SUMMARY

To not import of wastes through road and railway border gates

On January 9, 2019, the Ministry of Industry and Trade issues the Circular No. 01/2019/TT-BCT prescribing the border gates for import of wastes.

Accordingly, the import of wastes for use as production materials may be conducted through border gates under regulations, except road and railway border gates. This regulation does not apply to temporary import, re-export, border-gate transfer and transit of wastes.

This Circular takes effect on February 22, 2019.

CIRCULAR

Prescribing the border gates for import of wastes[1]

 

Pursuant to the June 12, 2017 Law on Foreign Trade Management;

Pursuant to the Government’s Decree No. 98/2017/ND-CP of August 18, 2017, defining the functions, tasks, powers and organizational structure of the Ministry of Industry and Trade;

Pursuant to the Government’s Decree No. 69/2018/ND-CP of May 15, 2018, detailing a number of articles of the Law on Foreign Trade Management;

Pursuant to the Government’s Decree No. 112/2014/ND-CP of November 21, 2014, on the management of land border gates;

At the proposal of the Director of the Agency of Foreign Trade,

The Minister of Industry and Trade promulgates the Circular prescribing the border gates for import of wastes.

 

Article 1.Scope of regulation

1. This Circular prescribes the border gates for import of wastes permitted for import from foreign countries for use as production materials on the Prime Minister-prescribed list.

2. This Circular does not apply to temporary import, re-export, border-gate transfer and transit of wastes.

Article 2.Subjects of application

This Circular applies to traders importing wastes for use as production materials and related agencies and organizations.

Article 3.Provisions on import border gates

The import of wastes for use as production materials may be conducted through border gates under regulations, except road and railway border gates.

Article 4.Effect

This Circular takes effect on February 22, 2019.-
