RESOLUTION

On the pre-feasibility study report of the Project on land recovery, compensation, support and resettlement for Long Thanh international airport[1]

THE NATIONAL ASSEMBLY

Pursuant to the Constitution of the Socialist Republic of Vietnam;

Pursuant to Public Investment Law No. 49/2014/QH13;

Pursuant to Land Law No. 45/2013/QH13;

Pursuant to the National Assembly’s Resolution No. 94/2015/QH13 of June 25, 2015, on the policy on investment in Long Thanh international airport project;

Pursuant to the National Assembly’s Resolution No. 38/2017/QH14 of June 19, 2017, separating the contents on land recovery, compensation, support and resettlement of the Long Thanh international airport project into a component project;

Pursuant to the National Assembly’s Resolution No. 26/2016/QH14 of November 10, 2016, on the medium-term public investment plan during 2016-2020;

After considering the Government’s Report No. 492/TTr-CP of October 22, 2017, Verification Report No. 737/BC-UBKT14 of October 25, 2017, of the National Assembly’s Committee on Economic Affairs, Explanatory Report No. 230/BC-UBTVQH4 of November 23, 2017, of the National Assembly Standing Committee, relevant documents and opinions of National Assembly deputies.

RESOLVES:

Article 1

To adopt a number of contents of the pre-feasibility report of the Project on land recovery, compensation, support and resettlement for Long Thanh international airport (below referred to as the Project) as follows:

1. The Project’s total investment: VND 22,938 billion (twenty two thousand, nine hundred and thirty eight billion dong).

2. To-be-recovered land area: 5,399.35 hectares, of which the area for the Long Thanh international airport project is 5,000 hectares, the area of the Loc An - Binh Son resettlement zone is 282.35 hectares, the area of sub-zone III of Binh Son resettlement zone is 97 hectares, and the area of the cemetery is 20 hectares.

3. Land recovery, compensation, support and resettlement shall be carried out in a single stage and completed before 2021.

Article 2

1. To assign the Government to specify support levels for households whose income is affected, ensuring harmony with those provided under projects already implemented in the locality.

2. The Government shall direct the People’s Committee of Dong Nai province to manage, exploit and use the Long Thanh international airport’s land area which has been recovered but on which infrastructure has not been built yet, and re-allocate such land area according to the implementation schedule of the Long Thanh international airport project, and give priority to leasing land to households and individuals whose agricultural land is recovered.

2. Fund allocation: In addition to the amount of VND 5 trillion (five trillion dong) which has been allocated by the National Assembly under its Resolution No. 26/2016/QH14 of November 10, 2016, the Project will be additionally allocated VND 15 trillion (fifteen trillion dong) from the total fund of VND 80 trillion (eighty trillion dong) arranged for national important projects under Resolution No. 26/2016/QH14 of November 10, 2016; and VND 2,938 billion (two thousand nine hundred and thirty eight billion dong) from the source of revenues from the collection of land use levy and allocation of resettlement land in the first phase of the Project, in case such revenues are not enough, the Government shall report it to the National Assembly Standing Committee for considering and deciding on additional allocation from the fund under the plan on medium-term investment of state budget funds during 2016-2020.

4. All proceeds from the auction of land use rights, allocation of resettlement land and lease of land under the Project shall be remitted to the central budget.

The Government shall determine an appropriate sharing rate between the central budget and local budget for regulating the proceeds to be earned from the use of land under planning in the surrounding areas of Long Thanh international airport.

Article 3

The Government shall direct related ministries and sectors and the People’s Committee of Dong Nai province to coordinate with one another in performing the following tasks:

1. To finalize the Project’s feasibility study report and submit it to the State Appraisal Council for reporting to the Prime Minister for decision on investment in the Project; to review unit prices used for compensation and support so as to ensure fairness between organizations and households and individuals.

2. To prepare master plans and designs of land lots in the resettlement zone and the minimum resettlement housing area suitable to the needs and payment capacity of people whose land is recovered.

3. To make and implement land recovery, compensation, support and resettlement plans, ensuring publicity and transparency, availability of technical and social infrastructure facilities, and stabilization of the livelihood of people and operation of agencies, organizations and units whose land is recovered.

4. To expeditiously prepare and implement a scheme on employment and livelihood for relocated people.

5. To properly disseminate public information, creating high consensus among people on the implementation the Project; to timely deal with complaints, denunciations, petitions and arising matters, ensuring security and social order and safety in the locality; to strictly handle violations committed in the process of implementing the Project.

Article 4

The Standing Committee, the Committee on Economic Affairs, the Ethnic Council, and other Committees of the National Assembly, National Assembly deputies’ delegations, National Assembly deputies, and the People’s Council of Dong Nai province shall, within the ambit of their tasks and powers, oversee the implementation of this Resolution.

This Resolution takes effect on the date of its adoption by the National Assembly.-

This Resolution was adopted on November 24, 2017, by the XIV^thNational Assembly of the Socialist Republic of Vietnam at its 4^thsession.-
