TRANSPORTING CHEMICALS FROM ONE TON OR MORE
MUST POSSESS CHEMICAL PERMIT

 

This is one of the contents regulated under the Circular No. 08/2012/TT-BYT date May 17, 2005 of the Ministry of Public Health guiding the transport of dangerous goods in the health sector by road motor vehicles.

Specifically, agencies, organizations or individuals (hereinafter referred to as the carriers) when transporting chemicals of from one thousand kilograms (1,000 kg) /vehicle/time or more must possess a transport of chemicals permit. When transporting chemicals of less than 1,000 kg/vehicle/time, the carriers are not required to possess a transport of chemicals permit but must comply with provisions on requirements on transport vehicles..

The vehicle transporting chemicals must satisfy the provisions such as: when transporting, it must have appliances and equipment for fire prevention and fighting

 

that are suitable to chemicals; It must have hood or canvas that may fully and tightly cover the cargo compartment to ensure no water permeation during transport; The size of the symbol of dangerous goods stuck on the vehicle is 500 mm x 500 mm.

The carriers of chemicals have responsibility to formulate clear and complete schedules for transport of dangerous goods; to send notices of specific times of their schedules of transport of chemicals and certified copies of permits for transport of chemicals and chemical safety data sheets to provincial-level People's Committees of provinces where the vehicles will go through under those made schedules in order to plan on assistance and support in case happening incidents….

This Circular takes effect on October 01, 2013.

LANG SON: BY 2020, THE ECONOMIC GROWTH RATE ACHIEVES 9-10%
 

To strive for the target that by 2020, Lang Son shall become a province with sustainable economic growth and positive economic restructuring…The Prime Minister issued the Decision No. 545/QD-TTg dated May 9, 2012 approving the master plan on socio-economic development of Lang Son province till 2020.

In order to achieve the specific target by 2020, the average economic growth rate shall reach 9-10%; the average per-capita GDP shall reach USD 2,600, the total social investment capital shall reach VND 64,000-66,000 billion…The Prime Minister pointed out some orientations socio-economic development of Lang Son province in the period of 2011 – 2020.

Specifically, to step up industrial development at high growth rate and with efficiency, attaching importance to investment in and renewal of technological equipment for higher competitiveness of products; To prioritize the development

 

of industries with potential and advantages; To diversify and raise the quality of services, strongly restructuring the service sector; To develop a commodity agriculture in association with market consumption demand; to concentrate on intensive farming and crop multiplication with science and technology application to increase productivity and quality of agricultural products; To strongly renew education administration, to build a comprehensive contingent of teachers and educational administrators…

The master plan on socio-­economic development of Lang Son province till 2020 serves as a basis for the making, approval and implementation of sectoral planning and investment projects in Lang Son province.

This Decision takes effect on its signing date.

SUPPLEMENTING THE LIST OF OBJECTS SUBJECT TO PLANT QUARANTINE
 

On August 15, 2012, the Ministry of Agriculture and Rural Development issued the Circular No.  40/2012/TT-BNNPTNT promulgating the list of objects subject to plant quarantine of the Socialist Republic of Vietnam.

Accordingly, compared with the Decision No. 72/2005/QD-BNN dated November 14, 2012, this Circular supplements the list of objects subject to plant quarantine (hereinafter referred to as objects) which export, import, border-gate transfer, temporary import for re-export, temporary export for re-import and transit in Vietnam including: Plant products such as Tubers, fruits, seeds, flowers, leaves,

 

trunks, branches, stumps, roots of all kinds; Rubber latex, resin, natural eraser, paper pulp, reeled paper; Mushrooms, wood ear mushrooms of all kinds; and organic fertilizer, micro-organic fertilizer of all kinds.

The Circular also clearly mentions, for export of objects not in the list objects subject to plant quarantine shall comply with requirement of importing countries and international common practices in which Vietnam has signed or acceded.

This Circular annuls the Decision No.72/2005/QD-BNN and takes effect on September 29, 2012.


LIVESTOCK FEED MUST BE ASSAYED IN PETS
 

This is one of the contents regulated under the Circular No. 42/2012/TT-BNNPTNT dated August 15, 2012 promulgating new national technical regulation on testing, inspecting domestic animals and livestock feed.

Accordingly, in addition to testing the livestock feed by analyzing the quality criteria in the laboratory complying QCVN 01-10:2009/BNNPTNT and QCVN 01-12: 2009/BNNPTNT on livestock feed, maximum level of antibiotics, drugs, microorganism and heavy metals in feeds for chickens, pigs. This Circular request

 

to assay feed directly on pets, the number of animals tested and the number of iterations depends on the experimental design.

Besides, the Circular also promulgated 02 national technical regulations on testing, inspecting honey bees and ostrich with a view to monitoring and evaluating the criteria related to the quality of new breeds first imported or newly created locally in a certain time and condition in order to determine the advantages, stability, uniformity on productivity and quality of livestock breeds.

This Circular shall take effect on September 29, 2012

ANNOUNCED ORIGINAL PROPRIETARY MEDICINES MUST HAVE PATENT
 

On August 22, 2012, the Minister of Public Health signed the Decision No. 2962/QD-BYT on promulgating temporary regulation on documents needs supply in order to announce lists of original proprietary medicines, medicines used for treatment similar with original proprietary medicines, medicines with documents proving bioequivalence.

Specifically, documents need supply in order to announce medicines under lists of original proprietary medicines including: a written request to the Ministry of Public Health for announcement of original proprietary;  Patent granted by one of competent intellectual property agencies determining scope of protection for corresponding medicine; Documents certifying on being transfer of patent use right or transferring ownership of patent from the owner of patent enclosed with the facility's commitment for exactness of this documents; Certificate of pharmacy product or certificate of free sale or Certificate of product circulation of medicine or other documents to prove (if any). 

 

If the enterprises want to announce medicine under lists of medicine used for treatment similar with original proprietary medicines, they need supply some documents such as: a written request to the Ministry of Public Health for announcement of medicine used for treatment similar with original proprietary medicines; Documents proving medicine prepared similar with original proprietary medicines; Documents proving that medicine has direction, use dose and information about medicine usage like as original proprietary medicines; Documents proving effectiveness and safety of medicine compared to original proprietary medicine

Besides, the Minister also promulgated the list of 14 intellectual property agencies granting patent approved to consider announcement of list of original proprietary medicines. Specifically, Austrian Patent Office, National Institute of Industrial Property - Brazil, Intellectual property Australia

This Decision takes effect from the day of signing.
