SUMMARY

From March 05, 2020, royalty-liable prices of many minerals shall change

On January 20, 2020, the Ministry of Finance issues the Circular No. 05/2020/TT-BTC on amending and supplementing a number of Articles of the Circular No. 05/2020/TT-BTC dated May 12, 2017 of the Minister of Finance on 44/2017/TT-BTC on the frame of royalty-liable prices for groups and types of resources with similar physical and chemical property.

Accordingly, to change the minimum royalty-liable prices of soil exploited for ground leveling and work construction from VND 49.000 per m3 down to VND 27.000 per m3. The maximum price remains unchanged.

In addition, as the former regulations, limestone for manufacturing industrial lime (exploited mineral) shall have the minimum royalty-liable prices of VND 161.000 per m3 and the maximum royalty-liable prices of VND 63.000 per m3, now the royalty-liable prices shall be lower to VND 63.000 per m3 and VND 90.000 per m3.

For the backfill sand (including saline sand), which has the former maximum royalty-liable price of VND 80.000 per m3now shall be up to VND 200.000 per m3. Besides, this Circular add a  frame of royalty-liable prices for CO2 which is recovered from natural mineral water with the minimum price of VND 2.3 million per ton and the maximum price of VND 2.8 million per ton.

This Circular also repeal the transitional provisions of the Circular No. 44/2017/TT-BTC on that the type of resources in the price table of royalties tax issued by the provincial People's Committee no longer consistent with the price frame of taxable natural resources, the provincial People's Committee shall issue the adjusted document that no later than 90 days from the Circular No. 44/2017/TT-BTC is no longer applicable.

This Circular takes effect from March 05, 2020.

On amending and supplementing a number of Articles of the Circular No. 44/2017/TT-BTC dated May 12, 2017 of the Minister of Finance on the frame of royalty-liable prices for groups and types of resources with similar physical and chemical property

Pursuant to the Law No. 45/2009/QH12 on Royalties dated November 25, 2009;

Pursuant to the Law No. 11/2012/QH13 on Prices dated June 20, 2012 and its guiding documents;

Pursuant to the Resolution No. 1084/2015/UBTVQH13 dated December 10, 2015 of the National Assembly Standing Committee on promulgating the Tariff Schedule of Royalties;

Pursuant to the Government’s Decree No. 50/2010/ND-CP of May 15, 2018, detailing a number of articles of the Law on Royalties;

Pursuant to the Government’s Decree No. 12/2015/ND-CP on detailing the implementation of the Law Amending and Supplementing a Number of Articles of the Tax Laws and amending and supplementing a number of articles of the decrees on taxes;

Pursuant to the Government's Decree No. 87/2017/ND-CP dated July 26, 2017 defining the functions, tasks, powers and organizational structure of the Ministry of Finance;

At the request of the Director of the General Department of Taxation;

The Minister of Finance hereby promulgates the Circular on amending and supplementing a number of Articles of the CIRCULAR No. 44/2017/TT-BTC dated May 12, 2017 of the Minister of Finance on 44/2017/TT-BTC on the frame of royalty-liable prices for groups and types of resources with similar physical and chemical property.

Article 1. To amend and supplement a number of Articles of the Circular No. 44/2017/TT-BTC dated May 12, 2017 of the Minister of Finance on 44/2017/TT-BTC on the frame of royalty-liable prices for groups and types of resources with similar physical and chemical property (Hereinafter referred to as the Circular No 44/2017/TT-BTC):

1. To amend and supplement Clause 4 Article 5 of the Circular No 44/2017/TT-BTC as follow:

“4. Royalty-liable prices in the Table of Royalty-liable prices must conform with the frame of Royalty-liable prices (higher than or equal to the minimum price and lower than or equal to the maximum price), of the group and type of mineral prescribed in the frame of royalty-liable prices, except for case prescribed in Article 6 this Circular.”

2. To replace the Appendices No. I, II, III and V  issued together with the Circular No. 44/2017/TT-BTC by the Appendices  No. I, II, III and V issued together with this Circular

3. To add the Appendix No. VII - Price bracket for calculation of royalties on other resources issued together with this Circular.

Article 2. To repeal Article 8 of the Circular No. 44/2017/TT-BTC.

Article 3. Effect

1. This Circular takes effect on May 05, 2020.

2. Any problem arising in the course of implementation should be promptly reported to the Ministry of Finance to review and handle./.
