Circular 28/2019/TT-BCT amend Circular 57/2018/TT-BCT detailing Decrees on tobacco business

CIRCULAR

On amending and supplementing a number of Articles of the Circular No. 57/2018/TT-BCT dated December 26, 2018 of the Minister of Industry and Trade detailing a number of Articles of Decrees related to tobacco business

Pursuant to the Government’s Decree No. 98/2017/ND-CP dated August 18, 2017 defining the functions, tasks, powers and organizational structure of the Ministry of Industry and Trade;

Pursuant to the Government’s Decree No. 67/2013/ND-CP dated June 27, 2013 detailing some articles and implementation measures of the Law on Prevention of Tobacco Harm on tobacco business and the Government’s Decree No. 106/2017/ND-CP dated September 14, 2017 on  amending, supplementing a number of articles of the Decree No. 67/2013/ND-CP dated June 27, 2013;

Pursuant to the Government’s Decree No. 08/2018/ND-CP dated January 15, 2018 on amending a number of the Articles of the Decrees related to business conditions under state management of the Ministry of Industry and Trade;

At the request of the Industry Agency,

The Minister of Industry and Trade hereby issues the Circular on amending and supplementing a number of Articles of the Circular No. 57/2018/TT-BCT dated December 26, 2018 of the Minister of Industry and Trade detailing a number of Articles of Decrees related to tobacco business as follows:

Article 1. To amend and supplement a number of Articles of the Circular No. 57/2018/TT-BCT dated December 26, 2018 of the Minister of Industry and Trade detailing a number of Articles of Decrees related to tobacco business as follows:

1. To add Article 13a as follow:

“Article 13a. Methods of sending and receiving report:

Report is sent to receiving agency by one of the following methods:

a) Send directly;

b) Send by post;

c) Other methods in accordance with law provisions.”

2. To amend Clause 2 and 4 Article 22 as follows:

“2. Provisions on proposal forms and lists for issuance of License to manufacture tobacco and forms of License to manufacture tobacco shall take effect from January 01, 2021.

4. Provisions on proposal forms and lists for issuance of License to manufacture tobacco and forms of License to manufacture tobacco in the Circular No. 21/2013/TT-BCT shall be applied until December 31, 2020.”

3. Appendix 1 enclosed with this Circular shall replace Appendix 74 enclosed with the Circular No. 57/2018/TT-BCT dated December 26, 2018 of the Minister of Industry and Trade detailing a number of Articles of Decrees related to tobacco business.

Article 2. Effect

This Circular takes effect on January 01, 2020./.
