ORDINANCE
Amending and Supplementing a Number of Planning-Related Articles of 4 Ordinances[1]
Pursuant to the Constitution of the Socialist Republic of Vietnam;
Pursuant to the National Assembly’s Resolution No. 74/2018/QH14 of November 20, 2018, on the sixth session of the XIVthNational Assembly;
The National Assembly Standing Committee promulgates the Ordinance Amending and Supplementing a Number of Planning-Related Articles of Ordinance No. 02/2018/PL-UBTVQH12 on Defense Industry, Ordinance No. 11/2016/UBTVQH13 on Market Surveillance; Ordinance No. 31/2000/PL-UBTVQH10 on Library, and Ordinance No. 26/2005/PL-UBTVQH11, on Preferential Treatment of People with Meritorious Services to the Revolution, of which a number of articles were amended and supplemented under Ordinance No. 04/2012/UBTVQH13.
Article 1.To amend and supplement a number of articles of the Ordinance on Defense Industry
1. To amend and supplement Clause 1, Article 6 as follows:
“1. Disclosing state secrets on building and development of the defense industry in the master plan on the system of defense works, military zones, ammunition depots, and defense industry, plans on building and development of the defense industry, scientific and technological results related to the defense industry, and tasks on product manufacturing serving national defense and security.”.
2. To amend and supplement Chapter III as follows:
“Chapter III
PLANS ON BUILDING AND DEVELOPMENT OF THE DEFENSE INDUSTRY
Article 12. Plans on building and development of the defense industry
1. Defense industry building and development plans must adhere to the principles defined in Article 4 of this Ordinance and meet the following requirements:
a/ Efficiently exploiting and using all national potentials and resources for building and development of the defense industry; supplying increasingly modern and advanced weapons and military technical equipment;
b/ Ensuring the balance, synchronism, rational scale and proper arrangement in strategic geographical areas;
c/ Being in line with national socio-economic development plans.
2. Grounds for formulation of plans on building and development of the defense industry:
a/ National defense and security tasks and socio-economic development tasks of the country;
b/ Strategies on sufficient supply of weapons and military technical equipment for the people’s armed forces;
c/ The master plan on the system of defense works, military zones, ammunition depots, and defense industry;
d/ The national industrial development plan, and the State’s capability to balance investment resources for building and development of the defense industry.
3. A plan on building and development of the defense industry must have the following contents:
a/ Definition of objectives, tasks, programs and key projects;
b/ Organization of the system of defense industrial establishments;
c/ Balance of resources, and implementation conditions and solutions.
Article 13. Competence to approve plans on building and development of the defense industry
1. The Prime Minister shall approve plans on building and development of the defense industry.
2. The Ministry of National Defense shall assume the prime responsibility for, and coordinate with the Ministry of Planning and Investment, Ministry of Industry and Trade and Ministry of Finance and related state agencies in, formulating plans on building and development of the defense industry for submission to the Prime Minister for approval.
Article 14. Formulation, approval and implementation of programs and investment projects on the defense industry
Based on the master plan on the system of defense works, military zones, ammunition depots, and defense industry and plans on building and development of the defense industry, which have been approved by the Prime Minister, the Ministry of National Defense shall assume the prime responsibility for, and coordinate with the Ministry of Planning and Investment, Ministry of Industry and Trade and Ministry of Finance and related state agencies in, formulating programs and investment projects on the defense industry, submit them to the Prime Minister for decision and organize the implementation thereof.
Article 15. Inspection and examination of the implementation of plans, programs and investment projects on the defense industry
The Ministry of Planning and Investment, Ministry of National Defense, Ministry of Industry and Trade and Ministry of Finance and related ministries and sectors shall, within the ambit of their respective tasks and powers, organize the inspection and examination of the building and development of the defense industry within the master plan on the system of defense works, military zones, ammunition depots, and defense industry, and plans, programs and investment projects on the defense industry.”.
3. To amend and supplement Article 19 as follows:
“Article 19. Land for the defense industry
1. The Prime Minister shall approve master plans and plans on the use of defense land, including land for the defense industry.
2. The Ministry of National Defense shall assume the prime responsibility for, and coordinate with competent state agencies in, formulating master plans and plans on the use of defense land, including land for building and development of core defense industrial establishments, then submit them to the Prime Minister for approval and organize the implementation thereof.
4. To amend and supplement Clause 2, Article 24 as follows:
“2. Formulating, and organizing the implementation of, policies, plans and tasks on the defense industry, and contents on building and development of the defense industry in the master plan on the system of defense works, military zones, ammunition depots, and defense industry.”.
Article 2.To amend and supplement Point a, Clause 1, Article 4 of the Ordinance on Market Surveillance
To amend and supplement Point a, Clause 1, Article 4 as follows:
“a/ Formulating, and directing the implementation of, strategies and plans on development of the market surveillance force;”.
Article 3.To amend and supplement Clause 1, Article 24 of the Ordinance on Library
To amend and supplement Clause 1, Article 24 as follows:
“1. Formulating, and directing the implementation of, strategies and plans for development of libraries of all types; formulating plans on development of the network of libraries within the master plan on the network of culture and sports establishments and other related master plans;”.
Article 4.To amend and supplement Clauses 2 and 3, Article 34a of the Ordinance on Preferential Treatment of People with Meritorious Services to the Revolution
To amend and supplement Clauses 2 and 3, Article 34a as follows:
“2. To formulate the master plan on the system of social relief institutions to nurture and take care of people with meritorious services to the revolution, and submit it to the Prime Minister for approval under the law on planning; to organize the management of the system of social relief institutions to nurture and take care of people with meritorious services to the revolution.
3. To coordinate with related agencies in formulating plans on determination of commemorative works of war martyrs’ meritorious services in related master plans; to issue regulations on the management of these works;”.
Article 5.Effect
This Ordinance takes effect on January 1, 2019.-
