CIRCULAR
Prescribing tariff quota-based import of material tobacco under the Comprehensive and Progressive Agreement for Trans-Pacific Partnership[1]
Pursuant to the Government’s Decree No. 98/2017/ND-CP of August 18, 2017, defining the functions, tasks, powers and organizational structure of the Ministry of Industry and Trade;
Pursuant to the Government’s Decree No. 69/2018/ND-CP of May 15, 2018, detailing a number of articles of the Law on Foreign Trade Management;
In implementation of the Comprehensive and Progressive Agreement for Trans-Pacific Partnership (CPTPP Agreement), which was concluded on March 8, 2018, and officially took effect in Vietnam on January 14, 2019;
At the proposal of the Director General of the Agency of Foreign Trade,
The Minister of Industry and Trade promulgates the Circular prescribing import of material tobacco under the tariff quotas committed in the CPTPP Agreement.
Article 1.Scope of regulation
This Circular regulates the import of material tobacco (HS code 2401) under the tariff quotas committed in the CPTPP Agreement.
Article 2.Subjects of application
1. Traders importing material tobacco under the tariff quotas committed in the CPTPP Agreement.
2. Organizations and individuals involved in import of material tobacco under the tariff quotas committed in the CPTPP Agreement.
Article 3.Tariff quota volumes
1. The tariff quota volume of material tobacco to be imported each year is provided in Appendix I to this Circular.
2. The tariff quota volume of material tobacco to be imported under the CPTPP Agreement is not included in the tariff quota volume of material tobacco to be imported under Vietnam’s commitments upon accession to the World Trade Organization (WTO), which is announced every year by the Ministry of Industry and Trade.
Article 4.Subjects eligible for and methods of tariff quota allocation
1. Tariff quotas shall be allocated to state commercial enterprises under Circular No. 12/2018/TT-BCT.
2. Methods of tariff quota allocation must comply with the Ministry of Industry and Trade’s Circular No. 12/2018/TT-BCT of June 15, 2018, detailing a number of articles of the Law on Foreign Trade Management, and the Government’s Decree No. 69/2018/ND-CP of May 15, 2018, detailing a number of articles of the Law on Foreign Trade Management.
Article 5.Other provisions
Duties and tariff quotas must comply with the Government’s regulations.
Article 6.Effect
This Circular takes effect on February 29, 2020.-
