The Ministry of Finance has issued the Decision No. 788/QD-BTC dated April 27, 2015 on promulgating new administrative procedures on export of gold jewelry, goldsmiths’ wares and other golden articles in subheadings 71.13, 71.14, 71.15 of export tax schedule in the field of customs under the authority of Ministry of Finance. Accordingly, from May 07, 2015, Enterprises exporting gold jewelry and goldsmiths’ wares and other golden articles in subheadings 71.13, 71.14, 71.15 of export tax schedule that have gold content of under 95% and declare the export tax at 0%. The performing agencies are the Department of Customs, sub-department of customs of provinces, cities and the results of performing administrative procedures are: According to the Circular 38/2015/TT-BTC of the Ministry of Finance. |
Within that, to the Requirements, conditions of performing administrative procedures: the testing results of gold content under 95% issued by organizations in charge of assessing gold content in jewelry and goldsmiths’ wares include: Quality Assurance and Testing Center 1, Quality Assurance and Testing Center 3, Doji Institute & Laboratory for Gemology and Jewelry, A Chau Commercial Bank – Gold Center or organization appointed by the Directorate for Standards, Metrology and Quality. It is not applied for enterprises that export under the form of export processing, or being qualified to be determined to produce from the entire imported, exported material under the form of export production. This Decision takes effect on May 07, 2015. |

In accordance with the Decree No. 15/2015/ND-CP dated February 14, 2015 of the Government On investment in the form of public-private partnership. The ratio of equity of an investor must not be lower than 15% of the total investment capital. For a project capitalized at over VND 1,500 billion, the equity ratio shall be determined on the principle of partial progress. Besides, the Decree also prescribes the Conditions for projects to be selected with the public-private partnership form. Accordingly, A project to be selected for implementation in the form of public-private partnership must fully satisfy the following conditions to be in line with the development master plan and plan of the sector or region and local socio-economic development plan; to be suitable to the investment field; to be capable of attracting and receiving commercial capital, technologies and management experience of investors; to be capable of providing quality products or services in a continuous and stable manner to meet user demands; and to have a total investment capital of at least VND 20 billion, except |
investment projects under O&M contracts and projects as agricultural and rural infrastructure facilities and services to develop connection between production and processing and consumption of agricultural products. Similarly, projects proposed by investors must have a total investment capital of at least VND 20 billion; be suitable to the investment field; to be capable of attracting and receiving commercial capital, technologies and management experience of investors……. and investors being state enterprises enter into partnerships with other enterprises for proposing projects. Also in accordance with this Decree, investors shall be selected in the form of open bidding or contractor appointment; investors may enjoy incentives in the course of bidding for investor selection when having feasibility study reports or project proposals (for group-C projects) approved by ministries, sectors or provincial-level People’s Committees. This Decree takes effect on April 10, 2015. |

On May 04, 2015, the State Bank of Vietnam issued the Circular No. 05/2015/TT-NHNN guiding credit institutions to collaborate with credit guarantee fund in offering secured loan of credit guarantee fund as stipulated under Decision No. 58/2013/QD-TTg dated October 15, 2013 of the Prime Minister. Also in accordance with this Circular, before lending, the lending party and Credit Guarantee Fund, based on the regulations on operation, agree contents in accordance with the regulations on the lending of credit institutions for the customers. Agreement on collaboration between the lending party and Credit Guarantee Fund includes orders of collaboration among parties in the receipt, appraisal of documents and handle with the demands on borrowing capital from customers; contents related to collaboration on providing disbursement documents; collaboration in considering the time for payment for customers; measures on collecting the loan that shall be applied when the loan is |
due but the customers can’t pay; specific regulations on each case that credit guarantee fund can refuse to perform a part or whole part of guarantee obligations in accordance with the Regulations and the law related to the borrowing and risk management of the lending party; responsibilities on coordination among parties in the receipt and handle with guarantee assets in the case that credit guarantee fund refuse to perform its guarantee obligations… Within that, f refusing to perform the whole part of guaranteed obligations: the credit guarantee fund shall transfer the rights of receipt and handling with the guaranteed assets of customers to the lending parties. The lending party shall give the letter of guarantee back to the credit guarantee fund right after the credit guarantee fund fully transfers the guaranteed assets. This Circular takes effect on June 18, 2015 and replaces the Circular No. 01/2006/TT-NHNN dated February 20, 2006. |

