On November 01, 2014, the Government issued the Resolution No. 78/NQ-CP on tax exemption for the Government bond in the international market in 2014. At the Resolution, the Government exempts the enterprise income tax and personnel income taxes for incomes from Government bond’s interest in the international market in 2014. At the same time, the Government appoints the Ministry of Finance to list in the prospectus and the documents supplied to the investors and appoints the |
Ministry of Justice to insert the legal opinions on issuing international government bonds in 2014. Previously, at the Resolution No. 64/NQ-CP on the Government’s regular meeting on August 08, 2014, the Government agreed to issue he government bonds in international capital market to exchange the bonds issued in 2005 and 2010; accordingly, the new capital sources shall be used in pay the due bonds |

The Ministry of Natural Resources and Environment has just issued the Circular No. 37/2014/TT-BTNMT dated June 30, 2014 detailing compensation, support and resettlement upon land recovery by the State. Within that, the important content is the change of the land use purpose from agricultural land to residential land for resettlement in case the land parcel with a house is recovered and has an area of agricultural land not recognized as residential land, which is prescribed in Clause 5, Article 6 of Decree No. 47/2014/ND-CP. Accordingly, in case the land parcel to be recovered has an area of agricultural land not recognized as residential land, change of the use purpose from agricultural land to residential land for resettlement may be effected only when the remaining area of the recovered land is eligible for parcel split under regulations of provincial-level People’s Committees of localities where the recovered land exists. In case the remaining area of the land parcel with a house is ineligible for parcel split under regulations of provincial-level People’s Committees of localities where the recovered land exists, a competent state agency shall decide on recovery or the land user may continue to use the remaining area under land use master plan and plans. Funds for compensation, support and resettlement for remaining |
areas in land parcels with houses ineligible for parcel split upon land recovery by the State must be stated in plans on compensation, support and resettlement. Also in accordance with this Circular, Cadres, civil servants and public employees (who are working or have retired due to old age or loss of working capacity or have been laid off with allowance), who are currently using agricultural land acquired from the transfer of agricultural land use rights in accordance with law, may receive land compensations but are not eligible for supports for stabilization of livelihood and production, training, occupation change and job seeking upon land recovery by the State. In case a household’s members are cadres, civil servants and public employees (who are working or have retired due to old age or loss of working capacity or have been laid off with allowance) and those who are not cadres, civil servants and public employees but currently use agricultural land for the agricultural production purpose, when the State recovers agricultural land of such household, its members who are not cadres, civil servants and public employees may receive support for stabilization of their livelihood and production, training, occupation change and job seeking. This Circular takes effect on August 13, 2014. |

On October 15, 2014, the Ministry of Education and Training issued the Circular No. 34/2014/TT-BGDDT guiding the implementation of a number of the Decree No. 73/2012/ND-CP dated September 26, 2012 of the Government on the foreign cooperation and investment in education, prescribing that students as Vietnamese citizens who study at primary schools or primary level of the foreign-invested mixed-level general schools must study Vietnamese program and Vietnamese studies. Program’s duration is no less than 70 minutes/week, from 4th grade to 5th grade and no less than 90 minutes/week, lower and upper secondary classes. Beside the Vietnamese program, students as Vietnamese citizens from 1st grade to 5th grade must learn Vietnamese no less than 140 minutes/week from December 01, 2014. This Vietnamese program’s objectives is to help students establish and develop their power of vocabulary as well as Vietnamese skills (listening, speaking, reading and writing) to facilitate study and interactions with their peers; provide students |
with initial knowledge of Vietnamese, Vietnamese culture and people. Organization of teaching in compulsory education programs for students being Vietnamese citizens must meet the conditions such as teachers are Vietnamese citizens who are fully qualified according to the regulation of the Vietnamese law; there are teaching materials compiled by the Ministry of Education and Training, or compiled by the educational institutions themselves based on the Vietnamese program and Vietnamese studies program as defined in Article 4 of this Circular and approved by the Provincial Service of Education and Training and language for teaching is Vietnamese. The evaluation of the performance of Vietnamese students that study compulsory education programs must rely on objectives and standardized knowledge, skills of the general education program promulgated by the Minister of Education and Training. This Circular takes effect on December 01, 2014. |

On August 01, 2014, the Prime Minister signed the Decision No. 1290/QD-TTg Approving the Plan of Action for development of electronics industry in implementation of Vietnam’s industrialization strategy within the framework of Vietnam-Japan cooperation through 2020, with a vision toward 2030; with a vision toward 2030 to build Vietnam into a country with large-scale production of electronic equipment with new, smart and environment-friendly technologies. At the same time, some strategic issues are mentioned such as the development of support industries for electronics industry; the development of human resources for electronics industry; the development and expansion of the domestic and export markets for electronics industry; the attraction of investment from leading electronics corporations around the world; the development of key |
products of electronics industry and the formation of electronics industry clusters…In particular, to elaborate regulations to permit export processing enterprises to sell on the domestic market electronic parts and accessories which cannot be produced in Vietnam in order to develop support enterprises and increase the localization rate of assembling enterprises and support the attraction and implementation of large FDI projects in electronics industry; to form electronics industry clusters to facilitate the capital accumulation and investment of enterprises in order to create linkages among and raise operation effectiveness of electronics enterprises; to encourage the application of the tripartite (enterprise-institute, school-state management agency) training model for training highly skilled human resources to meet requirements of enterprises. This Decision takes effect on the signing date. |

This is one of the Prime Minister’s objectives at the Decision No. 1288/QD-TTg dated August 1, 2014 approving the National Program on industrial extension to 2020. This program is implemented to 2020 for organizations and individuals directly investing or engaged in industrial and cottage industry production in rural districts, towns, townships, communes and wards of grade-2 and -3 cities, and wards of grade-1 cities which have been upgraded from communes for no more than 5 years; Industrial production establishments applying cleaner production with some main contents on organizing job and trade training; supporting the building of management capacity, awareness raising and application of cleaner production in industry through consultancy and training activities, seminars, workshops and forums; domestic and overseas study tours and surveys and supporting the building |
of technical demonstration models, technology transfer and application of modern machinery and equipment and scientific and technical advances. So that to 2020, train around 100,000 workers for rural industrial establishments; to support around 10,000 trainees to attend business start-up and management capacity building training courses and thematic seminars and workshops; to support the building of 160 technical demonstration models… Economic non-business operation funds from the central budget shall be allocated for industrial extension activities managed and implemented by the Ministry of Industry and Trade, which are estimated at VND 1,212 billion. The Ministry of Industry and Trade shall estimate funds for the Program implementation; cooperate with domestic and overseas organizations and individuals to call for funds and resources for industrial extension activities. This Decision takes effect on the signing date. |
