Circular No.22/2018/TT-BTTTT dated December 28, 2018 of the Ministry of Information and Communications on promulgating Lists of imports and exports of the printing and publishing industries

Pursuant to the Law on Publishing dated November 20, 2012;

Pursuant to the Law on Foreign Trade Management dated June 12, 2017;

Pursuant to the Decree No. 17/2017/ND-CP dated February 17, 2017 of the Government on defining the functions, tasks, powers and organizational structure of the Ministry of Information and Communications

Pursuant to the Decree No. 195/2013/ND-CP dated November 21, 2013 of the Government detailing a number of articles of, and measures for implementing, the Publication Law

Pursuant to the Decree No. 69/2018/ND-CP dated May 15, 2018 of the Government on guidelines for the Law on Foreign Trade Management

Pursuant to the Decree No. 60/2014/ND-CP dated June 19. 2014 of the Government on prescribing printing activities

Pursuant to the Decree No. 25/2018/ND-CP dated February 28, 2018 of the Government on amending and supplementing a number of articles of the Government’s Decree No. 60/2014/ND-CP of June 19, 2014, prescribing printing activities;

At the request of the Director of the Authority of Publication, Printing and Distribution,

The Minister of Information and Communications hereby issues the Circular onpromulgating Lists of imports and exports of the printing and publishing industries

Article 1. Lists of imports and exports of the printing and publishing industries

To issue with this Circular the Lists of imports and exports of the printing and publishing industries, including:

1. Appendix 01: List of commodities classified by HS codes and methods for management of imports and exports of the printing industry.

2. Appendix 02: List of commodities classified by HS codes and methods for management of imports and exports of the publishing industry.

Article 2. Implementation provisions

1. This Circular takes effect on February 12, 2019 and supersedes the Circulars as follows:

a) The Circular No. 16/2015/TT-BTTTT dated June 17, 2015 of the Ministry of Information and Communications detailing the Government’s Decree No. 187/2013/ND-CP of November 20, 2013, prescribing import and export of goods in the fields of printing and distribution of publications;

b) Circular No. 41/2016/TT-BTTTT dated December 26, 2016 of the Ministry of Information and Communications on amending and supplementing a number of the Circular No. 16/2015/TT-BTTTT dated June 17, 2015 of the Minister of Information and Communications prescribing the implementation of the Decree No. 187/2013/ND-CP dated November 20, 2013 on export and import of goods in printing and publication industries;

2. The Chief of Office, Director of Authority of Publication, Printing and Distribution, heads of affiliates of the Ministry of Information and Communications; authorities, organizations and individuals participating in or related to import and export of commodities of the printing and publishing industries shall implement this Circular.

3. Any difficulties arising in the course of implementation of this Circular should be promptly reported to the Authority of Publication, Printing and Distribution affiliated to the Ministry of Information and Communications for consideration./.

APPENDIX 01

LIST OF COMMODITIES CLASSIFIED BY HS CODES AND METHODS FOR MANAGEMENT OF IMPORTS AND EXPORTS OF THE PRINTING INDUSTRY
(Issued with the Circular No. 22/2018/TT-BTTTT dated December 28, 2018 of the Minister of Information and Communications)

I. Commodities classified by HS codes and methods for management of import thereof

1. Upon import of the commodities mentioned in the List below, the import license issued by the Ministry of Information and Communications is required (only applicable to commodities with their 08-digit HS codes)

2. Procedures and applications for issuance of import license to the commodities on the List specified in Section I.1 shall comply with Articles 27 and 28 of the Government’s Decree No. 60/2014/ND-CP dated June 19, 2014 (To amend and supplement a number of Articles of the Government’s Decree No. 25/2018/ND-CP dated February 28, 2018).

3. Upon import of the printing commodities of headings 84.40, 84.41 and 84.42 and commodities of heading 84.43 specified in the Circular No. 65/2017/TT-BTC dated June 27, 2017 of the Ministry of Finance that are not included in the List in Section I.1, the import license issued by the Ministry of Information and Communications is required.

II. EXPORTS

Exported commodities on the List in Section I.1, the export license issued by the Ministry of Information and Communications is not required./.

APPENDIX 02

LIST OF COMMODITIES CLASSIFIED BY HS CODES AND METHODS FOR MANAGEMENT OF IMPORTS AND EXPORTS OF THE PUBLISHING INDUSTRY

I. Commodities classified by HS codes and methods for management of import thereof

Procedures and applications for confirmation of registration of import of publications for business purpose regarding commodities on the List in Section I.1 shall comply with Article 39 of the Law on Publishing and Circular No. 23/2014/TT-BTTTT dated December 29, 2014 of the Minister of Information and Communications detailing and guiding the implementation of a number or Articles of the Law on Publication and the Decree No. 195/2013/ND-CP dated November 21, 2013 of the Government detailing a number of Articles and the implementation of the Law on Publication.

3. Procedures and applications for issuance of import license to publications imported for non-business purpose regarding commodities on the List in Section I.1 shall comply with Article 41 of the Law on Publishing and Circular No. 23/2014/TT-BTTTT dated December 29, 2014 of the Minister of Information and Communications detailing and guiding the implementation of a number or Articles of the Law on Publication and the Decree No. 195/2013/ND-CP dated November 21, 2013 of the Government detailing a number of Articles and the implementation of the Law on Publication.

4. Regarding the commodities on the List in Section I.1, which are not required to obtain the import license as prescribed in Clauses 1 and 2 Article 42 of the Law on Publishing, management methods specified in this Circular shall not be applied.

5. The import of commodities on the List in Section I.1, which contain contents in breach of regulations laid down in Clause 1 Article 10 of the Law on Publishing shall be prohibited in any case.

II. Exports

1. The commodities on the List in Section I.1 which have been published and sold legally in Vietnam are allowed to be exported abroad as prescribed in Article 43 of the Law on Publishing and are not required to obtain the export license issued by the Ministry of Information and Communications.

2. The export of commodities on the List in Section I.1, which contain contents in breach of regulations laid down in Clause 1 Article 10 of the Law on Publishing shall be prohibited in any cases./.
