DECISION
Approving the Scheme on consolidation and development of the network of social support establishments during 2016-2025[1]
THE PRIME MINISTER
Pursuant to the December 25, 2001 Law on Organization of the Government;
Pursuant to the November 23, 2009 Law on the Elderly;
Pursuant to the June 15, 2004 Law on Child Protection, Care and Education;
Pursuant to the June 17, 2010 Law on Persons with Disabilities;
Pursuant to the Government’s Decree No. 68/2008/ND-CP of May 30, 2008, prescribing conditions and procedures for setting up, operation and dissolution of social protection establishments; and Decree No. 81/2012/ND-CP of October 8, 2012, amending and supplementing a number of articles of the Government’s Decree No. 68/2008/ND-CP of May 30, 2008, prescribing the conditions and procedures for setting up, operation and dissolution of social protection establishments, and the Government’s Decree No. 109/2002/ND-CP of December 27, 2002, amending and supplementing a number of articles of the Government’s Decree No. 195/CP of December 31, 1994, detailing and guiding a number of articles of the Labor Code regarding working time and rest time;
Pursuant to the Government’s Decree No. 16/2015/ND-CP of February 14, 2015, prescribing the autonomy mechanism applicable to public non-business units;
Pursuant to the Government’s Resolution No. 70/NQ-CP of November 1, 2012, promulgating the Government’s action program on implementation of the XIthParty Central Committee’s Resolution No. 15-NQ/TW of June 1, 2012, on a number of social policy-related issues during 2012-2020;
At the proposal of the Minister of Labor, War Invalids and Social Affairs,
DECIDES:
Article 1.To approve the Scheme on consolidation and development of the network of social support establishments during 2016-2025, with the following principal contents:
1. Objectives
- To develop the network of social support establishments so as to, together with other social security policies, better meet social protection beneficiaries’ demands, thus contributing to sustainable development;
- To encourage and mobilize social resources for social support work; to bring into play the society’s concern and care for social protection beneficiaries;
- To raise the effectiveness of use of state budget funds for social security work;
- To enhance state management capacity of People’s Committees at all levels.
2. The network of public and non-public social support establishments (collectively referred to as social support establishment network) includes:
a/ Social protection establishments providing care for the elderly;
b/ Social protection establishments providing care for disadvantaged children;
c/ Social protection establishments providing care for persons with disabilities;
d/ Social protection establishments providing care and functional rehabilitation for persons suffering mental illness or mental disorders;
dd/ Multi-purpose social protection establishments providing care for different groups of social protection beneficiaries or persons in need of social support;
e/ Social service centers providing counseling, urgent care or other essential supports for persons in need of social support.
3. Objectives and solutions of the Scheme
a/ Studying, modifying and supplementing legal documents so as to develop social support establishments:
- To formulate and issue a list of social support services and a schedule of service charge rates;
- To further improve regulations and standards on social support establishments, ensuring convenient access and use for beneficiaries;
- To adopt policies to encourage and attract enterprises, organizations and individuals to invest in the development of social support establishments;
- To enhance local administrations’ responsibilities in social support work.
b/ Elaborating a master plan on the social support establishment network:
- To review and reorganize social support establishments, focusing on the enhancement of their operation capacity;
- To encourage the cooperation between the State and enterprises, organizations and individuals in social support establishments’ activities.
c/ Providing training and retraining for civil servants, public employees and workers of social support establishments in order to meet requirements on staff composition and professional norms and standards;
d/ Renewing mechanisms and methods for managing and operating social support establishments on the principle that families and communities shall play a main role in providing preventive services, supporting, caring and nurturing social protection beneficiaries while social support establishments shall take care for and nurture them in a given period of time;
dd/ Funding sources:
- Funds for implementing the Scheme include funds from the state budget (the central and local budgets) and funds raised from other lawful financial sources in which funds from the non-state sector shall play a key role in the investment in consolidation and development of the social support establishment network;
- The allocation of funds from the central budget as support for consolidation and development of the social support establishment network must comply with the law on public investment with priorities given to localities with difficult socio-economic conditions;
- The allocation of state budget funds for regular operations of social support establishments must comply with the law on the state budget.
e/ Taking advantage of international assistance in terms of experiences, techniques and finances in the course of development of the country’s social support establishment network;
g/ The building, consolidation and development of social support establishments shall be integrated into the Government’s programs and schemes on the elderly, support for persons with disabilities, social support and functional rehabilitation for persons suffering mental illness or mental disorders, care for disadvantaged children, gender equality, and development of the social work profession.
Article 2.Organization of implementation
1. Ministries and sectors:
a/ The Ministry of Labor, War Invalids and Social Affairs shall:
- Assume the prime responsibility for, and coordinate with ministries, sectors and localities in, organizing the implementation of the Scheme;
- Assume the prime responsibility for, and coordinate with ministries, sectors and localities in:
+ Formulating and submitting to the Prime Minister for approval a master plan on the social support establishment network right in 2015; and promulgating a list of social support services;
+ Elaborating and approving techno-economic norms applicable to social support services; the schedule of social support service charge rates; and criteria, size and standards for each type of social support establishment.
- Research and propose social support programs and projects;
- Supervise, evaluate, conduct surveys, build databases, and carry out preliminary and final reviews of, the Scheme implementation for reporting to the Prime Minister.
b/ The Ministry of Planning and Investment shall summarize and allocate development investment funds and mobilize domestic and overseas resources for the Scheme implementation in accordance with the Law on Public Investment.
c/ The Ministry of Finance shall:
- Arrange funds for the Scheme implementation in accordance with the law on the state budget;
- Assume the prime responsibility for, and coordinate with the Ministry of Labor, War Invalids and Social Affairs and the Ministry of Planning and Investment in, submitting to the Prime Minister for promulgation mechanisms and policies on socialization of social support establishments.
d/ The Ministry of Natural Resources and Environment shall guide localities in formulating land-use master plans, creating favorable conditions for the building of social support establishments;
dd/ The Ministry of Health shall provide guidance on disease prevention, health care, medical examination and treatment, and functional rehabilitation for beneficiaries in social support establishments;
e/ Other related ministries and sectors shall, within the ambit of their functions and duties, implement the Scheme and coordinate with the Ministry of Labor, War Invalids and Social Affairs in elaborating relevant legal documents.
2. Provincial-level People’s Committees shall:
a/ Formulate plans on the Scheme implementation in their localities;
b/ Direct and implement the Scheme and solutions set in the Scheme in their localities;
c/ Arrange funds, manpower and physical foundations for the Scheme implementation.
3. The Central Committee of the Vietnam Fatherland Front shall mobilize its member organizations and people to participate in provision of social support for disadvantaged persons.
Article 3.This Decision takes effect on the date of its signing.
Article 4.Ministries, heads of ministerial-level agencies, heads of government-attached agencies, and chairpersons of provincial-level People’s Committees shall implement this Decision.-
