RESOLUTION

Approving the Free Trade Agreement between the Socialist Republic of Vietnam and the European Union^[1]

THE NATIONAL ASSEMBLY

Pursuant to the Constitution of the Socialist Republic of Vietnam;

Pursuant to Law No. 108/2016/QH13 on Treaties;

At the proposal of the President in Report No. 01/TTr-CTN of April 18, 2020, approving the Free Trade Agreement between the Socialist Republic of Vietnam and the European Union;

In consideration of the Government’s Explanatory Report No. 192/BC-CP of May 8, 2020, the National Assembly Committee for External Relations’ Appraisal Report No. 4686/BC-UBDN14 of May 13, 2020, and opinions of National Assembly deputies,

RESOLVES:

Article 1.Ratification of the treaty

To ratify the Free Trade Agreement between the Socialist Republic of Vietnam and the European Union (below referred to as the Agreement) that was concluded on June 30, 2019, in Hanoi, Vietnam. The full text of the Agreement in English and its Vietnamese translation are provided in Appendix 1 to this Resolution.

Article 2.Application of the treaty

To apply the whole content of the Agreement, in which:

1. The provisions of the Agreement provided in Appendix 2 to this Resolution will be applied directly;

2. The provisions of the Agreement provided in Appendix 3 to this Resolution will be applied directly until Law No. 50/2005/QH11 on Intellectual Property which was amended and supplemented under Law No. 36/2009/QH12 and Law No. 42/2019/QH14 comes into force;

3. To apply the Agreement to the United Kingdom in the period from the effective date of this Agreement through December 31, 2020 (this period may be extended for 24 months under the agreement between the United Kingdom and the European Union on the United Kingdom’s withdrawal from the European Union).

Article 3.Organization ofimplementation of the treaty

1.The Government, Supreme People’s Court, Supreme People’s Procuracy, and related agencies and organizations shall review according to their competence the legal documents provided in Appendix 4 to this Resolution and other relevant legal documents for revision or annulment thereof or promulgation of new ones, or propose competent agencies to revise or annul legal documents or promulgate new ones, ensuring the consistency of the legal system, and effective implementation of and keeping up with the roadmap for implementing commitments under the Agreement.

2. The Prime Minister shall organize the implementation of the Agreement; approve and direct related central and local agencies and organizations to implement the Agreement; prepare resources to optimize and bring into play opportunities and benefits brought about by the Agreement; effectively take measures to prevent and address adverse impacts that might arise during the implementation of the Agreement; promptly and fully disseminate the Agreement’s contents to create unanimity in the awareness and action of the political system, enterprises and citizens; and regularly review and evaluate implementation results and effectiveness of commitments already signed in the Agreement, and annually report to the National Assembly on the implementation of the Agreement.

3. The Government shall direct related ministries and sectors in completing external affairs procedures for ratification of the Agreement and notify the date the Agreement becomes effective in Vietnam.

Article 4.Oversight of the implementation of the Resolution

The National Assembly, National Assembly Standing Committee, Ethnic Council, and National Assembly Committees, deputies’ delegations and deputies shall, within the ambit of their tasks and powers, oversee the implementation of the Resolution.

This Resolution was adopted on June 8, 2020, by the XIV^thNational Assembly of the Socialist Republic of Vietnam at its 9^thsession.-
