum demand of the power system, reserve coefficient of the power system, rates of electrified communes and households, and power supply reliability indicators;

dd/ General energy statistical indexes: total supply of primary energy, primary energy intensity of gross domestic product (GDP), primary energy supply per capita; energy dependency in total primary energy supply; total final energy consumption, primary energy intensity of GDP, final energy consumption per capita; and energy diversification rate, fuel shares in primary energy supply and final energy consumption;

e/ Renewable energy indexes: renewable energy shares in primary energy supply, electricity production and final energy consumption; greenhouse gas emission indexes in the fields of energy, industrial production, manufacturing industries, construction, and transport, and other sub-sectors;

g/ Comparison of Vietnam’s energy statistics indexes with those of some countries in the region and the world.

2. Energy information shall be publicized on the website of the energy information system atwww.veis.erea.gov.vn.

3. Energy information shall be provided and used by group as follows:

a/ Sharing to the public;

b/ Provision to international organizations according to the obligations and responsibilities in the agreements between the Socialist Republic of Vietnam and these organizations;

c/ Provision upon request of related organizations and individuals to serve state management work in accordance with law.

 

Chapter III

ENERGY INFORMATION SYSTEM

Article 12.Establishment and operation of the energy information system

1. The focal unit shall assume the prime responsibility for, and coordinate with related units in, establishing and operating the energy information system, energy database and website of the energy information system.

2. The focal unit shall submit its proposal on personnel and funds for the establishment and operation of the energy information system to competent authorities for approval.

Article 13.Infrastructure facilities of and measures to manage the energy information system

1. Basic infrastructure facilities of the energy information system include:

a/ A server room ensuring the operation of the energy information system, consisting of electricity supply and lighting systems, UPS devices, equipment cabinets, air conditioners, fight prevention and fighting devices, surveillance cameras and entrance and exit control devices;

b/ Server equipment;

c/ Data storage and backup devices;

d/ Information safety, security and confidentiality equipment;

dd/ Equipment serving information access, exploitation and update.

e/ Infrastructure software, including the operating system and related software;

g/ Special-use software for computation and estimation of models and data separation and conversion;

h/ Digitalization and digital content creation devices;

i/ Communications equipment and transmission lines.

2. Measures for management of the energy information system

a/ To regularly supervise and maintain the operation of the system, ensuring uninterrupted and safe operation;

b/ To periodically review and propose measures to maintain, update and develop the system’s infrastructure to meet actual demands in each period.

Article 14.Funds for the operation of the energy information system

1. Funds for the establishment, operation, maintenance and development of the energy information system come from the following sources:

a/ Allocations from the state budget on the basis of annual cost estimates of the Ministry of Industry and Trade;

b/ Donations of organizations and individuals at home and abroad;

c/ Funds from other lawful sources in accordance with law.

2. Funds for establishment, operation, maintenance and development of the energy information system shall be spent on:

a/ Investment in physical and technical foundations and human resources serving the establishment, operation, maintenance and development of the energy information system;

b/ Research and training activities serving the management, operation, maintenance and exploitation of the energy information system;

c/ Survey, collection, processing, update and integration of information to the energy information system;

d/ Activities to ensure information safety, security and confidentiality.

3. The focal point shall be responsible for summing up annual cost estimates from the sources prescribed in Clause 1 of this Article.

 

Chapter IV

ORGANIZATION OF IMPLEMENTATION

Article 15.Responsibilities of units under the Ministry of Industry and Trade

1. The Electricity and Renewable Energy Authority shall:

a/ Act as the focal point in establishing and managing the operation of the energy information system;

b/ Formulate, and guide the implementation of, the operation management process, ensuring system safety and information security;

c/ Formulate and guide the reporting process; organize training courses to raise capacity of reporting units, coordinating units and organizations and individuals involved in collection of energy information;

d/ Organize the receipt, examination and verification of information collected from reports and survey data, and take responsibility for the contents of information and data updated to the energy database.

2. The Electricity Regulatory Authority of Vietnam shall provide and update information on the number of enterprises licensed to conduct electricity activities, number and capacity of power plants participating in the electricity market, and other energy information falling under its management;

3. The Energy Conservation and Sustainable Development Department shall provide and update annual information on key energy users and other energy information falling under its management;

4. The Oil, Gas and Coal Department shall provide and update information on oil, gas and coal deposits and other energy information falling under its management;

5. The Institute of Energy shall provide and update information on energy demand forecasts and energy prospects and other energy information according to its functions and tasks.

6. The units referred to in Clauses 2, 3, 4 and 5 of this Article shall send reports to the focal point before June 30 of the year following the reporting year.

Article 16.Responsibilities of provincial-level Departments of Industry and Trade

Provincial-level Departments of Industry and Trade shall request related organizations and individuals in their localities to provide information and report data as prescribed in Forms No. 5.1 thru 5.7 provided in Appendix V to this Circular.

Article 17.Responsibilities of reporting units

1. The Electricity of Vietnam shall report data as prescribed in Forms No.1.1 thru 1.16 provided in Appendix I to this Circular.

2. Electricity production units not belonging to the Electricity of Vietnam shall report data as prescribed in Form No. 1.17  provided in Appendix I to this Circular.

3. The Vietnam National Coal-Mineral Industries Holding Cooperation Limited  and coal mining and trading enterprises shall report data as prescribed in Forms No. 2.1 thru 2.4  provided in Appendix II to this Circular.

4. The Vietnam Oil and Gas Group shall report data of its attached units as prescribed in Forms No. 3.1 thru 3.15 provided in Appendix III to this Circular.

5. Oil refining enterprises not belonging the Vietnam Oil and Gas Group shall report data as prescribed in Forms No. 3.16 thru 3.18 provided in Appendix III to this Circular.

6. Enterprises not belonging to the Vietnam Oil and Gas Group which produce petrol and petroleum oil products from condensate shall report data as prescribed in Forms No. 3.19 thru 3.21 provided in Appendix III to this Circular.

7. Biofuel production and blending enterprises not belonging to the Vietnam Oil and Gas Group shall report data as prescribed in Forms No. 3.22 thru 3.24 provided in Appendix III to this Circular.

8. CNG production and distribution enterprises not belonging to the Vietnam Oil and Gas Group shall report data as prescribed in Forms No. 3.25 thru 3.27 provided in Appendix III to this Circular.

9. Vietnam National Petroleum Group and petroleum wholesale enterprises shall report data as prescribed in Form No. 4 provided in Appendix IV to this Circular.

Article 18.Coordination of ministries and sectors in information exchange and provision

Ministries and sectors shall, within the ambit of their functions and tasks, via cooperation activities, exchange with and provide to the focal point the information prescribed in Article 8 of this Circular serving the formation and maintenance of the energy database in a synchronous and efficient manner.

Article 19.Effect

This Circular takes effect on April 1, 2020.

Article 20.Implementation responsibility

1. The Director of the Electricity and Renewable Energy Authority shall guide, monitor and inspect the implementation of this Circular.

2. Heads of related units under the Ministry of Industry and Trade; directors of provincial-level Departments of Industry and Trade and related organizations and individuals shall implement this Circular.-