On February 14, 2015, the Government issued the Decree No. 18/2015/ND-CP prescribing environmental protection master plan, strategic environmental assessment, environmental impact assessment and environmental protection plan. Within that, the most important contents on registration of environmental protection plans, from April 01, 2015, Investment projects on construction, or expansion of the scale or increase of the capacity, of production, business and service establishments; production, business and service investment projects; and investment projects on expansion of the scale or increase of the capacity of production, business or service establishments For a production, business and service investment project which is implemented in two (2) or more provinces, its environmental protection plan shall be registered with the People’s Committee of one of such provinces as requested by the project or establishment owner. Particularly, catering services with a restaurant area of below 200 m2; personal or household-scale repair or maintenance services for household appliances; photocopy, internet access and video game services; raising cattle, |
poultry and wild animals with a breeding facility area of below 50 m2, aquaculture on a water surface area of below 5,000 m2; personal or household-scale cultivation on agricultural land or forest land; assay planting on an area of below 1 ha; construction of houses for individuals and households; construction of working offices, guesthouses, hotels and tourist accommodations on a floor area of below 500 m2..are not subjected to registration of environmental protection plans. One other important content is the environmental impact assessment and environmental protection plan. Accordingly, from April 01. 2015, Projects to build tourist sites; sports, recreation and entertainment centers or golf courses with an area of at least 10 ha and projects to build department stores and trade centers with a floor area of at least 10,000 m2 are subjected to reporting on results of implementation of environmental protection facilities. Besides, projects to build medical examination and treatment establishment and other health establishments with under 50 at least patient beds are not subjected to reporting on results of implementation of environmental protection facilities. This Decree takes effect on April 01, 2015. |

In accordance with the Decree No. 14/2015/ND-CP dated February 13, 2015 of the Government Detailing and guiding the implementation of a number of articles of the Railway Law, exempt ticket price exemption for children of under six years old from April 15. For other objectives, the Decree also details the level of price deduction, the reduction of 90% of the ticket prices, applies to persons engaged in revolutionary activities before January 1, 1945, persons engaged in revolutionary activities from January 1, 1945 to before the August 19, 1945 General Uprisings; Vietnam Hero Mothers; and the reduction of 30% of the ticket prices, applies to subjects being war-invalids, persons enjoying policies like war-invalids; agent orange victims; exception seriously disable or seriously disabled persons. Persons entitled to ticket price exemption or reduction shall produce certificates of subjects together with personal identity papers when they buy train tickets and travel on trains. For work construction, resource exploitation and other activities in areas adjacent to railway work- protecting scope, the minimum safety distance of a number of works in areas adjacent to railway work- protecting scope is defined at least 05 (five) meters from the railway traffic |
safety corridors, for houses built with flammable materials; at least 10 (ten) meters from the railway traffic safety corridors, for lime, pottery or brick kilns, pig-iron and steel furnaces, cement kilns, crystal production furnaces; for toxic, explosive, fire and explosion- prone substance warehouses, they must be built away from railway traffic safety corridors at distances prescribed by relevant law and for electricity transmission lines over railways, besides the safety distances prescribed by electricity law, measures will be applied to ensure the non-interferences into railway communications and signal systems and to ensure safety when electricity transmission lines break. Urban centers to be constructed with urban railways must they function as political, economic, cultural, scientific and technological, tourist and service centers, traffic hubs for domestic and international exchanges, playing the role of boosting the socio-economic development of a territorial region, inter-provincial regions or the whole country. The non-agricultural labor ratio to the total labor represents 85% or higher; the population size is one million inhabitants or more and the average population density is 12,000 persons/ km2 or more. This Decree takes effect on April 15, 2015. |
