CIRCULAR
Promulgating the list of scraps of which temporary import for re-export or border-gate transfer is suspended[1]
Pursuant to June 12, 2017 Law on Foreign Trade Management;
Pursuant to the Government’s Decree No. 98/2017/ND-CP of August 18, 2017, defining the functions, tasks, powers and organizational structure of the Ministry of Industry and Trade;
Pursuant to the Government’s Decree No. 69/2018/ND-CP of May 15, 2018, detailing a number of articles of the Law on Foreign Trade Management;
At the proposal of the Director of the Agency of Foreign Trade,
The Minister of Industry and Trade promulgates the Circular providing the list of scraps of which temporary import for re-export or border-gate transfer is suspended.
Article 1.Scope of regulation
This Circular promulgates the list of scraps of which temporary import for re-export or border-gate transfer is suspended.
Article 2.Subject of application
1. Traders engaged in temporary import for re-export or border-gate transfer business.
2. Organizations and agencies managing temporary import for re-export and border-gate transfer business.
3. Agencies, organizations and individuals related to temporary import for re-export or border-gate transfer business.
Article 3.To promulgate the list of scraps of which temporary import for re-export or border-gate transfer is suspended
1. To provide the list of scraps of which temporary import for re-export or border-gate transfer is suspended in the Appendix to this Circular.
2. The list of scraps provided in the Appendix to this Circular is not applicable to cases of border-gate transfer of goods transported directly from exporting countries to importing countries not via Vietnamese border gates.
Article 4.Effect
1. This Circular takes effect on January 1, 2010 through December 31, 2024, and replaces the Ministry of Industry and Trade’s Circular No. 41/2018/TT-BCT of November 6, 2018, prescribing the list of scraps of which temporary import for re-export or border-gate transfer is suspended.
2. Any problems arising in the course of implementation of this Circular should be reported in writing to the Ministry of Industry and Trade for solution.

APPENDIX
LIST OF SCRAPS OF WHICH TEMPORARY IMPORT FOR RE-EXPORT OR BORDER-GATE TRANSFER IS SUSPENDED

This list is drawn up based on the list of Vietnam’s exports and imports promulgated together with the Ministry of Finance’s Circular No. 65/2017/TT-BTC of June 27, 2017. The principles for use of the list are as follow:
1. In case only 2-digit headings are provided, this Circular applies to all 8-digit sub-headings in this Chapter.
2. In case only 4-digit headings are provided, this Circular applies to all 8-digit sub-headings pertaining to such 4-digit headings.
3. In case of headings 3919, 3920 and 3921, and subheadings 3923.21 and 3923.29 on this List, this Circular applies only to used goods.
