RESOLUTION
On the feasibility study report for the investment project to build Long Thanh international airport, phase 1[1]
THE NATIONAL ASSEMBLY
Pursuant to the Constitution of the Socialist Republic of Vietnam;
Pursuant to Law No. 49/2014/QH13 on Public Investment, which has a number of articles amended and supplemented under Law No. 28/2018/QH14;
Pursuant to Land Law No. 45/2013/QH13, which has a number of articles amended and supplemented under Law No. 35/2018/QH14;
Pursuant to the National Assembly’s Resolution No. 94/2015/QH13 of June 25, 2015, on the policy on investment in the Long Thanh international airport project;
Pursuant to the National Assembly’s Resolution No. 53/2017/QH14 of November 24, 2017, on the feasibility study report of the project on land recovery, compensation, support and resettlement for Long Thanh international airport;
After considering the Government’s Report No. 450/TTr-CP of October 7, 2019, Verification Report No. 1655/BC-UBKT14 of October 23, 2019, of the National Assembly’s Committee on Economic Affairs, Explanatory Report No. 494/BC-UBTVQH14 of November 22, 2019, of the National Assembly Standing Committee, relevant documents, and opinions of National Assembly deputies,
RESOLVES:
Article 1
To approve a number of major contents of the feasibility study report for the investment project to build Long Thanh international airport, phase 1 (below referred to as the project),as follows:
1. To invest in building 1 runway and 1 passenger terminal with synchronous auxiliary items for receiving 25 million passengers and 1.2 million tons of cargo per year;
2. The Government shall consider and decide on the project’s total investment amount, including expenses for compensation and ground clearance, under the laws on public investment, construction, and management and use of public assets, and relevant laws, provided that the total investment amount of the whole Long Thanh international airport project does not exceed the total investment amount prescribed in the National Assembly’s Resolution No. 94/2015/QH13 of June 25, 2015, on the policy on investment in the Long Thanh international airport project (below referred to as Resolution No. 94/2015/QH13);
3. The Government shall select investors in accordance with law, ensuring national defense and security maintenance, and guaranteeing the State’s interests and national interests; ensure the state management under the law on civil aviation, and that the airport will be used for military purposes;
4. Capital raising plans:
a/ To use investors’ capital but not government guarantee;
b/ To ensure the project’s progress, feasibility and efficiency, and transparency and publicity;
5. Applicable technologies: To comply with Clause 4, Article 2 of Resolution No. 94/2015/QH13;
6. To adjust the land area for national defense purpose from 1,050 hectares to 570 hectares exclusively for national defense purpose and 480 hectares for construction of aviation infrastructure facilities for military and civil purposes. The management and use of the land area for military and civil purposes must comply with the land law and law on civil aviation, giving priority to military activities upon performance of national defense tasks;
7. To additionally build 2 road routes linked to the project, namely: route No. 01 linked to national highway 51; and route No. 02 linked to the Ho Chi Minh City-Long Thanh-Dau Giay expressway. The investment, land recovery, compensation, support and resettlement must comply with law.
Article 2
1. The Government shall direct the State Appraisal Council, Ministry of Transport, related ministries and sectors, and the People’s Committee of Dong Nai province to coordinate with one another in performing the following jobs:
a/ To promptly consider and complete the feasibility study report of the project, ensuring its quality and progress, and submit it to the Prime Minister for investment decision, further clarifying the contents on total investment amount, socio-economic and financial efficiency, main technologies, management, operation, human resources training, and special mechanisms and policies (if any) according to their competence;
b/ To complete the land recovery, compensation, support and resettlement work to hand over land areas for the project construction, ensuring that the project is completed and put into operation in accordance with Resolution No. 94/2015/QH13.
2. The Government shall study investment in building a transport system linking the Long Thanh international airport area with the southern key economic region in suitability with each investment period to make Long Thanh international airport become an entrepot airport of the region and the world.
Article 3
The Government shall annually report to the National Assembly on the implementation of the Long Thanh international airport project under the National Assembly’s resolutions.
The Standing Committee, Committee on Economic Affairs, Ethnic Council, and other Committees of the National Assembly, National Assembly deputies’ delegations, National Assembly deputies, and the People’s Council of Dong Nai province shall, within the ambit of their tasks and powers, oversee the implementation of this Resolution.
This Resolution takes effect on the date of its adoption by the National Assembly.-
This Resolution was adopted on November 26, 2019, by the XIVthNational Assembly of the Socialist Republic of Vietnam at its 8thsession.-
